welcome back to the DUI Channel we are in Sylvania Township Ohio where on August 30th 2023 at 9:36 p.m. an officer with the Sylvania Township Police Department stated he was out with a suspicious vehicle in the northeast corner of the parking lot of Stranahan Elementary School another officer arrived on scene following the request for assistance and began speaking to the driver of the vehicle as his investigation begins how are you Hi how are you what's your name my name is Nicole Nicole yes oh okay Nicole um yes okay where are you coming from tonight I'm coming from Toledo I work at oh I she was read the Ohio Bureau of Motor Vehicles form 2255 and asked to provide a breath alcohol sample I don't know I'm going to I'm going to explain I just don't want you to cry before you know what's going on okay so basically here's your next choice this is the last step of the process okay you have two choices the first one is to refuse this breath test okay if you refuse this breath test your license is going to be suspended for one year that's not one year in jail that's a onee license suspension if you give me a breath test and you're over a 08 which is the legal limit at oh oh it would be in 90 days so one year 365 days versus 90 days if you blow under a 08 you would have no suspension okay does that make sense yes are you willing to do the test I don't know I blow in I don't know water marar I don't know what I blow in well here's you got one year if you refuse it 90 days if you blow over or Z if you blow under I need to know if you'd like to do this Cas if I blow under but I yeah that was everything I had in me okay sit down the breath alcohol sample yielded a result of27 G ethanol per 210 L of breath because this suspect was only 20 years old the result was over 10 times the legal limit of 002 G ethanol per 210 L of breath to drive in the state of Ohio if under 21 years of age in court Nicole was charged with two counts of operating a vehicle under the influence of alcohol or drugs or OVI on November 16th 2023 3 months and 6 days after the arrest the defendant pled no contest was found guilty of only one count of OVI she was ordered to pay a total of $650 the balance is not due until December 16th 2023 as of December 6th 2023 the entire balance is outstanding she was sentenced to 180 days in jail with 174 days suspended 12 months on probation a license suspension for one year an interlock device with plates for one year six points on her license out of a maximum of 12 no alcohol drug or traffic offenses participate in a drug and alcohol assessment maintain employment must not possess alcohol illegal drugs or non-prescribed medicine and ordered to attend a driver Intervention Program for 6 days jail credit okay that's a that's the Y sheet that I look Wednesday 96 8:30 Sylvania municipal court at 6700 so I have to be here or I have to pay the ticket before I be here you need to go to the court on that date I have to yes meor okay you have any charge if I press a charge it's a criminal charge the misdemeanor of the first degree so I have to come in order to press charges on him and then it all gets dropped on me what are you pressing charges on he came up here and threatened me who did my baby daddy but I dropped all that I literally wrote a note to the judge saying that I didn't want to press this for this is for drunk driving tonight this has nothing to do with a okay this has nothing to do with tonight so I just have to show up to this court I'm unaware of any other things that occurred tonight okay you never told me about anything with your baby daddy so we've had pretty previous trespass like I've never had any other charge besides this so like I wasn't driving I'm so confused I don't know hop out let me get to pick it up in the morning okay I will get in contact with them so also I don't know if she's understood this um can you remind her when she soers up that she cannot drive her license is suspended for right now for how long 30 90 days you got to go to court so I have to go to court clear that up and then my license is good because I have a whole kid it's up to the judge Okay so until then my license is suspended correct yeah until Court was no I told you 90 days you told me I didn't have to worry about nothing no said 90 days if you blow over a 08 which you did okay you were two and a half times that okay okay so your license is suspended under an ALS suspension for 90 days okay the judge has the ability to amend that if he chooses I can't do that so that's why we have have on the 30th top no the sixth uh her court date info is at the very top and it's mandatory make sure she goes okay perfect thank you so much for picking her up
