SYLVANIA TOWNSHIP, OH - On August 30th, 2023 at 9:36PM, a vehicle passed very closely between a Sylvania Township Police Department squad car parked in an elementary school parking lot and the building itself. The officer working for the department stepped out of the cruiser and began questioning the suspected driver. Another officer arrived on scene shortly after and began questioning the suspect as well. While speaking with the suspect, the officer noticed signs of impairment including glassy and slightly red eyes as well as the smell of the odor of an alcoholic beverage coming from her breath. When asked for identification, the suspect struggled to retrieve the correct documentation and eventually gave the officer her daughter's social security card by accident. When the officer asked for the suspect's age, she claimed that she was 21 years old. Against the advise of her passenger, the suspect stepped out of the vehicle when asked to do so by the officer who was leading the investigation. Once out of the car, the suspect claimed that she had "half a sip" of an alcoholic beverage at a bar in the City of Toledo and stated that she entered the parking lot because she had to go to the bathroom. The suspect further admitted to smoking marijuana earlier in the day. The officer then told the suspect that they would be performing tests before she could relieve herself to which she complied. During the horizontal gaze nystagmus test, the officer observed the suspect to have lack of smooth pursuit in both the right and left eye and the onset of nystagmus prior to 45 degrees in the left eye. Because the suspect was moving so much during the exercise, the officer was unable to evaluate the suspect's right eye during the latter part of the test. The sergeant on scene then allowed the suspect to relieve herself behind a nearby shed. Once the suspect came back to the front of his patrol car, the officer instructed the suspect how to perform the walk-and-turn test. During the exercise, the suspect stepped off line, started earlier than instructed, did not walk heel-to-toe on several steps, extended her arms for balance, and took 18 steps forward and 12 steps backwards. For the one leg stand test, the suspect claimed that she did not know how to count, extended her arms for balance, placed her foot down several times, and bent her knee at one point during the test. For the modified Romberg balance test, the officer observed slight eye lid tremors while the suspect swayed during balancing. The suspect counted to 15 seconds while the officer's watch displayed 23 seconds. Following the conclusion of the field sobriety tests, the suspect was asked to provide a preliminary breath test which she ultimately refused. The suspect was then arrested for operating a vehicle under the influence of alcohol or drugs, or OVI. Following the arrest, the sergeant told the officer that the suspect was only 20 years of age. After three separate conversations with witnesses on scene, the suspect was transported to the Sylvania Township Police Department for further OVI processing. While there, the suspect submitted a breath alcohol sample of .207g ethanol/210L of breath. This is above two times the legal limit of .08g ethanol/210L of breath or 10 times the legal limit of .02g ethanol/210L of breath to drive in the State of Ohio if under 21 years of age.
