regarding a vehicle traveling Northbound on the southbound side of the highway as the deputies were traveling southbound the headlights of a white 2017 Chrysler Pacifica were observed traveling in the opposite direction near mile post 175. the deputies activated their emergency lights to stop the oncoming vehicle as their investigation begins [Applause] you're in the wrong lane stop stop the car again [Music] hi so we got a female pretty intoxicated she's under arrest right now for a DUI um she started hyperventilating she collapsed but she's been calling me fine now so you should collapsed that's when I page you guys I wanted to check out and make sure but she's she's calmed down now just kind of repeating that she never makes mistakes right now so she's just oh pretty drunk all right do you want to just get rolling with her then if she's calmed down well if you guys just want to maybe take a look at her and if I guess let you guys make a judgment call she's calm down now so I don't know if you guys want you guys get here if you have to do anything but once the emergency medical personnel arrived on scene the suspect was able to calm her breathing and subsequently refuse treatment if something happens later on or if you're not I'm fine okay just wanted to let you know that okay look at you I mean the star signal came right following the arrest the suspect Kimberly was taken to the Ward County jail for further processing whereupon she consented to providing a breath alcohol sample [Music] pretty good [Music] um the breath alcohol sample yielded a result of 0.247 percent breath alcohol content this is over three times the legal limit of 0.08 percent breath alcohol content to drive in the state of North Dakota in court Kimberly pled guilty to one count of driving Under the Influence or DUI 0.16 or greater first offense this is a Class B misdemeanor in North Dakota between fines and administrative fees the defendant was ordered to pay a total of one thousand dollars this amount has been paid in full Kimberly was sentenced to two days in jail and not put on probation she was further ordered to participate in a Victim Impact Panel and a chemical dependency evaluation
