WARD COUNTY, ND - On May 15th, 2020 at 1:41AM, Ward County Sheriff's Deputies responded to multiple calls regarding a wrong-way driver on U.S. Highway 83 in an uncorporated area near the southern border of Ward County. As the deputies approached mile post 175, oncoming lights were observed appearing over the horizon in the passing lane. The deputies activated their emergency lights and instructed the driver to pull over their vehicle after the deputy yelled, "stop." The deputy approached the driver and sole occupant of the vehicle to alert her that she was traveling the wrong way. The officer observed a strong odor of alcohol and could detect slurred speech from the suspect. The suspect also had bloodshot watery eyes. The deputy asked the suspect to step out of the vehicle and perform field sobriety tests to which she complied. Once in the front seat of the squad car, the suspect began crying and told the officer she wanted him to take her to her children at her lake house. During the horizontal gaze nystagmus (HGN) test, the suspect had to be instructed several times not to move her head. Due to the suspect crying and becoming very emotional, the deputy was unable to complete the test. The deputy then instructed the suspect to recite the alphabet. The suspect began reciting the alphabet before being instructed to do so, but evenutually receited the alphabet accurately. The suspect was then asked to count backwards from 69 to 52. The suspect counted beyond 52 before stopping. The suspect was then asked to perform the HGN test again. During the test, the deputy observed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and nystagmus prior to the onset of 45 degrees in both eyes. The deputy informed the suspect that North Dakota law required drivers to take a screening test and such a refusal would result in the revocation of their license for 180 days. The suspect consented to providing a breath sample. The results yielded .294% breath alcohol content (BrAC). The BrAC limit to drive in the State of North Dakota is .08%. The suspect was then arrested for driving under the influence (DUI). Immediately after being handcuffed, the suspect began hyperventilating and claimed that she could not breath. An ambulance was then called on scene and evaluated the suspect. The suspect was able to calm her breath and subsequently refused treatment. Following the medical event, the suspect was taken to the Ward County Jail for further DUI processing.
