the officer activated his emergency lights pulled the driver over near Freddy's Frozen Custard and Steak Burgers and approached the vehicle as his investigation begins hello let's option to accept the red light back there where you turned you stopped so far ahead of the white line that your back tires were on it so where you were stopped is where people were supposed to be Crossing which is why they were having to like walk around the hood of your car you got your license and insurance with you tonight in a current registration ID's in the window there man like in the window of your wallet and turn with several small steps on your other foot like this and then nine Heel To Toe steps back one two three all the way to nine my right foot just the front foot stays on the line on number nine whichever one's in front and then you turn with several small steps with the other foot while you're walking keep your arms at your sides look at your feet while you walk and count out loud and don't stop the test once you started it you can start whenever you're ready okay starting to see your face in the ear you don't have to turn twice just stand with your feet together and arms at your sides since you're being arrested you have the right to remain silent anything you say can will be used against you in court you have the right to the advice and president of attorney if you can't afford to the suspect was transported to the Iowa City police station for further processing after a 20-minute observation period the officer asked the suspect to provide an evidentiary breath sample once again below a long steady breath up until I tell you to stop whenever you're ready and just keep going it'll run you all the way out of air probably just keep going until there's a click Okay click there you go thank you it'll print and everything the breath test yield today result of 0.114 breath alcohol content the suspect Marco was charged with operating while Under the Influence first offense or OWI in court the defendant pled guilty on April 16 2020. he was given a 1 410 dollar fine with the option of being reduced for an unspecified amount of community service Marco declined this option and along with a 447.50 surcharge He was ordered to pay a total of one thousand eight hundred fifty Seven dollars and fifty cents this amount has been being full the defendant was sentenced to two days in jail with the option of attending a 48-hour OWI course for two days jail credited this option was declined also and on September 26 2022 one day short of exactly 1 000 days after his arrest Marco served two days in the Johnson County Sheriff's Office jail
