IOWA CITY, IA - At 12:35AM on January 1st, 2020, Iowa City Police Officers pulled over a driver who did not stop before the white line at a stop light. The officer observed that the pedestrian crossing the street had to walk around the suspect's vehicle as he had stopped in the crosswalk. The suspect admitted to drinking earlier in the evening and that he and a friend were out celebrating New Year's. When asked how much the suspect had to drink, he responded, "two beers." The officer then asked the suspect to step out of the vehicle. The suspect pulled out a sweatshirt from the backseat of his car before exiting the vehicle. The officer initiated a field sobriety test (FST) starting with the horizontal gaze nystagmus (HGN) test. The suspect answered the officer's questions and told him that he had no issues with his eyes that would prevent him from performing the exercise. During the HGN test, the suspect was unable to follow the officer's finger smoothly and the officer observed a jerking motion at maximum deviation. The officer had to remind the suspect to blink. The officer then asked the suspect if he had any physical issues that would prevent him from walking or balancing to which he responded that he had only unrelated issues that would not affect his mobility. While performing the test, the suspect then proceeded to take 10 steps forward, counted to four while turning (this was not instructed by the officer), then turned again after completing the exercise. T he suspect then performed the one leg stand test. The suspect demonstrated proficiency in the test, but did not properly count the number "24," before being asked to stop by the officer. Following the FST, the officer questioned the suspect specifically on what he had to drink throughout the evening. The suspect again answered that he had only two alcoholic beverages with the first being consumed at 8PM and the last being consumed at midnight. The officer then administered a breathalyzer test. The officer informed the suspect that at the age of 19, the legal limit to drive in the State of Iowa is .020% BAC. The officer told the suspect he blew a .107% BAC. The officer arrested the driver for operating while under the influence (OWI). Following the arrest, the officers attempted to ascertain whether or not the suspects were trying to hide wristbands immediately after being stopped. The passenger stated he does not believe that the driver did so and that he, himself, is 21-years-old so would not be wearing one regardless. The officer asked for identification and confirmed his age through dispatch. The passenger asked the officers if he could drive the vehicle home for the suspect, but they declined citing that he had been drinking with his friend who they had just arrested for OWI. The officer then administered a breathalyzer test on the passenger who proceeded to blow .08% BAC. The arresting officer then took the key to the vehicle and locked the doors. The passenger was eventually taken to Iowa City Hall by the non-arresting officer as a place of refuge until he could contact someone to give him a ride home for the evening.
