welcome back to the DUI Channel we are in Harvard Illinois where on April 24 2020 at 9 28 PM Harvard Police observed a Ford F-150 leaving a Dollar General parking lot heading Northbound on State Route 14. the truck then crossed over the fog wine and Center Line while traveling the officer activated his emergency lights pulled over the vehicle and approached the driver as his investigation begins we got a license on you dude you been drinking tonight [Music] all right you got uh Insurance on you all right I'm gonna go run this you gonna turns on you [Music] I barely remember on this reason I pulled you over it's because you're swerving all over the place what's going on just [Music] you sure you haven't been drinking at all no no you're not sure no you've been drinking I've never been drinking okay and then the car in a nobody any guns drugs no guns nope no drugs okay all right give me a second all right you take anything today no no okay after the officer confirmed that the suspect had vowed insurance and a clear license another officer was called to the scene to conduct a field sobriety test I got a pretty good eye dilation thinking I'm smelling alcohol on him he's got a case of beer sitting next to him [Music] yes and he went and pulled on the door Dollar General me sitting there [Music] let's go man good so what do you get to drink tonight have you anything to forms so yeah I'm gonna process them first yeah um but you gotta do warning Motors right away it's the first thing when you walk in the door okay warning a motorists um so put his 27 and two and it's 28. and start your tickets at least do your um your A2 to your lane violations to what you saw um it's got insurance okay so do your A2 and your proper lane usage did you go completely over center line is that what you did or Lane fog line Center Line both it's Center Line and then you hit fog line that's why I knocked him down okay so d-ray two do your 11 708d like proper you know violated median um so 11 708d do your A2 and then what other ones you have and then print that that's a plate your current who's got a license yeah so print those um push your court date out right okay um and then we can do breath up and if he want decides to blow and he goes over then you can come back out and you can print a name and obviously ntas fill out your board for your bond sheet like they want yeah yeah so but warning the motors right away okay following the arrest the suspect David was brought to the Harvard Police Department for further processing where the officer read the suspect the Illinois warning to Motors form and asked if he would consent to providing a chemical breath alcohol sample David are you gonna uh do you want to blow let's recommended I can recommend one way or the other the warning motorist says that if you don't blow it's 12 month suspension if you do it's a six-month suspension that's that document that I just read you okay all right another Ross will be done in just couple minutes to do it then the suspect consented to providing a chemical breath alcohol sample which yielded a result of 0.151 percent in court the defendant was charged with two counts of driving Under the Influence or DUI the first count was disposed as Noah prasek way this means that the prosecution chose to no longer pursue the case on September 30th 2020 five months and six days after the arrest the defendant entered a negotiated guilty plea for the second count of DUI He was ordered to pay 2 261.50 this amount has been paid in full David was sentenced to zero days in jail one year of Probation and further ordered to attend DUI school and a Victim Impact Panel
