Harvard, IL – At 9:28PM on April 24th, 2020, Harvard Police pulled over a driver crossing over both the fog line and center line of the road. When the officer approached the vehicle, the driver was playing "Hurricane" by I Prevail. While speaking to the suspect, the officer immediately smelled an alcoholic beverage emitting from their breath. The officer also noticed his eyes were red, bloodshot, and that his speech was slurred. The officer observed an open case of beer next to the suspect which had beverages missing. When asked if the suspect had been drinking in the night, he claimed that he did not have anything to drink. After a license check of the subject was finished, the officer contacted a secondary unit to assist in the investigation. Upon arrival, the secondary officer spoke with the suspect who confused him as the street to where the suspect was heading was in the opposite direction of how the vehicle was oriented. Given the totality of the traffic stop, the officer asked the suspect to step out of the vehicle and perform a standardized field sobriety test (FST) to which he consented. Before the tests began, the suspect admitted to drinking two beers. During the horizontal gaze nystagmus test, the officer observed lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and onset prior of 45 degrees in both eyes. For the walk-and-turn test, the suspect began the test with his left foot and took two steps before falling off the line. The suspect made a second attempt, took eight steps, stepped off the line several times, used his arms for balance, and did not make all heel-to-toe steps. The suspect did not complete the test. The suspect was also unable to complete the one leg stand test after using his arms for balance and hopping on one foot. Following the FST, the suspect was arrested for driving under the influence (DUI) and placed in the back of the primary officer’s vehicle. The suspect was then transported to the Harvard Police Department for further DUI processing.
