welcome back to the DUI Channel we are in Urbana Illinois we on January 6 2020 at 5:48 p.m. in herbana a police officer detected a strong odor of cannabis while driving through the Circle K parking lot located on North Cunningham a the smell became extremely strong as the officer passed a light blue 2003 Mercury Grand Marquee that was stationary at a gas pump the officer then turned his vehicle around and approached the driver as his investigation begins is this m okay I couldn't help notice when I drove by a strong load of cannabis coming from here okay uhhuh so understanding that cannabis is legal now yeah still not legal to have within your car and smoking it okay so I'm smelling a mixture of fresh cannabis and a mixture of burnt cannabis right now I smoked earlier like like way earlier in the car earlier but I was Park when I smoked ear you still can't you can't uhuh no you can't what's your last name oh what's your first name uh Jamar j m a r what's your birth dat 89 10 for the suspect consented to providing an evidentiary sample of his blood if you do do it I got to get a shot too they're going to draw blood mhm and you're going to urinate in the cup and it's it's one of those I can't urinate I can't I can't I can't well test is over with then and that's considered a fail okay if you do do it and you're found to have more than what you're supposed to of THD in your body then your license will be suspended just minimum 6 months if you fail to do it it'll be suspended for at least 12 months you understand that yeah okay so we're going to go to Carl and have it done and at that point you will have the opportunity to accept or deny having it done okay hey you understand that you got a you going to have a bond man hey they want they want to go to Carl and take some piss and take I they got you know do they going to do the proceed should I do it though yeah I mean what do the what do the thing they want me to piss I don't I can't piss right now it's so cold don't know he he said he going to charge with uh with the D and all that he said like I just got my all right we head out following the arrest the suspect Jamar was taken to the Carl Foundation hospital to submit an evidentiary sample of his blood which yielded a result of greater than 20 nanograms of THC per milliliter in the state of Illinois a person is presumed under the influence of cannabis if their THC concentration is 5 nogs or more in whole blood in court the defendant was charged with one count of driving under the the influence of any other drug or combination of drugs or DUI on January 5th 2021 365 days after the arrest the charge was dismissed Jamar was ordered to pay $10 for the bond fee this amount has been paid in full because the only charge from the incident was dropped the defendant was not sentenced of note Jamar was once again ordered to continue payments on the possession of cannabis ordinance violation from November 16th 2011 from which the arrest warrant was aced the amount outstanding was $37.50 when on February 23rd 2021 9 years 3 months and 7 days after the violation was issued the charge was dismissed due to this Jamar was no longer ordered to pay the remaining balance
