URBANA, IL - On January 6th, 2020 at 5:48PM, an Urbana Police Officer smelled an odor of cannabis while driving through a gas station within city limits. The smell became stronger when passing by a 2003 Mercury Grand Marquis with an occupant in the driver's seat of the vehicle. The officer approached the suspect and began questioning if he had smoked cannabis earlier in the evening to which he admitted to doing so. After the officer informed the suspect that smoking marijuana and driving was illegal, he conducted a finger count test. The suspect struggled to perform the test as instructed and subsequently refused counting backwards and reciting a select portion of the alphabet. The officer then asked the suspect to follow his finger while administering the lack of convergence test. During both passes, the suspect's left eye did not converge. The suspect also had difficulty following the officer's finger throughout the exercise. During the horizontal gaze nystagmus test, the officer did not observe any nystagmus. For the one leg stand test, the suspect was unable to keep track of his count. The suspect was eventually arrested during the walk-and-turn test after failing to turn around and walk back the instructed amount of steps. The officers claimed that the suspect was arrested for both driving under the influence, or DUI, and for an arrest warrant for unpaid fines from a 2011 possession of cannabis ordinance violation. After being placed in the squad car, the officer allowed the suspect's father to speak with his son. The officer further allowed them to smoke so long as the smoke was not blown in the vehicle. The suspect was then taken to the Carle Foundation Hospital to obtain an evidentiary blood sample.
