welcome back to the DUI Channel we are in Ottawa Hills Ohio where on August 26 2022 at 1 24 a.m Ottawa Hills police observed a red 2012 Ford Focus drive through a flashing red light at the intersection of West Bancroft Street and Richards Road as police followed the vehicle the driver continued to travel at a high rate of speed until the officers caught up with the suspect on Seeker road with help from the University of Toledo police the officer stopped the car and approached the passenger side of the vehicle as their investigation begins why are you guys trapping like that you guys even are you guys aware the reason why we stopped you okay red light violation two of them and you guys are speeding you thought you could go through a blinking red light so the blinking red lights at Bancroft and Richards we were there when you drove through without stopping you're cruising pretty good we couldn't catch up to you until you got to that late there's a no turn on red you turned on red okay you have your license approved insurance with you today have you been drinking no okay so where you guys coming from um what'd you say Waffle House no before that she's I'm talking were they were scooting man so we were pulling out of the station and uh they blew through the red light we were on Richards and they just shot straight through it and I'm like you gotta go catch up to them and they were cruising I mean like we were not even like I told him like we got the siren because like they're not stopping and then they got right up to this light turned right on red because I thought we were gonna catch them right there and then they turn right on red and zip it through here I'm like you gotta hit your lights you're not gonna get them I was so confused when I saw you guys come up behind me I was like I'm just gonna throw on my rears I know it's one of these two cars yeah she was she thought it was this one on the right and I was like no it's one left but yeah they were scooting dude I don't even know how fast should I make our tests open I can run a couple if you need to yeah so you already ran at least I was working on her so they admitted to drinking and they're underage what you'll have to do is said that he'll run some we can I can run one too but uh obviously you're gonna run the driver make sure she's good even though she told you she hasn't clearly there's been alcohol consumption tonight through all the parties we'll give her Runner through the test so you're at least gonna watch us a driver and then we can test the two people in the back and then like you said they've already admitted to drinking and then I can test the passenger too but uh yeah but we'll do is we'll run through sfst's you can have them blow into the PBT especially the driver you want to make sure that she's sober we'll go from there but essentially how it works is um assuming that the driver is sober all the people in the car that's underage that have consumed alcohol that admitted to it and we can uh yeah they get all-purpose Citation for underage alcohol consumption all right I already missed so I'm happy to do is I'm going to ask you if you want to blow into this PBT okay you don't have to you can you can decline it but if you decline it we're going to take it out we're going to test your eyes and everything like that okay we just want to make sure you're safe to drive because if you're not safe to drive then we're not gonna let you go tonight okay um right so regardless yeah so I'm giving you the option to take this if not we're still going to take it out we're gonna test your eyes and take you through a series of sobriety tests okay are you willing to take this okay right over here you can stay right there for now all right step out for me real quick all right so what I'll maybe do is I'm gonna have you put your uh wrap your lips on this you're gonna take one big inhale through your nose you're gonna blow it through your mouth okay it's gonna be one steady breath okay so go ahead and blowing through or breathing through your nose I'm off on it no breathing through your nose and then you put your mouth down and you're gonna blow wrap your lips around it keep going keep keep going keep going don't block out your teeth low low are you blowing are you sucking all right blow keep going keep going keep going keep going on the tip of my finger so for this next test you can stay right there for me what I'm gonna what you're going to do is you're gonna do the walk and turn Okay so you're gonna imagine a line right here okay place your left foot on the line and put your right foot in front of it Heel To Toe keep your hands down by your side okay so don't begin the test until I instruct you to do so okay okay so for this test you're going to take nine heel toe steps forward nine yes if you want to take off your shoes you can some surf sandals if not you can keep them on it's up to you okay so left foot on the line right in front of it hands down by your side okay so for this test you're going to take nine heel toe steps forward when you get to your ninth step on your lead foot you're going to do a series of small steps into a turn and take 90 Heel To Toe steps back backwards not backwards but when you do your turn you're gonna do nine little toe steps back I'll give you a demonstration okay so it's going to look like this one two three simulating that I'm on my ninth step I'm gonna do a series of small steps on my lead foot and do nine heel toe steps back so you're going to keep your hands down by your side count out loud watch your feet the entire time and do not begin the test or stop the test until you're done okay all right you may begin to toe all right get back into position okay so left foot on the line right foot in front of it hands down by your side you're going to take nine Heel To Toe steps forward yep don't be getting the test until you tell you to do so so I'll demonstrate it again for you okay hands down by your side when I tell you to begin you're going to do nine pillow toe steps forward when you get to your turn you're going to do a series of small steps and nine heel to toes steps back okay it's gonna look something like this one two three simulating that I'm on my ninth step you can do a series of small steps one two three you're keeping your feet Heel To Toe keeping your hands down by your side watching your feet okay do not stop the test until you're done you may begin okay get back up here um I'm gonna need your watch for this okay Okay so do you have any problems with either of your legs there's one better than the other no I just hurt my ankle boots okay all right so for this test you can just for right now keep your feet together hands down by your side so for this one you're going to pick whichever leg of your choosing you're going to pick it up in the air keep your foot parallel to the ground keep it at six inches off the ground and you're going to keep your hands down by your side and look at it your foot the entire time don't begin until I tell you to do so okay so it'll look like this one one thousand two one thousand three one thousand four one thousand and so on until I tell you to stop okay do you understand that yes okay are you ready sorry okay you maybe again count out loud keep your okay so keep your foot off the ground pick it up do you actually instructed you two you need to count out loud six hundred thousand seven thousand eight thousand ten maybe 12 13 14 15 16 okay you can stop okay so how much did you have to drink tonight um do you have anything on your lips or anything like that do you have lip gloss or anything on your lips okay can you wipe it off and we can try to have you blow again if you want to do that because when you put your lips on this you gotta keep it tight so when you're blowing no air is coming out okay are you willing to take it again do you have those on the suspect's preliminary breath test sample yielded a result of 0.05 percent breath alcohol concentration underage okay just ever hang out here and then just go talk real quick and tell her you can tell that she's at 0.5 and then just kind of go from there that's for her guidance because I haven't done one yet yeah you can put your shoes on the lead officer then stepped away from the suspect to speak to another officer on scene so what I got this diagnosed shoes admin condo let's have a hang tight for here for a second okay are they inside your vehicle oh he's got him there you go thank you of suspension for no priors is one year do you understand and if you take the test it's only suspended for 90 days yes but when you go to court within five days she'll give you a court date you can petition for your driving privileges through the judge okay you understand that please okay okay with that being said are you willing to submit to a breath sample okay oh following the arrest the suspect Asia was transported to the Ottawa Hills Police Department for further DUI processing whereupon she submitted two breath alcohol samples the lower of the two samples yielded a result of 0.050 percent breath alcohol content in Ohio the legal breath alcohol concentration limit to operate a motor vehicle under the age of 21 is 0.02 percent in core Asia was charged with failure to stop at flashing red lights and two counts of operating a vehicle under the influence of alcohol or drugs or OVI on October 18 2022 53 days after the arrest the suspect entered a plea deal which placed the former two charges off docket and reduced the latter OVI charge to Reckless operation she was ordered to pay two hundred and twenty dollars this amount has been paid in full Asia was sentenced to 30 days in jail with all 30 days suspended and one year of inactive probation with the only condition being good behavior of no the defendant did not receive a licensed suspension and her driving privileges were not affected in any way is anybody else willing to blow into this today into the BBT okay all right well you guys did admit to drinking so we're still going to take out and test you okay you all admitted to underage drinking it's still legal in the state of Ohio you have to be 21 years of age to drink so with admission itself that's uh you guys told us that you drank so I'm giving you the option to do this okay can you elaborate how are we playing you I just don't understand right how old are you and how you said you had something to drink right I'm telling you I understand that when I went to college I'm not saying that I drink underage it's not what I'm telling you but I'm you guys admitted to us that you guys have all drank you you told us right away that these two had drank and then after that you said that you guys had drink right you told me that she had drank too before I took her out of the vehicle he said you guys all had one shot when you walked in correct yes okay
