welcome back to the DUI Channel we are in the village of mundeline Illinois where on May 26 2020 at 8:30 p.m. a mundeline police officer traveling in an unmarked police car observed a blue 2011 Chevrolet Impala heading Southbound on North Diamond Lake Road the officer then began pacing the vehicle at 37 mph in a posted 30 mph Zone the vehicle turned into an apartment complex just outside Village limits while still in Libertyville Township the officer then activated his emergency lights and approached the vehicle on the driver's side as his investigation begins going a little fast man I know where you coming from U my house to go to my friends who I work with going to your friend's house you know I work with her we're about to have a bonfire work with who Sam who Sam she lives in during the search of the suspect's vehicle the officer found a small amount of cannabis and a grinder containing cannabis once at the mundeline police department the suspect was read the Illinois warning to motor's form which he subsequently refused to sign of note during the 20-minute observation period the suspect implied that he would Target and damage the officer's packages as he was an employee at a nearby Amazon warehouse I hope you all order from Amazon and all your packages get damaged oh that's the thing man as long as you guys live around this area your packages are going to come through my warehouse and I know you guys' last name and I know how to look up packages you threatening man I'm not threatening I'm just saying your packages might D it sounds like it you know alcohol sample just listen to me I'm going to ask you to do it it's up to you whether or not you want to do it or not okay if you choose to you can blow into the machine if you don't want to you can push R for a refuse no so what is the consequences of this is your second one within the last 5 years correct then it'll be uh 3 years suspension of your driver's license you refuse if you blow and you blow over then it's a one-year suspension you guys are kidding me I have to go to work to make money I'm it's a $50 Uber drive to my house to get to work you guys have put me out of a job here if I blow over you know that right if you blow over if I blow over which I don't think I will but if I do you guys are P me out up well I mean this is your decision no you no this is your decision I it'll tell you in one second the results of the evidentiary breath test yielded 225 g ethanol per 210 L of breath there's no how am I standing I don't know that's pretty high though how am I standing can we do it a second time like there's no way well no the machine read your your breath there's no way we we how am I that's that's your that's your blood alcohol right now because a suspect was skeptical of the breath test results an officer allowed him to submit to a preliminary breath test to assuage his disbelief no way yeah there's no way I only took two I only took like three mixed drinks there's no way it is showing the same 2 three there's no way the results of the preliminary breath test yielded 233% breath alcohol content in court the defendant Lee was charged with 11 to 14 mph above speed limit possession of adult used cannabis in a motor vehicle and two counts of driving Under the Influence or DUI on July 2nd 2021 one year 1 month and 6 days after the arrest the defendant entered a plea deal which disposed every charge except one count of DUI as Noah pray this means that the prosecution chose to no longer pursue the case the defendant was ultimately found guilty of the remaining count of DUI only along with a $1,250 fine Lee was ordered to pay a total of $2,818 this amount has been paid in full he was send to zero days in jail 12 months on probation 240 hours of Public Service maintain employment cannot possess illegal drugs no driving participate in an administrative sanctions program no alcohol cons assumed no bars or taverns must be nowhere alcohol is sold and attend DUI School
