welcome back to the DUI Channel we are in fenmore Wisconsin where on March 14th 2020 at 3:30 a.m. a fenmore police officer observed a vehicle traveling Northbound on Lincoln a with both the passenger side tail light and brake light burnt out and not functioning properly the officer then pulled the vehicle over near the intersection of 10th Street and Garfield Street exited his Patrol vehicle and approached the suspect as his investigation begins officer the reason I'm today is because you have a break light out what's that sry which one which one it's your passenger side yep so if it's your driver's license why you go ahead and hand me that bag weed out thank you go ahead and turn the vehicle off for me where you coming from uh I was driving home from a friend's place who's your friend um what's that it's just a friend of mine that's all can I see your driver's license and proof of insurance just got that in here today so this is registration how about your proof of insurance that's what I asked for confused between the two of those my bad man there you go right in your hand there you go there's your registration back anything newer what this one expired January 17th of 20 anything newer yeah there should be one in here yeah that yep that one that one's July there's the old one all right Hunter there's your driver or your proof of insurance might even be that might even his driver's license was valid the officer reapo the suspect as his investigation proceeds all right Hunter I am going to have you step out of the vehicle for me why is that I do want to make sure called hn test okay what I want you to do is I want you to follow tip my finger with your eyes and your eyes only I don't want you to move your head at all okay do you understand yep okay for no got okay and this test has a starting position I'm going to get you set up in that starting position right now okay what I want you to do is I want you to place your left foot on a straight imaginary line for me okay go ahead and put your glasses back on if if that helps okay all right I I didn't think that we'd have to go through doing all this stuff but I don't think it was very necessary but that's fine you can continue so place your left foot on that straight imagin line for me okay from there I want you to place your right foot heel to toe in front of your left foot remain in that nope don't start the test yet oh okay sorry remain in that position until I tell you to start the test okay so take a step back for me left foot on that line right foot heel to toe in front of your left foot remain in that position until you tell to start the test do you understand you're in this position right now what I want you to do is I want you to take nine heel til to toe steps down that straight imaginary line it'll look something like this 1 2 3 all the way to 9 this representing your ninth step leave this foot planted and take small choppy steps until you're facing back in the other direction go the other way from there I want you to take another nine Heel To Toe steps down that line it'll look something like this one two three all the way to n okay while you're performing the test I want you watch your feet count out loud what numbers your arms down your side and don't stop the test until you've completed it you understand nine steps forward and back nine steps as well as I explained it to you okay I was just reassuring because like I do have ADD and it's hard for me to like pay attention sometimes and comprehend to like directions yep n he to to steps you yep whenever you're ready go ahead and start raise arms turn too okay the next test is called the one leg stand test okay I just want you to keep your feet together arms down your side for me sorry just yep just keep your feet together arms down your side while I'm explaining the test okay what I want you to do when I tell you to begin what I want you to do is I want you to raise the foot of your choice approximately 6 Ines off the ground it'll look something like this from there I want you to count out loud 1 1,000 2 1,000 3 1,000 4 1,000 5 1,000 and tell your tell to stop counting if at any point in time you should set your foot down just go ahead and pick it back up and continue counting from where you last left off okay while you're performing the test I want you to watch the tip of your foot count out loud for me and keep your arms down to your side count to how much until I tell you to stop counting okay okay hold on one second for me whenever you're ready go ahead and begin okay can you look at the tip of your nose thank you all right what I'm going to be doing is I'm going to be doing a series of small circles around your face okay at one point in time I'm going to come in towards the bridge of your nose at no point in time am I going to touch you though okay okay so once again just follow tip my finger with your rise and your eyes only okay okay you understand mhm okay the next test is hold the rberg test okay what I want you you can put your glass back on if it if you think it'll help yet it's up to you okay definitely feel like it does sure okay what I when I tell you to begin what I want you to do is I want you to close your eyes tilt your head backwards and begin estimating the passing of 30 seconds okay at no point in time do I want you to tap your foot I don't want you to count out loud nothing like that okay once you've completed estimating the passing of 30 seconds I want you to open your eyes and say completed okay okay do you understand the test yep now I got it okay hold on one second okay whenever you're ready go ahead and begin okay right now yep tilt your head back for me thank you I Dres okay and how did you get to that I just kind of like waited and kind of counted my head a little bit but okay all right Hunter at this time I am going to be placing you under arrest for I well intoxicated I mean like I don't go ahead and turn around place your hand behind your back I mean I don't think that that I mean based on what I observed from field sobriety test I do feel you under under the influence okay so go ahead and turn around place your hands behind your back I'm not going to tell you no I'm just saying like all right man okay I don't know why we got to do this more but whatever going to double lock them so they don't get any tighter on you could you uh explain to me what what thing that the standardized field sobriety test so you're not going to say like what it was like specifically there are multiple clues that we look for during the tests do you have anything in your pockets that's going to poke me hurt me stab me anything like that no okay you're just like I don't know you know what I mean it's like coming at me like that and stuff so not necessarily just don't really think that this made this e to send me home it's not really necessary man I know it's not what's not necessary to be arresting me right now I just don't find it very necessary and like I'm not really just trying to go home man did you make that that's pretty cool no I bought that actually where'd you get it uh at morale fast and oh musk mean I'm not giving you permission to search it and I'm not really saying that I mean I just feel like you shouldn't even be arresting me right now I know you're just going to say sure but could be it you could be a nice person right now and just let me finish driving the rest of the way home well that's the problem is that you're driving I feel as though you're under the influence of an attx him well I'm really not and like I feel like I don't understand why you even think that anyway in the first place because of the clues I observed on during field sobriety well I mean I didn't think that you even necessarily had to pull me out the vehicle while inventorying the vehicle the officers located a second bag containing THC a separate bag with CBD marijuana and a vape pen all of this evidence was eventually discarded following the search of the vehicle the suspect was transported to Grant Regional hospital whereupon he was read the Wisconsin informing the accused form to which he refused to submit to an evidentiary chemical test of his blood Hunter will you submit to an evidential chemical test of your blood I mean like I don't think that very necessary for you to do this already anyway so I don't think I probably won't be allowing that to happen because I I just need a yes or a no no you don't want to no okay in court the defendant Hunter was charged with operating while intoxicated First Defense or ow on June 17th 2020 3 months in 3 days after the arrest the defendant pled no contest and was found guilty of ow He was ordered to pay a bond amount of 93750 this amount has been paid in full he was further ordered to participate in an alcohol assessment and his license was revoked for 6 months he received no jail time and was not put on probation 7 months and 7 days after sentencing on January 24th 2021 at 5:55 a.m. amm Grant County Sheriff's Office responded to a call of a stuck vehicle at STS Andrew and Thomas School in pzi Wisconsin upon arrival a deputy observed the suspect later identified as Hunter step out of his vehicle morning morning no I'm just a little bit stuck I have someone com and help me out okay so what are they coming out of out okay what happened to the front of your car uh that has to started like that it's it's [Applause] uh oh yeah yeah I'll prior to this okay everything's all good that looks like more than a deer there and they found your bumper down on down by banland Auto same plate as this the FR bumper was down there what what would you say down by the auto dealership down between keer [Applause] and during the 17 and a 12 minutes of investigating the incident the suspect claimed he was leaving work and pulled over into the school parking lot to check his car for damage after potentially striking a deer the deputy observed heavy damage to the vehicle which was covered in dirt snow and mud the suspect also claimed that he had used his boot in an attempt to gain traction on his front tire but when questioned by the deputy struggled to remember on which Tire the attempt was made when the suspect opened his door to retrieve his insurance the deputy could smell a strong odor of marijuana coming from the vehicle the suspect would not indicate to the deputy the exact time when he had last smoked marijuana however the suspect did admit to drinking one beer earlier the deputy noted that the suspect had bloodshot and glassy eyes while also slurring his speech because of this the deputy offered to administer field sobriety tests at a nearby fire department but the suspect told the deputy that he did not believe that that was necessary later the discussion the suspect said that he had a few beers with his last beer consumed at 1:30 a.m. the deputy would eventually reapo The Suspect with his Sergeant for one last attempt to administer a field sobriety test yeah another problem man would have been any any different I would not have been in an okay place so I appreciate you over here and checking on me man yep so what I'm going to do now I'm going to patch you now do you have any on you at all that's going to hurt me or stick me at all I mean I don't think that you necessarily need to do that but okay well what I'm going to do is I'm P you down to make sure you don't have anything and then we're going to go through those fields okay cuz you got all the jacket stuff on I mean like no I mean I feel like we've already been through all this and it's all good right like I explained that based off the order the admission of drinking um your your general behaviors your know I mean I feel like I feel like I'm not in my vehicle I'm not driving and and I just don't think that's I'd rather just like walk through front house and I be okay right that's time that's time AC at this point okay like no I mean like I'm not D like I wasn't in my car I haven't been driving okay right so I'm cool okay you were driving no no no do you want to go through these the field sobriety tests or not I don't think I no no I don't think I need that's fine you don't this time you're going to be under arrest for okay well no no turn around and face your car and we can do we can we can do Feld ride guys no you you had that chance You' had that chance we asked you a couple times and you Hunter cooperate please please please sir apprciate cooperation okay I don't think it's okay come on guys come on guys have you been drinking or had anything way ear T night man okay while the suspect was being searched after placed in handcuffs the deputy and Sergeant located a smoking device with residue testing positive for marijuana this was confiscated and labeled to disposal the suspect was then transported to Grant Regional hospital and read the Wisconsin informing the accused form whereupon he consented to provide an evidentiary sample of his blood will you submit to an evidentiary chemical test of your blood yeah I didn't know where I yes okay the blood alcohol sample yielded a result of1 163 G ethanol per 100 milliliters in court Hunter was charged with operating with prohibited alcohol concentration second offense and ow second offense on May 23rd 2021 3 months and 29 days after the arrest the defendant was once again found gu y of ow and ordered to pay $2,123 in total assessments this amount has been paid in full Hunter was further sentenced to 15 days in jail a 12-month license revocation an ignition Interac device for 12 months participate in an alcohol assessment and provide a DNA sample to the Wisconsin Department of Justice
