welcome back folks to the DUI Channel we are in Fernandina Beach Florida where on June 14 2020 at 1 44 a.m a Fernandina Beach police officer observed a white truck traveling East on Sadler Road and an Irish speed and abruptly changing lanes almost to that car ES hey she brought her 301 1050 Dairy Queen the officer remarked that the vehicle may have struck another car in the parking lot or a gulf Alpha Zulu x-ray 99 after pulling into a parking space the officer approached the truck as his investigation begins bro what is your Rush this thing's smoking he almost hit that charger or Challenger when you pulled in the parking lot dude your brakes are like smoking right now get your license what you've been drinking tonight I only had two drinks tonight catching up with little friends all right is anything open over there in that bush box no sir it should okay hey bro check the side of your car and make sure he didn't hit it he came very close I don't think he hit it but I want to make going to ask if the firearm could be left in but he just said he'd rather me take it to the station for the property so the suspect Devin was arrested for driving under the influencer DUI and transported to the Fernandina Beach Police Department headquarters for processing while there the suspect submitted two breath alcohol samples of which the lower sample registered 0.184 grams per 210 liters ethanol this is over twice the legal limit of 0.08 grams per 210 liters ethanol to drive in the State of Florida he was charged with improper right turn along with two counts of DUI with property damage or injury the improper right turn was dismissed and one count of DUI was considered no action this means that although the suspect was charged with the second count of DUI the prosecution never filed the charge formally against the defendant Devon played no contest and was found guilty to the other count of DUI He was ordered to pay 956 dollars for the total assessment this amount has been paid in full the defendant was further sentenced to one day in jail which was credited as time served six months of probation 50 hours of community service and his license was revoked for six months on February 2nd 2021 all conditions of its sentencing were satisfied
