FERNANDINA BEACH, FL - At 1:44AM on June 14th, 2020, a driver was pulled over by a Fernandina Beach Police Officer for speeding on Sadler Road. The suspect claimed that he was having issues with his truck and was testing his rev limiter. The officer observed that the vehicle had smoking brakes and that the suspect may have hit a car when turning into a Dairy Queen parking lot. When asked how much he had had to drink in the night, the suspect claimed he had "two beers." The officer observed alcoholic beverages in a box container in front of the passenger seat of the vehicle. The officer confirmed with the owner of the Dodge Challenger that was already parked in the Dairy Queen that his vehicale had been hit whereupon the suspect admitted guilt and that he was at fault. The suspect then admitted to driving fast and the officer showed the spot on his vehicle where he had hit the parked vehicle. The officer took possession of the suspect's firearm and placed in his cruiser. The officer then wrote a ticket for improper right turn due to the accident and distributed the crash report to both the suspect and victim before the suspect asked an unrelated administratitve question regarding his firearm. The officer told the suspect that at this point, he would be conducting a driving under the influence (DUI) investigation. Once the suspect was read his Miranda rights and he agreed to understanding them, the officer asked the suspect how much he had to drink for the entire day. The suspect stated that he had three drinks during the day and two more in the night. The suspect then changed his position to drinking only one alcoholic beverage in the day then two more far earlier in the evening. On a scale from 0 - 10 with 0 being completely sober, the suspect claimed he felt like a "4 to 4 and a half." The suspect told the officer he felt no effects from the alcohol, was not buzzing, and believed he was safe to drive. The suspect told the officer he did not consume any illicit drugs. The officer told the suspect that he would like to perform a field sobriety test (FST) which the the suspect agreed. During the horizontal gaze nystagmus test, the officer observed that the suspect was unable to follow the officer's pen smoothly and displayed distinct nystagmus throughout the test. The suspect consistently moved his head and had to be instructed not to do so during the exercise. The suspect performed the lack of converge test improperly by moving his head after instructed not to do so. For the walk-and-turn test, the suspect had to be told to go back into the starting position after having been instructed to remain in place. The suspect was observed missing heel to toes on several steps and failed to walk in a straight line for much of the exercise. During the one leg stand test, the suspect immediately performed the test incorrectly and was told by the officer to restart. In the next attempt, the suspect counted, "Mississippi," instead of "one-thousand." The suspect estimated the passage of 30 seconds as 41 seconds in the Romberg test. When reciting the alphabet, the suspect stopped at the letter "V," paused for 13 seconds, then said, "J." The suspect claimed he did that because he knew the alphabet better backwards than forwards. Following the FST, the man was arrested for DUI with property damage. The officer handcuffed the suspect in the front because he was cooperative throughout the interaction.
