welcome back to the DUI Channel we're in Miami Township Claremont County Ohio where on October 8th 2023 at 2:25 a.m. an officer with the Miami Township Police Department observed a tail light out on a 2013 Hyundai Elantra traveling Southbound on Branch Hill Guinea Pike and making multiple marked Lane violations the officer pulled the vehicle over at the waffle house within Township limits and approached the driver's side as his investigation begins hello how are you good how are you's off I pulled you over cuz couple things one you've went over the center line a couple times the middle line also the fog line on the right side of the road and when you come to that light at 28 brancho Guinea you got to stop before the Stop Bar and also you have tail light out okay no I I'm aware of the tail light I just got a job I haven't gotten paid yet Goa okay so I'm just waiting for to go to to Auto line what is it called Auto Zone so I'm just waiting to go to Auto Zone to get that fixed got fair enough yeah all right so I am aware of the 23 ta light I did get pulled over and I did war cool correct so um yeah okay you got got your ID there yeah where you coming from this evening um back with you okay thank you after the officer confirmed the suspect's driver's license to be clear and valid he reapo the vehicle as his investigation proceeds yeah it's weather's changing that's for with you drinking one drink necessarily isn't illegal it's operating a vehicle Under the Influence which statutory law and a high is 008 so if you're not above wait okay this is probably not going to go anywhere okay all right does that make sense and that's what I'm saying so if you feel like my tests were okay then I don't feel like we need to do the the variety test okay so you don't want to take it no I and it's not the fact that I don't want to take it it's the fact of do you feel like we need it it's a tool that assists me engaging you I don't know how else to explain that and like I said I Live 5 minutes down the road okay I can drop them off and go about my way and that's it I don't want to be more than what it needs to be so if you feel as if how how old are you I don't want to the suspect was transported to the Miami Township Police Department for further processing upon arrival she was read the Ohio Bureau of Motor Vehicles form 2255 and consented to providing a breath alcohol sample just purging all the air out of the system I really don't care what's going on okay if yall want me to blow it I'll blow it okay once you hear that tone keep keep blowing and just keep that tone up okay whenever you're ready yep deep breath yep keep that going you need about 10 seconds air keep going keep going keep going keep going keep going keep going keep going keep going keep going okay stop the suspect Maya provided a breath alcohol sample which yielded a result of1 169 G per 210 l in Cor the defendant was charged with driving in marked lanes and two counts of operating vehicle under the influence of alcohol or OVI on October 30th 2023 22 days after the arrest the defendant pled guilty to one count of OVI with the remaining charges dismissed Maya was ordered to pay a total of $654 between fines and fees as of February 10th 2024 the entire balance is outstanding she was sentenced to zero days in jail one year of community control a license suspension of 365 days ordered to attend a residential Driver's Intervention Program and not allowed to have drugs or alcohol
