MIAMI TOWNSHIP, CLERMONT COUNTY, OH - On October 8th, 2023 at 2:25AM, an officer with the Miami Township Police Department observed a vehicle traveling with an inoperable taillight and making several marked lane violations. The officer then pulled the vehicle over at the Waffle House within township limits. The officer smelled an odor of an alcoholic beverage emitting from the suspect's breath. The suspect claimed that she was the designated driver and picking up friends from a local sports bar that had drank. After confirming that the suspect had a valid license, the officer asked her to step out of the vehicle to perform a field sobriety test. During the horizontal gaze nystagmus test, the suspect was observed having a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees in both eyes. The officer did not detect vertical nystagmus. The suspect had a noticeable sway during the instructional phase of the walk-and-turn test. The suspect further did not touch heel-to-toe on every step and made an improper turn while performing the test. For the one leg stand test, the suspect counted improperly and had a noticeable sway. The suspect also put her foot down for balance. The suspect was further asked to recite the alphabet starting with the letter "C" and ending with the letter "Z" to which the suspect performed as asked. During the finger count test, the suspect was asked to perform two iterations. After the suspect stopped after one iteration, she was reminded that she was asked to perform the iteration twice. The suspect then once again performed the test once. Following the field sobriety tests, the suspect was offered to provide a preliminary breath alcohol sample which she eventually refused. The suspect was then placed under arrest for operating a vehicle under the influence, or OVI, and taken to the Miami Township Police Department for further processing.
