Do you have Are you having any kind of medical problem or anything like that? >> I'm fine. Okay. Do you have your license, registration, and insurance with you? I have my license. My registration is in my phone cuz I don't have the copy of it. Okay. Where are you coming from tonight? Uh, from Amalie, from the Joe Rogan show. Okay. As he was speaking with her, he observed indicators of impairment and detected the odor of alcohol. She identified herself as Paula and told the officer that she was coming from the Yard House and admitted to consuming alcohol earlier that evening. Based on his suspicion of impairment, Paula was asked to exit the vehicle and perform field sobriety exercises. You still living on Yes. All right. That's good. Do you have any medical problems or anything like that? No. You taking any medications? Yes. What kind of medications you take? Anxiety. Okay. All right. Just say your name for me. Okay. Odor of marijuana. Sounds like slurp. Say it all again. Yes. All right. Can you hop out real quick for me? Yep. Just come back this way. You You said you're coming from from where now? The Amalie Arena. Okay. What was going on over there? The Joe Rogan show. Okay. Officer Baden started with the horizontal gaze nystagmus HGN test where he observed 636 indicators of impairment. The second exercise was the walk and turn test. During the walk and turn test, Paula failed to touch heel to toe on each step and turned improperly. The final exercise was the one leg stand test. During the one leg stand test, Paula failed to raise her foot in the proper fashion and put her foot down before the test was complete. Uh, I mean, what time did that Did that usually get out at like 11:00 or what happened? >> like 10:30. Okay. Are you just now getting over here or did you go somewhere afterwards or >> I went with my boyfriend and my coworkers to the Jake What is the Yard House? Okay. Okay. Let me see this. How much have you had to drink tonight? I just had three um, the Trulys. Okay. Okay. Can I check your eyes as part of field sobriety to make sure you're okay to drive? Yeah. All right. Do what? I'm going to have you step right here in my flashlight for me. Do you wear glasses or contacts? >> Contacts. Do you have them in right now? Yes. Okay. Feet together, hands down by your side. Can you see my light? Yes. What color is the light? Red. All right. I'm going to move this red light from side to side. What I want you to do is focus on this red light, follow it with your eyes and your eyes only without moving your head. Okay? Do you understand? Mhm. No, don't guess which one. Just focus on it. No, keep it going. Keep it going. Okay. Can you spell your last name? Paula. Paula? Paula, I'm seeing some things in your eyes that's giving me some concern as far as your level of sobriety. Would you do a couple other field sobriety exercises for me? Like what? Uh, it's called the walk and turn and the one leg stand. That I can do because I don't have balance in like my heels. >> Do I mean, I I would If you would prefer to do it without the shoes, that's absolutely >> I I can try, but Okay. It's usually with with this, I can't do it easily. >> Yeah, I mean, if I wouldn't expect you to try to do it in high heels. Yeah. Do you have any other shoes that you might would be able to to change into? No. No? Okay. Um, all right, Paula. Tell you what? Will you come over here for me real quick? Do you want to just put your purse down for a second? I have it under my jacket. Yeah. 684, can I get a 54 not 10-18? All right. I'm just going to shut your door real quick. Just I don't know if anybody's going to come by, but just to just to make sure. We're going to step over here in this parking lot real quick. 54 Okay. All right. Listen, I got glasses, too. I understand that. But I'm What I'm looking for is very specific things, okay? Um, tell you what? I'm going to actually Let's step over this way. I'm going to have you stand right here for me. I'm going to go grab some tape and come right back to you, okay? Okay. So, what was I doing because I drive through here every single day? You were all over the road. Like you were you crossed over the lane line like four or five times. I'm sorry. >> as it's 35 through here, you got up to 45. Um, and then it's just And then you blasted whatever that box was or whatever that was that on Cleveland back there by Dakota. Dakota? Yeah. I can't remember the street. Yeah. It was on Cleveland right there as soon as you crossed over the uh the railroad tracks. Okay. You hit like a big box or something like that that was in the road. What happened? Oh, I know. I saw that one, but I I didn't I saw it like afterwards and I was like, might as well just hit it. Okay. All right, Paula. Cuz I didn't want to swerve and like hit something, so I was like, I did see it though. Got you. It was like a cardboard box. Yeah. Yeah, I saw that. What did it look like? I know. I saw it. Can you do me a favor and just stand on this tape to hold it still for me? Yeah, I saw the box, but I I like, you know what? I'm like I usually say like if it's not an animal or something or person, I'm like I'm going to hit the box before I get into an accident. All right, just hang tight right there. Did you want to take them shoes off? It's up to you. Do you Would you feel more comfortable Yeah. without them? It's the same thing, probably. Okay. All right, just hang tight. Uh 6 in vertical and 8 in horizontal. All right, Paula. All right, you see this tape you helped me put down? Yeah. Okay, what I want you to do is put your left foot on the tape for me. So go ahead and take Take a step off. Take a step off. >> [snorts] >> So I want your left foot to be the very There, just like that. >> I'm telling you I have no balance. Again, I mean I I I know you got You're not the highest of heels I've ever seen. >> no balance regardless of the heels or not. So that's what I'm saying. You don't want to do yoga. All right. So I want you to take your right foot, touch heel to toe in front of your left foot. Okay. Make sure you're touching heel to toe. No, hang on. Hang on. Paula, I I don't want you to do anything until I tell you to, okay? So you're going to take a step off. All right. So left foot on the tape for me. Left foot. There you go. Right foot, touch heel to toe in front of your left foot. Hands down by your side. And then just stay like that. Don't move until I tell you to start, okay? And whenever I tell you to start, what I want you to do is take nine heel to toe steps down the line, okay? I want you to keep your hands down by your side. I want you to look down at your feet, and I want you to count each step out loud as you take it, okay? So it's going to look like this. So one, two, three, so forth so until nine. Now once you get to nine, you're going to keep this front foot still. You're going to take that back foot off the line. If you If that feel more comfortable, by all means take shoes off. I have no balance, so I know with shoes it's By all means, if you feel more comfortable taking them off, that's perfectly fine. All right. So left foot on the line. Right foot, touch heel to toe in front of your left foot. Okay, hands down by your side. All right. So again, when I tell you to start, you're going to take nine heel to toe steps down the line, okay? You're going to keep your hands down by your side. You're going to look down at your feet, and you're going to count each step out loud as you take it, all right? So it's going to look like this. So one, two, three, so forth so until nine. Now once you get to nine, you're going to keep this front foot still. You're going to take your back foot off the line, and then using a series of small steps, turn around just like this. Okay? Once you get turned around, you're going to take nine more heel to toe steps back down the line just like the first time, with the first step being number one. So one, two, three, so forth so until you get to nine, okay? Once you start, I don't want you to stop. Hang on. Hang on. Do you understand the instructions? Yeah. Do you have Do you have any questions about them? Okay. Go ahead and take your right foot, touch heel to toe in front of your left foot. So this is the beginning position. Very first time you take a step it's going to be number one. If you don't have any questions, you can go ahead and begin. One. Two. Three. Four. Five. Six. Seven. Eight. Nine. And then you say turn around? Just like I showed you, just like I explained it to you. One. Two. Three. Four. Five. Six. Seven. Eight. Nine. Okay. All right. So we're not going to worry about the tape anymore, but I'm going to have you step right here on my flashlight for me. Okay. So step on the flashlight, face towards me. There you go. So feet together, hands down by your side, all right? And whenever I tell you to start, what I want you to do is raise one foot about 6 in off the ground, okay? 6 in is about the length of a dollar bill or a can of Coke. I'm not going to measure it, just in that ballpark, okay? About yay high, all right? You're going to keep both legs straight just like you got them. You're going to keep your hands down by your side just like you got them, okay? You're going to raise one foot about 6 in off the ground. Point your toe forward in front of you to keep your foot parallel with the ground below you. I want you to look down at your toe. Count out loud. 1,001, 1,002, 1,003, 1,004, so forth so until I tell you to stop. Okay. Okay. Do you have any questions? No. Do you understand the instructions? No. So 1,000 what? You're going to just look while you're looking down at your toe. You're going to count out loud. 1,001, 1,002, 1,003, 1,004, 1,005, and just keep counting until I tell you to stop. Okay. Okay. Do you have Do you understand? Any questions? No. Okay. You can go ahead and begin. 1,001, 1,002, Make sure you're looking at your toe. Oh. 1,001, 1,002, 1,003, 1,004, 1,005, I want you to keep going until I tell you to stop. 1,005, 1,006, 1,007, 1,008, 1,009, 1,010, 1,012, 1,013, 1,014, 1,015, I have no balance. That's all right, you can relax. So feet together for me. Hands down by your side. Based on her erratic driving, her indicators of impairment, the odor of alcohol, her admission to consuming alcohol, and her inability to adequately perform the field sobriety exercises, Paula was placed under arrest for driving under the influence. After being placed inside the police car, Paula was transported by Officer Baden to the Hillsborough County Sheriff's Office for further processing. All right, what I want you to do now is just go ahead and put your hands on your back for me. What's going on right now is you are getting placed under arrest for driving under the influence, okay? Really? Yeah, once we get down to booking, I am going to ask that you submit to a breath sample. It's going to measure the amount of alcohol that you have in your system. If you don't, there's some penalties that would go along with it, namely your license will get suspended for a period of 1 year for a first refusal, or 18 months if your license has been previously suspended for a prior refusal, okay? Will you provide a breath sample for me tonight? Sure. So slide over here this way. Okay, my shoes. We're going to grab them. It's going to be a little hard for you. >> phone though cuz >> Yeah, I'm going to grab that. Do you have a phone Do you have a phone and a wallet in your purse? Yeah. All right, I'll grab it for you. And then I do need to call my parents. You'll be able to to make your phone calls once you get down to booking. Slide over this way for me. 641015. Do you have a female for search? Can I call Can I get my phone, please? >> I'm fixing to go get it right now. Grab a seat for me. Please. I'm fixing to go grab it right now. I I need to call my parents right now because they're like going to yell at me. Well, I mean listen, uh Paula, I'm not trying to be rude or anything, but you are 34 years old? I know, but I'm also Hispanic, and I don't know if you guys are Hispanic, but I'm I'm I'm not, or I am. Oh, he's Hispanic. But he's also an adult, so. >> also call in 2 3 hours Yeah. Please. >> So just slide in for me real quick. I'm going to go grab your phone right now though. But I'm fine. You're not fine. You shouldn't be driving. Slide in. I literally had like three. And that's probably like two too many for you. So slide in for me. Uh she is she is a 10-16, huh? Yeah, that's fine. That's her mom calling. Yep. There's a key. Cool. I'm going to leave this this wallet and purse in here, but I got the phone and credit cards. 60,000 mints in here. I don't know what that is. Pen or something? Or makeups? Uh you want to leave her jacket too? Yeah, I'm going to grab that. Or I'm no, I'm sorry. I'm going to leave that. That's what I meant to say. >> [laughter] >> I don't really see anything else. Did Did you guys have a female on the cycle or I think it might be the neighbor's. Ooh, they're probably Okay. All right. I'm going to go see. And then she has a 10-16. Yeah. Yeah, if you need it for whatever. What's that? It's going to get towed. I'll let you know which tow truck company it is that's going to come get it. Uh she's going to go down to the Orient Road Jail. That's where I'm going to ask that you provide a breath sample. Um from there you will have to stay for a minimum of 8 hours. So it's 12:30 now, so you're looking at 8:30 would be about the earliest that you could be able to get out. Um it looks it's from the information I have right now it's just a misdemeanor DUI, which typically is a $500 bond. Um so I got you had a two or three debit cards or credit cards or whatever in your in your wallet, so I'll grab those. Um if you have $500 on those, you can use those to bond yourself out. You could also go through a bail bondsman if you wanted to, which typically Okay. Which typically that's like 10%, so either whichever way you do it, that's that's kind of up to you. Um and then from there it all goes through the court system. So tonight you're going to go down to the Orient Road Jail. Like I said, you got to stay for 8 hours, and then the it's a $500 bond, and then after that it's all lawyers talking to lawyers type situation. So is it because of my car? No, it was that you couldn't stay in your lane, you're driving too fast, so it's a whole lot of things. That's why I was wanting to make sure everything was okay whenever I first made contact with you, and then whenever I made contact with you I saw indications of impairment, which is what led me to presume or to begin a DUI investigation, and based on the results of the field sobriety exercises and my interaction with you. How you I am. She's on the other side. She's She's real cooperative. All right, Paula, hop out for me. All right, officer Pena, I'm just going to search you, okay? Do you have anything at all in your pockets? Watch, anything like that, wallets? You know what I mean? Uh will you take that watch off for me, though, whenever whenever you get there. Yeah, I don't know what I'm doing. It's like they're like the kind of sort of pockets, you know? Yeah, I know. I don't know. They're like okay. They're like so shallow. Yeah. You know, like they don't really got to like Yeah, they don't even come out really. No. Okay, go ahead, look at me. Open your mouth. Put your tongue against the roof of your mouth. Perfect. And I'm going to try not to get all caught up in your hair. Do you want any other stuff off or just this? Uh that's fine. >> All right, you got to hop in. Watch your head. It's like super low. I'm going to buckle it in real quick unless you want to >> Buckle? Yeah, it's it's it's right there. So you just come straight across and you thingamajigger. I see both of mine are broken. Mine Mine worked for a long time. I had a I had a big old like 6'7 300-lb dude come in straight in, and he like ripped the the tensioner off. So mine's like yeah, mine almost So I when I got my car one side was working, and now I went to buckle somebody the other day, and it's like twisted in there. >> Yeah. >> And I'm like I haven't had anybody like act a fool back there, so there's no reason it for it to be like that. But I think a lot of times if you just get like a bigger person and they kind of like just pull on it the right way, it just gets hung up. Yeah. Unbind it. Yeah, that was the problem with mine. Thank you. No. Uh you you can make a phone call once you get down to booking, but to be honest with you it's probably going to be a couple hours from that point. Yeah, turn your phone off so the battery doesn't die. 684 684 10:35 on a CBT 58631 Yeah, well At least I mean at least you didn't get into a crash and you know, you didn't end up in the hospital or something. Well, nobody plans on doing that. So I have to be there for 8 hours. Correct. Yeah, like 8:30 would be the earliest. Uh it looks like B&D Towing, which I believe their location is down by Port Tampa, if you're familiar with Tampa. For for what? To call because it's the the phone call process or part is kind of towards the end of the intake process. So you're going to have to you know, talk to a nurse, they're going to take your fingerprints, picture, uh get you booked in first, and then towards the end of that is when they let you make phone calls. So it kind of depends on how busy they are on how long it would take, but realistically it's probably going to be a couple hours. Well However much you drank was enough to to impair your normal faculties where you shouldn't be driving. Well, that that's might be some of it, too, cuz alcohol with that is going to enhance both of both of their effects. So So, this, what do I have to do? Tonight or in the future? In the future. Uh To be honest with you, it's probably going to go all go through the court system. So, depending on what the breath results are, um the state attorney might uh look at it and offer like maybe a diversion program. Um potentially, I don't know. You know, that's that's up to them. Uh and then you you're going to have an attorney. Either you're going to hire one or they're going to give you a public defender. And your your attorney and the state attorney will talk to each other and you know, if if your attorney feels that taking it to court is the best course of action for you, then that's what we'll do. Um if they come to an agreement and, you know, kind of kind of find something that suits everybody, then that that's something that happens a lot, too. So, I mean, there's really a lot of different possible outcomes that can happen. So, I can't tell you definitively what will happen. Uh but that's kind of typically typically the two most common things. Officer Navarro, do you know who Watts is? Lou Watson? Yes. I don't. No, Officer Navarro. Uh it sounds familiar, but I can't place him personally. >> from hot pastor. I don't know. >> No, not hot pastor. Sorry. Uh I might He's in the narcotics Yeah, I might recognize his face, but the name sounds familiar, but I can't put a name to a face. What's the last name? Uh I don't know. Day Davis is kind of a common name, so I don't know about that one. Uh yeah, I'm not sure. Do what? Uh Uh I mean, they're if they work they work during the daytime? Mhm. They work daytime. Oh, well, I'm I don't know. Oh, okay. Okay. Oh, okay. Got you. Yeah, I'm not sure. Over here? Yeah, I work at the one that's right on Broadway. Oh, okay. Yeah. You still work there or no? No, I work Oh, okay. So, you switched from Wells Fargo to Bank of America? Yeah, that's a special That's a what? Fair enough. Makes sense. Yeah? 684, I'm coming 97 CBT 58643. All right, Paul, I got to read this to you. Can you hear me okay? I'm Officer Baden of the Tampa Police Department. I'm now requesting that you submit to a lawful test of your breath for the purpose of determining its alcohol content. If you refuse to take the test I requested of you, your driving privilege will be If you refuse to take the test I requested of you, your driving privilege will be suspended for a period of 1 year for a first refusal or 18 months if your driving privilege has been previously suspended or if you've been previously fined under Florida Statute 327.35215 for refusing to submit to a lawful test of your breath, urine, or blood. Additionally, if you refuse to take the test I requested of you, and if your driving privilege has been previously suspended or if you've been previously fined under Florida Statute 327.35215 for refusal to submit to a lawful test of your breath, urine, or blood, you'll be committing a misdemeanor in addition to any other penalties which can be imposed by law. Refusing to submit the testing is admissible as evidence in a criminal proceeding. Okay, do you understand that? Will you provide a breath sample? All right, let me get you out real quick. Where's my purse? I left the purse in the car, but I got your cell phone and all the credit cards out of it. Oh, yeah, that stuff was like just makeup and all that type of stuff. So. It's all right. We're going to make you do it. Sorry, don't hold the door for me or anything. At the jail, agreed to submit to a breath test. Her breath test results indicated BAC levels of 0.125 and 0.113, respectively, which were over the legal limit of 0.08. She was charged with a DUI under 316.193's 1 and later released on a 500 bond pending her court appearance. For letting somebody else in? Apparently. I call that being rude, but that's just me. They tell us the same thing all right. Yes, sir. Thank you.
