In September 2025, Whiteall Police Department and Homeland Security Investigations executed a coordinated sting operation targeting an elder fraud courier in Columbus, Ohio. A woman had been deceived into withdrawing $29,000 in cash after scammers impersonated officials from the Federal Trade Commission. She had already surrendered $20,000 in a prior transaction, funds that would never be recovered. The moment Josiah Davis accepted the cash box and placed it into his backpack, officers established probable cause under United States versus Watson. 1,976. Watson holds that a warrantless arrest in a public space is constitutionally valid. When law enforcement directly observes the commission of a crime, combined with pre-operation intelligence from HSI, the probable cause basis here was unambiguous and legally unassailable at the moment officers moved in. >> Get them out the window. Pull them out. This black door right here. >> Keep your hands up where we can see him. Hey, let's move around. Let's grab the driver. Somebody watch him real quick. >> Right here. >> All right. Back here. Come on. Watch me. >> Hey, unbuckle your seat belt. >> Unbuckle your seat belt and come to me. Don't reach for nothing. Don't reach for anything. Do not reach for nothing. >> I'm not reaching for nothing. I'm not reaching for nothing. >> Do not reach for anything. Put your hands behind your back. Face the car. Palms of the air like you're praying. Spread your feet. Spread them. I don't think anybody else is in the car. Keep your legs. How long have you know the driver? >> You might want to pat him down again before he goes back there. Is this one right here? Yeah. Okay. Cache salad on. You got pockets in these black ones? You got anything else on you? No guns, knives, drugs, anything like that? All right. We check the back seat every time before and after people go in there. So, okay. You're >> getting in. I better find out. I didn't check his shoe, but both the driver and the suspect who collected the cash were taken into custody and it was time to speak to them. >> Is that your Is that your cruiser, Meritt? >> Come on back. Come on back here. You got anything on you? >> My car's here, but I don't know the guy I bring from the airport. >> Are you Are you the Are you Uber driver? >> Yeah. You're an Uber driver? >> Yeah. >> My My phone's here in the phone. Yeah. All right. Have a seat there for a minute. Okay. 21 copy. O for the driver. >> Where was you taking them to? >> Huh? >> Where were you taking them? >> From airport >> to where? >> Here. Could we >> Was you Where was you going to go? >> I don't know because this next one. >> Huh? >> This next one? >> Not yet. Not yet. Okay. >> Just he say waiting. He go to inside. I wait. >> Did he go inside? >> Yeah, he was inside. But I'm waiting. He's too to let >> Huh? >> He's late. Check. Check how many the minute I Which one? >> This. >> No. No. That Yeah. >> This >> you see almost 19 minutes I waiting for him because he he two stop. >> He next to I don't know where he go. >> Where where did you pick pick him up at? >> I I bring from the airport. So you picked him up at the airport? >> I don't know now because I I don't know him. I waiting. He go inside the store. >> Here. >> Yeah. The store. I waiting for him. But I got He's coming. >> Oh, wait. So did you did you pick him up at the airport or you meeting him here? >> No, from airport. >> So you picked him up at Port Columbus? >> Yeah. >> Both of them or just one of them? >> Only one? One. >> And then brought them brought him here. He he was he I I I work in the airport. >> Yes. >> So he called me I I I give the because he share the share pick up. I just every day every day we work like that because we pick up anybody. >> Okay. >> So I I bring here but he have to stop. I waiting for him. >> What do you stop at? >> I don't know him. >> I waiting. I don't know because I I go to next one. He sit 20 minutes. I wait and then I got star. I don't know who his address. You understand? >> I'm I'm confused. Like >> did you did you get him at the airport? >> Yeah, I bring from the airport. >> Okay. Where at at the airport? >> At the >> like up by the terminal? >> Yeah. Terminal. >> Okay. And then you came straight here. >> Yeah. I bring >> with him and then he went inside. >> Yeah. >> And then you're waiting on him. >> Yeah. Okay. I was looking on you. >> You have no idea who he is? >> No, never. >> Because I'm working I'm working at black taxi on our driver. >> What is a phone number for you? Phone number. >> What's your phone number? >> Oh, >> hey. Face that way. Face that way. Can you show me the pickup location on here? Can you show me a pickup location? >> Pick up. >> Yeah. >> Already. Okay. >> Off John Columbus International Airport. >> Yeah. Going to go back there. >> Yeah. >> Oh my god. He go to airport. >> So they was going to go back to the airport. You pick him up and we're going to take him back. >> Mhm. >> And he have two ways. >> Huh? >> I I bring to airport and then he'll go back to the airport. Where is your Uber information in here? Like your information in case we want to get your records or whatever. What time What time did they ask for the Uber? Can you tell what time? >> When I when he requested the Uber. >> Just tell maybe 20 maybe 15 minutes. >> Is it on there? >> Yeah. Can you show me where where it's at? >> What when >> like what time you picked them up or whatever >> the map for my map or for the guy >> on on here? Yeah. For that you you for your map for him. Like what time did he request the Uber? >> Oh, >> finish it. >> Yeah, finish it. Come on out, sir. >> Yes. >> So, um, these guys were involved in some kind of scam. >> So, they was trying to scam this lady over here. So, that's why everything happened. Okay. >> All right. Um, a detective might call you to talk to you about it, but I think I got most of the information from you. So, um, as of right now, as soon as they move, you can get out of here. Okay. >> Okay. >> All right. >> Okay. Thank you. >> Thank you. Apparently, the driver wasn't part of the scheme. He was simply an Uber driver who had unknowingly picked up the suspect, later identified as Josiah Davis. The officers eventually spoke to the victim after the arrest. >> All right, so the phone's muted now. So, and then we'll know when he gets back on. So, obviously, I'm Detective Kinsy with Whiteall Police Department. I deal in fraud. >> Um, I am familiar with the scam. Okay. and someone else at another agency uh informed me what was going on. Okay, this this is uh make sure we're all the way up here. This is uh you know something that's overseas. Okay, so but obviously I'm going to get your money back. How much money did you spend on the gold bars? >> I didn't buy any gold bars. >> What did you buy? >> I went to the bank. >> So your money, how much money? >> Was $29,000. >> $29,000. And what they did was they told you that uh your bank account had been compromised and you needed to put it somewhere or what was >> No, I I was talking to someone from the department. >> Mhm. Okay. >> Okay. And this is his name. >> Yep. And um I've already >> Where do you live by chance? >> I live in >> Okay. >> So, right across the street from Texas. >> Yep. Okay. >> Okay. And um >> So, what did he tell you? >> Well, I've already done a drop off once. >> Same people pickup. >> No, this was a different person. >> So, you've already How much did you drop off the first time? >> $20,000. >> $20,000. Okay. That stuff's gone. cuz that it's all coming from my bank account. >> Yeah, I'm not I'll be able to get your 29 back, but I'm not going to be able to get your >> 20,000. >> Because you moved cash, right? So, I can't trace cash. >> That's what I was told to do. >> I know. >> Yeah. >> Um well, at least this time it wasn't gold bars. Um, okay. Well, sit tight. When he gets back on, you can tell him everything. You gave him the money. I just want to go home. Stuff like that. And I'll be right back to talk to you. Okay. >> Okay. >> Eventually, Josiah's bag was searched and he was taken into custody. Get a picture of this. Uh, get a big one. Heat. Heat. Cool. Did we get a camera? >> Jesse got it. >> Are we thinking this Uber driver knows nothing? >> I think so. >> You think he knows? No. >> How much cash? >> 29,000. >> Yeah. Who are you? >> Is my phone going to come with me? >> Huh? Is my phone going to come with me? >> No, we're taking it. That's our sound. You'll probably never get it back. No, >> we're going to ride a search war and dump it. >> I'm not worried. >> Who are you? Huh? I'm not even here. >> Who are you? >> What's social? >> Here's how it's going to work. You're going to sit in jail until you tell somebody who you are. So, if you're going to sit there for the next 20 years, you're going to be John Doe. That's who you will be. Hold up. Let me finish my spiel. All right. So, it's going to be uh a situation there. You understand? Huh? >> Like what you mean? >> What I mean? You come out these cuffs. All right. They're not tight on you. All right. Yeah. You come out those cuffs, we going to have some problems. All right. >> Yeah. Yeah. Yeah. Yeah. You grown. You over 18. This is what happens when you do stupid stuff and you uh make adult decisions. >> I'm going to die. >> You understand? >> Well, not necessary. Just keep your mouth shut. Just go in and do what you got to do and you going to be all right. Huh? >> What do I do? >> Well, hey, what do you do? All right. We going to stand right here. We're going to go to the left here. Stand by. >> Okay. Come on. All right, brother. Come on. Well, and now the sad thing about that is, you know, again, uh this is where you got to make decisions. You know what you want to do. You only 115 lb, right? >> Everybody in jail is 230 and 300 lb and you know, we're going to walk all the way around the back here, you know? So, when you make a decision that can cause you your livelihood, make a decision that can cause you to get in jail, you know, who can you be mad with? >> Nobody but myself. >> You damn stupid. You understand? So, let this be a learning lesson. and let it be, you know, uh, a learning experience and you would never do it again. Now again, you live in Georgia, you up in Ohio someplace. Anything happened to you, your mother would not know nothing about you. Am I right? >> Some people don't have ID on them because they feel, well, if I got ID on me, they know who I am. You get killed up here because of something stupid now, you be missing. You understand? Now, how you think that make your mother feel that she can't find you? You haven't called. You haven't returned the calls. Don't nobody know nothing. Am I right? Now you miss it. You understand? But yet you in a ditch someplace and we don't know nothing about it until somebody smells you, right? Which it does happen. You understand? Now you decompose and whatnot and bam. You know, he ain't got no ID on you. We do a dond do. Do you got dental insurance? Do you have dental records? So they will pull, you know, your dental and trace you that way. If you have fingerprints, they might trade you that way, you know, and then that's when they do, you know, your mother might put a uh hey, a missing son is missing and it trickles up here. You be like, oh shoot, this is like the guy that she might be looking for. Now she got to come up to Ohio, am I right? To identify what's left of you. That's it. They find you. Now it might be 10 years before they find you. What happens then? Now you just well dang. Well, what did he do? Well, he hang out with the wrong kids. He's a good kid. This that and another. He wanted to be a rapper and this that and another. So on and so forth. He just get mixed up with the wrong people. Blah blah blah blah. You know, it's not worth it. You only 20 years old. You understand? You're not even old enough to carry your gun yet. You understand? And you're making adult decisions that get them in trouble, you know? And they can go to jail for life if they don't get killed. You know what I'm saying? And here you're 20. I wish I would had left I'm from Cleveland. Left Cleveland and went to Georgia without nobody knowing, you know, where I'm at and doing something silly this where you get arrested. You understand? So I can only preach to you, you know, but it's going to be up to you if you absorb and realize what's going on. As of now, you scared, you know, cuz you don't know what's going to happen. Once they close those cells on you, you just see I see you just another, you understand? So, I know a few people down there. Hopefully, they will, you know, take good care of you. Watch your head. All right. I had to put the seat belt on you just in case if I roll this thing, you can't say that you wouldn't seat belt or not. Heavy ate. >> I can't even get up in this thing. >> Let's examine the constitutional framework. The Uber driver presented an immediate Fourth Amendment question under Terry versus Ohio 1,968. A brief investigative stop requires only reasonable articulable suspicion, a significantly lower bar than probable cause. The driver had transported the suspect directly to the crime scene. That proximity alone satisfied the Terry threshold, making the temporary detention lawful. His ride share records displayed in the Uber application on his phone corroborated his account precisely. Airport pickup, goodwill drop, return to airport. Digital rid share data constitutes contemporaneous documentary evidence. Officers correctly identified and released him as a nonparticipant. The most significant legal vulnerability in this case is the absence of a documented Miranda advisement before Davis was questioned about his identity while in custody. Miranda versus Arizona 1,966 requires that prior to custodial interrogation, a suspect must be informed of the right to remain silent and the right to counsel. Officers repeatedly asked Davis to identify himself after he was handcuffed. He refused. No. Miranda adisement is captured on body cam before this questioning began. The government may argue the booking exception under Burkimer versus McCarti 1,984, which holds that routine identification questions fall outside Miranda's scope. However, Davis's sustained refusal and the escalating nature of the questioning, including threats of indefinite John Doe detention, cross into territory. Courts have found implicates fifth amendment protections. Defense council will scrutinize this carefully. Any incriminating statement made during this window is at risk of suppression. On the phone, seizure officers got this right. One officer explicitly stated, "A search warrant would be obtained before accessing the devices contents. This is the correct procedure under Riley versus California 2014, where the Supreme Court held unanimously that law enforcement cannot search the contents of an arresty's cell phone without a warrant. Davis's phone, once searched under warrant, will likely yield communication records, coordination evidence, and network contacts that substantially deepen his exposure. Under Ohio law, Davis faces theft by deception under OC. Section 2,913.02. An amount exceeding $25,000 constitutes a first-degree felony carrying a potential sentence of 3 to 11 years. The financial exploitation of an elderly or disabled adult under OC section 5, 101.61 adds a separate enhancement given the victim's age and vulnerability should federal authorities pursue charges through HSI wire fraud under 18USC. section 1 343 and organized crime statutes could substantially expand Davis's legal exposure beyond the state level. Now the grades the officers and detective Kabinsky receive a B+. The operation was legally grounded and tactically coordinated. The phone seizure procedure was correct. The victim interview was handled with professionalism. The grade is held from an A by one critical gap. No Miranda adisement was documented on body cam prior to custodial questioning in a fraud case built partly on Davis's statements. This is not a minor omission. Josiah Davis receives a D. He did not physically resist. That is the only mitigating factor. Every other decision he made was wrong, including traveling interstate. To collect criminal proceeds from an elderly victim, the Uber driver receives an A minus. Full cooperation, voluntary production of digital evidence, consistent account under questioning. His release was legally necessary and correct. The department as an institution receives an A minus. The inter agency coordination with HSI was the decisive factor that prevented a $49,000 loss. The minus reflects the Miranda documentation gap at the policy level. Three lessons from this incident. First, Miranda compliance must be documented on body cam, not assumed. In an era of universal recording, an undocumented advisement is legally equivalent to no adisement at all. Second, digital evidence is now the backbone of fraud prosecution. Rid share records, phone data, and app timestamps can both exonerate the innocent and convict the guilty. preserve and subpoena early. Third elder fraud is not a victimless property crime. This woman had already lost $20,000 before this arrest. Earlier identification and victim outreach could have prevented that first loss entirely. Let us know if there's an interaction or legal topic you would like us to discuss in the comments below. Thank you for watching and don't forget to check out our second channel, Audit the Court, for even more police interaction and courtroom content. HANDS. GET THEM UP. >> Keep your hands up where we can see him. >> In seconds, the suspect's plan fell apart. What he didn't know was that police had already been waiting for him. And just moments later, he regretted his decision. This is what happens when you do stupid stuff. You don't understand. >> Earlier that day, Homeland Security investigators warned local police that a financial scam was about to happen. An elderly woman had been tricked into believing her bank account had been compromised. The scammers told her to withdraw all of her money and bring it to a meeting point, a Goodwill store on Robinwood Avenue. She was told someone would collect the cash to secure it, but investigators were already watching. Officers watched as the victim arrived and parked outside the store. Moments later, a man wearing gray sweatpants and a black hoodie walked up to her car. He took a box of cash, nearly $29,000, and placed it inside his backpack. Then he walked toward a nearby vehicle. That's when officers moved in. >> All right, she's giving him a box. He's putting in the backpack now. There's been an exchange. He's walking away. Walking up toward the front of the store. >> All right, still walking up toward the front. up at the front. Also, that black car is a black uh Chevy that's involved also. >> Get him out the window. Put them out. >> Right here. Keep your hands up where we can see him. >> Hey, let's move around. Let's grab the driver. Somebody watch him real quick. >> Right here. >> All right. Back here. Come on. >> Hey, unbuckle your seat belt. >> Unbuckle your seat belt. Come to me. Don't reach for nothing. Don't reach for anything. >> Do not reach for nothing. >> I'm not reaching for nothing. I'm not reaching for anything. >> Do not reach for anything. >> Put your hands behind your back. Face the car. Palms together like you're praying. Spread your feet. Spread them. I don't think anybody else is in the car. Keep your legs. I want to go over the driver. >> You might want to pat him down again before he goes back there. Is this one right here? Yeah. Okay. >> You got pockets in these black ones? You got anything else on you? No guns, knives, drugs, anything like that? All right. We check the back seat every time before and after people go in there. So, >> okay. >> You getting in? I better find out. I didn't check his shoes, but both the driver and the suspect who collected the cash were taken into custody and it was time to speak to them. >> Is that your Is that your cruiser merit? >> Come on back. You pick him up and was going to take him back. >> Mhm. And he have two ways. >> Huh? >> I I bring to airport and then he'll go back to the airport. Where is your Uber information in here?
