2022 officer Daniel Brown with the okal police department responded to a report of a female who was slumped over behind the wheel of a white 2018 Volkswagen Tiguan at the Circle K located on 245 any 28th Avenue she and another officer made contact with the caller before knocking on her windows and Awakening the occupant of the vehicle the occupant told officer Brown that she did not have her driver's license with her but she identified herself as 27-year-old Ella sorry okay stop going on your phone please give me your ID I'm so sorry okay well I've asked three times for it now well I'm sorry just sorry guys after a long eventful night come out thank you Happy Thanksgiving thank you is the car registered to you yes th% what's your name Ella flak Ella Flack yes what's your name bre I'm just going to run her cuz she can't find her ID for 36 Miss Flack are you from or you just haven't updated your address yet I have not updated do you have anyone in town that can come pick you up you obviously are not fit to drive as officer Brown was speaking with Ella she detected the odor of alcohol and observed other indicators of impairment Ella was offered an opportunity to have her friend come and get her but her friend was also under the influence and unable to drive since officer Brown believed that Ella was not able to safely operate a motor vehicle she initiated a DUI investigation Alo was asked to exit the vehicle and perform field sobriety exercises so you can either call a friend and have them here in the next 10 or 15 minutes or I'm going to do a DUI investigation okay um is there a way for me to possibly get my ID back you never gave me your ID you probably left it at the bar I would recommend you call a friend a sap I'll pick that stuff up for it's okay um take a couple more steps back for me please I'm just officer Brown started with the walk and turn test during the walk and turn test Ella did not touch Heel To Toe on each step and failed to turn the first time she attempted the test again but she was unable to follow instructions the second exercise was the horizontal gaze nagus hgn test during the HG and test officer Brown observed the lack of smooth Pursuit distinct and sustained nice status at maximum deviation and the onset of niist stmas prior to 45° the this field sobriety exercise was the one leg stand test and Ella failed to raise her foot in the proper fashion did not count alloud as instructed and placed her foot down before the test was complete the final exercise was the recitation of the alphabet and Ella was unable to do this in the correct sequence back yes ma'am I'm just trying to get a good camera view can you update the address are you Willet exercises so I'm going to explain the first one to you it's wheel the odor of alcohol and her inability to adequately perform the field sobriety exercises Ella was placed under arrest for driving Under the Influence after Ella was placed in the car she was transported by Officer Brown to the Marian County Jail officer Matthew stayed behind as her vehicle was towed by Carl Johnson's Towing okay so you are being placed under ARR for DUI even if I have someone comeing to get me and I'm not trying to drive your jacket's in the way your friend is also drunk she can't I'm not trying to call friends me all right just step right here to the left this is once we get once I can talk to you apprciate that I'm so sorry that's okay Ella was booked into the Marian County Jail at for 42 a.m. she agreed to submit breath samples and her breath test results indicated back levels of .1 for5 G to 10 and .144 G to 10 which would be almost double the legal limit of 0.08% Ella waved Her Miranda rights and admitted to consuming five drinks at several bars earlier that evening Ella was charged with driving under the influence fluence FSS 316.193 1C and later released the same day at 3:34 p.m. her case was later disposed of on January 25th 2023 a total
