How are you? better than I deserve. >> Uh Sam and then run about 20. >> Yeah, he's the one that called in. >> Woo. >> Who was driving? >> I don't know which one of them was driving, but whichever one of them was driving, they was running every bit of 120. >> That's what That's what Travis said. >> Every bit of 120 when they pass. I was right behind him when it happened. >> All of us would be alive. Every one of us. >> I see that. >> Around 7:26 p.m. on September 23rd, 2023, Deputy Chase Tremble with the Habersam County Sheriff's Office responded to a report of a motor vehicle accident on Goff 15 in Grandis Heights. He arrived on scene and noticed that a 2018 Toyota Camry was resting on the guardrail. He was also informed that the driver was likely speeding at around 120 m at the time of the crash. There was airbag deployment inside the vehicle and debris all over the road. Deputy Traml initially made contact with one of passengers before making contact with the driver. The driver was identified as 20-year-old Augusta Naggi. >> Every one of them >> you saw it happen too. >> I was right behind it. >> Did you see who? >> I didn't see it, but >> Okay. Jason, if y'all need something, call me. >> I appreciate you. >> You okay? >> I just need to be seen my neck hurt. >> Have a seat right there for me. >> Who's driving? >> What happened? >> We hit the side lane and we went into the grass and it kind of like threw us this way. >> Okay. You got your driver's license? Um, >> I will call I will call your bag and just >> my keys which on my my wallet is my my key wallet is my keys. >> Okay, hop over here for me. >> I can try to >> That's okay. Hop over the guard rail for me. >> How fast were you going? >> Give me your dad's number. It's over. >> Come right over here. >> Give me your dad's number. >> Can I just give him my number real quick? You got a got I'll start getting dead first. >> It's in my It's in my center console. >> Yeah, mine's in the car. >> All right, come right over here. >> Give me a second. >> No, come right over here. >> All right, tell me what happened. >> I was driving. >> Okay, go in front of that car right there. This one? >> Yep. >> Lean right there. >> So, you were driving >> and I hit like the the one that makes the noise, that yellow line, and then I went to the grass. >> We hit it. I hit it too hard. >> Mhm. >> You're not hurt, are you? >> You didn't black out. >> I have blood on me, but I don't know where it's from. What's your name? >> Augusta. >> Augusta. What? >> Naggie. All >> right. How old are you, Augusta? >> 20. >> All right. How much have you had to drink? >> I've only had two drinks. >> Okay. The reason why I asked is I smell it coming off of you, Augusta. Okay. >> My main concern is that you're okay, which you said that you are, but I'm I need to check and make sure that you're not impaired. All right. How long ago was those two drinks? >> Like an hour ago. >> Okay. Take a half step forward for me. Come right here, Augusta. I'm going to have you submit some voluntary evaluations to make sure that you're not impaired. Okay. >> All right. Tell me something. How far did you make it in school? >> As he was speaking with Augusta, he detected the odor of alcohol and observed other indicators of impairment. Augusta admitted to consuming alcohol earlier that day and even told the deputy that she had been arrested for another DUI 2 years earlier based on his suspicion of impairment. He asked Augusta to perform field sobriety exercises. >> I'm in college right now. >> Okay. Is it a safe assumption to say that you know your English alphabet? >> I already have a DUI. I I got it two years ago and I'm about to get off in November. I know how this goes. >> Okay. >> I mean, you don't have to do anything. I'm asking you to submit the voluntary evaluation. >> I'll do it. >> Okay. >> So, do you know your alphabet? >> Right. What I want you to do is I want you to recite your alphabet for me. Okay. But I want you to start with the letter D like doll. >> And I want you to stop with the letter X like X-ray. So, I want you to go from D to X. Don't want to start with any rhyme. Don't want to start with any rhythms. Just nice and slow. You understand? Okay. >> Do you have any questions? >> All right. Whenever you're ready, do that for me. >> D. Wait. A B C D Oh, [ __ ] SEE, Y'ALL already gonna take that as that. >> I'm not. I'm listening to you. >> D E F G H I J K L M N P Q R S X. >> Do you wear glasses or contacts? >> Do you have any problems with your knees, your legs, or your back? Did you hit your head in the crash? >> Did you said you didn't black out though? >> Perfect. All right. What I want you to do is stand with your feet together. You want to he toe to toe like I've got mine. Keep your hands down by your side for me. Can you do that? Hey, Colar. Colar, can you have them cut their lights off? Augusta, can you do that for me? >> Now, what I'm going to do is I'm going to hold my finger up in front of your face and I'm going to move it side to side. >> CAN I DO THAT WITH I GOT tears in my eyes, bro? What >> I'm going to hold my finger up in front of your face. I'm going to move it side to side. >> Sometimes it's going to be fast. >> I know. >> Sometimes it's going to be slow. like >> WD Traml started with the horizontal gaze nestagmus HGN test. The second exercise was the walk and turn test. During the walk and turn test, Augusta did not touch heel to toe on each step and turned improperly. The third exercise was the one leg stand test and Augusta failed to raise her foot in the proper fashion and did not count in the correct sequence. >> I just want you to follow with your eyes keeping your head still. Okay. Put your feet together for me. Put your hands down by your side. >> I'm sorry. >> It's okay. Keep your hands down by your side for me. Okay. All right. Ball tip of my finger. Okay. You're doing good. 413 clear. It's okay. All right. You have any problems with your knees, your legs, or your back? All right. Step right up here on this white line for me. Okay. All right. So, you see how the line's going straight down the road? What I want you to do is take your left foot, put it on the line for me. Put it on the outside edge, though. So, I want your foot >> out here. Side. >> Yep. Then, what I want you to do is take your right foot, put in front of your left foot, touching heel to toe. Keep your hands down by your side. I don't want you to move until I tell you to. Okay? Now, when I tell you to, I want you to take nine heel to toe steps down that line. >> Nine. >> Mhm. When you get to nine, leave your lead foot planted, turn around, taking a series of steps, and take nine steps back. I'm going to demonstrate it so you understand. When I do it, I'm going to take three, but when you're done, you're going to take nine. Okay? You get back in that position for me. Put your right foot back in front of your left. All right? So, again, left foot on the line, right foot in front of you, left foot touching heel to toe. We'll count each step like so. One, two, three, all the way until you get to nine. When you get to nine, leave your lead foot planted. Turn around. Taking that series of steps and take nine to jump back. One, >> nine steps. Four, nine steps. Five, >> three, all the way until you get to nine. Couple things I want you to remember. Keep your eye focused on the tip of your toes. Count out loud. Keep your arms down by your side. And once you start walking, don't stop until you're done. Okay? If you have any questions. All right. Whenever you're ready, you can begin. Move. All right. Come back around for me. Turn right here. So again, with your feet together, heel to heel, toe to toe, and your hands down by your side. I'm going to have you elevate one of your feet for just a minute. Okay? It doesn't matter to me which one. It can be your left foot or your right foot. With that foot elevated, I want you to count out loud in the following manner. 1,00 1,002,00 3. Continue counting till I tell you to stop. Now, what I want you to remember, just keep your eye focused on the tip of your elevated foot. >> I have to look at my foot. >> Mhm. Count out loud. Keep your arms down by your side. Keep both legs straight. You understand? >> All right. Here's what it's going to look like. >> Your feet together, hands down by your side. You're going to elevate that foot out in front of you. Hold on just a second. We're going to count out loud. 1,00 1,002 10003 and continue counting in that manner. All right. Again, keep your eyes on your toe. Count out loud. Arms stand by your side. Both legs straight. You understand? You have any questions? All right. Whenever you're ready. Hold on. Hold on just a second. You don't have any questions, right? >> No, sir. >> All right. Whenever you're ready, you can begin. 2001. 23 2004 2006 7 2008 2009 2011 2012 137 2018 2019 20 >> There you Stop right there. I know you said you had a DUI before, but your license is good, so it's not suspended or anything crazy like that. >> No, I got it back this year. >> Okay. >> It's all right. Okay, take a deep breath in and blow. Blow blow blow blow blow blow blow blow blow blow blow blow blow blow blow blow blow. Good. I think the boy the boy is in the back of the car. Okay. >> Based on the motor vehicle crash, the odor of alcohol, the witness statements regarding what happened, and her inability to adequately perform the field sobriety exercises. Augusta was placed under arrest for DUI. A search of her vehicle would later indicate the presence of open containers. After Augusta was placed under arrest, Deputy Traml read her. The George implied consent notice and she agreed to submit breath samples. >> All right, turn around for me. Turn this way. All right, Augusta, you are being placed under arrest for DUI.
