I shouldn't have let her stay in that bath all night. I should have watched her. I was being selfish cuz I needed sleep. >> But you should have called 911. >> Probably should have. >> No, no, not probably >> should have. On May 22nd, 2019 in Sturgis, Michigan, Wade Allen was brought in for questioning in connection with the death of Kelly Gene Warner Miller, who had died as a result of homicide. Spoiler details are in the video description, and the full results of all charges in the case are laid out at the end of the video. >> Might take a little bit to >> Please take your time. I I have nowhere else to be. Um, so I will bear with you. Officer Wire will bear with you. >> Absolutely. >> Um, if you need a tissue, there's plenty of tissues there. Um, >> I'll start with saying that she's hypoglycemic. >> Okay. >> All right. So, her eating levels are important. She has to have a certain amount of sugars or whatever. I only bring that to attention because I know at one point while she was making cereal, she fainted and really hurt her head and it really concerned me cuz a little after that I started seeing impairment issues whether speech, memory, things like that. I was concerned. >> How long ago would you say that was? >> So, just for reference, today is May 23rd and right now it's approximately 4:47 in the morning. >> Yeah. >> For her, um, that incident had to happen in March. Okay. So, it's been a little bit ago. >> When you say she fainted and hurt her head, how how did she hurt her head? >> I watched her when she fell and she fell back. It was back of her head on the floor. And I said her motor skills and memory were starting to not be at her best. >> Okay. When she fell, you described it as she kind of fell backwards and hit the back of her head on the floor. >> Yeah. Where in was this at your apartment at? Yeah. >> At 209. Okay. Where inside of the apartment did she fall? Where did that happen at? >> Kitchen. >> In the kitchen. Okay. When she fell, would did she become unconscious? Did she knock herself out? Did she just kind of stone herself? Did she She >> was unconscious for a little bit. >> Okay. About how long would you say a little bit would be? Well, >> I would say 5 to 10 minutes. And even though that might seem like a little bit to me, that's a long time for someone to be unconscious. >> Right. And that's just would that be your estimation or did you happen to did you look at a clock and have any type of reference time or anything like that? >> That's just my estimation. >> Just your estimation. Okay. >> But I know that's a long time for somebody sometimes. >> Okay. So, this was back in March when this happened. Okay. Has anything happened since March? >> Well, I think there might have been some things before before she came back. I think she was gone a while. She came back with some marks. So, >> is this from March of 2019 until now, which is May of 2019? >> No, it would have been before then. Okay. So, let's let's go start from March of 2019 when you witnessed her faint and hit her head and move until up until today. >> All right. And I believe she left for a while, got into a really bad relationship, and then when she came back to me, there's something. But yeah, there was that and then I was trying to take care of her. It was I saw like a yellow thing forming in her eye at one point. Then that turned into a blood sack that became both eyes. When did you observe this or when did you notice this issue with her eyes? >> This this was within a week or all of this is going to be only two weeks time period because it was about two weeks after that when I found her in the shower. >> All right. So she passed out, hit her head on the floor. You said within a week she had something in her eye. in that first week. Um, I know that, like I said, the What did it look like in her eye? >> It looked like a >> Well, it looked like yellow pots, >> which I would that been. I think it started in both of them. I I had no idea what what that meant. >> So when you noticed this Oh, let me back up. So when she fell, hit her head, lost consciousness, did she then come back around? >> Yeah. Just lost some memory of like she didn't know how or why she fell. >> Okay. Yeah. >> So then after that you said that you noticed something in her eyes that looked like some yellow bus. >> It turned into blood. Like that was really weird. >> So when you say blood, you mean like some hemorrhaging like the vessels in her eyes or I guess describe to me what you mean by blood in her eye. might be a good word. Uh was it like you know sometimes um somebody they might have like broken blood vessels in their eye. So you see kind of like the vein going through the eye where it's actually in the eye. It's not like cuz you had said blood sack. So to me when I think blood sick I think maybe something outside of the >> I it started with bloodshot but then it got then it got thick with where that yellow fus stuff was and blood so it was >> really odd and like when I say motor skills like she was at a point where she wasn't able to feed herself And that really concerned me. I did my best to try to help feed her cuz one time I I came in, I saw her sitting on the tub and I tried to feed her this meal and one of these freezer dinners. I have a bunch of those. And um it was chili. And she was just kind of like holding it like this. And she just moving so slow. And there was just chili all over her. And I said, I tried to feed her as much as I could. I said, "You need help. I'll either." And then like I can't like drinking water. I eventually started to give her a straw cuz like when I try to pour water into her mouth, there was a few times she would choke on it. So I'm like, "This is not working. We need a straw." When she passed out and hit her head, did you guys go to a doctor or anything? You noticed the stuff in her eye or maybe the motor skills were a little bit off or anything like that? Did you try to get some medical treatment for see what was going on? Anything like that? >> I didn't take her. No, I I didn't know if she could move or get around. >> What do you mean by that? just wasn't walking all that bad. Like I said, her motor skills were not good. Um, she needed to I was worried. I did start talking to her case worker about how she might need a adult foster care, you know, cuz before even that there was issues of bladder control problems like on my bed, I got a big old yellow stain for where she be on that. She didn't pitch like I have she had issues with bladder control. >> Okay. Um, before she fell and hit her head, how were her motor skills and functioning? Was she able to get around, feed herself, drink, talk? >> Yeah. Better than that. [clears throat] >> Okay. So then what happened after you noticed her motor skills were off? She got the blood in her eyes and she was not able to feed herself or drink. that that started towards the last two weeks, you know, the second week. >> Last two weeks of >> like I said, from the time of her falling at one time, >> right, which you said was in March. >> Yeah. To the time that I found her in the bathtub was two weeks. So first week was like I said the shortterm memory the speech a little off and stuff walking like her balance was off is what I mean by that and so that second week that's when I started taking on a responsibility of trying to feed her and such And sometimes I'll take the time to go in the shower with her to make sure she can wash herself. But was she able to wash herself? [clears throat] >> Did you have to bathe her? >> Yeah. >> Okay. Um, you had mentioned something about finding her in the bathtub. Is that when you found her in there and she you tried to give her the chili or >> No, the chili was I want I figure she'd be okay in a bathtub just taking a bath. So I started the water for her. >> I thought she'd be okay if she was laying down, not standing up. I wouldn't have to watch over >> so she wouldn't fall. >> Yeah. >> Right. So I see him ignoring breathing and I just what really shocked me is when I saw her feet and it is that she started with hot water and just I don't know didn't have the strength to turn the knob or I don't I can't understand why she didn't earn it for justice or and I don't know if that was a cause of death is is hot water or if or maybe she tried to get up and it fell or something. I I don't know. That's I seriously do want to know what the cause of death was because I really don't know. >> I just know that. >> Yeah, I don't know either. But I I just wanted >> She was in that tub when I found her. >> Okay. >> And she just wasn't strong enough to change the water. And I I didn't think it was that bad. I thought she could handle bad. >> So when you say you put her in when when you put her in there, how was she positioned? Was she sitting on her bottom? Was she on her knees? Was she You said she wasn't standing, correct? >> No. But if she did try to stand >> when you left the bathroom, how was she positioned? She was laying in the tub. >> Okay. And you said you started the water so the water was running. >> Yeah. And >> Okay. And was the tub the stopper in there so that the tub would accumulate water so she could take a bath? >> Yeah. And >> And did you go back in there? >> I went to sleep. >> You went to sleep? >> I thought she would be okay. >> And then when did you go back into the bathtub? or the bathroom, I'm sorry. >> Not till morning when I woke up, I realized she was in bed with me. >> Okay. >> Was the water still running or was was the water off? >> Uh water was off, so she had to have turned it at some point. >> Had to. So why is she just cold? I >> I don't know. >> I I don't know. Like >> So do we know approximately when this was when you went back in in the morning and found her in the bathtub and she wasn't breathing? >> Eight or nine? No, like what date? Like today is what? May >> 23rd. >> I I I I don't know my dates. I I know I was working at Speedway for a few weeks and she passed away during my time working there. So, I mean, if I had the employment schedule log of that, I only definite thing I can give you right now. I don't have >> Okay. When you went back into the bathroom and she was in the bathtub, was her head above water or below water? >> Water. >> Below water. Okay. And that I don't know if what happened at that point. Did you call 911? Did you call anybody at all? >> I I didn't know what >> I don't know how different it would have been. I mean, if I would have made a report for like I I I've been through a lot of scenarios where I've not I've been accused of a lot and I've been through a lot. So, I haven't been in a situation where I felt like like I could it's hard to feel like I could be honest if I feel like I I go through scenarios all the time where I'm accused and >> well, I tell you, we're not here making any accusation. We're just here to >> It's hard to trust >> figure out what happened. It's hard to trust and I just I I didn't do the right action. I probably should everywhere. I should have done some things right. And I I just felt like whatever I would have said would have just been taken the wrong way or said the wrong way. And it's my own issue. >> Well, I tell you what, let's I'm We are not accusing anybody. >> Not at all. Basically what we're here to do is we're here to figure out what happened. So I just want you to lead me through. You know, you told me that she was not have not able to take care of herself. She was not able to um care for herself. Motor skills were off. Um put her in bathtub, made sure she was down so that she wouldn't fall, hit her head again. um turned the water in, went in, fell asleep, went in the next morning, and her head was below the water and she was not breed. Is that correct? >> Yeah. >> Okay. At that point, lead me from there on to what happened. What were your next steps as to what happened? >> Well, at this point, I I treat it like I was guilty of the situation. I felt like no matter what I say or do, I was just going to be guilty. But I fig even no matter what, best I'll do is I want to give her a proper some. She doesn't have any family. She doesn't have any anything. At least wherever I'll put her, I would visit her. I wouldn't want her to have like >> nobody visit her, you know? >> Mhm. >> I mean, I don't know what I don't know what you guys would do with her now, but >> if I could know where she was buried, I would like to go, you know, I like to visit my mom's grave when I can, so I would visit her. That's pretty much where my thoughts went at this point. It's just let her have a place of peace somewhere, >> right? She deserves that. >> I mean, I don't have those answers. Not something I think about. You know, >> this whole situation is just it's not something normal for me to think about. >> I get that. So I just I didn't have people to talk to. It's not something you just talk about, >> right? >> I only had one friend which probably made the call. And I'm not going to be upset with him. He probably got to a point where his conscious got to. But >> yeah, it happens to people. I mean, especially when you're talking about something like someone passing away. >> So who who is your friend that you talk to about? Um, well, Stephen Russ. >> Russ. >> Yeah. >> Like, rus. >> Yeah. >> Okay. >> And I'm not going to be upset with him with that. That That's some Like I was only open with him. That's why I know when the call was made, I know he made it. I'm not I mean, you guys can't tell me or won't >> I can tell you that a person named Steven called. They They did not leave a last name. >> We have no idea who he is. They just said that they did not want to be involved that they were just concerned and wanted to wall her job. >> Yeah. And I'm not upset with that because I talked to him because I said mentally I need to be able to cope. I needed to be able to >> get that weight off of your shoulders. >> That's the best way to cope with stuff is to talk to somebody. >> And that's the only, you know, and >> Yeah. >> And that's why I did talk to at least him. >> Okay. That's good. Mhm. >> Um, >> where does Steven live at? >> He lives at Enchanted Glenn in Colon. >> Enchanted Glenn. >> Okay. So, let's get back to our our sequence of what how things kind of played out and and what happened. So, wake up in the morning, she's in the bathtub, she's not breathing. What What transpired from there? Well, not pretty, I'll tell you that. Seeing things that I can't unsee, but okay. So, I It took me a while to get some coolers. In the process of that, I would run cold water on her until I got some clues cuz I was like, >> I mean, you have a lot of detective shows, right? You know, so tell you if you keep the body cold or something, maybe >> they'll preserve it. I don't know. Maybe I'm ignorant in what I'm thinking, but >> that's TV, right? Mhm. So, so I just I kept cold water running on her a lot. Um, >> when you say that, you mean that she was still in the bathtub, I assume? >> Yeah. >> Yeah. Okay. >> I I I Yeah, I can I I didn't move her at all for a long time. >> How long do you think a long time would be? >> Two or 3 weeks? like portion of April. I I think Okay. >> Um, >> sorry. I got my my wife is texting me, so I'm listening. I'm just trying to multitask. And >> hey, the wife, it's important. >> Mhm. How often do you add cold water to the tub? Once a day or >> maybe twice a day? >> A couple times a day? Just >> maybe like >> ice cold water. >> Yeah. I I just I felt like it would help preserve. I >> Mhm. No, I'm sure it did. but not pretty. It's like I've seen the whole decompensation process and cuz I would come in I would come in and check on her and I know she's passed but I still talk to her. >> Okay. which probably makes you greatly talked to her was someone that you had feelings for. You had a relationship for a long time. >> I don't I definitely don't think that it's something that makes you crazy. I mean, it it's no different than someone who goes to a great site and talks to one of their loved ones who's passed, >> you know? I mean, it's a great site and you know that they're not physically there um but they could still be there in spirit. So, yeah. I Okay. So, you she was in there run water on her and you said it took a while to get coolers. So, I'm assuming at some point you got >> coolers. I did. Where did you get the coolers from? >> Well, how many coolers did you get? >> Two. I didn't know I needed a second one until after the fact. Like I said, the decompensation process watching the whole thing like first couple days she's movable, right? >> Then after that, you see like the blood kind of settle where she was laying at. >> Mhm. And a little while after that, that's when I started seeing like black around her fingertips and her groin and waistline. And by then she was pretty stiff for good while because when she was laying in the tub, she kind of laid like against the wall, I think, or something. But even after a while, the stiffness faded away and she just kind of, you know, laid on her shoulder. So, what happened at that point? You said that you bought one and then realized you needed a second. What What do you mean by that? >> I wanted to put her all in one so she could be whole. And so I couldn't really move her in any kind of way to keep her whole. Nothing I could do to keep her remain whole. That's where I really got close. >> What happened at that point? >> Well, when I had to get the second cooler out, I had to put a leg in that one. I'm not going to lie, that was the grossest thing ever. >> I guess help me understand how she was in one and her legs were on another. >> I had I had to cut her leg. >> Okay. When you say that, you mean that her body was too big for the first cooler? So, you couldn't fit her in the first cooler. And was she too stiff to be able to move her around to put her in the cooler? >> If I could move her, I would have had her like up to her chest or something. >> Well, you couldn't. Okay. So, you say you cut her legs. How where did you cut her legs at? This is the most disgusting thing ever. Hopefully you never have to see something like this in your life. Ever. All right. So here And then here I started here, but then I realized her knees were still over the edge. >> Mhm. >> So I had to go here, too. >> Okay. And how did you cut her legs? >> I use a saw. >> A saw? What? Like a handsaw? Like a >> reciprocating saw? >> Reciprocating saw. >> Yeah. I don't have it anymore. But >> where did what happened to the salt? >> I gave it away. >> Who did you give it to? >> Uh, Bill. >> Bill. He was supposed to give me a DVD player. Bill like a neighbor, friend. relative, friend. Does he live around you? >> He lives I think. >> He has no idea about anything. Like I said, I couldn't talk to anybody. Steven goes by the name Ryan. So, you'll hear me say Ryan Ste, but he doesn't like to go by Stephen. >> Gotcha. >> So, he goes by Ryan Russ. Okay. >> Well, Ryan Kirby, he takes on his wife's last name. >> All right. Let's get back to what would you say his name was? Your friend that you gave salsa to or the reciprocating saw? >> Bill. >> Bill. Is that his real name? >> Yeah. >> Okay. Do you know his last name? >> I just know Bill. I only just recently got to know him. >> How did you meet him? >> Shelter. >> Which one? >> Uh, Centerville Keystone. And he said now he's living is he still living in Keystone or he lives >> Burke. >> In Bur. >> Does he live with anybody in particular in Bur? >> No himself. >> Himself. Is he a young guy, old guy? >> My age. >> Your age? >> 35ish. >> He honestly >> Is he a white guy, black guy? >> White guy. He honestly had no idea about >> Okay. And the only one I did talk to was Ryan. That was it. >> Okay. All right. So, Way, we talked about a whole lot here. So, I just want to recap the past a little bit. Um, I know this is a rough subject, but I want to make sure that I have what you're telling me correct. So, that's why I want to confirm it with you. Um, okay. Because I don't want to get something in here that's not right because I'm I'm listening and I'm writing at the same time and you know, the story is is continuing on. Oh, >> well, >> so >> I don't know the condition. I haven't checked on her in a while after the cooler. So, like if there was water in her lungs still or not, I don't know. Uh, I know I I know that what I would have wanted to do, except she was too heavy for me, is take him under a shower, get a washer off cuz after she passed on, she cracked herself. And I was like, man, I didn't even know that till I got her into cooler. Otherwise, hell, high water. I would have washed her off, right? >> She don't need to be laying like that. Okay. Unfortunately, she she's heavy. >> Okay. So, she takes a bath, passes away in a bathtub. Um, you store her in the bathtub until you can get cooler, run cold water on her, and keep the decal down. Um, by the first cooler, she wouldn't fit. So, you try um removing her legs below the knee, >> up below, and above. All right. So, below first, right? Cuz then we said and then she was still too long. So, then you removed above the knee. >> And what did you do with those portions? >> Second cooler. >> The second cooler. Okay. Um, so removed the legs, were able to fit her in the cooler. Um, put her legs in the second cooler. Where did you get the second cooler from? >> Walmart. >> Walmart. Awesome. Okay. >> I'm not a very complicated guy. >> Okay. And then you said the reciprocating saw that you used, where did you get that from? >> Walmart. >> Walmart. Okay. And then the reciprocating saw after you removed her legs, then was there a reason that you got rid of it or just had it and you didn't really need it or I mean, how did that whole thing play out with Bill? >> He needed it and I needed a DVD player. I don't have anything for entertainment, though. I mean, he's a mechanic. And the only other thing I was going to think about using it for is like Brian had to get rid of a couch recently. I said, "You could stop at my place. We could have cut that couch up because his apartment complex said that they were going to charge him $100 to take it to the junkyard or something." >> Mhm. I said if you cut it down into small pieces, you won't be charged anything. So a25, $30 little sawing saves you $100, >> right? >> Absolutely. Wherever you can save money, right? I mean, things are expensive these days. >> Yeah. >> Well, he refused. He didn't want to come by and pick it up, so we had to use like a hammer and hatchet, and still he had a metal frame, so he found somebody to get rid of the frame. Good for you. But I said that saw would have cut through the frame. >> So let's go back to removing her legs. Where did that happen at? >> Living room. >> In the living room. >> Yeah. >> Okay. >> Cuz by then I was able to get her in the big one. >> Okay. So when you say you got her in the big one, how did that work, too? >> She was heavy. So I mean I couldn't Oh, I want to kind of show by hand, but basically I just hand's getting sore. >> Yeah, just adjust that. It's It's pretty loose, so it shouldn't >> shouldn't be pinching anything. Um, I just kind of had to lift her up over the tub and then just into the cooler. >> Okay. >> And it took some effort. And after I got her out, I I couldn't just leave the legs over because the whole idea of the cooler is just to contain smell the decomp all of that to contain it. >> Okay. >> Cuz for a while, I mean, odor, >> right? >> You know, >> so you pulled her up and out of the tub, slid her into the cooler. Yeah. >> And then we're >> so I tried to pull her out to the living room. >> Okay. >> But I couldn't move her like so. I was thinking the chest and I couldn't do it. That's when I said, "Okay, I got to get a second cooler." >> Mhm. [clears throat] And then um I just don't I I let her just stay in there because I knew if I keep opening it even if I wanted to look at her create odor and I didn't look at her very much after. >> Okay. And about how long ago do you think that that was the last time you closed the cooler, put her to rest until today? >> About the third or fourth week in April. I want to say the fourth week. >> Okay. So, going through your apartment, I found the reciprocating saw um box that was in there and it had a date of purchase was um April 17th. Is that >> sound about right? >> That's about right. Yep. Going with your timeline here. So >> I mean I if I am wrong in timeline it's not on purpose but >> well I can tell you I mean it's a printed receipt and it's on the side of the box I know that >> just in case I wanted to return it. >> Okay. >> And it looked like you bought some extra blades like another blade pack with it. >> Yeah. What did you get those for? Just for me. Did it come with blades or >> It came with one, but this is gross. All right. A lot of this is gross, >> right? >> But the truth is is I need a long enough blade to cover the thigh. >> Gotcha. So the ones you bought were longer ones. >> Yeah, it was only one. >> Just one. >> There's no sense of getting two or three, >> right? Yeah. I mean, I know I'm waving my rights in silence and everything. I I hope somehow by being honest with you guys, this means something. >> It does. And we really appreciate you being honest with us. That's going to that goes a long way with us. >> I hope so. >> Yeah. >> I mean, I'm not proud of anything at all. >> Sure. But stuff happens and we just trying to get this >> not how this should be like >> I kept saying that to where like this is not how you should have went this >> Wait, where were you keeping the coolers? I kept the big one in the living room and the small one in my bedroom. >> Why did you split them up like that? >> Honestly, I don't know. I probably should have kept the phone together, but I think the only logic that could have been involved in that was if I have guessed they look at only one pillar, but they saw two, then that's might have brought questions. >> So, do you think maybe this was just to kind of make sure that people didn't question why you had >> two >> two coolers? Okay. and maybe wouldn't want to look inside of them or think something was a little bit off or >> Well, I put boxes on top of my big one, but I was like, a lot of those boxes I figure, okay, my lease is till February. I figure, well, if I leave, I just want to put my microwave, my I got the microwave box that has a warranty. Um, and just basically all the things I paid for, I want to put them back in their boxes if I move. >> Gotcha. >> So, you said that you're not working at >> Speedway. >> Speedway anymore. So, what how are you generating your income? >> Well, right now I'm doing some lawn care. I got some lawn care projects coming up. >> Okay. >> Uh through the people at the comic shop. Mhm. >> That's my hangout. >> Absolutely. >> And uh they're closing this week. >> Closing for good. >> Yeah. >> Really? That sucks. >> It's tragic. Like horrible. >> So, I bought my poster, which I don't know if you guys saw that, but my big old Marvel post. >> Oh, yeah. I saw that. That's totally cool. I like it. >> I had to because they're closing, >> right? >> So, I wanted to keep something from the shop. Well, talking with the owner, she said it they're going to need some landscaping, a lot of maintenance, and that I can earn a few dollars that way. I said, "That's awesome. At least until I get my applications filled out." Her husband works at Little Caesar, so I got a pretty good certainty I could work there. >> And the other application was for PSSE, >> which I know I can pretty much get hired in there, >> right? I just I don't have a full sense of the city. Like I don't know all these streets all that well yet. To me the factories seem like a long distance but the reality is not that far and I'm just trying to get past that mental block like wait you can do this. Wait you can walk this. Trying to motivate myself and it's just kind of a mental block. >> Gotcha. It don't make sense. I like to win other than count walk five plus miles a day, not a problem. And yet, for some reason, I can't get myself up and motivated like I need to. So wait, when this happened to to Kelly um and you kept her in the tub and put her in the cooler, did you think that this was a right thing to do or a wrong thing to do or did what what did you think about it? I think, like I said, I want to give her a proper burial. >> I'm not trying to have her be on display to be really like I don't know how people are going to I guess what I'm asking is when you found her in the bathtub, she was not breathing. She was no longer alive. You kept her body in the bathtub by running cold water on it so that she wouldn't decompose and then purchased a cooler, put her body in, but figured out that it wasn't long enough. So then you cut her legs off, purchased another cooler, put her legs in there. Did you think that was the wrong thing to do? rather than finding her and calling 911 when you found her deceased. >> Well, in the beginning, I was I I don't know how to make that report without it being like I said, I've been accused so much. It's hard for me to want to make a report about things. I I I'm not as far as right or wrong. I don't know as far as reports. I don't know if telling the truth or being honest means anything. And when you lose that sense, >> what do you mean by that? I guess I don't understand what you mean by that. >> Because I feel like no matter what I say or do sometimes I I I don't know if I can can be in the right, you know, in the eyes of others. I don't know how other people look at me. So I don't know. I didn't feel comfortable making it. It wasn't a matter of right or wrong. just a comfort thing. >> So, would it be fair to say that you felt more comfortable by keeping her in the apartment in the tub and then keeping her in the apartment in the coolers? You felt more comfortable doing that than you did calling the police or medics or something like that? In a way, I want to say yes, I did because I kept her company. I talked to her and when I could, I would put her somewhere decent, you know. >> Mhm. >> Is that that what you were planning to do? Is that what you mean by that? When you could >> Okay. Where were you planning on putting her? >> I don't have a place in >> Didn't have a play check. I mean, as I travel around countryside, I could look around and say, "Okay, that could be or that could be." But the only thing I thought in my mind could be like a a lake or a hill or something. At least she'll have some wildlife or something, maybe. >> How long did you think you were going to keep her in the apartment for before you found the place? I wasn't really think I just think about you know I mean I I it was kind of like play by ear like like for example the last few days I think the smaller cooler might have had a odor start to develop again the big one I don't think it. So, in my mind, I'm like, "Okay, now I have to do something." And that's just kind of how it is. I'm responding to a need to do situation. >> Okay. >> It's not like I've thought, okay, this is where this should go or this is when this kind of like this is happening. How should I respond? >> Gotcha. So, when was it that you called Stephen then? >> Well, I talked to him about it. Oh, B. It had to be the end of March around the time of like within a week after she passed. >> Okay. And what did you tell him happened? >> I told him that. >> So wait, I want you just to remind you that we we have spoken to Stephen. Okay. So, you know, we've been 100% honest with each other up until this point. So, I want to make sure that we we continue to be honest. And if there's something, you know, that we've talked about that's not really 100% honest, now would be, you know, the time to to say, "Okay, you know, I I think I might have said this, but I really meant that." Um, that way, you know, we're all telling each other the truth. I told him about that cutting process. >> Okay. What did you tell him happened to Kelly? I think I told him that she fell down. >> Did you tell him that you backhanded her and something happened and she passed away? >> Backhanded her? >> No. If you said that, then I'm a little bit upset because that's not true. >> So, wait. This is This is >> her. No. >> Did you and Kelly have some type of an argument fight? I mean, did something transpire between the two of you that was, you know, maybe mutual, you know, she came at you or something where you're trying to defend yourself or just kind of calm things down. >> There was no argument. >> Okay. Okay. Because this is the point where, you know, I'm being honest with you, you're being honest with me. I am being I'm telling you exactly what what came in. >> I'm telling you absolute truth. She was in that bathtub [snorts] when I went to sleep. >> Backhanded her and killed her and cut her up and put her in the cooler. >> That's not at all the case. >> No, not at all the case. >> I am being 100%. >> Okay. I'm just throwing it out there. >> I'm a little upset right now because that is >> Well, I don't want you to be upset with me. >> I know I'm upset with you. I'm not upset with you, but I am upset >> that he So then this is why, you know, we bring these things up because this is what we're trying to do. Officer Wire and myself are trying to get make sure we get to the bottom of the story. Um, so an autopsy will be performed on Kelly and what they will do is they will go through, you know, all medical conditions, everything uh that transpired. They'll be able to tell us what her exact cause of death was. Um, and I just want to make sure that you were telling me she was in a bathtub. You woke up, she wasn't breathing. Water was above her her airways and then we get to the medical examiner's office and they say she's got water in her lungs. That's not what caused her death, >> you know. So, I mean, if there's something else, it's something else. You know, it doesn't matter to me one way or the other. It doesn't matter to officer wire. >> Yeah. Like, I I don't know. Ultimately, what we're trying to do here, Wade, is we are just trying to when Kelly's family or loved ones or other people who cared for her like you did, um, you know, ask, we can be like, we can just tell them, hey, you know, this is what happened. Um, >> that >> so, you know, not only for them, but also for you. So that way everyone has a peace of mind and everyone has a clear conscience and everyone doesn't have a weight on their shoulders of >> ever since that first fall I've been worried like I said with the balance being >> okay >> my fear is that she might have tried to got up and might have slipped back down. >> Okay. >> Okay. But I I I don't know how to ver I'm not a expert. I don't know how to verify that. Mhm. >> Well, that's what the medical examiner would see like the water. I don't know if that was her cause of death, >> but I know I did shower her a few times. So, there is probably going to be water. Is it enough to fill her lungs? I don't know. >> Mhm. >> That's why I told you everything. >> Okay. >> Because >> Well, like I said, you know, I'm just want to make sure that >> And she does have other marks and stuff. Like I said, because before she came back, she she left someone that hurt her bad. >> Okay. >> Okay. And you said that wasn't relevant right now and me telling you this, but >> she has marched from >> Okay. >> Well, you know, they'll be able to tell us, hey, this market is this old, this mark is this old. And that's why I worked hard with you to be able to establish the timeline. you know, we we talked about couple days here, couple weeks there, and how it all means different things to different people. Um, and then we also talked about, you know, the reciprocating salt box that we found that had the date and the date of sale. >> And then, you know, when you heard 417 19, you're like, "Yeah, hey, that's exactly when, you know, this that works with my timeline." And so that way I can tell the medical examiner, okay, you know, this is when this happened. This is when you purchased this. I'm glad that that receipt was there that you >> because >> I try to tell you my timeline. I I wouldn't be able to tell you honestly the exact date, but at least you saw that. >> Yeah. >> Know it matched what I'm trying to tell. >> So I I see that the receipt was on a reciprocating saw, but did you how did you pay for the coolers? Was did you >> uh most of the time it was with my pay card? I think >> with your pay card. >> Yeah. >> Okay. Did you do you know did you save the receipt for those or >> No, I I I knew pretty sure I was going to be stuck with the coolers for a while. >> Okay. All right. Tell you what, I need to go blow my nose or something cuz it's itching me like crazy. So, if you'll excuse me for just one second, um I'll be right back. Okay. All right. I need some reassurance. Did I say do the right thing by doing what I did? >> Well, yeah. And we're basically that's why we're trying to ask you so many questions so we can you know get the whole story and why you did what you did and what you were thinking and what would we have done in that situation? What would other people do in that situation? Um so we just got to play everything over in our minds. That's why uh detective mail is taking good notes so we can go back and review everything. Um, so yeah, I mean, we'll get it all figured out. >> The fear that I have from police in general comes from when I was accused of a rape situation. And this is in my report file, so we can look it up. But at like 2:30 something in the morning, I wake up to a squad of police. I was in an abandoned factory and they bust down through the door and they had all their guns drawn on me. >> Jeez. >> And I had all these red dots on my chest. And I usually wear a hat. I don't normally go without a hat. I always have a hat. But >> I knew if I would have reached for a hat, I could have been dead. >> Bad things could happen. Know you're smart. Yeah. So when I saw those red dots, I'm like, "Okay, not going to reach for the head." Because they don't know what I'm reaching for. >> Yeah. >> So I had enough sense to say, "Don't put my hat on." But normally my instinct is when I wake up, put my hat on. >> Mhm. >> And when they interviewed her the second time, you'll see in the report, she confessed to making the story up. >> Ah, >> was that Kelly or was that somebody else? >> That was someone else. >> Okay. Okay. That was a woman named Emily. But >> that scares me. >> Yeah. >> I had a lot I still do where when I see flashlights around or anything, I'm afraid. >> Mhm. >> The police have made me afraid of that. >> I can understand that, too. I get a little nervous around cops. Even when I see them. [laughter] >> Um, other than that, have you ever been in trouble for anything else or? >> Most of the time it's I've been homeless for 15 years. Has it really been 15 years? >> This is my first time having a home. >> Wow. Gotcha. >> I never had keys to my own apartment till now. >> So, a lot of my cases have always been trespassing, abandoned houses. >> Gotcha. Okay. You've never been in trouble for arguing with somebody or fighting or shoplifting or anything like that? Okay. >> No shoplifting. No violent stuff. >> Okay. You know, I mean, >> have you ever been to jail before? >> For those trespassing for trespassing, >> it would only be like two or three days. >> Okay. You never gone to jail for fighting somebody or pushing somebody or >> Well, >> any kind of domestic violence or anything crazy like that. The >> domestic things in the past have been dismissed in court. Because like before when like well okay with Kelly Jean for example all right I kicked her in the butt cuz I was ashamed of her cheating on me and such and you know I I shouldn't have but I did. And then come to find out in court she tried to blame these bruises of her ankles on me. I said I have nothing to do with her ankles. That's false evidence >> because what happened was she fell down by the railroad again a balance issue by the railroad tracks and that caused the bruises from her ankles rolling. >> Not from you kicking her though. >> No. >> Gotcha. So when they brought that in court, I said, you know, up to this point, I would have settled for like, okay, you know, domestic, whatever. I I I would have said, you know, okay, if it was just me kicking her butt, you want to charge me and I can I can say, yeah, I did that. >> Sure. Yeah. >> But but when you added something to my situation, >> Yeah. That's not right. >> I No. No. Now, I'm going to, you know, go against that and I'm not guilty of that. So, >> did they end up dismissing that or >> they did dismiss that? >> Okay. And then you >> false evidence. >> You can't lie on me. Like, like him lying about me. I'm not happy with that. >> Okay. >> You know, don't >> How uh how long did it take you to forgive Kelly after you guys got into that dispute? You guys get back together pretty quick or >> It took us a little while, but we got back together after she went and realized that a lot of the guys she was with were just >> they wanted only one thing from her. >> Yeah, I understand that. Um, >> and she's like, >> how long do you think it took you? A couple weeks or a couple years or >> couple months? Couple months. >> Almost a year. Because what happened is she had child support. She did 200 days in jail. >> Oh, I see. I see. And after she got out, you guys got back together. >> Like there was a few months before that and then a few months after she got out, but I didn't even know she was in jail. Well, I knew she had the child support, but I didn't know how long it'd be. >> Okay. >> And then she was in a mental health place after that and then she was free and she was facing some child support again. wash because you're at shelter. Cuz I brought her out here to shelter. I said, "Look, I don't know if I can have you on my lease or on my case or any of that. So, I want you to I can't help you as much as the shelter can help you because they help me get where I got. I I did like three months there because I was working at Dollar General in Centerville for like 4 months or so." >> Gotcha. Yeah, I think I've seen you in there. >> I was holding down my job there. They were proud of me and you know they gave me an opportunity to try to stabilize myself out here. >> I said she could do the same thing but she just wanted to get on disability and that's a longer process. >> Yeah. >> I said well she could stay with me long enough but I needed her to get connected to the services. So her case worker is my case worker. We both have the same case. >> Okay. I see. Um, did you guys did you guys ever argue and verbally argue back and forth? Was she a hard person to live with or? >> No. >> No, not a hard person to live with. You guys got along pretty good. >> Yeah, she's a homebody. Like, she likes to read her books. >> Yeah. >> Stay in bed most of the time. >> When would you say the last time you guys actually got into an argument? Was it after the fact the time that you got in trouble for kicking her? Did you guys ever get any arguments after that or? >> We were only together for a few months. Like after I got her out here to Centerville and then got her out to stay with me. She was only with me for for February. No, not February. February, March. Well, maybe February, March. It was only a couple months. >> So, so right around February, she moved in with you at your apartment here. >> Yeah, roughly or at least visited cuz I did have her go to the shelter for so she get connected to the services. >> Okay. >> I wanted her to go with your scene. Actually, she had appointments for social security. >> Oh, I see. So, she actually didn't live with you. She stayed there every once in a while, but >> she was going to be living with me. >> Okay. The plan was to move her in. and she stayed with me for like a week or so, but then I realized I can't help her as much as the shelter could. So, I said, "Go there." And I think that was in February. I said, "Go there. Get connected. Try to behave." >> I mean, I I said, "I'm not telling talking to talk. I walked a walk. I already did that. >> I'm I'm trying to show you the way by by taking on that path." And then when we get settled where they got you connected to all those services, >> then I'll have you come out here because then now your case worker, which is my case worker, >> and see us both and um get you on the path you need to be. Disability is what she wants. >> Yeah. >> I didn't choose disability cuz I feel like I am able to work. >> Sure. Sure. You know, this Speedway was not my answer. They >> Why did you quit there at Speedway? >> I loved it there. >> Did you? >> I did. >> You know, I mean, I saw you and a few others. I got used to some regulars. >> Yeah. >> But they don't train people like they need to. [clears throat] >> They just >> cut you loose and you got to figure it out. Huh. >> Well, okay. The process is you're supposed to have five days of computer training, right? I only had two. And then my first day on ship by myself, they didn't even tell me what my cashier number stuff is. So, I can't open or close a register. >> I'm like, how do I I can't even do a shift without a register. >> Yeah. And then the day I quit was because they had a truck night and left me all by myself unloading a whole truck of things and didn't know where anything went. [clears throat] >> So I packed all the cooler things into the freezers with the freezer items and no cooler items going. But I didn't know. I just kind of put everything together. I said at least >> they're not going to go bad. >> Wow. We got a generator that'll kick on here. >> I see. >> There she is. Must be kind of stormy outside. Just give it a second. >> All right. >> Back on. >> Okay. But uh yeah, so I'm I'm behind and that morning I I was behind on coffee and the donuts and the manager comes in. She's so upset and I'm like, you don't think I'm a bit upset with myself falling behind, not feeling like I'm worthy or enough? You know, like I start feeling self-esteem issues when I fall behind, you know. >> Sure. Sure. >> Plus, you were probably stressed out from the whole Kelly incident, huh? >> Well, not something I can really talk about at work, right? >> Yeah. Yeah. So, but that was probably weighing heavy on your heart there. and and and they can't they can't know what I'm going through. >> Yeah. Exactly. >> You know, so when I express that I feel overwhelmed, which is what I told my manager there. I said I felt overwhelmed and things fell behind. >> What I needed was someone to help with the trucking and then I could have just done the rest of my shift fine. I would have been on top of the donuts, coffee, >> whatever else. >> Sure. cuz I've done a few nights. No problem. Perfect. Like I I checked everything on my list. I was doing great. >> But I just needed like at least one worker for 2 hours. I did it myself. My first shift, first time doing truck because second night was by myself. First time I was partnered with someone who never did it either. But I said, "You stay at register. I'll run this back here." But you got to get off shift at midnight. >> Gotcha. So, >> no way. >> And that was two hours that freezer done. >> My name is Jeff. >> Um, not the titles matter, but I'm the director of public safety. So, I'm the police and fire chief. >> Okay. >> Okay. Um, I've been in all night with these guys. Um, I have a couple of questions that I know Dave Dave got tied up uh with the guys at your house, so I'm stepping in for a little bit here. You lived with her up in Kazoo? >> No. Didn't live with her? No. >> Were you guys running the same like it would be like Keystone or a mission or something like that? >> Like she she was u she was in jail for 200 days and then into a mental rehab place. >> So you both weren't living at 440 North Church Street in Kazoo. That's not a residence and that's just a mailing address. >> Okay. >> Um >> but you both used it. >> We both used it. Yeah. >> Did you know her then? >> I did know her. Yeah. >> When did you meet her? >> Well, Facebook will tell you 2013, but I've known her probably since 2008. >> Okay. >> Give or take. But we were only friends for most of that time. We weren't like dating until like last two or 3 years. >> So you started dating about 2017, 2016. >> Yeah, something like that. >> So you moved down here in 2018? Uh >> I moved to Centerville in November. Okay. And then I moved to Stures February. >> And she moved in February also, >> I think. So towards like the third or fourth week. >> Where did she move in March? >> Well, she went back to the shelter for a little bit >> and then came back to stay with me in March. So there's like about two weeks between her first visit with me and then her staying with me. So like it's a little choppy, but I wanted her to get connected to the shelter. That was the purpose. >> So somewhere around March 13th through the 15th, somewhere in there, if she made a statement that she was moving, that was to move in with you on Maple Street. >> Yeah. Right. >> That that that would be on Facebook. She did mention she was moving. >> Why'd you quit using Facebook? >> Uh after that took us a while to get her a library card. She just didn't go to library yet. I mean, I got a library card and she got one finally, but that's the only way to get on a computer. >> Okay. So, she didn't have a phone? >> No, she don't have a phone. >> So, she was going to the library every day prior to moving here >> in Centerville. Yeah, that library. That's when she did most of her Facebook channels. She only got to library here like maybe once. I don't even know if she did. I don't think she did. Most of her chats were when she was in Centerville cuz that was her way to keep in touch. I said, you know, even though you're at the shelter, doesn't mean that you're too distant nor out of reach. You know, I I wanted her to know that I didn't just take her out of Kalazoo just to be abandoned. You know, >> I wanted her to feel like I'm still here. I just wanted you. You know, a lot of people don't want to go through shoulders. I get it. But I'm not abandoning her. I'm there for her. And that's that's what she did. She'll contact me on Facebook at that library to keep in touch to help her get through the daytoday stuff there. >> So, she's an avid Facebook user. Loads of posts every day. >> Yeah. Do yourself crap. Crafts >> whatever. Some of it was games, too, I think. >> Yeah. >> And then all of a sudden, it just stopped. >> Yeah. We had to She hasn't been out. She stayed home. She did not want to leave home much. And library card. We had to wait on that. The ID process. I mean, I got her ID eventually switched over to my address, but she had to get my address before she could get a library card. >> Okay, so bear with me. >> I heard your timeline of events of this correctly. Today's May 23rd, >> right? >> You bought the saws on April 17th. >> Yeah. >> Or a reciprocating saw, right? Same thing. >> Yeah. Give me an idea how long before the reciprocating saw did you purchase the coolers roughly before the saw? >> Mhm. I I only got the big cooler around the time of this the saw I think. >> So the saw was pretty close after the big cooler in time. >> Yeah. Yeah. >> Like was it that same day, the next day? >> It might >> It's within a week of that. a few days before or after. I It's within that week because I It could have been the same day even. >> So, you may have put her in the cooler, realized she's not going to fit, and then went and bought the saw. >> Yeah, cuz it was a >> And then how many weeks did you run water on her? >> Uh, weeks of that could have been up to two weeks. or more. >> I mean, I I'm not really having the math in my head right now, but I know like there had to be a few weeks. >> Hey, Dave. No, I I need him to talk. Call Lily White. Sorry. Dealing with the guys at your house. So you you honestly don't know what day she passed away. So this is the love of your life, the person you care so much about. At least that's what I've heard. You've been in a relationship with since 2008 at least as friends and dating for 3 years and you don't remember what day you passed away. That's weird. I'm not going to say I know the exact date, but I can give you the closest thing would be. All right. She passed away uh Saturday night. I saw her Sunday morning. Okay. The next Sunday after that was Palm Sunday. I went to church that day. So, I don't know the date of Palm Sunday. >> Okay, that helps. >> It's the only thing I could do to say I I know I went to church. >> It would have been probably March. >> No, Palm Sunday was the 14th of April. >> Okay. >> Oh, >> so she died the week before. You only ran water over for one week, >> I guess. I was April then? Easter was late this year. >> Well, then she might not have passed in March. It might have been April. I apologize. I I I'm trying to keep accurate, but that is about as accurate as I can give you is a week before Palm Sunday because I I know I went to church at this Episcopal church and I haven't been at church in a while. >> So, if that was the 14th, you think she died somewhere between the 6th and 7th of April? >> Yeah. cuz you're positive it was the weekend before Palm Sunday. >> Absolutely. I am positive of that. I I I didn't know when Palm Sunday fell, but Okay. So, she was all March. That means I was working Speedway for most of April or half of April. See, that's the only other timeline I know that's accurate is my two weeks at Speedway. She was >> Was she alive then or dead? >> Alive during my first week and then she passed away around my second week. So like I know those two weeks and that work schedule I I told other guy about that too. I said my work schedule is the best accurate time frame to work with but so that we can be in Palm Sunday cuz I know I know that one. So we got two different things what I'm telling you and then my employment history which doesn't change you know I'm trying to give you the best I can give you. I I I probably should have marked it down. You know, that would have been the right way to give her like an anniversary thing is to remember her here, you know, that day. >> Well, I'm just struggling. I mean, if you cared about her as much as you say you did, right? >> I do. I do. And I just I didn't think about it other than just I just remember it was a week before Palm Sunday. I know it was that weekend and then the next weekend I I went to church because I I had that whole week of just >> Yep. >> trying to cope with it. The only thing I feel like is I should have I shouldn't have let her stay in that bath all night. I should have watched her. I was being selfish cuz I needed sleep. But you should have called 911. Probably should have. No. No. Not probably. should have should >> explain to me again why you didn't. >> I've I've had issues of being accused of things and I just >> Which one? The child abuse, the domestic what? >> Yeah. Which one were you accused of that didn't occur? the rape accusation. Did you see that one? >> Maybe that's the child abuse. Was it a kid? >> That that was >> What's the domestic >> domestic? >> I thought my case got dismissed, but >> how recent was that one? If it was >> 2013. Oh, after I got dismissed, but um >> you're still arrested for it. So, I'm asking, you're saying you have a distrust of the system? >> Well, my distrust comes from the the rape situation, not with other guys. >> Okay. What What does that have to do with finding your significant other girlfriend deceased in your apartment? I I just didn't feel comfortable. I I just >> Because why? >> Because I've been accused of things and I just I don't know how to explain. I don't know how to explain that. I find it that way. And I just I failed her. Okay, I failed her and it's not something I'm proud of and I don't like the fact that I wasn't there for her like I should have been. I should have. As I was explaining with the other guy, her ability to take care of herself was starting to fall short drastically. And I wasn't there this time. Okay. And honestly, if I was to do any kind of emergency thing, I should have said something before even that. Like when she started falling down, I I the right thing is I should have just made that report and I didn't because I thought maybe she'd get better and then the worst case scenario. And then I just it was wrong of me. I should have made a report. I really should have. I don't know why. >> Help me out again. >> I struggle. I I believe you in some aspects and I'm struggling in others. Similar to you struggling. Help me out again with she moved here in February with you. Moved out, came back. Why'd she move out? because I wanted her to get connected to the shelter. With that connection that got her to go to her CH appointments and social security appointments, I physically cannot do that for her. They help me out at the shelter. I said, as much as I'd like to just stay have you stay here and keep you here, I can't take you to appointments that you need to go to. I know my limitations in that regard. As much as I think I can do everything for her, I couldn't for that. I knew I couldn't take her to an appointment. So, I had her stay there long enough to get connected and then they added her to my case. So, I had the same case worker as her. Eventually, I was going to add her to my lease as well because I talked to my landlord. He said, "It's fine. All I care about is you pay the rent. So, it was a process. We got her to have her address changed so she could get a library card. She loves her books and we got her social security letters worked on. I got some of her mail at my place. That was our goal. Get her on her disability. I was gonna keep working. That that's the only reason why she's had no I needed her connected. >> So the the conversation that we could have heard about there being another guy involved and then her coming back, that wouldn't be true. >> Well, she did leave for a while. >> Mhm. >> And then she did come back, but Remember the the the idea of us talking is being honest. >> Yeah. >> Yeah. >> She came back with a lot of marks and bruises on. Okay. >> I don't know who he is. She won't tell me that. All I know is she came back because she left because she was told that oh she was going to live some kind of better life with him. That's why I even told the case worker when she took off. I said, "Yeah, I think some guy told her that you can be able to treat her better and do better or something." And next thing I know, she came back and she she suffered some things. And and then when I I saw her fall and then her speech ability started Good. >> So, right there we got 60% truth, 40% not truth. I'm just throwing random figures out there. But part of what you just told me is absolutely true. Part of what you told me is not true. >> Her having coming back with marks and bruises. Yeah. So, how angry were you with her or leaving then coming back? No. I I love her. I know you do. >> I know. >> To the point where she's going to be with you and no one else.
