I need a tampon. Okay. >> Yeah. >> Here's right here. >> I need >> No. Give me Give me a tampon. >> I need water. I need water. I need water. I need water. I need water. [screaming] I need water. Super easy. You stupid, ignorant people. I hope people are listening TO THIS. I NEED WATER. I need water. [screaming] They told me I'm doing it. I want some water and they're not giving it to me. I am being hydrated and they're not giving it to me. Give me some water. Excuse me. >> One illegal U turn on a red light. That's it. That's the entire reason [music] this traffic stop happened. 2 hours later, she was booked into the St. Lucy County Jail on a felony. and she never took a single test. Tuesday the 9th of September, 2025, just after 8:30 at night, Port [music] St. Lucy, Florida, an officer on patrol watches a black Kia sitting in the left turn lane on Southwest Gatlin Boulevard. The light facing that lane is red, and there's a sign above it, a U-turn symbol with a prohibition sign over the top. The Kia makes the U-turn anyway. On the red, the officer stops it. The plate is Georgia. The car is a rental registered to Avis. The driver is alone. She identifies herself by Florida license as Jennifer Smith, 45, from Palm Beach Gardens. He asks for license, registration, and insurance. And according to the report, three things happen in about 90 seconds. She tries to open her purse and can't work the zipper flipping [music] at the side of it repeatedly. She tells him she's in an Uber and that she's an Uber driver, so she doesn't know where the registration or insurance are. And he asks where she's headed. She says she's on her way to Palm Beach Gardens [music] from Port St. Lucy. >> Hello, I'm Officer Whiting, Port St. Lucy Police Department. The reason why I'm pulling you over is one, you're in the red, and two, you can't make a U-turn there. >> I apologize. >> Okay. Do you have your license, registration, proof of insurance on you? >> I have >> 40 Thank you, ma'am. Do you have the registration and proof of insurance? >> It's It's an Uber car. >> Okay. So, what do you mean? Like it's one of Uber's cars. Are you one of their drivers? >> Um, yeah. >> You're an Uber driver? >> Okay. Where are you coming from tonight? >> Um, from Port St. Lucy. >> Okay. Where are you at right now? >> West Palm Beach. >> Okay. Can you go ahead and shut your car off for me? >> He asks [music] again and she tells him she's already in Palm Beach Gardens. She is in Port St. Lucy [music] about 30 mi away. The officer writes that he could smell alcohol coming from the vehicle. He asks her to turn the car off. She tells him it's already off, [music] then tries to put it in park. He asks for the keys. The report says she was hesitant and refused multiple times. Eventually, she hands them over and he puts them on the roof. She steps out [music] and as she walks to his patrol car, he writes that she stumbled and couldn't walk in a straight line. Then while he's running her details, she walks back to the Kia on her own, takes the keys off the roof, leans into the driver's seat. He's sitting in his car. He can't see what she's [music] doing in there. >> Ma'am, get out of your car. I told you to stand over here. You walked back. Sorry messing with your keys. Put your keys back up there. >> I apologize. Yep. >> I apologize. >> Go back over there. >> Okay. It's raining. >> Yes, I know it is rainy. Yes. Stand right there and wait. >> Do you still live off of Estella? Yeah. >> Where? >> Um in West Palm Beach. Yeah. >> Off Estriella. >> Okay. And you're in West Palm right now? >> Yeah. >> Okay. Can you read what that says on the side of my far? >> I'm sorry. I can't. Yeah. St. Lucy. >> Okay. You're You're not in West Palm right now, man. >> No, I know that. And I had to um I had to do work here. >> Um I had to I had to come here and tell people. So, and then I'm going back home. >> Okay. You're going back to West Palm. >> Yeah. >> Okay. Where were you where are you coming from? >> I Port St. Lucy. We were um talking to people about um helping people if someone didn't pay their taxes or if like if people did pay their taxes like like I don't know like helping people like also like with >> when the tow inventory was done later an officer found an empty bottle in the glove compartment. Japanese [music] rice wine, 15 1/2%. The officer lists four observations. The odor on her breath, that she couldn't stand straight without wobbling, that she swayed and couldn't walk a line, and that she couldn't stay on subject while he spoke to her. >> We had a anyway. >> Okay, Miss Jennifer, so I have some concerns that you're potentially under the influence of an alcoholic beverage while you're operating your motor vehicle. I can smell it. I can smell it on your breath. When I walked up to the side of the vehicle, it rire of alcohol. >> You're rambling on about stuff that doesn't make sense, which is a common thing. You are having trouble standing straight >> and you're having a hard time walking. >> So, to dispel my concerns that you're potentially under the influence, are you willing to assist me in conducting some field sobriety exercises? >> Um, absolutely not. Um, I don't think like I am. And please don't like don't don't. >> So, I'm going to explain this to you one more time now. Okay? If you're not going to be willing, stop. Stop. Okay? If you're not going to be willing to assist me in assisting you in conducting field sobriety exercises, I am going to have to make my decision to place you under arrest >> or give you a ticket or allow you to leave based off of the observations that I've already observed. Which like please let me explain which again the observations I observed. One, you made a U-turn at a sign that blatantly tells you no U-turn on a red light. Stop speaking. Two, when I walked up to the side of your vehicle, it rire of alcohol. Three, you have a hard time listening to anything I'm telling you. >> I listen. >> Okay. You have four, you have a hard time walking in a straight line. You're having a hard time standing straight right now. >> I don't like I don't have a hard time. >> So, based off that, >> so he asks her to do the standard field sobriety exercises, the roadside tests that give a driver the chance to dispel an officer's suspicion. Her answer quoted in the report is two words. Absolutely not. He explains what's called a tailor warning that refusing means he has to decide based on what he's already seen. She declines again. He reads her Miranda rights from his card. She says she doesn't understand. He tries to read them a second time. She walks away from him while he's doing it. >> Oh, you're fine. >> All right. We're just No, we're just You're nervous. No. >> Yeah. Don't do that, Mr. Ed. He's telling you to stop moving and you keep walking away. Okay. He's trying to explain something to you. You're not listening to him. >> I didn't do anything. >> Well, you did. He's telling you to stay here and you're walking away from him, ma'am. >> Yeah. It's going to hurt. They're They're handcuffs. There's I can fit my finger between both of them. So, you're good. Can you just make sure I'm good on that side? >> Yeah. >> What am I being charged of? >> Uh, I already explained to you two times. >> Here, we're going to walk to the the back door. Okay. >> Okay. >> I'm in a spare, so I got to unlock the front. >> Okay. >> Okay. >> All right. >> No, you're fine. It's >> I'm out. >> Yeah, I know. >> All right, Miss Jennifer, go ahead and take a seat. Okay. >> Go ahead and take a seat, Mr. Jennifer. Okay. >> All the way. Both legs. >> You got it. >> All right. Go ahead and wait right there for me. Okay. That's when she's detained not for the U-turn and not yet for the alcohol, but for repeatedly walking away in the middle of a dewy investigation at the station. A second officer, a certified breath test operator, reads her implied consent again and prepares the Intoxilizer. She refuses to give a sample. He tells her that refusing is itself a misdemeanor. She [snorts] refuses again. No field tests, no breath test. >> Come on, step out. Yeah, you're going to step out when I tell you to. >> Could you open the project, please? Thank you. >> My mustache is what? >> You're gross. >> Okay. >> Do not stop. Do not hurt my >> Nobody's doing anything. >> Do not Yeah, you are. You're hurting my wrist. Stop it. Stop it. Just let my wrist go. I like seriously you're something's wrong with you. >> Okay, >> stop. >> I'm not stupid. >> Okay, don't do not I will definitely call it. >> So 1919. >> Yeah. Can you like I'm sorry, but these are mine. I'm going to They're They're going to start bleeding my hair cuz she won't stop. >> They're going to start bleeding. >> So, I'm just going >> They're going to start bleeding. >> Yeah. >> Okay. >> Put that right in front of my camera. I'm going to go grab my laptop. >> I mean, I need >> So, I just mentioned, right? My name is Officer Gilles. >> Okay. and I work for the Port St. Lucy Police Department. >> Great. >> My badge number is 36. What's going on? >> Okay. So, from what I was told earlier is that you're placed under arrest. >> No. >> Or driving under the influence. >> I wasn't I was not drinking under the >> That's That's never done a a a test or like anything. Well, then if if uh we can do this, then we can start by basically um trying to get >> there is no number in this case at all. But on the way into the building in the [music] Sallyport, the officer's report says she lifted her right leg toward him. That single movement is the difference between a misdemeanor night and a felony one. She was charged under Florida statute 784.07 07 assault on a law enforcement officer. The report also records screaming outbursts in the processing room and conduct that led officers to move her back out to a patrol vehicle. We're not showing that and we're not describing it further. [music] The report also records one line that has nothing to do with the charges and everything to do with the night. >> All right, I'm done. Come on, let's go. What are you doing? >> So, man, my name is Officer Keas again, Fort Police Department. What are you doing? >> I introduced myself earlier. So, what's going to happen is the following. I just want to be transparent with you. So, at least you should know what's going on. >> Like, nothing happened. >> Nothing. >> And I'm not um like I did not drink and drive by any means. Like I would never do that. So, like don't think that. >> No. And again, that's your statement. But again, the reason that you're here in this uh temporary >> So, how how did I get pulled over? >> She's coming. She's coming here. She doesn't know how to drive. >> I do have some water. >> Yeah. >> Do you want some? >> Yeah, but you're I'm like >> like that. >> You want water?
