On Tuesday, September 9, 2025, a Port St. Lucie police officer on routine patrol watched a black Kia sedan make a U-turn from the left turn lane at SW Gatlin Blvd and SW Brescia St — on a red light, under a posted no-U-turn sign. The stop began as a traffic violation. According to the officer's report, the driver — identified as Jennifer Marie Smith, 45, of Palm Beach Gardens — struggled to open her purse, said she was an Uber driver and didn't know where the rental car's registration or insurance were, and gave conflicting answers about where she was, telling the officer she was traveling to Palm Beach Gardens and then that she was already there. The officer reported an odor of alcohol, an inability to stand straight without wobbling, swaying while walking, and difficulty staying on subject. Asked to perform standard field sobriety exercises, the report quotes her answer as "Absolutely Not." She declined again after being given a Taylor warning. At the station she refused to provide a breath sample after implied consent was read to her. Because she refused both, there is no field test result and no BAC in this case. She was charged with assault on a law enforcement officer under F.S.S. 784.07(2C) — a felony — after the officer reported she raised her right leg toward him in the sally port, and with DUI under F.S.S. 316.193(1A). She was cited for DUI and for refusal to submit to a breath test, given a written warning for the improper U-turn, and transported to the St. Lucie County Jail. The rental vehicle was towed. ⚖️ Jennifer Marie Smith has been CHARGED, not convicted. She is presumed innocent unless and until proven guilty in a court of law. Every detail here comes from the Port St. Lucie Police Department incident report and arrest affidavit, case 2025-22004. Officer observations are their account of that night. Personal identifying information has been redacted. Uninvolved people and vehicles are blurred. 📁 SOURCE Port St. Lucie Police Department incident report, arrest affidavit, and body-worn camera footage — Florida public record under Ch. 119, Fla. Stat.
