On that note, I have to ask you uh to swear to your statement. Is everything you told me today the truth? >> Besides what I lied to you all about? >> Yes, sir. >> At approximately 2:00 on the morning of Saturday, the 18th of April, 2015, Leach Police dispatch in Leach, Texas, took a 911 call from a house in the 5000 block of 44th Street. The caller was 27-year-old Jennifer Cruz, a phabbotomist, and the mother of two children. Officers arrived to find her dead in her own bedroom. On the same mattress lay 30-year-old Albert Martinez, known to everyone as Bo. He had been her boyfriend for about a week. A back window had been slid open. There were no witnesses inside the house. There was, however, a recording. Jennifer Cruz stayed on the line long enough to say a first name out loud. Later that morning, officers went to a rented room on 100th Street and brought in 29-year-old David Ricardo Curo, the father of her two children and the man she had been with since she was 15. He agreed to talk. The statement he gave ran 1 hour and 58 minutes. This is the interrogation of David Couo. >> Hey, my name is Detective Yolanda with Police Department. Detective Zach Johnson is also in the room and this statement is going to be referenced LPD. We're speaking to uh David Co. Um uh your cell phone uh do you have it with you? >> No, it's at my house. >> What kind of phone is it? >> It's a Samsung 4. No 4. No 4. >> And uh do you know your phone company? Is it AT&T or is it Sprint? >> Sprint. Okay. And do you have uh any children? >> Yes, I have two. Okay. And who's the mom to the children? >> Jennifer Cruz. >> And how long have you known her? >> I'm 29, so I've known her since I was 15. >> 15. >> 14 years. >> And she's mom to both the children? Does she have any other children? Um, >> no. I was with her for 12 years. >> 12 years. >> And the reason that you're here today is that we do want to talk to you about Jennifer. Um, uh, we went to her house today and, uh, this early this morning and she was found deceased in her house. >> No. Yes. And that's that's why that's why you're here. We need to talk to you. Um give you that information. >> Gosh. >> What? >> We just kind of want to talk to you about, you know, y'all's relationship, how long you've known her. You're not in custody. You're not in a You're not arrest under arrest for anything. You don't have any warrants or anything. Um since with our talk, you know, usually we talk to the person closest to them. I do uh need to read you some information for us to continue talking. Okay. Um and I know you probably need some time uh to to kind of process it cuz I know you're probably going to want to know some information. Um and we can give you some information and then you maybe help us with this case. Okay. Um, do you understand? And we'll just go through some history with you. Okay. Uh, let's get through this so we can get through some more. Okay. Um, get some more uh maybe we can figure out some some of them. Maybe you can answer some questions for us about what was going on in our life. Okay. Um, [snorts] you have the right to remain silent, not make any statement at all. Any statement you make uh will be used against you at your trial. Any statement you make may be used as evidence against you. [cough] Do you knowingly, intelligently, and voluntarily wave these rights and wish to speak to us now? >> I speak now. >> Okay. Let's kind of um let's kind of go through you said you've known her all all your life, right? Or since Let's kind of go through that. Okay. Um um how did y'all meet? [snorts] And just take your time, okay? We're just here to try and get this all figured out, okay? >> [snorts] [snorts] >> I think it was at a kin. >> How old were y'all? >> I think I was like 14 and she was like 12, I think. >> When did y'all start uh living together or did y'all get married? Would I ever marry? No, I think we're 19 or 18. She was living with her mom cuz I had went to jail. I think when I was 17, she was pregnant with my daughter. I went to jail cuz my brother had got raided and I happened to be there at the wrong place at the wrong time [snorts] and I I spent in jail for 4 months. I got out when I was like in January right when I turned 18 like on February 16th or 6th and she was I had my daughter in May uh February so she was gone 6 months she was 6 months old my daughter [snorts] she was 6 months of my daughter Where are your children today? >> There was her. [snorts] >> They wanted to apartment. What? >> 207. >> They're they wanted us they wanted us they was want to stay with her. So cuz we were supposed to go to Dallas. So I was going to take him to the zoo and >> my this weekend. >> Yeah. Then my daughter calls me all of a sudden she has a baseball game. >> Um and I don't know if it was a baseball game or something. I told her I don't know. We still might go though. and I decided not to go cuz I didn't want to miss it. It was a scrimmage, I think, for >> So, uh, when you said you lived with your mom [cough] and y'all lived [snorts] with your mom for about a year there at apartment, uh, 207, then where'd y'all move from? >> That house that she was in, we're trying to sell. >> Do you remember the address? >> 50144th Street. >> So, y'all bought that house together? >> Yeah, we bought that house together. >> How long ago did y'all buy that house? I can't remember. I think 2010. I think it was 2010. >> And you're talking about having your children this weekend. Um, kind of describe what happened in y'all's relationship. Um, are y'all do y'all have leg do you have legal custody? Who has joint custody? >> Y'all have joint custody. And >> she she had mandatory or whatever. She [snorts] >> I I left her I left her in August. in August. I wasn't happy. I wasn't happy with my job and I was always miserable. So y'all mainly split split up because you weren't happy with your job and just this [snorts] >> I was miserable coming home. I was working like 16 hour shifts. So I was miserable myself, working too much. It's all I did. I never really got to see my kids much because, you know, it was like 5:20 in the morning all the way till like 9 at night. >> Where were you working at then? >> Also working for Lumis Armored as a truck guard. [snorts] >> Where was Jennifer working at that time? >> I think she what she was working at now precision. >> What did she do? What did she do there? She was a phabotamist and I was putting her through college. That's what made it hard cuz there's times where she worked part time. I had to work even more. The house was expensive. And then I I got back in that little red car and I was let him use my Dodge. Then when I paid off my Dodge, I ended up getting that truck. We're split up. I remember split up when she came and she she called sign for me and she helped me get my truck. >> Is [cough and clears throat] that that Cadillac? [snorts] I think I've had it for like 2 years. >> What's her car right now? >> Huh? >> What car does she have right now? >> She has uh I don't even know what it's called. Kia. It's a key. >> What color is it? >> It's like a silver like charcoal. Charcoal gray. She just barely had gun. I was letting her use my car when we were split up. Um I guess she wanted more money and I was like, "Well, dang." you know, and like I guess she just she wanted more. So, she decided to take me to give me child support. And I told him was like, "No, I was I want joint custody of my kids." So, I had to get a lawyer. And he's like, "The only way you're going to get joint custody is you go down to a 40 hour job, you know, from 8 to 5. I can get you that joint custody. other than that you and the whole fill. So, you'll get you'll get whatever they give you and that's it. And I'll take away all that back pay because I' I've been with her for years. I mean, we've only split up like twice out of the 12 years. That's why I run a little mobile watch thing here and there, but >> And when did y'all pick the house up for sale? >> I couldn't tell you. Was that recently or? >> No, it wasn't. It was a few months ago. I think she had put me on child support. She said, "Let's just sell the house." >> Cuz we're in u we're in in April and you said um you got the paper finalized [cough and clears throat] in November. >> What the child support? >> The child support. >> I think it was like no November, December, I think. I can't tell. It was one It's one of the months I I started paying child support. I know for a fact in January. Yeah. So around that area was maybe December cuz it took a while. I took about 3 weeks. It might have been like >> Describe y'all's relationship when y'all when it was good whenever y'all you know did driver you know was there did the police ever have to come to your house? Was there ever any police reports filed in Brownfield or Meadow where we all lived or here in love? Never. I've never heard her. I I've never hit her. I've cheated on her a lot when I was younger. I hurt her real bad doing that. Then I [clears throat] [snorts] I stopped like when I was 26 2 I think I was 25 26 I started getting older and I was like I can't be doing this to her. >> She'll never argue never had any >> we argue here and there but it'll never be physical. Never I'll never hit her. Never. Never ever. >> Did y'all ever have to call the police to y'all's house? [cough and clears throat] [snorts] >> The only time she had called him is when we were split up and I was trying to get my stuff and she wasn't letting me get my stuff and I got upset and I broke my TV cuz she didn't want to give me my TV. He was like, "Well, you can have it." I'm like, but other than that, he let us go. I'm like, I just I'm just here to get my stuff. I still got stuff over there. I still got tools. I still got paint stuff. I still got my car out there. My my car in the back. I still have my gun out there. >> What kind of gun was it? >> It was a lot 40. I think it's still in the I think it's still the little the little container. What color container was it in? >> It's black. >> Do you remember where you left it in the house? >> It's in I know I took my shotgun, but I left that behind. I know why. I think it's cuz I stopped working for Lumis. That's when I was carrying it. I left that [cough] license. I think it's where the air conditioner units at. I think I don't know if it's still there. >> Is it a closet? Are you talking about a closet or >> Yeah, it's like a little [cough and clears throat] That's a little two door and I think I had it right there. I think I had it stashed cuz there's a there's a um water unit there and there's the AC unit. I had it in there. I had the lock on it. >> Do they have a combination lock or did it lock? >> I think I had I think I had the key. >> I think I had key. I'm not too sure. I haven't used it. It's been a while. Did she know where it was at? >> No, I wouldn't tell her where it was at. Not that I know of. She might cuz she went through the whole house cuz she had to start painting the house back to this color. So, I don't know. She might have ran into it and maybe sold it or >> cuz she had she started painting that room, her room. >> Did uh yesterday was Friday. Hey, did you work on Friday? >> Yeah, I washed I washed two cars, right? No, >> no, I didn't wash Thursday. I washed the cars yesterday. I was with my kids at my house. >> So, when did you pick up the kids? >> I picked them up right after school >> on Friday. Okay. >> Where did they go to school at? Right there by her house. store. >> I picked him up Thursday. >> Oh, Thursday. >> Yeah, I get them every Thursday. I picked him up Thursday cuz Jennifer text me. He's like, "Well, they're going to take your they're going to give me a fine if you don't pick up your car." I'm like, "Crap." I don't know if y'all seen that car in the back. And I was like, "Okay." He was like, "I don't got a trailer, but cuz the tarp was blown off and they're going to give her fine." So, I went over there Thursday. I went to the back alley and I kind of just went in there and I I had a blue tarp. It was just like, man, it was there. So, I pulled it all out and threw that blue tarp in the trash and I had that gray one and I kind of just kind of covered it a little bit. >> Were the kids in school on Friday? >> Okay. So you >> like [clears throat] I go in at 6:00 so I can get off at 3:00 in order to get them. So I have my mom take them >> on Friday morning. >> Yeah, Friday morning. So I So I'm able to get out at 3:00 and go pick them up. That's the only way I can do Okay. So, um >> I usually go in at it's supposed to be 7 to to 4, but I was I told my supervisor I have to go in earlier to get off early and get my kids. >> So, do the children spend the night with you on Thursday? >> With my mom? >> With your mom. That way she could take them to school. You could go ahead and go to work. >> Okay. And so you were at home on 100th Street on Thursday night and then you go to work until 3 >> on Friday. You get go to work 6:00 to 3 and then at 3:30 or 3:20 you pick up your two children. And after that, where did what did y'all do after that? Walmart. >> Which Walmart did y'all go to? the warm sub. Okay. >> About what time were y'all there? >> Four maybe. >> So right after pretty much. >> Yeah. >> What vehicle were you driving at the time? >> The Dodge. The the Avenger. >> Yes, sir. >> Yeah. So, you got gas at the the little Murphy's USA fuel deal there at Walmart? >> No, I think I think for school I went to the easy mart on 50th and I don't know what street just read the slide and other I think I went there spray. So, um, did you I told I told him cuz we're like, I think we're going to go to Dallas. We're going to go to Zoom. And she didn't tell me anything till the last minute Friday night. She called me. One time she called me. She called me late. And I was like, "No, we're still going to go." And she got upset. So, I decided not to go. >> This was on Friday. >> Friday night. I think she called me and it was late like 10 11 maybe >> like last night. >> Yeah, last night. >> So >> So I really don't know the schedules like >> That's okay. That's okay. >> Did you get So do you remember now that you did get gas? >> Yeah, I did get gas but not at Walmart. >> Okay. >> Did you go into Walmart? >> Yeah, I went into Walmart at Cuz >> at what time was that? >> I think it was at 4:00. What? Cuz from 3:20 I went I think I went straight to the gas station and >> it's an easy mart somewhere on 50th near slide. >> Yeah, I think it was easy mart. Yeah, it was easy mark. Yeah. Yeah, it was. Cuz >> what side of the road is it on? >> If you're going west on on 50th, it'll be on the right. >> It's that big one by the park. >> The new one. >> Yeah, the new one. Yeah. I know. >> Chicago. 50th of Chicago. I remember because there's a real nice Camaro there. >> Yeah. >> Me and my son were checking it out. Yeah. Then from there >> then I then that's when I went to Walmart and I had to get some I had to get some mouthwash and my daughter has I had to get her some >> hairs >> some hairspray and some soap and I had to change my oil so we can go to Dallas >> there. >> No. Well, not change. I bought the oil. Like I changed my own oil. >> Okay. >> And then we came home and I changed the oil. Then me and my son were washed in my car outside and then we went to my mom's and ate. >> What time did y'all go to your mom's to eat? >> Shoot. I washing my car for like shoot. It was nasty. I I don't know. >> Was it still? >> Yeah, I think it was 8 I think it was 7:50. >> Okay. [cough] >> 750. >> I think it was around [snorts] there. I don't know. They're still light still. >> So, you go over and drop drop them off at the apartment or they can't mom comes over. >> My mom usually cooks for us. She She had some tacos for us. >> Okay. >> Yeah, we're out there. >> How long were y'all out there? >> They stayed there. >> Was it just you and the two children that were at or >> No. Yeah, it was me and me and my kids and my my mom was there and my my little No, my brother was at work. [snorts] His his girlfriend was there. >> What's her name? >> Marie Taylor Marie. >> And what's your brother's name? >> Alonso. >> Alonso. >> Alonso. >> Still live with Linda. >> Just don't. >> Where's your dad? >> You don't have So, how long did you stay at at your mom's house or apartment? I don't know. I think I ate. We ate. We talked a little bit. I got to tell you and I was dark >> when you left. >> Yeah. And I went home. I went home and I've been sick and I was taking some medication and I was just dozing off and I was talking to my girlfriend. >> Who's your girlfriend? >> Her name is Maddie. >> Is she the the girl that's up here? >> No, no, that one that one's a friend. >> And what's your girlfriend's name? >> Forget Maddie. >> Mandy. >> Mandy. >> Rodriguez. She's not from here. She's from Odessa. >> Okay. >> She literally in Odessa right now. Okay. >> Talking with her on the telephone. >> Yeah. >> What's her phone number? >> All I know is the area code 438. So when you started talking um started talking to her, is that the time you got home or >> Yeah. >> Okay. [snorts] Did you talk to her at all while you were at your mom's? Anything you remember? >> I were texting back and forth. She She was upset. >> Why was she upset? >> She was trying to get a car. and she she didn't no one was ever proving her cuz she ain't got no credit. So we're kind of we kind of got in an argument not an argument. We kind of just she got upset. She was giving me an attitude with my mom talking to her and then um I went home and I I didn't text her. We were texting back and forth and I was we were kind of arguing and we kind of just blew it off like later on. We started talking again and texting cuz she was she was very upset and I was I was trying to tell her, you know, what's going on? Are you okay? You know, what's wrong? You know, she got upset doing that. So there's there's times where she was texting me and I just don't want to argue. >> Uh so how long did y'all go back and forth? You know straight all night. >> Did you ever leave the house? Uh did you leave the house at all? >> No. We're we're going back and forth and I'd fall asleep and she would text me. She'll call me because I told her I was going to Dallas and I think she got upset. She got more upset. She got she got jealous. >> Who's the young lady that was at the house today? What's her name? >> Her name is Jennifer. >> What's her last name? >> I don't know. >> How do you know her? >> Facebook. >> Facebook. >> She's a real good friend. She She helps me out. She she hasn't run up now. I'm sick. So, >> do you know her last name? When did you start talking to her? >> And my baby. That's why I'm like because her her Facebook name is actually Faith Hope Love or something. And I know she gave me her her last name, but man, I forgot it. I know her name is Jennifer, though. >> That's okay. She's here. So, we'll get it. >> She's a real good friend. Like, I've only known [clears throat] her for so long, but [snorts] she she's there. She's there. >> Did you Was there anyone else? So, you're go you're going back and forth. You said talking to uh your girlfriend um Mandy. Uh uh you didn't you said that. Was there who was at the house at that point? Was there anyone else at the house? >> I think Reuben. I think Ruben was there. I think Reuben was asleep. >> Yeah. >> Anybody else? >> Mhm. It's just usually me and him live there. >> Okay. >> And he when I have my kids, he don't have his kids, but you know, it's it's opposite. So, okay. >> So, when did uh Jennifer go to your house? Cuz she was here this morning. So, when did she arrive at your house? Do you remember what time? >> Man, I think it was like 3 3 or 4 >> in the morning. >> Yeah, cuz she she had text me too and I don't know what's to do with her. She's going through a lot and she was texting me back and forth. She was saying something that she's in her feelings and so I was like, "You can come over and we can talk about it or whatever." And then she came over like later on. >> You thought What time did you think she arrived at your house? >> Man, I don't know. I was asleep when she came over. It was late. 3 >> 3 in the morning. >> I think not too sure. I don't know. I think it was about 3:00 3:30. We're texting back and forth and she was like she was just depressed and like man she ain't got no job and she got five kids and it's just like she's living with her mom. can come over if she want. So, she hadn't arrived till like later. I don't know what it was. Might have been like 3:30. >> Okay. But she's in Odessa, so she weren't anywhere near near you. Um, and you're saying from the time that you got home, started calling uh uh Amanda, you never left your house until the police got >> Mandy. I started calling back and forth and I've kind of dozed off and she called me cuz I'm on some I want some I got I've been getting sick. I got sick again. Did you go anywhere after you got home? Uh, >> and the time that we knocked on on the door? >> No. >> From the time you got home from eating at your mom's? >> I think I might have threw a cruise, but here and there, but I don't think from there I was just too tired. >> When you say threw a cruise, what do you mean? >> Just ride around. Just >> Do you remember where you went? >> Just around town. I was going to I was actually going to go to my friends cuz he wanted me to go out and I was like I don't want to feel like crap. >> Did you talk to him before you go to his house? >> Yeah, cuz I told him I'm going to go to Dallas and he's like I'm going to go to I don't know. >> What's his name? >> Jose. >> What's his last name? >> N. So you What time did you talk to him? I know. I talked to him when I was with at my mom's too around 8 because he's I was going to I told him I was going to I helped him the other day move some stuff and um so I can put my car that's in the back of my yard. I can move it there. That's he's a real good friend. And we're talking back and forth. I want to go down. I want to go. I'm just going to be my kids. I want to go out. He said, "We'll go." And he decided not to go. And that's when I was like, "I'm not going." And I was like, "Screw it." I called him. He didn't he he wasn't going to go either. So I was like, I guess his wife didn't know. >> So about what time did you get in your car to cruise around? I don't know. 11 and then I came home. >> How long were you out? >> I went for like 30 minutes, I think. >> I think Reuben when I got home, Reuben was like knocked out. He had all the lights off. >> And his dream was his door closed or >> Yeah, he was closed. >> So, you didn't see Reuben? >> No. >> You didn't see anybody? >> No. Usually my kids are [cough] >> This is about 11 to 11:30. >> Yeah. >> And which car did you go [snorts] riding around in? >> The Dodge. >> The Dodge. >> The The truck I want to use it to run that mower here and there. >> Did you go anywhere else? What area were you riding around in? >> I'm not going to. I know. I think I went on the loop. >> Which loop? What part of the loop? >> On the south loop. >> South loop. >> Then I went down. I think I went down the slide or no slide. I just >> just riding around just that usually kind of helps me kind of just I've been I've been stressing and I've been able to pay my bills, been able to pay Ruger and I know I haven't been able to pay months. So, it's kind of >> Who are you talking to when you're riding around? I'm Mandy. >> So, you're still talking to Mandy? >> Yeah, we're we're still back and forth and Yeah, we're still back and forth. Then I went I went back home and >> But you don't remember how long you were out for 30 minutes. You don't remember where did you go by anybody's house? >> Mhm. Just just to follow >> cuz you you started mentioning that Joseto that what does he >> Yeah, he lives on I didn't go over there. He was eating when I called him cuz I was going to go to his house and he's like, "Oh, I'm not even there yet." So, he was eating. So, I was like, "Man, screw it. I went back home." And I that's when we were talking. He's like, "Well, come later on." And I was just too tired. And I I didn't I think I just went around the loop and that's it. Just something real quick. I was I was just stressed. >> But you think you only rode around for 30 minutes? >> Yeah, just only a little bit. >> You said that you might have taken a couple cruises. Is that what you Was there any other time that you left the house? >> Mhm. >> Just between uh So you you eat at your mom's, you come home. Uh Reuben's there, but he's you don't really talk to him after that. No. >> His doors closed most of the time. So then you go on uh for about from 11 to 11:30 around that time. You're still talking to >> to to Mandy on the phone. Um you're riding around still. Um and then you uh you go back home. You still don't see Reuben. He's asleep. Um and then uh you don't know exactly where you rode around to, but you didn't stop by anybody's houses or anything like that. >> I just >> Any of your friends? >> No, not no way. I really don't really don't have much friends. >> Okay. And then uh you didn't leave the house after this this 11:30 >> cuz I was just in bed and I was feeling sick. I was starting to sit again. >> Nothing has been challenged yet. Not one answer. Look at what the detective has actually spent the last 50 minutes doing. She has asked for a work address, a phone carrier, a school pickup time, a gas station, and then which side of the road it sits on, which car he was driving, who else was awake in the house. Every one of those has an answer that exists outside this room. A time card, a cell tower, a store camera, a receipt. She is not listening for a lie. She is building a document. And notice who put the weapon into it. She never asked whether he owned a gun. 28 minutes in, in the middle of a complaint about a television set he could not get back, he volunteered it himself. Her voice did not move a fraction. She asked what color the container was. He has now sealed himself into a bed in a locked house from 11 onward. That is no longer a story he can quietly revise later. He has drawn a perimeter around the exact hours he needs to be somewhere else. And he has done it without ever being pushed. >> So, are you still after 11:30? Uh, when do you start talking to the lady that's here? >> Have you already started talking? >> She she had text me around two >> two in the morning. >> I think she text me at two. She's like, I'm in my feelings or something. I'm like, "Oh my god." She was like, "What's going on?" And we're texting back and forth. I was like, "I'm tired." I said, "I want to go to bed." and they haven't been able to get asleep. >> Then she shows up about 230 about 3 3:30 [cough] >> and [clears throat] she Does she have anybody with her? No. >> Shows up by herself. >> Yeah. >> And then did you talk to anybody else after that? She just comes in. >> I I talked to Jose, man. >> I think it was around 3. I said, "No, man. I'm not going to go. My daughter has a game and I wanted to get out because I just been really stressed. >> Stressed out, >> man. Making $200 a week is have to go donate blood and you know, it's hard to pay my bills and try to feed my kids. I can't even buy them clothes or I can't even buy myself clothes. [snorts] You think that's fair? I don't know. Me, I'm the type of man that if I can if I can't afford it, I'm going to go get it. That's why I started that mobile wash. What's up? Do you So, you wash cars as a side job. You like cash? >> Yeah, just cash. My My son, my kids help me. >> They help me and I pay them and whatever I make, you know. I try to I have so much, you know. I'm supposed to be paying Roman 400 a month. When was the last time you spoke to to Jennifer Cruz? >> I think it was Thursday. >> How did you talk to her face to face or did you talk to her on the phone? >> Yeah, she was saying something about her her new boyfriend. I guess he got out of prison or what? He's been threatening me. I told you tell him to stop already, man. I was like, he he messaged me saying that I requested his mom on Facebook. Like, I don't even know your mom. I don't care. Like, me and Jennifer have been split up already for since August, so I don't know how long that is. And that's good for y'all. Yeah. Yeah. We might have had some words. He threatened me with the gun. I'm like, well, I got guns, too. when I was trying to >> he he who he who threatened who in the gun >> he he did >> he [clears throat] threatened you? >> Yeah. >> How'd he threaten? Was it on [snorts] face to face? >> No. Messenger and u >> through Facebook. >> Yeah, through Facebook. I told him I got a gun, too. And I posted I just gave him a little picture of my my whole gun or I had one of my own pictures of of the 40. >> Yeah. 40. And uh I wasn't gonna do anything. I was like, "Man, just leave me alone already, man." And then he text me the next day. Why you requesting my mom? I was like, "I don't know." >> So he actually [clears throat] sent you a text message. >> Oh, no. Facebook. >> Facebook. >> And that's when I called Jennifer and I was like, "Hey, [snorts] what's going on here?" I was like, "What are y'all doing?" I was like, "What is this problem?" I mean, come on. He's I don't I don't know the guy. Yeah. I know he's from Brownfield. >> Do you know his name? >> Bo, I think. Martinez. I don't know his real name. And uh all I know he was a he was a drug dealer, I guess. Like turn drug dealer. And >> how long have they been together? >> It's crazy because me and Jennifer were having relation relations. I guess they would say about a month about a month ago. She would come to my house, run over to her house, we'll do what we do. So, I didn't see that coming. I thought she was talking to someone else from Brownfield. >> So, the last >> That's when I found that's when I found out that that guy she was with and like when she gets with guys and calls them boyfriend, she would talk to me. ignore me and which is fine cuz we really >> your girlfriend. >> Yeah. And I I was like, you know, it's all good >> and we're fine. Just as long as he doesn't hurt my kids, you're fine. >> So, why do you think he started threatening you? >> So, I'm like, and I messaged her, man. Just tell him your name dang kids. And yeah, I might have said something kind of rude, >> but not threatening. Then that's when he he he threatens me with the Anina, I guess they call it nowadays. >> What is that? >> Anina nine. >> Okay. >> So I was like, you didn't have to go all there, man. But I got guns, too. But I was like, you know, trying to scare them off. When's the last time you've been to the house there on uh 44th Street? >> I went there Thursday. Remember when I was telling you I had a different car? Yeah, >> because she had >> I don't know if she text me or call me. >> I think she called me. She's like, "Well, I don't know. I don't know what she told me. She told me something else." And she's like, "Well, you need to come get your car cuz they're they're going to give me a fine. if you don't move it. And I think cuz the tarp was already blown off because of the wind and the rain. I was like, "Okay, you know, I'll try to get it out by this weekend." That's that's what I told her. And we're, man, we're going back and forth. We just talking crap to each other. I'm like, "Man, just stop worrying. I'll go get my car." And I apologized to her. I was like, you know, I'm sorry, whatever I said. cuz I'm sorry [clears throat] and we'll just I'll just leave it like that. I'll go get my car. And I went right when I got my kids from school. I think it was Thursday when I went. Yeah, cuz I went there. I grabbed my my uh I moved my hood to my car and I grabbed my uh I had a What did I have? What is that thing called? >> The jack. I pic I picked up the jack. That's all I could get >> cuz it wouldn't fit in the car. >> So I went through the back. I just went through the back gate and man, it was all jacked up. I kind of just moved it. And >> the gate was jacked up. >> Yeah. >> That's what did it look like? >> It was in bad shape. I put it up and we used to have a pit bull and it tore it all all the bottom. I I made it bigger when I was staying there so I can move my cars in there cuz I wanted to build a shop and it kind of felt like went this way and it was just it was bad it was bad shape. So I kind of just I had to open it more to cuz it was a big old cart that I had to pull out. I was about this wide. So, I kind of I kind of messed it up a little bit more, but I had a log in front of it, too. So, that was the last time you were near the house. >> Yeah. Did you ever go into the house on that day? Did you notice any damage to the house on that day that you hadn't that was strange to you or not that she has an alarm on her? >> Okay. So, I don't know. >> Does the alarm work? Is it >> Yeah, I think so. >> And what kind of an alarm system is it? Is it surveillance? >> No, it's just a basic basic. You type it in. >> Would the alarm >> change the code? >> No, she changed it right there. The alarm would go off if you entered the house through a door, through a window. >> Yeah. >> So, >> what kind of company is it? >> At a >> Okay. [cough] >> Sometimes [clears throat] Jennifer's real forgetful. She would just like >> sure the windows open and like the front window. You can go through the front window. It's unlocked or >> No, it's like a It's one of the old school doors, you know, the windows where it slides out and it has like a little lock there. You can go through that dang thing. I was like, "You [music] need to fix that." I was like, "So, anybody can come in here while y'all sleep." So like I never got that fixed cuz I I could have never find a piece to I really I really didn't I should have tried more to try to get that piece but I never really did. I was too busy trying to paint the house and paint the house and make it look nice. When the police got over there this morning and SWAT's sitting out there and SWAT took you out of your house, what did you think? Cuz that that is not a normal occurrence. >> I've had that done before. >> You have? And >> when I got >> What happened when you were taken out of your house by SWAT the last time? Why did they have to do that? >> That when I when my brother got busted. >> Okay. Okay. Yeah, man. I really >> So, what was your thought this time? >> Drugs again. >> Okay. >> I heard uh Jennifer Jennifer thought I was a drug dealer. >> Okay. I was like, I'm not selling no drugs now. >> Why did she think you were? [cough] [clears throat] >> Because everybody some guy named I don't know his name but he said he's like she invited me a while back to her house. I was like what's going on now in talking about you said his name is Bo. Is that correct? And we talked about him for just a little bit. You said he'd actually sent you some messages on Facebook. You guys had messaged back and forth. Um, would you be able to actually show us that particular all those messages you guys went through with each other? [cough] [clears throat] >> The first messages I deleted >> and then >> then I was like, man, you know what? I I deleted them. Then Thursday he text me again. I'm like, this guy the first message is like Why are you trying to request my mom on Facebook? He's like, "If you need to know something about me, you need to come to my face. Stop being a female about it." And that upset me. >> Okay. That was Thursday. >> That was Thursday. And she just hung up on me. >> So, was there a feeling during the last month since you guys have been having sex and kind of that maybe that you guys could get back together and repair it? >> Hey, man. There's so much damage there. >> You think it was beyond repair? >> It was I hurt her so bad. >> Do you think y'all were just having sex and that was about it? >> Yeah. >> Okay. >> And she >> You said you hurt her real bad. Was that when you left her or >> Yeah, I left her. >> Cuz she stayed with you when you cheated on her. >> Yeah, she did. She would leave like for a week or two or come back and not months like >> Let me ask you this. When when you said you didn't have a that you uh didn't have your Glock at your house, right? When is the last time you fired a weapon like a gun like that? >> I fired >> or your shotgun any kind of >> I've never shot my shotgun before. I shot that that I shot that Glock when I was taking a test for Lumis. So, it's been a while since So, right now, you don't uh you haven't you haven't shot a gun in the last 24 hours? >> No. >> No. We have a test since uh that we need to do on your hand and that would just show if you fired a gun. Okay. >> Thank you for coming down here and talking to us. I'm not sure how familiar you are with investigations. There's a ton of stories on TV, but basically when you have a deceased person like Jennifer in this case, she's kind of she's in the middle, right? And then we work closest and we eventually will work out. Okay? You're probably the closest person to her that we could identify the quickest. Okay? So that's why you're here. We're trying to get every last bit of information that we possibly can that can lead us to who would do this. Okay. Um so, you know, doing a a test on your hands is is great for us because the faster that we can move off of anybody, the faster we can go and move on to another person. Do you understand what I'm saying? What we're actually trying to do is exclude as many people as we can because at the end of that time period, the only people left or the only person left, we won't have any choice but to include them. Do you know do you understand what I'm saying? So, um, you know, we talk to you, we ask you questions, we want to know, you know, where were you at during these times? Tell us about your movements. Tell us about people that can verify information. uh you know da da da da da we do all that so we can gather all that information and exclude you from the equation and move on. Okay. So [snorts] if you have any questions you can ask. I don't know about how much information that detective PA can release at this time cuz it's an active investigation. It's only hours old. Okay. But um everything that she does ask you or anything that I happen to ask you, please just be as honest and forthright as you can and and detail oriented as you can. >> Okay. This is Detective Linley. >> Oh, Zach. >> Hey, what's up? >> Burning the midnight oil. >> Yes. How about you burn that? >> Yeah. I think we all are. >> Okay. It's a noninvasive collection. All I'm going to do is be rubbing this on your hand. >> [snorts] >> Okay. Give me your right hand. Right hand. Just flip it over. Sorry. And same with left hand. Okay. >> [cough] >> Okay, that's it. This is a gunshot residue kit. It will detect even the minute amount of residue left over from the firing of a handgun. Any questions at all? >> Okay, thanks. No problem. Okay. Does she um does she know anybody else named David? Does she have any other guys that she hangs around with named David or that she has any connections with or anything or are you pretty much it? >> I guess. Okay. I know she would be with a lot of guys. I've talked to a lot of guys but not that I >> does. Three things have happened in the last 7 minutes and not one of them looked like an accusation. First, he was asked when he last fired a gun. He said it had been years. Then he was asked to hold out his hands and he agreed because a man who has not fired a gun has no reason to refuse a swab. The order matters. His answer had to exist before the kit did. Whatever the laboratory returns, it now lands on top of a recorded denial instead of arriving as a surprise. Second, the second detective explained the process to him and it came out sounding like a courtesy. Read it again. He told him that they work outward from the victim excluding people one at a time and that whoever is still standing at the end gets included by default. That is not a briefing. That is a countdown delivered kindly. And third, the question that sounds like nothing at all. Does she know anybody else named David? He is not being asked about her social circle. He is being handed one last opening to put a different name in this room. He says, "I guess." He says, "Not that I know." He offers no one and he has no idea why he was asked. >> Okay. And [clears throat] [snorts] you made you made sure that you had secured that 40 in in a place where as long I mean for any practical purpose, she probably didn't know where that gun would be at unless you went through that whole entire house. >> Well, cuz she was when they would uh come clean it. >> Yeah. >> Or not complain it, she would have to clean the whole house. So they can come look at it. >> Okay. >> So, >> was it in a Glock brand case? Says Glock on it. >> It's brand new. >> I only I went and shot it um testing. >> Okay. >> You know, do the test. >> And And what was that? Do you remember how many rounds you put through it for your test? >> I don't know. We went through I couldn't remember. Did you clean the weapon after you shot that weapon? >> Do you remember? >> Okay. >> We we took it apart and >> he would show us, okay, this is how you take it apart and put it back together. >> I already forgot. >> Okay. >> Um, and it's a 40 caliber weapon. What kind of ammunition were did you have to carry for your job? >> Did you carry >> I think the I'm not too sure. Was it hollowpoint ammunition or just the full metal jacket standard? >> The standard. >> Okay. >> Standard. >> Okay. Did you buy it or did they give you everything? >> They I've only I've only bought it. I bought it one time and I just bought a little case. I'm not really into guns. >> Okay. >> I'm not really into >> Okay. >> And ammunition type. Just >> Whenever you secured that weapon, um you did put it back in its case. Uh, do you remember if the magazine was in the weapon or out of the weapon when it was in the case? >> If it was >> the magazine. >> Oh, yeah. It was out. >> Was it like this or was it out of the weapon? >> It was out of the weapon. Okay. >> Was the magazine loaded with ammunition in it? >> Oh, no. >> Oh, okay. >> Did you happen to keep a box of the ammunition close to the weapon? Okay. So, the weapon in effect, it wasn't a threat to anybody cuz it it didn't have ammunition close to it. It wasn't loaded. The magazine was out of the weapon itself. Was the weapon still together or had you broken it down? >> No, still together. Okay. Did you purchase Did you have to purchase that weapon yourself? >> I purchased it and they they b let me borrow the money >> from the company. Yeah. Where did you buy it from? >> I bought it from the gun shop on 34th. >> Okay. Do you remember when you purchased it? >> Years. >> It's been years. Okay. [cough] Would you give us consent to search your vehicles and your residence and uh search your phone? That's so we can get confirm your your your statement. Will you do that for us? Okay. Let me get all this filled out. Um >> on the um on all the vehicles, right? >> Yeah. Well, you own two, right? >> Yeah. >> You own two and >> Oh, the Dodge, the truck. >> Is there another vehicle there on the scene at on 100 Street? What other >> purple truck? >> The purple truck. >> Yeah. I don't I don't drive that. >> Okay. So, >> I I've had a I've had carried some hollow points though before. >> Okay. >> I don't know if I have one magazine that that has one, but >> would it be in Jennifer's place or would it be at your place? >> Probably be in my place. >> Okay. And is it for the pistol? >> Yeah. >> Is it for the 40? >> Yeah. >> Okay. >> I had I had like three magazines or four magazines and I had them with me, but I never had my gun. >> Okay. I might have one in the truck. >> The black one. >> The Cadillac. Is that That's an Escalade, right? >> Yeah. >> Okay. >> I might I might have one in there, but >> Okay. If If there was one in there, what do you think it would be? What What kind of a weapon is it going to be? >> Oh, and I No, just the magazine. >> Oh, just the magazine. I got you. Okay. So, you and Jennifer had pretty much made peace with the fact that y'all had both moved on. >> Yeah. >> With your life. >> Yeah. We just kind of I I got with this this girl here not too long ago. I've known her. I've known her, but that's about it. I really don't. I've known her for a few years when I used to work for Lumis. >> Roll [clears throat] from Odessa. >> Yeah. Yeah, I drove to Odessa and uh we kind of hooked up on Facebook and she was last week >> and she knew about that. >> What was that? >> Um Jennifer knew about this girl that from Odessa. She didn't. >> Okay. >> She didn't care. She didn't care what I did. >> She didn't care at all. Spell coro for me, please. C A R R I L L O. Okay. >> There's two Rs and two L's, right? >> Yes, ma'am. >> That you guys have been separated. [snorts] Has there ever been a point at which the kiddos [snorts] made any outcries to you or said anything to you to where you had become concerned about their welfare while they were at mom's place? >> No. No. Okay. >> So, my son My son is >> My son's just still a little kid just my daughter >> I think my daughter still kind of hurt from it. issues. >> Okay. So, you you don't you don't have any concerns about your kiddos being with mom or >> anything like that? >> That was a real good one. >> Okay. Well, being with Jennifer. >> Oh, yeah. And Jennifer, >> there was no concern on your part. >> That not that was pretty good. And the past week or so, was there anything that popped up on your radar to where you had any immediate concern for your children uh being around Mr. uh I believe it's Bo Martinez? >> Like I said, I all I know he was a drug dealer. I just barely found this out yesterday or the day before. >> Okay. >> Who did you find that out from? >> My brother. My brother had told me. Yeah. >> How did it come up? >> No, I asked him. And I was like, "Do you know this guy?" Cuz he's from Brownfield. He's like, "Yeah, I was locked out with him." He's like, "I guess he ratted out all these people and they sent him to prison." So then then I was like, "Man, other than that, I don't really know him." So I was like, "Okay, just making sure if anybody knew cuz he just came out of the blue and I'm like, man, who's this guy?" And I that's when I messaged him. I was like, "Man, just don't harm my kids. >> Whatever you do, sell drugs. Don't do it around my kids." >> I'm going to ask you something, David, and you you need to be totally honest with me. You know, we we started working this case at 3:00 in the morning, okay? And there was a 911 call. And in that 911 call, she says you're at her house. Okay, that needs to be explained by you. That's why I asked you so specifically when was the last time we've been there because in the 911 call she she's calling your name and put the gun down and it's all recorded. you know, you've been very cooperative with us that right now is the time that you need to tell the truth. You know, what happened u and both also dead. You know that. Okay. You're going I mean, it wasn't a drug deal. It wasn't anything else. David, you were there. Okay. Now, as to what why you were there, that's what you have to explain. I went back and listened to that 911 call and she's saying, "David, put the gun down. David, it's not worth it." I listen to it. It's all recorded. And the rel, you know, it's not worth it over the relationship. You don't want me no more. All that's on, it's all recorded. So, we know that you were there. Now, David, it's time for you to tell us what really happened. you know, uh, I've been upfront with you, you know, from the beginning. I said, "We need to talk to you about her." What happened, David? >> It's right over here. >> Okay. and tell me what happened that that at 3:00 in the morning when we got that 911 call. Tell me from the beginning to the end what happened just in your words. This is your story to tell. You know, >> which vehicle were you in when you went over there? >> Dodge. >> The Dodge. Where was Jennifer? When you got there in your room, >> which her room >> Where was B? >> There. >> And then what happened? It's coming in. >> Where did you have the gun? Did you get it? Did you take it with you? >> Where's the gun right now? It's by the old CVS >> on the trees. >> Where? >> By the trees. >> By the the trees. >> By by the trees. Tom Street. Place. >> Tom. Oh, okay. Off of Marshall Shark Freeway. It's that abandoned building right next to Tom Street Place. What side of the building, partner? Is it closest to March Sharp or closest to 34th? Marsh. >> Okay. Is there anything else with that guy? >> H. >> Do you have is the magazine with it? >> I think so. >> Okay. >> Where's your clothing? you were wearing were you wearing these clothing or something else? >> So, whereabout would the gun be if if I I need to we need to go get it so no kids or no one gets it? Okay. Where would we if we wanted to go straight to that gun? Is it inside the building? Is it >> just behind the trees? >> Are there gates out? There's there's trees where it first starts. >> You say a gate. There's a gate driveway again right there. >> Is the magazine with it? >> I think so. >> I appreciate your honesty. I mean, I really do. I mean, it's very This is I saw it on your face, you know, but describe you see them in the house. You You're inside the room. Did you go in the bedroom? Okay. And then you said it escalated. Tell me what happened in your words. He >> came at me. >> How'd he come at you? >> He got up and just came. >> And what did um what did Jennifer do? >> Same. So, why'd you go to the house? >> I was going to confront him. Why is he threatening you? >> How far were you from uh from Bo when you shot him? Do you know? Not far. Life. >> Do you remember? Do you remember where he was shot at? >> I'm scared. >> Where was there? How about Jennifer? Do you know how many times you shot her? >> I don't know. Not scared. >> So, after after you shot both of them, is there anyone else in the house? Anybody else with you? Does uh your friend know? Um does she know what happened? Did you tell anyone that these threats been going on for the whole week? Were they escalating? When was the last What was the last threat he ever made to you, David? Do you remember? Thursday. >> Okay. And what was it? What was it that that caused you to go into this kind of mode, this defensive mode that you felt you needed to confront? Do you need to go to the bathroom or anything? Need some water? Want some water? Did >> he make a threat against you directly, David? What was it? Do you remember? Said just make sure you don't get hit with my nina. So, you better cowboy up. >> You don't get hit with my nina. You better cowboy up. And what does that mean to you, sir? Means he once he sees me, he's going to shoot me. Okay. You you had told us that you had had your Glock 40 in that house and we've gone over that extensively, but we now know that there's a good chance that you had had it all the time. Is that correct? >> No. >> When did you was is >> I've had it for a few months. >> Okay. Is that the same weapon that you used? Okay. How did you enter the home? Do you remember? >> A window. >> A window. Okay. Is that the same window you told me about? >> No, there's another window. >> Okay. And when you enter the window, how did you uh open the window to enter the residence? >> I just pushed up. >> Okay. Um, did you do anything to try to prevent yourself from leaving a fingerprint or or any trace of yourself or was that a concern at the time? >> When it escalated. Yeah. >> Okay. So, your intention on going over there was to what, sir? >> Just to scare him. >> Okay. So, you have the the weapon on your person on you. Okay. When you entered the home, um, how far did you have to go before you made contact with Jennifer and B? Okay. Who made contact first, you or them? >> He did. >> He did. Okay. Did he come out of the bedroom? >> Yeah. Okay. was there. >> I went into the bedroom and he got up real fast. And >> just happened that quick. >> Well, >> were they laying in bed or were they >> Yeah, they're they're laying in bed, I guess. >> What was he wearing? Do you remember? Did he have a weapon at the time? >> I'm not too sure. Okay. Did you as soon as you saw him, did you just go ahead and shoot at him? >> What happened when you saw him? >> I was telling him I was like, "Why why you threatening me and this and that? >> Did you see when she called 911? Did you tell she was calling 911?" >> Yeah, but I She said I wasn't acting. Why did you shoot her? One blank. Okay. Had there been anyone that you talked to that you said you were going to do this or go talk confront them that could say that he was just going to go talk to them? Did you talk to anyone about that? Did you tell your brother I'm going to go talk to him? >> No, I just told my brother. Did you you said you were talking to Prito or what's his name? Yet >> did you talk to him about anything that >> that was going on that he you know so you told your brother he'd been threatening you? Did you tell anybody else? And you didn't talk to her at all that day? You didn't talk to Jennifer at all? Do you remember uh what did were they both shot in the bedroom or were they shot in the living room or another room? There was evidence that the back door had been kicked in. Do you remember? Do you remember how you got in or did you really get it through? And >> so had there been damage to that door before? >> Which window did you go in? Did you want to explain which window? >> You said a back window. >> Where did that window lead to? >> The the room they slept in. No, a different room. How did you uh Was it window unlocked or was it So >> you just slid it open and and and >> Do you remember where you had the gun on you? >> I had it [clears throat] on. >> Were you carrying it in? You said you were wearing these same clothes. >> Pants. >> Pants. Where are the pants at right now? in your vehicle. In your red car, >> how did you leave the residence? Back door. You should go through the back gate. >> Where did you park when you got there? On the side. Would it be annoying? >> 45th. >> 45th. [clears throat] What made you decide to do that tonight? To go there tonight to confront him? thoughts in my head. Just sometimes it's just I don't know if I need help or if I'm bipolar or what. She's always telling me if if I'm bipolar. They're always bipolar. acting crazy. Not acting crazy. Just flip out. >> Well, they're going to call me as soon as if if if we need to. Would you show us where that gun is? If we need to transport you there to show us exactly where it is, would you do that for us? I think they think they can find it pretty easily with the information you gave us. >> I'm sorry. Just by the trees. >> Just kind of buried. >> At what point did you decide tonight that you needed to go over to the house? >> Okay. We talked pretty extensively about you going to your mom's house, y'all eating dinner, you made a couple of phone calls from there, you drove around the South Loop cuz you were under stress. Is all of that information true? Okay. Um, you said that you drove around till about 11:30 or so. You returned to your house. Did you in fact go back to your house about 11:30 or midnight or Okay. At what point did you leave your residence to travel to Jennifer's house? >> When did you leave your house to go to Jennifer's? >> Do you remember? Did you just drive straight from your house there or did you, you know, drive around, sit in your car for a little bit thinking about what what what you were doing? You just went straight. David Curio swore to his statement at 5 minutes past 10 that morning and asked as he did it whether it still counted besides what he had lied about. He was booked into the Leach County detention center that afternoon and held on a $1 million bond. The Glock was recovered from the treeine he described off the Marsha Sharp Freeway. On the 25th of June 2015, a Leach County grand jury indicted him on two counts of capital murder. The state did not seek the death penalty. His trial opened in the 137th District Court in February of 2018. Jurors were played Jennifer Cruz's 911 call. They also heard that Curio had asked a third party about obtaining a silencer and that after the shootings, he told his girlfriend to say he had been with her the whole night. Deliberations took a little over an hour. On the 8th of February 2018, the jury found him guilty of capital murder, and the court sentenced him to life in prison without the possibility of parole. He appealed on four grounds, among them the trial court's refusal to instruct the jury on self-defense. On the 13th of November, 2019, the 7th Court of Appeals at Amarillo affirmed the conviction in full. The court observed that no firearm belonging to anyone else was ever found at the scene. Jennifer Cruz was 27 years old. Albert Martinez was 30.
