After coming over the highlands sebrite bridge, he began pursuing the vehicle and noticed that the driver continued to swerve on Route 36 northbound. Since the driver continued swerving, he activated his emergency lights to initiate on Route 36 in the vicinity of Wadell Avenue. >> Oh, you bought the car from a friend? >> Yes. >> Okay. Where are you coming from right now, ma'am? >> Mama Beach. >> Where in Mammoth Beachoint? Okay. Where you heading to? >> Pick up my husband. Sorry. >> Okay. Have you had anything to drink today, ma'am? >> No. >> Nothing at all. >> Okay. Only because you're kind of slurring your speech a little bit here. >> No, not fine. >> Okay. All right. And do you have anything wrong with your license? >> Nope. >> Nothing at all? >> No. >> What ferry is he? >> Sergeant McGra exited his vehicle and made contact with the driver who was identified as Nicole Huser. As he was speaking with Nicole, Sergeant McGra detected the odor of alcohol and observed other indicators of impairment. She told the officer that she was driving to pick up her husband from the ferry terminal. After patrolman Kevin Connor arrived on scene to assist, he asked Nicole to exit the vehicle and perform field sobriety exercises. On >> he's on 650. He's coming. >> Okay. All right. Do you have another insurance card? This one's expired 2024 and this registration expired 2025. Okay, hang tight here. Okay. 34 to 60 or 28. You guys on the road 1734 county. We pull one out for testing. For testing, I'm going to snag your flashlight only because Oh, thank you. Should be Oh, here. You take that. I'm going to cuz I'm going to be shining in her face. That'll kill her. >> High speed. So, listen. She came over the bridge. High rate of speed. Zoom. No, that's okay. This better. Okay. She was She came over the bridge, cut off the lady in front of her, drove over the triangle, cut back over, no blinker. She's slurring her words. Says she's going to go pick up her husband from the ferry. Okay. and her brochure is expired as of January. >> All right, man. Listen, I'm going to have you exit the vehicle so I can run you through some tests real quick. Make sure you're ready to be driving and uh if everything's okay, we'll get you out of here. All right. We go right up there on the sidewalk. Okay. All right. Would you mind just Oh, right. R right up there on the sidewalk. Sorry. That way we're out of the road. Um, would you mind just taking your sunglasses off for me? You can face me. Okay. Sergeant McGrath started with the horizontal gaze nestagmas test. During the HGN test, Sergeant McGra observed the lack of smooth pursuit, distinct and sustained nestagmas at maximum deviation and the onset of nestagmas prior to 45°. The second exercise was the walk and turn test. During the walk and turn test, Nicole did not touch heel to toe on each step, turn improperly, and took an incorrect number of steps in each direction. The third exercise was the one leg stand test and Nicole did not raise her foot in the proper fashion while putting her foot down before the test was complete. The final exercise was the recitation of the alphabet from A to Z, but Nicole was unable to do so satisfactorily. >> Okay. Um, but it's not like a glass eye or anything like that. Okay. If you can put your feet together, hands at your sides. Okay. You see the tip of my pen right there? I want you to follow the tip of my pen using your eyes. Your eyes only. Don't move your head. Okay? Keep your head perfectly straight. Okay. Next test what I'm going to do is going to do a walk and turn test. We're going to stand right here right on this light where I'm shining. Okay. Would you feel comfortable doing the test in those shoes or do you want to try barefoot? Do you have another pair of shoes? No. >> Okay. So, what I'm going to do is I'm going to explain the test for you. I'm going to demonstrate it and then I'm going to ask you to perform it. Okay. Take a hold of glasses for me. So, what I'm going to have you do is I'm going to have you put that left foot on that imaginary straight line, right foot directly in front of it, touching heel to toe, just like I'm doing. Okay? Now, no, no, don't start yet. Don't start yet. I'm going to explain it. I'm going to demonstrate and then I'm going to ask you to do it. Okay? So, you see how I'm standing right here. Right foot in front of left, touching heel to toe. It's exactly how I want you to stand right now. Can you stand like that for me? >> Right foot in front of left, touching heel to toe. Okay? Now, just stay just like that. Okay? Don't move until I tell you to. When I tell you to begin, you're going to take nine heel to toe steps. Okay? Counting out loud each step with your arms at your side. Don't start yet. Don't start yet. Okay? It's going to look like this. I'm going to demonstrate it for you. I'm going to take three steps to demonstrate it. You're going to do nine. Okay? So, this is what it's going to look like. From the starting position, you're going to go one, two, three. Again, I did three. You're doing nine. After your ninth step, you're going to take a series of small steps just like that. Turn around and you're going to walk back to the direction of where you're standing. One, two, three. Counting out loud each step. Okay? Keeping your arms at your sides. Do you understand? >> Yes. >> Okay. Nine up. Turn around. Nine back. Don't forget to count out loud. You're supposed to do nine up, nine back. [Music] Okay. Next test we're going to do, ma'am. I'm going to have you stand just like this with your feet together, hands at your sides. Okay. When I tell you to begin, only when I tell you to begin, you're going to pick either leg of your choosing. Doesn't matter which one, and you're going to lift it approximately 6 in off the ground. >> I got knees, though. >> Okay, I'll take that into consideration. Looking at your race foot, you're going to count out loud. 1 10 100 2 100 3 100 4 100 and so on until I tell you to stop. Okay, it doesn't matter which leg you're choosing, okay? Just do your best. You're going to lift it approximately 6 in off the ground, just like I did, like this, staring at your race foot. You're going to count out loud 1,00 2 1,000 3 100 and so on. Okay? Don't forget to count out loud. >> 1,002,000 31,000 400. >> My knee is not good. >> Okay. If you can't do that, I'll do another catch. >> All right. Okay, come on. >> We're going to go back. We have some stuff we have to do at headquarters. Okay. >> And then we'll get you a ride. All right. Except this I'm accept this pickup truck you got. >> We're going to have to figure this out, >> brother. >> We're going have to figure this out, >> brother. We are. >> This pickup truck is unacceptable cuz I don't have the cage to drive her back. And >> we're going to have to figure this out. You know, >> you know what? Are you lucky or righty? So, I'm going to have you just sit on this side real quick. All right. [Music] All right. So, I'm going to read you a few things. Okay. Um, firstly, all right. You have the right to remain silent. Anything you say can and will will be used against you in the court of law. You have the right to talk to a lawyer and have him rep or present you while you're being questioned. If you cannot afford to hire a lawyer, one will be appointed to represent you before any questioning. If you wish, you can decide at any time to exercise these rights and not answer any questions or make any statements. Do you understand each of these rights that I explain to you? >> Yes. >> Now, having these rights in mind, do you wish to answer any questions I have? No. >> Okay. [Music] Okay. So if you don't mind just saying that right you c right question at this time could you just sign awesome thank you all right and this one's a little long so try to bear with me okay you have been arrested for driving while intoxicated NJSA 394-50 that's just a state statute for DWI. Okay. The law requires you to submit samples under your breath for the purpose of testing to to determine alcohol content. A record of the taking of breath samples, including the test results, will be made. Upon your request, a copy of that record will be made available to you. After you have provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. If you refuse to provide samples of your breath, you will be issued a separate summon for a refusal. A court may find you guilty of both the refusal and the driving while intoxicated. If a court finds you guilty of the refusal, you will be subject to various penalties including license revoke up to 20 years, a fine up to $2,000, an installation of a of an ignition interlock, and a referral to intoxicated driver resource center. You have no legal right to refuse to give or delay giving samples of your breath. Any response from me that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit the breath testing. Even if you agree to take the test, but then do not follow my instructions, do not properly perform the test, or do not provide sufficient breath samples, I will charge you with a refusal to submit the breath testing. I repeat, the law requires you to submit to submit samples of your breath for testing. Will you submit to the >> I you tell me? >> I I can't give you long advice, >> I guess. Okay. [Music] 60 count. Can you please start off 20 minute? 20 minute observation 1923 143 go 41 has been released. Can you just change it to DWI real quick please? 5143 TWWI and clear after report 1920. [Music] [Music] So, where is the car going? >> So, your car is getting impounded for 12 hours. So, there's a law in New Jersey called John's law. And what that basically says is that if you're arrested for any DWI offense, your vehicle has to be impounded for 12 hours. So, after that 12 hours, which would be, let's see, say 7:00 a.m. you can come back here. You'll get an impound slip. And then after you get that inbound slip, you can then pick up the vehicle. All right. >> It'll be here. >> It will be here. [Music] Mhm. [Music] [Music] [Music] [Music] All right. arms [Music] here. They're done. only because your your answer for this the standard statement form is ambiguous. I have to read you something. Okay. Your answer is unacceptable. Law requires you to submit samples of your breath for testing. If you do not answer with anything other than yes, you're going to have to be charged with a refusal. So, I ask you again, will you submit the test uh breath testing? >> Yes. >> Okay. [Music] You go. You're okay. I appreciate you. I appreciate you. Handed me one of these packets the other night. The letter, >> huh? I'll make something that go down right here. Good. Okay. [Music] [Music] [Music] That's what I always do. [Music] all about going the pack on the computer. >> I do the typed app or the the old school report one. That one I don't like filling out. [Music] That's the only thing she had. Okay. You want me to do something for you? Thank you. [Music] Appreciate you. >> You did. That's not serious. [Music] [Music] Okay. [Music] Put this here. So here What's your address again, man? At the station, Nicole was read the standard statement for motor vehicle operators and she agreed to submit breath samples. Her alco test results indicated a back level of 0 to 87% which was more than triple the legal limit of 0.08%. >> Mhm. What's good telephone number for you? [Music] [Music] Appreciate it again. We have to wait 20 minutes until we could actually do it. That's why we're sitting here, right? >> Does that phone work? >> Mhm. >> Um, do you mind if she calls her husband who's at the bar? Sure. Is that all right? >> Yeah, that's fine. If you want to call in, just let me know if you see home or something. [Music] >> You have to dial first and then hit the green button. Not lighting up. >> Not light up. I'll charge it [Music] tripped >> uh with the power surge. >> Yeah. [Music] Just give it one minute. >> Okay. Also, once uh once we're done with everything, um it's not like you go to jail or anything, but if you could get a ride home or have somebody sober come pick you up because if not, the other option would be that you stay in the cell >> until we believe that you're sober enough to leave and >> we don't want to have >> it's it's cold in there and it's >> Yeah, we we'd rather see you go home. So maybe if you want to call him and see if he can maybe Uber up here, maybe sign you out and you guys go home together or whoever you're comfortable with, that might be your best bet just because it's again either that or in there and it's really not the most pleasant.
