It's about the width of the pole. >> That's where that happened. >> I'd rather you like >> So there is a possibility that that that occurred as well. I mean my >> but I'm going to like [ __ ] pinch her >> around 3:09 a.m. on December 8th, 2023. Officer Molina Jerillo with the Tampa Police Department responded to the scene of a motor vehicle accident involving to damage traffic signs at the southwest corner of E7th Avenue and in 15th Street. The total value of the damage signs was later estimated to be $300. Officer Parker witnessed the driver of a gray 2020 Jeep exit from the vehicle and she was identified as 24year-old Kelly Bellkis >> by demeanor speech eyes super dilated intoxicated. >> She said she was driving. The friend passenger also gave a sworn statement saying that she was driving. >> All right. pretty shocked >> and she when she was saying, "Oh, it's it's a serious crash." And you know, like, "How is it serious?" She made us comment about how drunk driver. >> Yeah. She literally just admitted to drunk driving. >> So, we'll investigate, see where we're at. >> Of course. I tried to give you easy ones. Nice to meet you. >> Yeah. Yeah. >> Well, y'all probably have never seen you before. >> I have. Well, I'm new here. >> My overhead, though. So, what is officer? >> Officer Blanchard. >> Blanchard. Miss Cali. This is Officer Blanchard. He's going to talk to you a little bit now. Okay. I'm just kind of going to stand back and watch him do his thing so I can learn from him. Okay. >> Sorry. I understand the situation. >> Have you given someone your driver's license? >> Yes. Uh I can get that for you, but I do have her information written. >> What is your first name? >> Callie. >> Callie. >> C. Kelly. I'm officer Blanchard. The reason why I'm here is cuz uh these officers are conducting a traffic crash investigation. Okay. During their crash investigation may notice signs of impairment on you. It appears to them that perhaps you've had too much to drink and and and perhaps not driving a car. Uh I'm here to investigate that that that uh possibility of potential, whatever you want to call it. Um but I want to make a distinction. They're conducting a civil traffic crash investigation. I'm conducting a criminal DUI last year. >> Right. >> There was another girl on site as well. Um, >> well, those >> can they at least like provide the same like >> Well, Kelly, it was an over complicated thing. So, I'll give you a rundown and I'll explain to you what that is. During a traffic crash investigation, you're covered by what we would call the traffic crash report privilege. That means that the state of Florida is very interested in figuring out how it is that cars come in contact with objects and cars so they can write it on a piece of paper and make charts out of it. That's awesome. And when these officers initially approach you and ask you about that, you tell them what's going on or why you why it's sign. That's what that is. However, I'm making a distinction. >> She was right there. She's >> Cali. The distinction I'm making is important. I'm conducting a criminal DUI investigation. That means that when you speak to me about this, about what occurred here, it's slightly different. Okay? You we're exiting the coverage of the traffic report. The things you say to me are important. You should govern yourself accordingly cuz this is a criminal investigation. You understand that so far? All right. Now, to round that out and and and Hansen, I'm going to let you know what your Miranda rights are. Why am I letting you What am I? >> But you have to let you govern yourself accordingly. Okay. All right. So, I'm going to take this part out of my shirt pocket. I'm going to read this to you. I'm going to ask you if you understand it, and then I'll ask you to roll and answer my questions. Okay, here they are. You have the right to remain silent. Anything you say can or will be used against you in a court of law. You have the right to consult with an attorney before you make a statement or answer any question. And the right to have an attorney present during questioning. If you want an attorney but cannot afford to hire an attorney, one will be appointed to represent you before and during questioning for your charge. You may use any of these rights at any time before during questioning and you may stop the interview at any time. Do you understand these rights? >> I do. >> Are you willing to answer questions or make a statement without an attorney being present? >> Has anyone threatened you or promise you anything to cause you to answer questions or make a statement? >> No. So the question was, has anyone threatened you? >> Okay. Who threatened you? >> The girls that were very tired. >> The girls that you were with tonight. And who and and who are the girls that you were with? And in what capacity or means that but but you flesh that out for me. >> Noel. >> What did Noel say to you regarding this this matter? Make sure it's time. >> You can pick that up if you want to. Is it >> I don't want It's just It's It's perfume. >> What? What did Noel say to you? >> Don't say it in the name of the police outside of the menu. >> Stop for Stop for a moment. Stop for a moment. Hold on. I want to read. I want you to understand this. >> I know. >> Hold on. Stop. Stop. Stop. Pay attention to it. It says, "Has anyone threatened you, force, or promise you anything to cause you to answer questions and make a statement?" It sounds like Noel. hear me? Look at me. It's >> not like Noel was trying to cause you to not make a statement. >> She said, "When you leave tonight and anybody asks you, >> you don't have to say XYZ." >> Kelly, has any law enforcement officers tried to force you or promise you anything? >> No, not. >> So, you had a conversation with a with a friend or a person earlier. She said, "Hey, >> if something happens, I'll talk to the cops anybody about what's going on." >> Okay. So fair enough. My my concern is whether or not anybody in a in a position of authority has threatened you or forced you and that that's not the case. Okay, fair enough. It sounds like you may have gotten advice from this person or acquaintance or not going to the police. You have to choose if you want to follow that or not. So let me double back on my question. Are you willing to answer my questions? Yes or no? Okay. All right. Can you tell me what happened here? >> Really? I know where the reds were actually and I have driven here >> parked over here perhaps in this parking spot. >> Yeah, we were in New York and what get what gets you over here to this section of the >> It was our fault. We said my heart completely was dead. He was pain department. I know his name. >> Do you take any medicines? Have any physical problems or any medical issues? Anything wrong with you at all? >> I'm ADHD. >> You take medicine for ADHD? >> Do you take what you're supposed to take and nothing more? >> Yeah, nothing. as described. >> I know that. >> Okay. Okay. When was the last time you had that medication? >> Two months ago. >> Two months ago. >> Okay. >> Not in the as needed. >> Yeah. >> Okay. >> Not not. >> Is this your vehicle? >> This is my car. >> Is there Is there anything wrong with your vehicle? Does it drive and function ways supposed to steer and stop? >> That's fine. It's just an oil change up and this is 100% my fault. >> So, prior to tonight's event, so there's a door on the car. >> Yeah. When the world was like driving, you would believe that oil change and that's my fault. Now, what I'm being what I'm being told is is is that the officers >> heard or saw her hit the back sign back there and then >> and then put together that that sign over there was struck. >> As the officers were speaking with her, he observed indicators of impairment and detected the odor of alcohol. The officers first conducted a crash investigation. After concluding their crash investigation, Officer James Blanchard was called to the scene to initiate a DEU investigation. Kelly told officer Blanchard that she consumed at least six drinks earlier that evening at the Ritzy Boore. Based on his suspicion of impairment, Kelly was asked to perform field sobriety exercises. >> Okay. And I saw y'all referring to some damage on the car. I'm looking at the damage now. >> I know. I know. It appears as if that >> so mark like 100% sometimes like I hit another thing. Not I didn't hit it but it hit me two years ago and then that was on my record my obviously. >> Were you injured as a result of this crash at all? >> This time? >> Yeah. >> So, but in the years prior I was. >> What kind of injury have you suffered in years prior? Um, I had neck pain and then I suffered accomplishment. >> How many years ago was that? >> Two and a half. >> Did you seek treatment for that? >> I did. >> And And was that course of treatment? Did you go through it? Do what the doctor told you to do? >> The doctor said you're good. >> Yes. I was very 100% on everyone else. That was >> So that was a cut and a neck issue. Were those the same cracks? No prior. >> Yeah, the neck is really good for that. >> Um, so I'll take it over. >> You handle that for insurance? >> Yes. >> And that was handled to your satisfaction. Medical out of that. >> I mean, we chose medical reason for that. >> Yes. But it was we feel the best. >> Okay. I know. Do you have any any long-term effects in that? >> Yes, but it's been tracked through that. >> What effects do you have? What physical limitations do you have? >> Physical limitations is that I can do things a little bit obviously but not you know um and then from that I do my back and >> and how did those affect you today? I mean, so they just like lower grade medical level that they prescribe at as um a little too. But that's not your health. You >> take any medications for that? >> I don't have any medications. They just record it on the same um monthly. >> Have they have the doctor said do this or don't do that? Have you given any physical limitations? >> It's not a physical limit. It's just a mental. You have a anxiety disorder and this is the same level of >> Is the anxiety disorder separate from the ADHD? >> Yes. >> So you you have anxiety disorder arising out of having had neck and back issues. >> And and so the way it affects you today is by having anxiety. of well I just have the regular anxiety disorder and then on the side of that is my neck and back. >> So ADHD a regular regular anxiety order which is aggravated by the anxiety from the neck and back. >> Yes. >> And like a elevator level on the neck and back. >> Do you take no medications for the for the being? I don't take medication for anything because I don't >> just occasionally for the ADHD which you last a month ago for so right. >> Oh, >> how much did you say you had a drink tonight? >> I had at least six months. >> Six drinks. Where at? >> At the root bar. >> The roots. >> Are you Are you willing to do any field sobriety exercises for me today? >> Did no one go home? >> No. Noel. >> I have I don't know who Noel is or I wouldn't know if Noel her. >> That's not who you were with, right? That was Scarlet. >> Well, Noel's inside and she's who served us. >> I've not even seen Noel. I have no idea who that is. >> I'm sorry. I'm sorry. I'm sorry. >> The question for you is, >> are you willing to do some fields about it? And I feel like >> no because that will sue me in court. >> Well, let me let me flush that out a little bit for you so you can make an informed decision. I'm not trying to push you either way. >> Understand that number one, refusing to do the fuel survived exercises could be used against you in court. So when you say no, that could see me in court. I'm not I'm not sure what it is you're saying there, but I I I will say that your performance on the field exercises drunk. I know. Yeah, you have to say your thing. But >> well, if if I'm I'm trying to I'm trying to be fair with you and and it's if your concern is that how you are would appear on the fuel survived exercises, which I record on video, if you're concerned about that, my fair response is yes. And so when you say that's how it would appear in court, I don't know if that answers your question or that kind of rounds out what you're trying to say. I I want you to make a decision you're comfortable with, but I also have to let you know your circumstances. Okay, I make a decision here as a based on what I've seen so far, what I've been told and what I can see here. Um, understanding what I've explained to you and understanding Officer Blanchard started with the horizontal gaze nestagmus HGN test. The second exercise was the walk and turn test. During the walk and turn test, Kelly did not touch heel to toe on each step, took an incorrect number of steps, and failed to turn. The final exercise was the one leg stand test and Callie failed to raise her foot in the proper fashion or count in the correct sequence. Of course, refusing to do the field exercise against the court. Are you willing to do the field exercise? >> Yes or no? >> I am, but I know I am. >> So now you're saying I am, but >> I am >> an exception. So are you you willing to do them? >> I am. >> Your contact lenses? >> No. May I start by looking at your eyes? >> What's going to happen? I'm going to hold up this red light right here. I'm hold it up here in front of your eyes. I'm going to move it from side to side in front of your eyes. I want you to follow with just your eyes and keep your head still on while I do it. You understand? >> Absolutely. Absolutely. There's a red line. I want you to follow with just your eyes and keep your head still for me. Okay. >> Keep your head still and follow with only your eyes. Okay, take your hand and hold your head still if you want. It might help you. There you go. It's important to keep your head still. Keep your head pointed at me and follow us with only your arms. Okay. Grab still. your eyes. Okay, I'm going to move it just a little bit. >> Just keep your head still. Oh, just your eyes. Keep your head still. Yeah. Follow it up. Keep your head down towards me. Follow it up with your eyes. Just like that. You see the odds it's immediate. >> Yes. >> And interestingly, no vertical. >> I thought vertical was for like vertical means it's high for that person. >> Okay. Vertical is high for that person. Vertical is not necessarily tied to an absolute indicator. Vertical is high for that person. So immediate onset but not high for this particular person so far. Are you willing to do another exercise where I ask you to walk on a line and follow some instructions? >> Okay. Um are your shoes comfortable for you? >> All right. You feel free. You have something in your hands if you want. You can set them on the hood of your car. That way you don't keep your hands free. I don't know. >> Uh let's let's come over here. Callie make sure >> stand here [clears throat] on the line across with me. >> Well, they seem to have left. We have no we had no eyes on the way. We had no reason to detain them. Okay. Okay. So, you see the line here, the white line in front of you. I literally have no reason to stay here. >> Callie. Callie. >> Fine. >> See the white line in front of you right here? >> Yes. Thank you. >> Cali, come stand on the white line like I am. Right here facing that way. >> All right. What I'm going to show you is what's called a walk and turn exercise. Okay. Start by putting your left foot on the line just like this. Go ahead and do that. And put your right foot directly in front of it and stand heel to toe with your arms down at your side just like this. What I want you to do is stand like that and do not move or start until I tell you to. Okay? Do you understand so far? I do. >> Your objective right now is to stand on the line with your right foot in front of your left, heel to toe, just like this without moving while I give you the remainder of these instructions. Okay? Do you understand? And when I tell you to begin and not until then, I want you to take nine heel totoe steps on that line in a heel to toe fashion just like this. One, two, three, until you get to nine. At step nine, turn like I am. See how I'm stepping around here's a small step. So my outside foot my inside foot stays down on the line. Going to take nine steps back to where you at right now. Look down at your feet the whole time. Count all your steps out loud and make sure that all your steps are healed until mine were here. Once you start the exercise, take your nine steps turn around and come back without stopping. You understand the instructions? >> Yes. >> Okay. So go and put your right foot in front of your left. That's your starting position. Okay. The first time you move a foot will be step number one. Okay. You go ahead and begin. You can start. I'm here. >> Cali, how many steps have you taken? 12. >> 12. And you ran out of line to top it all off. What do you think you're supposed to do? At some point, you're supposed to turn around. >> I know. I know. >> Okay. >> No, it's a little all the way far past. And then that means I go home and I cry and this is all over. >> So, Callie, focusing on the test on the exercise that we're doing. Once you turn around, what do you think you should do? >> You should just cry. >> Do you recall how to turn around? No, it's just it's it was already felt at that point. >> Come over here. >> Stand here on the line >> where I'm pointing. >> I know. >> You going to face that direction right there. There you go. The next exercise is what's called a one leg stand exercise. Okay. >> I wouldn't do it. >> You wouldn't do it or you don't want to do it? >> I wouldn't pass it anyways. >> Do you want to try it? I'd like to, but I knew that like it's not in the same >> Well, understand I'm trying to be fair and thorough here with you. [snorts] Okay. So, >> the way that I I'll show you what I'm talking about. >> No, but I know like all of the other tests that pass and then they all left here and then I felt Callie, we need to focus on a couple things. Number one, yeah, your friends seem to have left you and abandoned you. Okay. Number two, on the exercises that we've done so far, yeah, we've seen some signs of impairment. Okay, >> I mean I will >> Okay, but the question is, are you wanting to do the this other exercise? >> Okay. All right. So, the way it works is this. You choose your left or your right foot. You're going to hold your foot about 6 in from the heel to the ground. We're counting at your foot and count by thousands. Okay. Put your arms down at your side. All right. Look down at your raised foot. about 6 inches from the heel to the ground and count 1,00 1,002 1,003 and so forth until I tell you to stop. If you put your foot down before I have you stop, pick it up. Keep on going from where you left off without me having to tell you to do that. I want you to keep your arms down at your side. I want you to keep your foot up for the 30 seconds without putting it down till I tell you to. I want you to look down at your foot and count by thousands. Wave your arms around. Don't hop around. Give us any instructions. Use a stopwatch. Keep 30 seconds. Make sure you go for the correct amount of time. What I want you to do is keep your foot up as instructor without putting it down until I tell you to. Do you understand? >> Soon as you start, I'll start the stopwatch. You can go ahead and begin. >> So, you put your foot down on 11 seconds. What do you think you should do? >> Continue from 12. No, >> you don't want to continue from 12. >> I know cuz I just rather I'm not I was here with people that I shouldn't have. And >> I am here to >> Cali >> based on the property damage caused by the motor vehicle accident, her indicators of impairment, the odor of alcohol, her admission to consuming alcohol earlier that evening, and her inability to adequately perform the field sobriety exercises. Calli was placed under arrest for driving under the influence. >> You want to continue? It's a 30 second exercise. You made it till about 12. You want to go? You want to pick it up from 12? Good. >> No. Well, it went down. So, >> okay. You want to keep on going? You go ahead and put your foot down. >> So, we can establish a couple of things. Your your friends have abandoned you. That's They're not the best of friends, are they? >> No. >> They're not. But >> stand with your feet together just like this, please. Go down just like this. Stand just like that. Don't move. Okay. What I want you to do next is bring your hands here behind you. There you go. So, Kelly, you're under arrest at this time. I'm going to DUI charge. Okay. Female. >> Yeah, female for the search. Oh, these over there. Oh, no. These are kills. >> Cheap handcuffs. My handcuffing technique stinks. Don't do it like I do. >> I'll give you a three. >> I'll give you a three. >> Out of a 10. >> Those are double. >> What was that? What was it? A five these days. What do they What do they score? Out >> a seven. >> Seven. Yeah. Yeah. Barely earned a three. >> So, uh, Kelly, do you have anything on you? It's unlawful. Sharp, drugs, dangerous weapons. Nothing at all. No guns or nothing. >> You don't appear to have any pockets. Well, what's what's what's in your hand? Usually >> that's I can just tell me what it is. >> It's a hand. >> It's a hand fan. Okay, we'll get it out in a sec. Is there anything else? >> No. >> It's not some ancient weapon that's going to harm us, is it? >> No. No. It's like an China fan. >> Well, you never know these things. What about in your car? Do you have any cash in your car? >> You have a phone, right? >> What' you sit down over there? Didn't you have a >> I had a phone over there. >> Do you have a phone over there? How much cash do you have on you today? >> Maybe $20. $20. >> I do. Cali, look at me. I want to have a female officer come over here. Take a look through your pockets real quick. He'll retrieve the super dangerous fan out of your leg for us and I'll put that back in the car. Okay. [snorts] Now, give you a quick rundown as to what happens. Okay. Uh We'll sit in the car within we're 10 minutes from the office which is attached to the jail. We're going to go down there. I'll let you know what's going on. If you decide you want to take a breath test, you can do that. I'll let you know what happens if you don't >> and and and it's paperwork and I'll tell you and then you'll be out later on this morning. Okay. That's that's the rundown. >> All right. It is what it is. >> No, thank you. I appreciate it. >> You did fine. I've seen people do worse. It'll be all right. Uh walk with me over to my car. just frustrated at the women that I was with. >> How long have you known these girls? >> I've been friends with them for years. >> Years rolled out. >> All right. >> You do find out who your friends are in hard times, don't you? >> So, turn around for me. >> The other way. Okay, that's fine. That's fine. I'm I'm going to get this fan out of here. Like right. It's in the left. >> Okay. >> I'm sorry. I don't want you really threw up. It's just a van. >> It's just a a car. >> Okay. What do you What do you use this for when you're out parking? >> This is when you're hot inside for people who get hot inside. >> That makes sense. >> Callie, hang on. Before you hop in there, I noticed something real quick while he was getting that. Anything. >> What What is this bulge that you have here across your midsection? Is that a package of some sort? >> Don't. You don't have to reach it. >> It's a Oh, it's a squish. I'm sorry. >> Okay, stop. >> Put it down. >> Yeah, it's fine. >> Is there anything else like that on you? >> Um, yes. >> Okay, just set that down right there by the other one. >> Okay. Nope. You're good. Stand back up. Stop reaching in your waistband. >> We will have a female. No, stop. >> I did not ask you to take any of this stuff out. Just listen to what I'm asking. [snorts] Okay. We will have a female come and do anything else. >> Stop. Okay. >> Yes. >> Soft squishies suddenly on the ground. >> Can't hurt anybody. I promise. >> Kelly, have a seat in the car. >> I don't want anybody to have my car. >> Shot her unit. I got scared for a second. Oh, she's about to pull this thing off. >> What? >> Well, she shot her hand in there. I'm like, she's about to just pull this thing down. I'm like, oh god, please don't. >> Is that candy? >> It looks like candy. >> No, it's candy to me. >> And it looks sealed. And this is just a wrapper of some sort. This doesn't look like a paraphernalia bag. It doesn't even look powdery or anything. >> All right. Well, that's going to kick it onto this to our candy back in our car. >> And uh >> yeah, there doesn't even look powder here. >> Nope. Nope. over here. >> We're good. We're good. >> I don't know how. >> Okay. >> There is no drugs in here. >> Cool. >> Plenty of wrapping paper. >> Perhaps they were ingested earlier. Who knows? I mean, >> they came out of it. I saw them and then they were about to catch. >> Did you want her phone to go over there? >> Yeah. Yeah, I mean there's definitely um alcohol on board. Uh pupils are definitely dilated >> with how she was bouncing at like almost zero zero horizontal. >> So probably like a point6 to 26 to a.3 she >> can also induce your your immediate HN though is is going to be CNS depressants. So she's on aderall. >> Sometimes people will do some offsets. I'm I'm spitballing. problem is there's so much alcohol on board that it's masking all that. >> Yeah. >> But we could speculate, you know, but but the people do tend to work one against the other. >> Well, I'm curious what she blows. Is there any way >> email text like he's got to he's got to let me know cuz I got to put on the report. Perfect. So, I'll let you know. >> Very cool. Thank you. What time do you got off? >> Uh now like literally uh 6 minutes. >> I'll email it to you guys. the uh >> oh yeah my phone number I think it's between a 0 26 and between a point phone number on the uh on the NDT I can I can get that to you and yeah >> I'll send you mine too since I've got the information >> I can send you >> that's the problem with drug impairment is is is >> very hard >> is when it's mass that much alcohol it's now such a person uh if there's no alcohol it's it's much cleaner it's it's it's a bit more fun actually uh because you can really kind of get in and play with it her her size and having admitted at least six drinks too. >> She's going to be up there. >> Six drinks. >> Drivers obvious. >> So you have a purse or any a wallet? Any money in there? No. >> No drugs inside. >> No further involvement camera. No dope. >> We just need a >> She's rolling with her own narcans. >> Yeah. >> Responsible party. That's why I was like there was 100% dope in that car. But they're >> Yeah. That's That's interesting. But that's that's that's what >> we have at these things. >> She's a victim of like badly. [snorts] >> Um >> yeah, it's just like miscellaneous crap. Um >> I don't see anything about >> Yeah, I don't see a pursuit laid down. So it's like all like >> I do see that a toe and a attachment. >> She is I mean she is wrong way interstate. She is >> like this is not even as soon as we walked up and she's stumbling her way around the car. >> I'm going to be honest, there's not much to search, but >> yeah. >> Nice. >> She had an organ on her, so I figured might as well just check make sure there's nothing in the cracks and crevices. >> I mean, I can't get up in the cracks and crevices, but I can. >> She's wearing like one of those bodysuits, so >> may not need a may not be a need to. I think it's pretty obvious. Uh just she's not wearing much. We're Neore City. >> Yeah. when he was like, "Am I gonna be female officer?" I'm like, >> he's like, "I'm married." [clears throat] >> Well, you never know. >> Hold up. She's wearing more than tape, so better safe than sorry. >> Fair enough. >> Some lady the other day was wearing like a moo and had no underwear or a bra on, and I was like, "Uh, >> well, got another." >> You get it in the jail. >> I'll email you all everything. Thanks. >> You got it, buddy. She's nice and very nice. >> She's polite. >> Hey, Kelly. Come on down and talk to this officer. She's going to ask you a few questions. >> Hey, Kelly. I'm Officer Donghue. You go ahead and hop out for you here real quick. Okay. Go ahead and face the car. Do you have anything on you that's going to poke, stick, hurt, anything like that? Anything you're not supposed to have on you? >> Okay. Are you wearing a m today? Uh no bra. >> Okay. >> What is this? Like a jacket scarf thing? >> What is this? >> I don't know. >> Sorry. Here is a scarf. Scarf. It's >> a scarf. Okay. There's not much to search on her. >> Let me uh check this real quick. We got to go another notch on these. >> I am going to take your shoes off though.
