Mrs. Herald. >> Yeah. >> How are you tonight? >> I'm doing good. How are you? >> Okay. >> You know what happened? You know why they got? >> So they were telling me they're my friends. I don't go to school here. They were just telling my friends that I should like to pull into here and I just wasn't sure like what to do. >> So I was pulling I mean I was pulling in and then I they were like oh skip the skip the cones skip the cones and I didn't think it was right but I mean I kept >> Okay. What you were just visiting here for the >> Yeah. I'm just dropping them off. I mean it's not Yeah. >> What do you live around here? >> I live in South Tampa. That that address is not current. That's my parents. I just moved. Where were y'all coming from tonight? >> I picked them up somewhere near downtown. >> Okay. You and how much? >> Around 2004 a.m. on February 24th, 2024, Officer Joshua Bar with the Tampa Police Department arrived on scene inside the Rick Thomas parking garage. At 810 Frederick H. Spalding Drive to conduct a DUI investigation. This was on property belonged to the University of Tampa. Officer Ba was informed that the [clears throat] driver of the Hyundai, identified as 22-year-old Aninsley Fitzgerald, was driving in the wrong direction, passed a do not enter sign and that she had knocked down multiple traffic cones. >> You had to drink tonight? >> Not much at all. >> Okay. What did you have? >> Like one drink and that was because I drink wine with my dinner. You >> drink wine? >> Yeah. >> Okay. >> I have like one glass. It's not Yeah, it's >> the back bumper in your car. >> It's been gone for a long time. Somebody crashed into me a long time ago and it fell off >> and I just I don't have the money to fix it. So, it's >> okay. You want to hop out for me real quick? I'm going to I'd like to check make sure you're okay to drive. Okay. >> If you would shut the door, we'll go up here away from everybody. Come on up here. >> As officer Bar was speaking with her, he observed indicators of impairment and detected the odor of alcohol. She told the officer that she had a glass of wine earlier that evening based on his suspicion of impairment. Aninssley was asked to exit the vehicle and perform field sobriety exercises. >> Do you have um any medical problems or anything? >> Uh nothing crazy. No, I mean my hip's been fractured. My right hip has been fractured and I played hockey my whole life and I'm already so I mean >> Okay. pain, but like nothing crazy. No. >> Um, how long ago did you fracture the hip? A >> couple years. >> Did you have to have surgery or anything? >> Uh, no. I had an MRI done, but >> Okay. Physical therapy, anything like that? >> A little bit. Yeah. >> Okay. You feel you're back to normal now? >> Yeah, I'm pretty I'm okay. It sometimes it like acts up, but it's nothing too bad. This um this knee too with the same like ligament tear or something. I I don't remember. Again, basic training, but >> Okay. And you I mean how does your legs feel right now? Your hip? Everything's okay. Are you able to walk? Okay. >> Yeah. >> Are you on any medications? >> Not not right now, though. >> Okay. Anything else physically like your back, your feet, anything like that? >> No, I think it's just >> Okay. Have you ever been told you've had anything wrong with your eyes? >> No. >> Okay. What I'd like to do is begin by checking your eyes. Are you okay with that? >> Yeah. Okay. Do you want to put your feet together like I'm doing and then your arms down to your side? All right. See the red light in front of you. What I'm going to have you do, >> Officer Borlo started with the horizontal gaze nice HGN test. The second exercise was the walk and turn test. During the walk and turn test, Aninsley did not touch heel to toe on each step and turned improperly. The final exercise was the one leg stand test and Aninsley failed to raise her foot in the proper fashion and did not accurately estimate the passage of 30 seconds. >> I'd like you to follow that light with your eyes, but keep your head still as I move that back and forth. Okay. Heat. Heat. Keep your head still. >> Oh, >> I also do move a lot. >> Try your best to stand still. I know it's hard. >> Yeah, it it's really hard for me. Trust me. Heat up here. Okay. All right. You said you're not on any medications right now? >> No. Okay. >> I mean, like cough medicine, but if that counts, I mean, >> yeah. >> No. When did you Well, when did you last take it? >> 2 or 3 hours ago, maybe. >> What type of cough medicine was it? Uh I took so we're taking the mucinx. >> Okay. >> I do have a prescription for allergy meds too. >> That's fine. The mucinex that you took that was a cough cough medicine that you regular like the very like the normal >> like a liquid form of it or the pill >> liquid >> liquid and you just took like the the one normal dose. >> Okay. All right. I'd like you to do um two other exercises. Okay. Um involves walking on a line and then standing on one leg. >> Okay. >> Could you do that for me? >> Uh yeah. I'm not going to like I'm not going to lie. One leg kind of hard because you know Ouch. But yeah. >> Okay. Um this is a little bit crooked right here. Why don't we uh do me a favor? Just just wait right here. Come on over this side. That's just too crooked right there. >> All right, let's stand right. We'll use this yellow line right here. Oh, the yellow line. >> This yellow line right here. Yep. We'll use that one straight down. Don't worry about the angle buttons. Yep. So, what I'm going to um do is I'm going to give you the instructions. I'm going to show you how to do this. Okay. >> Okay. Um, while I'm doing all of that, I want you to stand on the line with your left foot on the line. >> So, put your left foot on the line first. >> Okay? >> Yep. And then take your right foot, place it in front of your left foot, so it touches heel to toe. They're want Make sure one foot is directly in front of the other foot. And then place your arms down to your side. Now, don't begin walking until I tell you to start. Okay? >> So, when [snorts] I tell you to, I'd like you to take nine heel to toe steps, counting your steps out loud as you walk down the line. You're then going to turn around, walk back down the same line, nine heel to toe steps, counting your steps out loud. Okay? >> I don't want you to start just yet. Okay? >> Okay. So, your first step will be number one, and each step needs to be heel to toe like this. 1 2 3 and so on until you get to nine. >> On your ninth step, I want you to leave your front foot on the line. Remove only your back foot, taking a series of small steps to complete a turn, just like this. >> Okay? >> Okay. And then you're going to walk back down the line. nine heel to toe steps, counting your steps out loud. 1 2 3 and so on until you get to nine. So, while you do this, I would like you to look at your feet as you walk. >> Count your steps out loud. >> Keep your arms down to your side. Then once you begin walking, don't stop until you completely finish this. >> Okay? >> Do you have any questions on how to do this? >> No, I should begin. >> Okay, you can begin when you're ready. 1 2 3 4 5 6 7 8 9 I'm going to face. I'm sorry. I'm in 1 2 3 4 5 6 7 8 9 >> Okay. All right. Next, what I want you to do is actually you can come stand right here off of the line. Just stand right in front of me and stand like right here. Just put your feet together, arms down to your side. Now, don't do anything until I tell you. Okay? >> This one, when I'm going to show you first, okay? When I tell you to, you're going to raise one foot. Doesn't matter which one you do. You're going to raise it so it's about 6 in off of the ground. >> Okay? >> Point your toe straight out just like this. >> Look at that foot and then count out loud. 1,00 1,002 1,00 3 1,004 and so on until I tell you to stop. All right. >> Okay. Make sure you keep your legs straight. Don't bend it at the knee like this. Make sure it's straight. Make sure >> I do move a lot. I have like just I I move a lot. So I Yeah. >> Well, what do you mean? What do you mean by that? >> Like I can't stop moving. Yeah. Yeah. >> Just like arm twitching and stuff. >> Yeah. I can't It's hard. >> That's fine. But I can do it. >> If your If your hands and stuff move like that, that's totally fine. But what I want you to do is try to keep your arms down to your side, your leg up or your foot about 6 in off of the ground. Make sure your toes pointed out, not up in the air, but out like that. >> Okay. >> All right. Do you have any questions on how to do that? >> No, I'm good. >> All right. You can begin when you're ready. >> Make sure you're looking at your foot. 100023,000 4,0005 1067 Oh good Lord 108 109 2010 2011 2012 2013 2014 2015 2016 178 >> just continue from where you were >> based on her erratic driving her indicators of impairment the odor of alcohol her admission to consuming alcohol earlier that evening and her inability to adequately perform the field sobriety exercises. Aninssley was placed under arrest for driving under the influence. A search of the vehicle incident to arrest yielded the presence of multiple open containers. After she was placed under arrest, Aninsley told the officer that she was in the army reserves. >> 2018, 2019,2021,22. Okay, you can put your put your foot down. >> Yeah. >> Okay. Put your hands behind your back. Put your hands behind your back. Do don't resist. You're going to get you're going to get charged with something else. Okay. >> You are being placed under arrest for DUI. >> No, I'm not. >> All right. Come on up. Come on over here. >> I'm not Can you watch? I'm not. I >> Come up here. >> Come on up to the front of the car. >> I can't stand still. >> No, I can't stand on one foot. I'm sorry. I can't. >> Well, it's not just about standing on one foot. Okay. It's a little bit more than that. Right. We are going to go down to the jail and I'm going to ask you to do a breath test. Are you willing to do the breath test? >> Hold on. I'm sorry. Hold on. Do you have anything illegal on you? >> No. I have to >> any any pills? >> Did they already leave? >> Yes. >> Do you have any pills or anything like that in your pocket? Okay. >> All right. >> Can I take it? >> I'm going to have you. You got to have the seat in the back of my arm. Okay. I'm sorry. I >> Come on. Be back up. >> I have ice. >> You have what? You you can tell me. >> No. >> Okay. >> Are you active military right now? >> Yes. >> Okay. >> I have no I have me to roll the window down for you. >> I just have to slow down from spot. >> Okay. >> Can I have my phone and everything on my car? >> I'll get it for you. Yep. It's not I >> Come on. Hop in. Hop in for me so I can get your stuff. >> No. Can I [panting] >> Hop all the way in. >> I have >> I have >> You have what? >> I get >> Hold on. You have what? >> I'm okay. Trust me. I No, I can't. >> All right. Hang on. I'll be right back. She didn't cause any damage to that stuff. >> I don't think so. I mean, she just she basically drove through the barricades, right? All those notes and dragging that cone from the car. >> They're making like a racket and stuff like I mean like like crazy racket. >> We were but we were sitting right out front >> cuz we had a a call before about a suspicious mail. So that turned out to be nothing. So Darren came over to help us out with that. We were just, you know, tactical information exchange right there. She must have shoved it from in the exit. Drive the wrong way. >> Yeah. All the way around. >> All the way up that little ramp. >> All right, let me get her stuff out of the car. Heat. Heat. Heat. Heat. There are so many open containers in here. It is >> astounding. >> There really It really is. Everywhere you look, there's a container or something. All right, let's see. There are like a hard seltzer. There's an empty can of like a I don't know what this is. Selzer of some sort. Empty box of twisted tea. There's an looks like an empty twisted tea can on the floor. A Miller light can empty. Here's a box for a silver patron tequila. There's nothing in it. Another seltzer. Empty. Another seltzer. Empty. Seltzer empty. That's the twisted tea I was talking about earlier. This car is a wreck. Holy cow. Here is a Tito's little shop. Empty. Another beast hard seltzer or oh maybe it's a beer in the here's a Lamar Procco rose in the glove compartment 74 DXT. All right. You just do the rotation impound for me. >> Yeah. >> Appreciate it. >> No, that's it. >> Just a supplement that you do. Whatever. Just a supplement that you're going to do. >> Yeah. >> I appreciate it greatly. >> Absolutely. >> Thank you. >> Thank you. >> Yeah, I think I did. If not, I'll double check. Make sure I'm on it. Gotcha. >> Can I have my phone with me? >> Not up here. No, you'll be okay. >> Is it coming to the jail with me? >> Yeah, it is. >> You promise? >> Yep. Yep. I'm going to sit inside. No, I >> Are you sure you >> It won't be with you, but you will be able to access it for like phone numbers. They won't let you. >> Yeah. Yep. All right. Um, are you willing to do the breath test there? Uh I No, I can't force you to do it. Um >> no, I don't do that. >> Okay. If there there Have you ever Are you familiar with what happens in Florida if you don't do the breath test? >> No. >> Okay. So, basically what happens is if you don't do the breath test, um your license gets suspended. >> Okay. >> So, for DXT for 1 year. >> Okay. >> Um let me look at your license. Hang on. Make sure there's nothing else on here. I'm assuming there's not. >> Okay. >> Uh suspended license. >> Oh, why? >> Failure to pay >> failure to pay traffic fines on November 6, 2023. >> Again, November 6th in 2023. And then insurance, >> okay, >> on March 16. That I'm sorry. >> What's that? >> I wasn't aware of that. I'm sorry. >> Okay. >> I wouldn't be [snorts] driving if I knew that. Sorry. Yeah. Basically, um, so what'll what would happen with you? You >> the options for you are, um, if you refuse the breath test, it's a one-year suspension. If you do the breath test and you blow over a 08, it's a 6-mon suspension. Either way, you can go and apply for a hardship license so you can drive for work and necessities. So, um, those are the uh those are your options, you know. I mean, really, there's only two options. Either take it or you don't take it. It's totally up to you. >> I have my phone. >> Yep. All your credit cards and everything. Yep. Thanks, guys. See you later. Um, we got a little bit of a drive if you want to think about it. >> What's that? >> So, we have a little bit of drive. We have about a 15-minute drive if you want to think about it. What you want to do? >> 672 >> 10:15 10:35 CBT 1 1449 0 for 227 hours. >> All right, Miss Fitzgerald. >> Yeah. >> Um, do you want to take the breath test? Do you have any questions? No questions. >> What's that? >> Okay, I understand. [music] Um, I do have to read you something. Okay. And it's basically the same thing that I just told you. Um, but kind of like in a legal format. Oops. There we go. You're welcome to read along. I'm going to read this paragraph right here. Okay. Some of this is not going to apply to you. So when I'm done reading this, I'll explain that. So right here, if you refuse to take the test, I have requested of you, your driving privilege will be suspended for a period of 1 year for a first refusal or 18 months if your driving privilege has been previously suspended or if you have been previously fined under Florida statute 327.35215, which is voting under the influence for refusing to submit to a lawful test of your breath or blood. Additionally, if you refuse to take the test I have requested of you and if your driving privilege has been previously suspended or if you have been previously fined under Florida statute 327.35215 for a refusal to submit to a level test of your breath, urine or blood, you will be committing a misdemeanor in addition to any other penalties which can be imposed by law. Refusing to submit to testing is admissible as evidence in a criminal proceeding. So out of this, the 18 months and the additional misdemeanor charge does not apply to you. >> Okay? >> The only thing that applies to you out of this is the one-year suspension and this refusing to submit to testing is admissible as evidence in a criminal proceeding. >> Okay? >> Meaning that if it were to go to court, I could say yes, you refused. >> Okay? >> Uh do you understand that? >> Yeah. >> Do you have any questions about that? Uh, what is it if I take it and regardless of the results mean? >> You're well, no matter what, regardless of the results, you're charged with DUI tonight. >> Okay. >> So, it doesn't matter what the results come back as, you're still charged with DUI. >> Okay. >> Does that answer that question? >> Yeah. >> Okay. Do you still refuse to take the test? >> Yeah. >> Okay. Hang tight. I got a couple of things of paperwork I got to do real quick and we'll get you inside. Okay. Are you are you um active reserve or active duty? >> Reserve. >> Okay. Cuz I saw a reserve card in there and um I just want to make sure we didn't have to make any notifications and I don't I don't think we do. Is the address on your license correct for you? >> Um, it's my pants. Yeah. >> I don't currently live there, but it was my >> What would you like to use for mailing? >> Is there an apartment number? >> No. So, in order for you to get the driving permit, >> um, so you can still drive for like work and stuff, >> what do you what do you do for work? >> I mean, army right now, I also I don't have another job right now. >> Okay. So, basically what you're going to have to do is you're in order to get that um [snorts] uh in order to get the permit to continue driving, you are going to have to clear up the suspensions that are on your license. Okay. >> Um do you remember what those are for? >> Yeah. >> A parking ticket, you think? >> Well, I mean traffic ticket, but Um, >> do you remember what it was for? >> I couldn't tell you. I know it was a while ago and I honestly don't. >> Yeah, like like over a year ago, obviously. >> Um, >> I probably got it >> cuz there's two of them. Looks like you got two of them the same day. Did you get two tickets in one? >> I don't remember. No, I do not remember. >> Really? Cuz they're different ticket numbers. That's strange. Cuz they're the same ticket number. >> Not on the same day. I wouldn't know because I >> they're I mean they're um >> What are they for? >> It doesn't say right here. I'd have to actually I can try to look it up in another cuz I I honestly have not sure about that. Um, >> I vaguely remember getting one a long time ago. It probably like I thought I thought something I thought I saw something else like a patriot, but I mean sales people. >> Fair to pay fine right here. Penelis County >> and failure to pay traffic fine Penelis County. Um it it doesn't I mean I can't I don't see any other information other than that. Two tickets um cuz I know they're they're one digit off. So they were there were two tickets given to you at the same time. >> I'm really not sure >> back in November of 2023. So the >> they the tickets if the effective date is November the tickets probably would have been given to you sometime in the summer. >> I didn't get that question. >> But I couldn't tell you. I don't I don't go to San I really don't know. >> Yeah, I couldn't really tell you exactly what they're wanting. >> Hey, I've got a female that will uh need to be searched a little bit better when we get in here. Booking. >> You want to book a CBT? >> I'm going to go straight to booking. One park allow security. Thanks. Walk your arrest up to the door. Somebody come outside. >> All right, we'll do Ainsley was transported by officer Barlo to the Hillsbor County Sheriff's Office for further processing at the jail. She refused to submit to a breath test. She was charged with a DUI 316.1 931A and eventually released pending her court appearance. >> Straight up there. All right, we'll go straight up that door there. Have you stand right over here? Yes.
