Uh, do you have your license on your registration insurance card? >> Yeah. Yeah, no problem. Around 10:30 to p.m. on September 6th, 2025, officers Vincent Fiser and Kevin Pisano with the Denver Township Police Department were stopped at a red light at Route 46 East and Route 53 South. They performed a random plate check on a white 2021 Acula and learned that the vehicle did not have a valid registration. They initiated a traffic stop and the driver pulled over on Route 53 just south of the Route 80 overpass. I can smell booze in the carot. >> Yeah, you can give it to my officer over there. >> Yeah. Can I do this? How you doing? >> I'm good. How about you? >> Thank you. The driver of the Acula was identified as Toshiba Foster, a Democrat who [clears throat] serves as a council woman in Morristown. As they started speaking with Toshiba, the officers detected the odor of alcohol and observed other indicators of impairment. Toshiba told the officers that she was headed home after coming from a friend's house. Based on their suspicion of impairment, Toshiba was asked to exit the vehicle and perform field sobriety exercises. >> Can I see it? Thank you. >> Get her up. >> Can you step out? Is it Toshiba? Yes. >> Can you just step out? The uh officer over here wants to talk to you on the sidewalk. Okay. >> Just be careful. Thank you. >> No, it's No, I just don't want you getting hit. You can uh you can walk to the back and onto the sidewalk in a safer area. >> All right, man. >> Yes. So, just want to talk to you a little bit more. >> Okay. >> Obviously, I can you smell alcohol coming from the vehicle. >> Okay. >> How many drinks you have tonight? >> I didn't have any drinks tonight. >> You didn't have any drinks? >> No. >> Okay. Well, listen. I can still come out of the car. >> Okay. >> I can smell coming off you now. >> Okay. >> I just want Let's just be honest cuz I'm going to run you through some tests. >> Okay. >> Okay. >> Yeah. >> So, where you coming from? Where am I coming from? >> Yeah, >> I was coming from hanging out. >> Okay. Where was that? >> Excuse me. >> Where was that? >> I was with my friend. >> Okay. >> Oh, >> where? Just wondering. >> Huh? >> Just wondering where you were coming from. >> A friend? Just a friend's house? >> Yes. >> Okay. And obviously you were drinking there, >> huh? >> You were drinking there. >> I had a drink. Yes. >> Okay. Cuz there's obviously a couple bottles recycle on the ground. >> Excuse me. There's a couple bottles of procco on the floor there. >> Oh, yeah. Okay. >> All right. All right. So, listen. I just want to run you through some tests to make sure you're good to drive. >> Okay. >> Okay. >> The first exercise was the horizontal gaze nestagmus HGN test. The second exercise was the walk and turn test. During the walk and turn test, Toshiba did not touch heel to toe on each step, took an incorrect number of steps, and turned improperly. The third exercise was the one leg stand test. During the one leg stand test, Toshiba failed to raise her foot in the proper fashion and did not keep her arms at her sides. >> All right. So, what I want you to do is just face me. Okay. Did you put your feet together for me? >> Yeah. >> Uh together. And then your hands down at your sides. All right. Well, the first test I'm going to do is eye test. Okay. Um do you have any injuries with your eyes? >> Huh? >> Do you have any injuries with your eyes? >> No. >> No. All right. So, what what I'm going to do, you see the tip of my finger? >> Yes. >> Okay. With your eyes, your eyes only. I just want you to follow the tip of my finger. Do you understand those instructions? >> Oh, here it is. >> Okay. And just keep your hands out of your sides. >> Yeah. Thank you. >> You follow the tip tip of my finger. your eyes. >> Just your eyes. Okay. >> Just your eyes. Just >> Oh, sorry. >> No, you're good. Just your eyes. Just see my fingers. Straighten your head out. Just your eyes. Okay. Just your eyes. >> Oh, sorry. 72. Sorry. 72's on the top. >> Yeah. 72 10 west here. Shots New Jersey Ridge Victor Delta >> 3319. eyes. Oh, my fingers off. >> Double track on that state, but it's a Dodge pickup. >> Just your eyes. All right. >> I know it's hard. Just your eyes. All right. Chin down. Hard. All right. >> Red is North Carolina. >> North Carolina, sir. I'm going to put you through another test. Okay. Next one's going to be the walk and turn. Okay. Okay. >> All right. What I need you to do is left foot, pretend like that's on the invisible line. You're going to put your right foot in front of it touching heel and toe and your hands out of your sides. Okay. >> What am I doing? >> All right. I'm going to get you the starting position. Okay. For the test. Okay. So, I want you to take your left foot. All right. Put your right foot in front of it like this. Touch it heel to toe. Hands at your sides. Okay. And I want you to stay in that position until I give you the full instructions of the test. >> Do you understand that? >> No. Say say that again. >> So your left foot right on invisible line, right? >> Now put your right foot in front of that. Touch and heel to toe. >> Can you touch heel toe? >> Oh, no. I need you to touch heel toe. >> Okay. So I'm explain it very All right. So see my feet before you get in the starting position. I'm going to do it for you. Okay. Left foot, right foot in front. Touching heel toe, hands out your sides. Okay. I need you to stay in that position until I explain the whole test. Okay. >> So, heel toe. Okay. >> Yep. So, can you get in that position for me? >> No, no, no. We're not We're not walking yet, man. >> Oh, we're not walking. >> No. No. >> All right. So, left foot, right foot in front. >> Right foot in front. >> Yep. Touching heel toe. >> Heel toe. >> All right. Hands down your side. Okay. >> I need you to stay in that position until I'm done. Nope. I need you to stay in the position. >> Okay. So, this is going to be your starting position. Okay. I need you to stay in that position until I finish the test explaining the test. Okay. So, left foot, right foot in front, touching heel to toe, hands at your sides. Okay. >> Can you do that for me? >> Okay. Can you stay in that position? Okay. All right. Can you can you stay in the position or no? Okay. Now, what you're going to do is during that time frame, you're going to take nine steps down. All right. All right. And then you're going to take nine return steps. Okay. I'm going to I'm going to demonstrate for you. Okay. So, you're going to start out like this, right? One, two, three. For demonstration purposes, I'm only doing three steps. Okay? You're going to keep your front foot planted when you get to your ninth step. Okay. Take a series of small choppy steps. Okay. Now, we're going to take nine return steps touching heel toe. One, two, >> nine. >> Three. >> Okay. So, we >> So, I'm doing nine or three. >> You're doing nine. For demonstration purposes, I did three. Okay. So, nine steps down. Keep your front foot planted. Take a series of small choppy steps and take nine return steps. >> Okay. >> Go nine. Nine. >> Yes. And you're going to count aloud during that time. If you fall off your line, okay, just return to where you were at that point and keep counting. Okay. >> Yes. >> Okay. >> Okay. Like I said, count out loud. All right. During that time frame, >> understand? >> So, I got to go up nine. >> Yes. >> Okay. and then come back down nine. >> Yes. Once you get to nine step, you keep your front foot planted, take a series of small steps and make nine return steps. >> Okay. >> And make sure you keep your hands at your side while doing that. >> Okay. >> Okay. >> So, they have to do like this lock step. >> I can show you again if you like. Okay. >> All right. Right foot in front. One, two, three. But you're going to go all the way to nine. Okay. Take a series small steps. Right. Nine return steps. One, two, three. Like I said, for demonstration purposes, I only did nine. I only did three steps. Okay. >> But I got to do mine. >> Yes. All right. Can you get back in the starting position? All right. Do you understand? Do you need me to explain anything further for you? >> One more time. >> Okay. So, you're going to take nine steps down. When you get to your ninth step, you're going to take a series of small choppy steps, okay? And turn yourself around. And then you're going to take nine return steps. You're going to count those out loud. Okay? >> Count them out loud. >> Yes. >> And then you got to keep your hands down your side during the entirety of the test. Okay. I'm going to show you another example. Okay. >> Okay. >> One, two, three. Keep your front foot planted. One, two. >> But I have to do >> Yes, ma'am. Exactly. Example purposes. I'm only doing only doing three. Okay. You're doing nine. >> Going nine and come back. >> Yes. Counting allowed, right? Hands down your side. Okay. >> And I can't do nothing else. >> No. >> And like this. >> Yes, ma'am. >> When you're ready. >> Huh? >> When you're ready. >> Okay. We have a mile up. >> All right. So, I got to go up nine and down nine. >> Yes, ma'am. >> And I have to go left and come back. >> Yes, ma'am. >> So, you going to tell me where I got to go? >> I told you you can start whenever you want. >> I'll start whenever I want. Okay. All right. You going to go? walk. >> Okay. >> This is embarrassing. So, you know, just register >> your registration expired. >> And then we're here because I smelled the odor alcohol emanating from the vehicle. Okay. So, that's why I asked you out of the vehicle. >> All right. So nine. That's all I got to do is nine. >> Like I said, nine down. >> Front foot planted. Take small choppy steps. Nine return steps. Walk counting left. >> You got to stay in the starting position. >> And then you got to start from the starting position. Okay. >> Touching heel to toe. Yes, ma'am. All right. All right. That's All right, good. Um, I got one more test for you if you make your way back over here. Okay, so >> I'm going to have one more test for you. Okay, another another balance test. Okay. >> Okay. >> So, I'm going to get you in a starting position. You keep your feet together, hands out your side. Okay. >> Mhm. >> That's going to be your starting position. Okay. During the test, okay, you're going to whichever leg you prefer. Do you have any injuries to your legs or anything like that? No injuries. >> Okay. No injuries that prevent you from doing a simple balance test. >> Simple balance test. No injuries that would prevent you from doing that. Okay. So, what you're going to do during the test, okay, is you're going to take whichever leg you prefer. You're going to raise off the ground approximately 6 in off the ground while keeping your legs straight. Okay? You're going to look down at your foot, okay? And you're going to count out loud. 1,001 1 2 10003 until I tell you to stop. Okay. I'm going to demonstrate that for you. Okay. Right. Right leg out. 1000100200 10003 10004 10005. Okay. Kind of loud. Like I said, until I tell you stop for any reason you drop your foot, I want you to resume from where you were. So, 105, you're at 105,000 10006007. Okay. If for any point you lose your balance and you put your foot to the ground, okay, I want you to continue where you last left off. >> Do you understand that? >> No, I don't. But say it again. >> If you like I said, right, you're going to keep your feet together. When I tell you to do so, you're going to raise your foot approximately 6 in off the ground. Okay? >> I don't know, but 6 in. What does that mean? >> 6 in. >> No, straight out like that. Okay. >> Oh, okay. So you're going to approximately yes approximately 60 inches off the ground while keeping your legs straight. Okay? >> While doing so you're going to count aloud with your hands out of your side,000 1,00200 34 like I just showed and explained to you. Okay? And if for any reason you lose your balance, come back to starting position, you raise your foot off the ground and you continue where you last left off. >> Okay? All right. You understand my instructions? >> I kind of, but not really. But okay. >> All right. Like I said, feet together, hands at your sides. When I tell you to begin, you got to be like this. >> Yes. 10,00 1,002,00 3,004 10,0005. Okay. >> And you're going to continue on and so forth until I tell you to stop. Okay. >> You understand those instructions? I'm >> trying. Okay. >> Okay. There we go. I can explain to me one more time if you want. >> One more time. >> All right. So, from the starting position, I'm going to tell you to begin. >> Okay. You're going to raise your foot and leg approximately 6 in off the ground. Okay. During that time, you're going to count aloud. 1,001 1,002 1003 and so on until you stop. Okay? So, it's going to look like this, right? 10001,002 10003 10004 till I tell you to stop. Okay? >> And if any point you lose your balance, just continue where you last left off. You understand those >> part when you say continue where I left off. >> So if you're at 100, 104, right? And you lose your balance. You're going to regain your balance and you bring your foot back up and you're going to be 10456. Okay? from from where you last left off. >> Okay. >> Okay. All right. Can you can you get back in the starting position for me? Feet feet together. >> Okay. >> And what I'm going to do is I'm going to time you. Okay. >> So, whenever you're ready, >> you ready? Okay. You can begin. 1,000 1,00 2,00 34 1,0005 1,006 1,00078 9 1,10, 11, 2012, 2013 1,4,5,68,00 19, 20, 21, 17, 123, 124, 125, 126, All right. All right, man.
