Traffic stop on you. Don't call nobody else to show up on the traffic stop. That's how bad things happen. Right. In other words, him going to jail for interfering with the stop. That's what I'm referring to. Right. Do you have any question for me about that? Now my next question to you is this. How much have you had today? >> But that was like literally like 4 hours ago. Reason why I ask >> Around 10:48 p.m. on November 2nd, 2024, Sergeant Spencer with the Santa Rosa County Sheriff's Office observed a red 2016 Nissan being driven erratically. He initiated a traffic stop and the driver pulled over in the vicinity of Byron Street and Park Avenue. He exited the vehicle and made contact with the driver of the Nissan who was identified as 27year-old Destiny Hesler. >> I smell the alcohol coming. >> Listen to me. >> I know. Listen. I'm going to tell you the truth. Listen. >> No. Listen. >> I switch vehicles. >> Listen to me. I smell the odor of alcohol coming from you or your dog and I'm understanding that and I'm trying to tell you the truth about this. I get that. I literally for 4 days now my car key fob has been lost. My car has been stuck at down the street for 4 days now. I finally got it. It just so happened I got in a fight with this guy that I've been talking to. I'm an emotional, right? So, I drove it home. That's it. Literally, it was like 2 and 1/2 hours, maybe 3 hours ago. 2 and 1/2 3 hours ago. I'm only right because the guy that does irrelevant. That is my house right there. Yes. So I just guilt of alcohol alone means nothing to me. What does mean something to me is a series of other indicators that I've seen put together make me believe that a crime is so in other words when I'm talking to you before you have pupils that are pretty much huge. That's it. Literally I swear I have not been drinking like that. It was I've been very upset the last It's been like 45 minutes. I've been crying my eyes out over some stupid ass guy. That's it. Literally, that's it. I'm crying over some guy. That's it. No, I just want my ticket so I can go home and cry over this stupid ass guy. That's it. That's all I want. All right. Do you understand that? You're right. You understand that? I'm going to base our decision on what we got so far. We'll talk to you about that. So, with that being said, what he's asking, are you willing to do field sobriety test? >> I just want to go full. >> I'm heartbroken tonight, >> but we have to get this out of the way first. >> Okay, I get that. I don't want to do anything. I just want to go full. Okay. So, what he's saying, and let me explain this to you. What he's saying is you're refusing means the indicators we have right now. You will still go to jail. Okay. >> No, I can't go to jail. I'm a correction officer. >> Can I save my family? >> Not right now. No, not right now. >> So, and like you said, you have the right. >> What did I do though? What did I do actually wrong? I didn't do anything wrong. >> I understand my eyes red, but I've been crying. >> You also do smell like You also do smell like alcoh. >> Listen, you go ask You can go ask Paula. >> As he was speaking with Destiny, he detected the odor of alcohol and observed other indicators of impairment. Deputy Henry Hancock arrived on scene shortly afterwards and initiated his DUI investigation. Based on the officer's suspicion of impairment, Destiny was asked to perform field sobriety exercises. Around this time, she mentioned that she worked as a correctional officer. >> Ask her. >> I don't care about that right now. I've already heard that. Are you refusing? >> I'm crying. So, my eyes are red. >> Are you refusing Phil? >> I don't want to go to jail. No, I will do the [ __ ] check, but I don't want to go to jail. >> You will do. So, you're willing to do a field sobriety test? >> Whatever you need me to do. >> Okay. >> But my house is right there. >> Step over here to the sidewalk >> for him, not you. He pulled me over. You didn't. >> He's relinquishing this to me now. >> No, he pulled me over. You did not. >> Okay. So, you're refusing. >> No, he pulled me over. You did not. I know that as much. Who are you? His sergeant. No, he's my sergeant. >> Why isn't he doing it? >> So, you're refusing? >> No, I'm asking a simple question. Why are you not doing my check instead of him? That's all I asked. >> I called him over here. We'll do all investigation. >> Okay. Now, I'm asking why are you not doing my check? >> Because he needs to stay available because >> you're a newer. >> I just explained that. That's all I'm asking. I'm >> just answered that question. >> What did you say? >> I said because he's a supervisor, he needs to stay available. So, I need to do this. >> So, you're newer. >> I don't know what that has to do with anything. Are you >> I can get in more trouble cuz you're newer and he's more uh sophisticated than you are. >> Okay, ma'am. I'm about to take this as a refusal at this point. >> It's not refusal. I said I would do it. But I want to know I'm not getting in more trouble cuz you're newer than he is. >> You don't you don't get an option on who does it or who. So, are you refusing to do it for >> I'm not doing refusal. I'm just saying I don't want to get in more trouble because you don't know what you're doing than he does. You're new. >> This is my last time asking. >> Are you refusing to do anything? I already said that. >> Yeah, I'll let him do it. But are you going to watch to make sure he knows what he's doing? >> Knows what he's doing. I'll have to actually watch him do >> I don't I don't know that he's a new cop apparently. That's what he just said. I >> did not say that. But okay. So, you're willing to do it? >> Sure. Let's go. >> Okay. Step over here to the sidewalk. >> Can I take these boots off? >> Yep, sure. If you want to. >> All right. First task I'm going to do, I'm just going to check your eyes. Okay. Deputy Hancock started with the horizontal gaze nestagmas HGN test. During the HGN test, Deputy Hancock observed the lack of smooth pursuit, distinct and sustained nestagmas at maximum deviation and the onset of nestagmas prior to 45°. The second exercise was the walk and turn test. During the walk and turn test, Destiny did not touch heel to toe on each step and turned improperly. The final exercise was the one leg stand test. During the one leg stand test, Destiny failed to raise her foot in the proper fashion. All right. See the tip of the spin? >> Mhm. >> Okay. What I want you to do is follow with your eyes and your eyes only. Okay? Don't move your head. All right. Do you wear any glasses or contacts? I'm wearing contact Heat. Heat. Okay, I'm going now. Okay. All right. Um this way. All right. So, the next task I'm going to do is the walk and turn. Okay. It's a series of nine steps. Yeah. Do you want to I guess have him block the road? All right. We're going to use this line over here in the middle of the road. All right. So, what we're going to do is we're going to start out in this position right here. Arms at your side. >> Left foot on the line. Right foot in front. >> All right. Touching heel to toe. All right. What I'm What you're going to do is take a series of nine steps down the line, heel to toe. Okay. Keeping your arms at your side. Don't use your arms for balance. Keep them at your side. Okay. Nope. Don't start until I tell you to begin. Okay. Okay. Get back in the position I told you. All right. Hold this position till I tell you to bing it. Okay. You understand? All right. I'm going to demonstrate this. Okay. We're when you start the nine heel to toe steps, you're going to go down the line, do nine toe steps, and on that ninth step, you're going to take a series of small steps and return back down the line nine more steps. Okay? So, I'll demonstrate. One, two, three, four. And when you get to that ninth step, this is what the series of small steps looks like. Do you understand? And then return the nine back down the line. One 2 3 4 until you reach that ninth step. Do you understand the instructions? Okay. Get back in the position I asked you to. may begin. Count your steps out loud. Okay. All right. The next task is going to be one leg of stand. And it's going to look like this. Arms at your side again, feet together. And when I tell you to begin, you're going to lift one foot off the ground, 6 in. It's approximately the size of a Coke soda can. Okay? And you're going to count out loud 1,00 1, 1,002, 100,00 on until I tell you to stop. Do you understand? It's going to look something like this. 100,00 1,002 1003 1004 1006 and so on. If your foot touches the ground, it's okay. Pick it back up and continue. Okay. All right. You may begin. 10089 2011 2012 134 2016 Okay, you can stop. All right.
