Around 1 132 a.m. on May 9, 2025, Sergeant Dominick Kaiser with the Hanover Township Police Department responded to a residence at Bed Place on a report of a suspicious female that had attempted to open someone's front door. The homeowner mentioned that the female was wearing black and it looked like she could be intoxicated. As he arrived on scene, he observed a 2021 Accura RDX leaving the area at a high rate of speed. Due to her erratic driving, Sergeant Kaiser began pursuing the vehicle as it headed east on Manchester Drive before eventually pulling into a parking area black. At this time he initiated a traffic stop. Hand police. How you doing tonight? Hi, I'm good. Where are you coming from? I'm coming from Bhin. Where are you trying to go to? No. Sergeant Kaiser exited his vehicle and made contact with the driver who was identified as 27year-old Shakira. The driver matched the witness description from the residents at Bairplace. As he was speaking with Shakira, Sergeant Kaiser detected the uh odor of alcohol and observed other indicators of impairment. Shakira told him that she was coming from Bontton and she admitted to consuming alcohol earlier that evening. Based on his suspicion of impairment, he asked Shakira to exit the vehicle and perform field sobriety exercises. 94. This is going to be that female. All right. How do you say your first name? Sergeant Kaiser started with the horizontal gaze nestagmus test. During the HGN test, Sergeant Kaiser observed the lack of smooth pursuit in both eyes and distinct and sustained nestagmas in her right eye. The second exercise was asking her to recite the alphabet which she could not do so satisfactorially. The third exercise was asking her to count from quantum 7 to 35, but she counted past 35 during the exercise. The fourth exercise was the walk and turn. During the walk and turn test, Shakira did not touch heel to toe on each step and turned improperly. The final exercise was the one leg stand test and Shakira did not raise her foot in the proper fashion while putting her foot down before the test was complete. Based on her, the witness's account of what happened, herratic driving, the odor of alcohol, her admission to consuming alcohol earlier that day, and her inability to adequately perform the field sobriety exercises. Shakira was placed under arrest. While seated in the back of the patrol car, Shakira was read the standard statement for motor vehicle operators and she agreed to submit breath samples. A record of the taking of breath samples, including the test results, will be made. Upon your request, a copy of that record will be made available to you. After you have provided samples of your breath for testing, you have the right to you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine. If you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. A court may find you guilty for both refusal and driving while intoxicated. If a court finds you guilty of the refusal, you will be subject to various penalties, including license suspension of 20 years, a fine of $2,000, installation of an ignition interlocked, and a referral to intoxicated driver resource center. You have no legal right to have an attorney, physician, or anyone else present for you with you for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit to breath testing. Even if you agree to take the test, but then do not follow my instructions, do not properly perform the tests and do not provide sufficient breath. Sergeant Kaiser first transported her to the Paripony Police Department where the Alcatist was administered. Her alcotist results indicated a BAC level of 0.21% which was nearly triple the legal limit of 0.28%. Samples I will charge you with refusal.
