If you don't want a copy of the report, you file all the information on there of your vehicle, your vehicle. You have a car. I don't have a car unfortunately. Just give your name. Okay. Okay. All right. Other than that, you're all good. I'll move out of your way. All right. You sure you don't want any? Okay. Enough trouble for one day, right? Why don't you back up, park in a spot, and then we'll come over here and talk. We'll do that. >> Yeah. That way we get a Just give us one second. We're trying to move cars around. Right. >> Yeah. >> Yeah. It's warm out. 431 you okay? >> Let's go. >> I don't know her name. Let's get out of traffic over here in the shade. >> Yeah, Jill. I left my car at her house because I have problems with my car. She said take my car today. >> Great day to take her. >> Well, I'm sorry about that. >> Jill, did I give you your document? Your documents back? >> What? >> Did I give your documents back? >> No, >> I didn't. >> You don't have a license, right? Okay. All right. Yeah. Just come on over here with me. All right. Just let her back out of the space. Okay. >> Yeah. I don't think you give him back. >> Oh, okay. I'll check real quick. >> All right. Yeah. Just come on over here. We'll There's a little bit of shade. Just talk to you for a minute. So, I got to drive traffic in the shade here. >> Yeah. Yeah. You have your license, though. You found it? >> No, she didn't. You don't know what you do with your license? >> I give it to him. >> Okay. You have it in your possession. >> I'll check my car again, but I'm pretty sure I give it back to her first. >> So, where were you coming from today? >> Roxson. >> Rumson. What was Rumson? >> My dad's house. >> Okay. My body came on, just so you're aware. Okay. Um, what what's the address of your your father? >> Okay. Um, I'm going to ask you a question. It's I expect honesty, right? How much alcohol have you today? >> Nothing. Okay. Are you sure of that? >> Yes. >> Okay. So, >> yes or no? >> Yes, that's fine. Listen, and you're you're allowed to consume alcohol. You're of age. You know, I'm 21, too, right? >> Um not holding it against anybody, but so the reason I asked is that I have an order of alcoholic beverage coming off of your person right now. Okay. That's why I'm asking. All right. Um so, once again, how much alcohol? >> I had a drink in last night. Like I had drinks last night. >> How much did you drink last night? You want me to ask you? >> Couple glasses of wine. >> Okay. Enough that you think you'd still be intoxicated at 4:00 in the afternoon. >> No. >> Okay. All right. So, what I'm going to ask you to do next, your name's Jill, right? Call Miss Manx. Miss Mrs. Manx. Jill. What are you? >> Call me Andre. >> Andre? >> Yes. >> Is that your nickname? >> Miss Jill. Andre. >> Miss Jill. Andre. >> Yeah. >> Okay. What's the basis on that? Jill Andre. We're getting divorced. >> Oh, okay. So, your maiden name is Andre. Okay. Mind if I call you chill then? >> Mhm. Yeah. Okay. >> Um, how about this? So, I'm going to ask if I could do a test of your eyes. Okay. And with that being said, we'll ensure that you're safe to drive and then get you on your way. >> Okay. >> Okay. >> Do you um have a glass eye, >> Mr. Uh, any like an odd question. >> I know, but it's part of it's it's it's make us ask that. uh any pre-existing head injury. >> Sergeant Lawrenson started with the horizontal gaze nestagmus HGN test. The second exercise was the walk and turn test. During the walk and turn test, Jill failed to touch heel to toe on each step and turn improperly. The final exercise was the one leg stand test. During the one leg stand test, Jill failed to raise her foot in the proper fashion and put her foot down before the test was complete. >> Um, what I'm asking you to do, Jill, Miss Miss Jill Andre, is keep your feet together. Can you put your hands down your side for me real quick? Can you see the tip of my pen? Mhm. >> With the tip with your eyes and your eyes only, I'm going to ask that you follow the tip of my pen. Do you understand the instructions? >> Yes. Okay. >> With your eyes and your eyes only, I'm requesting that you follow the tip of my pen right here. Okay. Okay. Ready? with your eyes and your eyes only. Oh, >> okay. You understand the instructions? All right. Let's hit my pen with your eyes and your eyes only. Keep your hands by your side. >> Just like that. Okay. All right. Once again, I'm going to ask you to follow the tip of my pen with your eyes and your eyes only. Do you understand the instructions? >> Yes. >> Okay. You're not following the tip of my pen and you keep moving your head. >> Oh, sorry. >> That's okay. Do you understand the instructions though? Do you need me to reexplain any portion of the test? >> No. >> No. Okay. See, it's in my pen. >> Mhm. Okay. Follow my pen. >> Yeah. >> Do you see the tip my pen? >> Mhm. >> Okay. I'm going to pull out one more time. Okay. I'll tip my pen with your eyes and your eyes only. Okay. With your eyes and your eyes only. All right. >> Okay. >> Okay. Do you see the tip of my pen? >> Mhm. >> Okay. Okay. We're going to go up. Okay. Chin down, eye level. Follow the tip of my pen with your eyes and your eyes only. Okay. Mhm. Continue. [Music] >> All right, Joe. So, I'm going to ask you to uh complete two more tests. Okay. Just to ensure that you're uh able to operate. Okay. >> Okay. >> All right. Uh do you have any issues with your legs? Any existing knee injuries, leg injuries, foot injuries, anything like that? Anything that would prevent you from walking or balancing? >> Nothing. Okay. >> If you don't mind, of course, we get a test. We just step in front of my vehicle here. >> Make sure we're in a safe location. >> Okay. >> Yeah. You mind just following him? We'll do it over here. >> Mandre, just be careful. >> We could be in here in front of the car. It's just a little easier. My concern is somebody comes around the bend, think it's an open spot, and then we're all like little. >> Yeah. No obstructions. Here you go. Okay. All right. I know it's going to be a little bit louder out here. I'll I'll try to raise my voice a little bit so you can hear me and understand. Okay. So, what I'm going to >> If If you think that's going to help you, that's fine. >> Okay. You can look. You can face me. All right. Actually, what I'll have you do is I'll have you stand right here. Right in the shadow. Right here. Right here, Jill. Yep. Stand there. Just face facing me. Just like that. Yep. Perfect. Keep your hands down at your side. And you're going to keep your legs together. Okay. You understand? Okay. All right. So, what I'm going to do is I'm going to explain the test. I'll demonstrate it. And then I'll ask you to perform the test. Do you understand? Okay. So, for right now, what I want you to do is I just want you to take your right foot, put it directly in front of your left foot, like you're on an imaginary line, like so. Okay. And I want you to stand like that with your hands down by your side while I explain everything. Okay? >> All right. Stay just like that. Nope. I didn't ask you to walk yet. Just stand just like this. Okay? >> Do you understand? >> Yes. >> I need I need your right foot directly in front of your left foot. Keeping them in a straight line with your hands down by your side. Stand just like that. I'll explain the test to you. Okay? What I'm going to ask you to do is walk a series of nine steps heel to toe. Every step that you take, your heel is going to touch the front of your front of your toe. I need you to stand in the uh in the starting position. Okay. Yep. Stand just like that. Okay. Let me explain the test and then I'll have you move. Okay. >> All right. So, what I'm gonna ask you to do is complete nine heel totoe steps down in just imaginary straight line. You're going to take a series of small steps to turn around and take nine steps back. Okay. >> Okay. >> The entire time I want you to keep your hands down by your side. I want you to count your steps out loud. And once again, you're going to walk in a heel totoe fashion just like this. Okay. 1 2 3. You're going to go all the way to nine. I only did three, but I want you to go all the way to nine. Once you get to your ninth step, I want you to take a series of small steps, and I want you to take nine steps back down the line. Okay? 1 2 3. Once again, I did three. You're going to do nine. Okay? If at any point you step off the line or lose your balance, just regain your balance. Continue stepping heel to toe. Okay? Do you have any questions for me? >> Do you understand the test as I explained? >> Nine and nine. >> Nine. Heel to toe. Make sure that your heel is touching the front of your other foot. Okay. >> All right. You can begin. >> Just make sure you're counting your steps out loud. Okay. >> Oh, okay. >> Yep. and keeping your hands down by your side. >> 1 2 3 4 5 6 7 8 9 >> Okay. All right. Stand back in the starting position just like I had you before. Right there facing me. Okay. >> All right. All I'm going to ask you to do Nope, not against the bumper. I need you to stand away from the car. Okay. What I need you to do here is keep your feet together, hands down by your side. Okay. This is going to be a balance test. All right. You can pick either foot of your choosing. Right or left, doesn't matter. But I need you to keep your hands down by your side. Choose the foot of your choosing. >> Yeah. Yeah. Choose a foot of either either uh you can choose either foot, right or left. I'm going to use my right foot. Okay. All you're going to do is you're going to lift it approximately 6 in off the ground with your foot pointing out straight in front of you. Okay? The entire time, hands down by your side, staring at your foot. I want you to count out loud. 1,00 1,002 1,003 so on and so forth until I tell you to stop. Okay? Do you understand? >> Yes. >> Okay. If at any point once again if you drop your foot, you lose your balance, just lift your foot back up and continue counting from where you left off. Okay. Any questions for me? Do you do you understand the test as I explained it? >> Yes. >> You can begin when you like. Jill, just remember to count out loud. Okay. >> 1,001. >> Yep. Keeping your hands down by your side, push straight out in front of you. approximately 6 in off the ground. Okay. Not just right here. >> Okay. >> Based on the motor vehicle crash, her indicators of impairment, and her inability to adequately perform the field sobriety exercises, Jill was placed under arrest for operating under the influence. Her vehicle was impounded for a mandatory 12-hour hold under John's law. >> All right. Do you mind facing the car? We're going to do one more test. Okay. >> Okay. >> Nope. Stay away from me. Okay. Right now. I believe you're intoxicated. Okay. >> 1071. All right. I know you got a couple bracelets on here. I'm just going to try to put these on without pinching you. Okay. >> Is that too tight? >> No. >> No. That's okay. All right. I'm just going to lock them real quick. All right. Jill, do you have anything in your pockets? Anything sharp? Anything? Any weapons? Anything? I'm sorry. >> A phone. >> A phone. That's it. Okay. All right. I'm just going to use back of my hand. Just check the front of your pockets here. Okay. And no, don't reach for me. Okay. What else do you have? during the car. Okay, we'll we'll get down. Don't worry about that. Okay. >> You want to take her and I'll Oh, no. Sorry. I'm sorry. You can do it. Yeah. We're just going to walk back to my car. You just step over the curb for me. Look, we're going to go this way to the other car. Okay. >> You unlocked? >> Yeah. >> Yeah. That car is unlocked. >> Okay. Thank you. Am I getting your purse in the in in the vehicle or anything that you need or require at the time? >> I need my wallet and my phone. >> Where would that be? We needed >> the center console. >> Center console. Okay. >> Yeah. >> And there's a purse. >> You mind just rotating a little bit? I'll get your phone out of your back pocket for you. All right. We'll bring that with us. >> Can you get it? I don't want to I don't want to touch you inappropriately. Okay. Can you slide it out of your pocket even though you're in handcuffs? There you go. Perfect. All right. Nope. I'll take it. I'm going to put it right in the front. We're going to bring it with us over to the headquarters. Okay. >> Okay. >> All right. Scott. >> Yeah. >> Yeah. Do you mind just watching for once? I want to turn the air on before I close the door. It's way too hot. Okay. >> I'm going to turn the AC on for you. Okay. All right. Let me just make sure the AC is on. It'll get a little bit cooler. All right. Do you feel it blowing on you, though? It's a very short ride. We're going right across the street. Okay. >> I know where I'm going. >> Okay. You need me to come sit on a hook. >> You me to go. >> Sorry. >> No, go ahead. Sorry. >> You want to search it? You go in. >> It's up to you. >> It's up to I don't know if you want to have her sit there. I'll just check the back real quick for you. He was drinking this multiple times while sitting there, so I'm not sure what's in here. >> Okay. >> Smells like water to me. >> Okay. Just notating existing damage on the vehicle on the front passenger side. I don't think >> Yeah, it is. >> You take the center console. >> I didn't say her her documents. Her phone is in there. >> No, she had her phone in her back pocket. >> Oh, so her phone is in her purse. >> Yes. >> And here's her purse. Her wallet was right here, which I'm assuming is what she was requesting. >> Okay. I do I do have her documents. >> Okay, perfect. Okay. >> All good. >> Yes. No. All right, Jill, get this off of you. All right, easiest thing. Just kind of slide your butt out with your feet first. All right, I know it's not comfortable. Try to help you out a little bit. There you go. All right, just wait here for me for one second. Thank you. All right. All right. Just walk up towards the steps towards my lieutenant over there. Just watch your step right here. Up one step and then we're going to go up the set of stairs on the right here. >> Uh, no, we're good. Thank you. Make a left here. >> All the way down. Okay, we'll make a left at the left order. Make a left right here for me. We're going to go to the trim on the right. And you sit right on the metal bench right here on the left. Okay. >> Yep. Right down there. All right. I can shoot the back of the hand one more time if you want. >> If you do one, okay, all right, Joe, just stand up for me for one second. Okay. Are you left-handed or right-handed? >> Right. >> Right-handed. Okay, perfect. All right, I'm just going to take the handcuff off. We're going to handcuff you to the bench instead. What time was your appointment at? >> Uh 4. I don't like to make assumptions at all. Have you ever been arrested here in Little Southern? >> No. >> Right. Paul Remson. >> Well, police. >> Yes. >> For what? >> Uh, my dad's a longstanding um >> well long-standing employee of Remson. >> Okay. >> And like knows all the police. So, so maybe we could call them like we have to >> get rid of whatever this >> Okay. Unfortunately, that's not how that works. >> Okay. This is completely separate. It doesn't matter who you know. Okay. The deal is is that we're going to go through some paperwork. All right? If you're willing to, we're going to uh do the alco test, which is the breath logic. All right. We'll test your breath if if you uh if you'll allow that. And then we'll have somebody come and pick you up. You'll be in and out of here in 30 minutes tops. Okay. >> Okay. >> All right. Um and I'll let you call somebody in a few. All right. Once I get through these questions, >> okay? >> Whoever you want. If you want to give me your dad, I can give you your dad. Just somebody that can pick you up but has a license. Okay. >> Okay. >> All right. All right. >> What happened to the car? the car got towed. >> No. >> Yeah, I got towed. It's impounded. It's going to be in central. I'll have all that information at the end. You can pick it up uh after 12 hours. Okay. >> Okay. >> All right. All right. I'm going to do a lot of talking. All right. Let me get through the whole thing and then if you have any specific questions after, then you can ask me. Okay. >> All right. I just have to read you the uh New Jersey Attorney General Standard Statement for motor vehicle operators. All right. Number one, you have been arrested for driving while intoxicated. NJSA39 uh colon 4-50. Number two, the law requires you to submit samples of your breath for the purpose of testing to determine alcohol content. Number three, a record of the taking of the breath samples, including the test results, will be made. Upon your request, a copy of that record will be made available to you. Number four, after you have provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. Number five, if you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. A court may find you guilty of both refusal and driving while intoxicated. Number six, if a court finds you guilty of the refusal, you will be subject to various penalties, including license revocation of up to 20 years, a fine up to I'm sorry, a fine of up to $2,000, installation of an ignition interlock, and a referral to an intoxicated driver resource center. These penalties may be in addition to penalties imposed by the court for any other offense of which you are found guilty. Number seven, you have no legal right to have an attorney, physician, or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Number eight, any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit the breath testing. Even if you agree to take the test, but then do not follow my instructions, do not properly perform the test, or do not provide sufficient breath samples, I will charge you with refusal to submit the breath testing. Number nine, I repeat, the law requires you to submit samples of your breath for testing. Will you submit the samples of your breath? >> I think I'm going to talk to a lawyer. >> Okay, I I've read that part already. Uh, you have no legal right to have an attorney present during breath testing. Okay. >> Okay. >> Um, all right. Your answer that you just gave me is not acceptable. The law requires that you submit samples of your breath for breath testing. If you do not answer or you answer with anything other than yes, I will charge you with refusal. Now, I'll ask you once again, will you submit to breath testing? I I I I I'm getting like really overwhelmed by this whole thing. >> I understand. Just to shorten this up a little bit. All right. When you apply for a license, you sign consent to give samples of your breath if you're uh if you're deemed to possibly be under the influence of alcohol or any other substance. Okay. As it states here, you're required to give samples of your breath if you're requested. Okay? If you refuse, you will be charged with a separate additional charge of refusal along with driving while intoxicated. Okay. So, I'm going to give you one more chance to answer yes or no. Will you submit the samples of your birth? >> What? And what happens? What's what's the consequence >> if you what? Well, I already explained what the consequence is. If you say no, you're going to get an additional summon for refusal. All right? And at that point, you will be subject to various penalties that will be imposed on top of the driving while intoxicated. Okay? If you say yes, the next course of action is that we do this the breath samples. All right? You'll come over, you'll give us samples of your breath, we'll do it two or three times, depending on how many times it takes. It'll print it out and we'll be good to go. All right? So, I'll I'll ask one more time. All right? Yes or no? >> Give me a minute. This is a lot. I mean, like, yes, I had a glass of wine, but like, yeah, like that's it's it seems like a lot, like, you know, and I'm just I All right, Jill, I do need an answer.
