Um the reason I'm stopping you, you're having a little trouble maintaining your lane, and it also looked like you're using your phone when you drove past me back there. What were you using your phone for? >> I'm sorry. I'm very sorry. >> What's that? >> I'm sorry. My boyfriend is sick to his stomach. I'm very sorry. >> Okay. I'm sorry to hear that. Yeah, let me come to your side. You can close this window. I'm going to come to the other side so I can hear you. >> Around 7:41 p.m. on December 17th, 2023, Officer Aaron Schubert with the Verona Police Department observed the driver of a 2007 Ford Focus making a wide turn while turning onto Lakeside Avenue after driving eastbound on Bloomfield Avenue. the driver was also using a wireless device. Officer Schubert made a U-turn, proceeded southbound on Lakeside Avenue, and observed the driver failing to stay within the lane boundaries. He activated his emergency lights to initiate a traffic stop, and the driver pulled over on Lakeside Avenue near Cunningham Drive. >> [groaning] [sighs and gasps] >> You said your boyfriend's sick? >> Yeah, he's sick. I'm sorry. I was rushing over there. >> Okay. Where does he live? >> Uh Verona Uh Verona Tavern. >> He lives at the Verona Tavern? >> No, he lives at Verona >> The driver was identified as 29-year-old Ashley, >> [snorts and clears throat] >> and Officer Schubert told her that she was using a wireless device and swerving across lanes. Ashley told the officer that her boyfriend was sick, and that she was headed towards the Caldwell Diner, even though she was going in the opposite direction. She was asked where her boyfriend lives, and she initially responded by saying that he lived at the Verona Tavern before stating that he lived at the Verona Inn. The Verona Inn is actually a bar in Verona, New Jersey. Ashley admitted to consuming one shot at the Verona Inn before driving, but she would later admit to having two shots at the bar. Officer Schubert asked Ashley for her documents, and Officer Clark arrived on scene to assist as he returned to his patrol car. >> Do you have your license as well? Thank you. I'm sorry, just one more time. What did you say your boyfriend lives? He lives at the Verona Inn by Verona? I'm sorry, one more time. Yes. Okay. Uh, do you know where you are now? What's that? Yeah. And you're heading to the Caldwell Diner? Is this the route you usually take to get to this Caldwell Diner? Do you know what street you're on right now? Mhm. Okay. Where are you Where are you coming from? Mhm. I'm sorry, one more time. That traffic, I can't hear you. Okay. Mhm. Okay, where were you coming from? You're coming from the Verona Inn? Okay. So, you're leaving the Verona Inn? And you're trying to get to Caldwell? Mhm. Okay. >> It was coming from >> Okay. Do you have anything to drink today? >> A little bit of >> What did you have to drink? Just one shot? Okay. >> And it was just some beer >> Okay. >> I'm sorry. >> When was the last time you got any sleep? >> I don't know. Honestly, I don't >> Okay. Do you have anything else to take today? Do you have any medications? No? >> No. >> Okay. Just look at me real quick. Do you have any medications for anything? >> No medications today. >> Did you have any smoke Did you have any smoke weed or anything? >> No. >> Nothing? >> do anything else. >> So, it's just the one shot? >> Just one shot. >> And you're being honest with me it was just one shot? >> Just one shot. >> Okay. Cuz I'm talking to you you're speaking very slowly. >> I know. I know. >> Okay. >> I know. I understand. I do. >> All right. Just stay in the car while I check out your information. I'll be right with you, okay? Um you said you were texting your boyfriend? Okay. Phone the Caldwell? Interesting. Why? >> It's like you know a dry area to be driving. >> You what? I mean you don't need to If it's planning, I it's >> I'm sorry. >> Yeah. I'll say it again. How are you doing? I'm Officer Clark. I'm Officer Clark. I'm just waiting for Officer Stuber. And how are you? Good. Thank you. Can you do me a favor? Can you just shut the car off for me really quick? Thank you. I appreciate that. How you doing tonight? >> I'm good. How are you? >> Good. Thank you. >> I'll be right back, okay? I just had to shut the car off. She's trying to call someone. I mean, I don't know who she's trying to talk to, but I don't know. What do you say? No. I'm trying to get the drink. I'm going to go put my phone in there. I don't need this thing going off cuz I'm going to be >> [singing] >> Um realistically, like the front of the car is probably going to be fine. Sure, it's wet, but >> I got the lights. Do you have that? I got All right, ma'am. So, just because of what I observed when you were driving and the fact that you consumed some alcohol today, we're just going to do some tests real quick to make sure you're good to drive, okay? All right. So, you might as you can put your window up to keep your uh your car dry when you step out. Now, is the car off? Okay. Do you want to put your phone in there so it stays dry? Okay. We're just going to step to the sidewalk over here. All right. You want to talk to Supert? He's just right here. You want to stand on the sidewalk? >> Okay. >> Just here. >> Based on the officer's suspicion of impairment, Ashley was asked to exit the vehicle and perform field sobriety exercises after Lieutenant Shephard arrived on scene. The first exercise was the horizontal gaze nystagmus HGN test. During the HGN test, Officer Supert observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45°. The second exercise was the walk and turn test. During the walk and turn test, Ashley failed to touch heel to toe on each step, took an incorrect number of steps, and failed to turn. The final exercise was the one leg stand test and Ashley failed to raise her foot in the proper fashion while displaying a lack of balance. >> So, there's just the one shot, right? Just the one shot? Okay. Do you uh What's your highest level of education? Your highest level of education? Did you go to high school or college? >> College. >> College? >> one semester. >> Okay. Did you finish high school? >> Yes. >> have a high school diploma? >> Yes. >> Okay. You going to understand the English language? >> Yes. >> Okay. Do you have any problems with your eyes? >> No. >> Any ongoing medical conditions that I should be aware of? Okay. Do you wear glasses or contacts? >> I wear contacts. >> No. Um okay. Are you diabetic? >> I am not. >> No. Okay. All right. So, um just take one more step forward so we're off the crack. So, I want you to stand there with your feet together and hands by your side. Okay. Do you see the tip of my pen? Right in front of you? Okay. Can you touch the tip of my pen with the tip of your finger? Perfect. So, what we're going to do, I want you to follow the pen with your eyes and your eyes only. Okay? Don't move your head. It's going to go side to side. Ready? Okay. Follow the tip of my pen. Don't move your head. >> See this in my phone? >> Yes. >> Okay. See this in my phone? >> Yes. >> Sorry, one more time. Follow this in my phone. Try to keep your eyes open, okay? >> My eyes are open. >> I know. You're squinting. I know. Keep your hands by your side. >> Sorry. My eyes are just I'm sorry. I'm cold. >> I understand. >> I'm following it. >> Okay, same thing. We're just going up and down, okay? >> [screaming] >> Okay. Um no, I understand. I feel you. I feel this way cuz I put the jacket on. >> I'm just very cold. >> have a jacket in the car you want to throw on? >> Yes, I have one in there. Do you want to throw it on? >> No, I'm sorry. Okay. So, All right. Step in the road right here. So, stand here close to the curb. Okay? Um next is going to be a walk and turn test, okay? Do you have any issues uh with your back or any injuries with your legs or back? What kind of issues? Does that affect your ability to walk? I'm just asking. I just want to take everything into consideration. Okay, but does that affect your ability to walk in any way, shape, or form? I I understand >> But I should be fine [snorts] by that. >> I understand you should be fine. I it's if you have any you can walk, it's great. I just want to know will it affect, even if it's a small way, will it affect your ability to walk at all? >> I hope not. I don't know, honestly. I hope not. >> Okay. Okay. Okay. So, take one step to your left right here. >> [snorts] >> Start towards me. One step to your left. Okay. So, I'm going to get you in the starting position. I want you to stay in the starting position while I explain the instructions of the test, okay? >> Yeah, sure. >> So, the starting position, I want you to imagine a line going straight up from your feet to straight out in front of you. Right, I'll explain it to you, okay? So, imagine there's an imaginary line starting from your feet going straight out in front of you. I would like you to put your left foot on the imaginary line. And then put your right foot in front of your left foot on the line touching heel to toe. Okay? And I want you to keep your hands by your side. All right. This is I'm by your side. This is the starting position. I want you to stay in that position while I explain the instructions, okay? >> Okay. Okay? So, from the starting position you're going to take nine heel-to-toe steps forward. It's going to look like this. One, two, three. Do you mind getting back in the starting position for me? Okay. Well, this is the this is the uh Do you want to do this one? >> Yes. >> Okay. That's fine. You were just a little slippery when you touch water. Okay. So, put your left foot on the white line. And put your right foot in front of your left foot on the line touching heel to toe. So, let's go back. With your left foot, put your left foot on the line. And then your right foot you're going to put in front of your left foot on the line touching heel to toe. Just like that, okay? That's the starting position. I want you to stay in that position while I'm explaining the instructions. Don't begin until I tell you to, okay? Okay. >> [snorts] >> Can you try and get back in the starting position for me? So, when I tell you to begin, not yet, when I tell you to begin, you're going to take nine heel-to-toe steps along the line like this. One, two, three. I did three, you're going to take nine. On your ninth step, you're going to keep your lead foot planted and with your back foot you're going to take a series of short steps to turn around. Once you turn around, you're going to take nine returning steps along the line heel to toe. One, two, three. I did three, you're going to do nine. Do you understand? I'm sorry, do you understand? >> Yes. >> Okay. So, while you're doing these, I would like you to keep your uh arms by your side. I would like you to count your steps out loud. And if at any point you fall off the line, just pick up back where you left off, okay? All right, you can begin. >> 1 >> Okay, you can stop. You can come back here. >> I don't really drink. >> [sighs] >> That's okay. We still have one more test. >> You said we're doing it over here. >> Okay. >> I'm very sorry. I don't usually drink. I really don't drink. >> Okay. It happens. Do you want to be honest about how much you had to drink? >> About two shots. >> Two shots? >> Yeah. >> Okay. >> I am I am very sorry. >> Okay. I I understand. We still have one more test, okay? Okay, so just like before, you will stand to your feet together, arms by your side. >> Yeah. >> This is going to be a balance test again. No issues with your legs or back aside from the chip? >> Okay. >> All right. I'm asking you, do you have any other injuries? >> No, I just have a >> Just the chip, okay. So, don't start until I tell you to begin. But, when I tell you to begin, you're going to lift one foot up, either one of your choice, approximately 6 in off the ground. And then you're going to count 1 1,000, 2 1,000, 3 1,000, and so on until I tell you to stop. >> Okay. >> Okay, so it's going to look like this. When I tell you to begin, you're going to one foot up approximately 6 in off the ground. And you count 1 1,000, 2 1,000, 3 1,000, and so on until I tell you to stop. >> Okay. >> While you're doing this, I would like you to keep your arms by your side. >> Okay. >> I would like you to count out loud. And I would like you to keep your foot straight or your leg straight. Okay? >> Okay. >> And if at any point you touch the ground, just pick it back up and start from where you left off. Does that make sense? Do you understand? >> Absolutely. >> Okay. All right, whenever you're ready, you can begin. Can you keep your arms by your side and put your foot out in front of you like you were instructed? So, you want me to explain it one more time? Do you want me to explain it one more time? >> Yes, please. >> Okay. So, when I tell you to begin, you're going to keep your arms by your side. You're going to lift one foot approximately 6 in off the ground in front of you. >> Okay. >> Do you look at me while I'm demonstrating it? Okay. And you're going to count 1 1,000, 2 1,000, 3 1,000, and so on until I tell you to stop. While you do it, I want you to count out loud. I want you to watch your foot, your raised foot, and I want you to keep your raised leg straight. Do you understand the instructions? Okay. Not yet. I'm sorry. All right, you can begin. Can you keep [screaming] your arms by your side? Can you keep your arms down by your side? Can you count out loud for me and keep your foot in front of you? All right, you can stop. >> Based on her erratic driving, the odor of alcohol, her admission to consuming alcohol before driving and her [clears throat] inability to adequately complete the field sobriety exercises, Officer Suberg placed Ashley under arrest for driving under the influence. Her vehicle was impounded for a mandatory 12-hour hold under John's Law. She was transported to the Verona Police Department for further processing. >> All right, ma'am. Can you put your hands behind your back for me? >> I'm sorry. >> No problem. For a while there, I thought you were going to >> Hm? I'm very sorry. >> Okay. It's okay. At the end of the day, this is just a traffic violation. Okay? >> I got it. I'm sorry. >> Do you need anything from your car right now? >> No, I'm just >> your phone? I got you. You want your phone? >> a minute. >> Okay. So, listen, your keys, is there anything on your key ring that I need to take off for you? Do you have house keys or anything like that on there? >> No, I think uh uh My keys are in my car, actually. >> Yep. No, I know they're in your car. Is there anything on your key ring that you need so you can get home? Okay. No problem. Unfortunately, part of this, we're going to have to tow your car. >> I got it. >> So, it's >> My house keys, I think, are under my my passenger seat. >> Okay. Do you have a wallet or anything in there you want us to grab for you? >> No, I don't. My wallet is in my pocket. >> In your pocket? Okay. All right, you can just walk this way to my car. >> I'm sorry. >> And we're going to step off right here where it's flat, where the driveway is. Just keep going. What side do you want to run? >> Uh this side. >> Hold on. >> Search her and take the lighter off of her? >> Yeah. >> I'm sorry. >> Stand right here. >> I'm very sorry. >> It's okay. All right. Stand facing my car. Don't move. >> I'm sorry. >> All right. We'll get you in and out as quick as we can. You got somebody that can pick you up? >> Yeah, but I just don't worry. I'm sorry. I'm sorry. >> All right. It is what it is. Um do you have anything in your pockets that's going to poke me or prick me? >> No. >> No? Okay. I'm just going to take the lighter off, okay? >> Go go for it. >> Here's step over to your right. I'm just going to put all your belongings up here, okay? >> Go for it. It's okay. >> Your phone and wallet, at least. >> My phone, my wallet, and my sunglasses. >> Nothing in your waistband, right? >> No. >> Okay. Do you have a hood on? >> No. >> Okay. >> [snorts] >> You can take a seat. >> Is there a problem? >> It's no problem. All right. Just lean back as best you can. Face that way. Put the seat belt on you. All right. House keys are in here. Let's go. >> We have your purse. We're going to take the whole purse with you with us, okay? So you can have it when you get out. >> That's fine. >> Okay. >> Thank you. >> We're going to take the whole purse, that's okay. >> I Yeah, I'm just making sure if she doesn't have anything >> She's got a wallet like a >> Um Yeah, go through this and go through that. I don't know if that's actually anything in there. >> Yeah, it's in there. >> [snorts] >> LT. She's got a whole bag of like uh like raw weed and edibles. She's going to photograph or you want to take it with us? >> No, just photograph it. >> All right. >> You take it and give it to her or should we leave it in the car? >> I mean, yeah, it's all in the bag. >> Yeah. Yeah, just take it and >> All right. >> Okay, we'll photograph it. [snorts] All right, you want >> Yeah, just throw it in the car real quick. >> The hell is this? Someone else with a little bag it was for. I don't know what this is though. >> Looks like a tum and a vitamin. >> Yeah. >> Or a Pepto. Pepto. >> All right. Mine's safe? >> I'll keep this safe. >> You're safe? >> Yeah. >> All right. Find dispatch. >> Got it. >> Transporting one adult female in custody from this location to headquarters. Starting miles 88184.5. >> Copy. >> [snorts] >> 215 PLT to move the vehicle. >> Perfect. >> What's that? So, we're going to our headquarters real quick. We just have to process you. We'll give you some summonses for the uh the motor vehicle violations I observed. You'll get a court date, and then we'll let you call somebody to come pick you up. >> Please just sign here. >> What's that? >> Driving under the >> Uh yes, you'll be charged for uh driving under the influence. Okay? Again, it's just a traffic summons, but it does have some big penalties to it. And uh a couple other motor vehicle violations I observed, okay? Nothing criminal, it's all traffic. But you will have a court date. >> Perfect. >> [snorts] >> Can you just write down the miles for me on the uh towed vehicle. 60291 and give it to Officer Clark. >> Perfect. >> Uh it is what it is. >> [snorts] >> 591 on the ramp. Ending miles 881.85.3. >> Perfect. >> At the Verona Police Department, Ashley was read the standard statement for motor vehicle operators and agreed to submit breath samples for testing. Her Alco-Test results indicated a back of 0.22% which was almost triple the legal limit of 0.08%. After the officers were finished with their paperwork, Ashley eventually released to a friend. He signed the potential shared liability warning form on Ashley's behalf. She was issued the following summonses: operating under the influence, reckless driving, careless driving, use of handheld wireless telephones, traffic on marked lanes, improper turn, and open container of alcohol or unsealed cannabis in motor vehicle. >> Okay, that's fine. >> Thank you. >> [snorts] >> All right. So, one more time, just face the other side for me. You can step out. >> Yeah. >> All right. So, wait right here. Right over here. All right. You can follow my partner over here through this door. >> All right. >> Watch your back in here, okay? Step up to the left up these stairs. All right. We're going to make a right in this door right here. Do you mind if we even got her for a second so she's going to start tripping? You can stand right here. So, we're just going to have another female come in to search you real quick and okay and then we'll get the process going. >> I'm very sorry that I have to make you guys do this. I really am. I'm sorry. >> It is what it is, you know. You're not the first, you won't be the last. Everyone makes mistakes. Yeah. Did you let your boyfriend know you're going to be a little late? >> Uh I don't know. >> Court records indicate that on June 13th, 2024, Ashley was found guilty of operating under the influence and the careless driving citation was downgraded to obstructing traffic. As a result of being found guilty, Ashley's had to use an ignition interlock device for 3 months, spend 12 hours at an intoxicated driver resource center, and pay a total of $880 in fines. The other five citations were dismissed as part of a plea agreement. >> My phone is wherever it is. I have no clue. Honestly, but I feel very bad though. This is not me. I feel very bad. >> No, I I believe you. But unfortunately, it is what it is right now, so. We'll get you out of here as soon as possible. >> [snorts]
