It had been heading east on Bloomfield Avenue, and its driver was using a wireless device. Seubert turned around and followed the car south on Lakeside. When he saw it drift out of its lane, he switched on his lights near Cunningham Drive and pulled it over. The driver, 29-year-old Ashley, heard Seubert say she had been using her phone and swerving. She told him her boyfriend was sick and she was going to the Caldwell Diner, though she was driving in the opposite direction. Asked where her boyfriend lived, she first said the Verona Tavern, then corrected herself to the Verona Inn, a bar. Ashley said she had one shot there before driving, but later told Seubert she had two. He asked for her license and registration. Officer Clark arrived to assist while Seubert returned to his patrol car. The officers suspected Ashley had been drinking. After Lieutenant Scheper arrived, they asked her to get out and take field sobriety tests. During the Horizontal Gaze Nystagmus test, Seubert saw her eyes jerk and fail to track smoothly. The jerking began at maximum deviation and before 45 degrees. Next came the Walk and Turn. Ashley failed to touch heel to toe, took too few steps, and did not turn correctly. During the One Leg Stand, she struggled to keep her balance and raise her foot as instructed. Seubert arrested Ashley for DWI based on her erratic driving, the smell of alcohol, her admission that she had been drinking, and her failed tests. Her car was impounded for 12 hours under John’s Law, and officers took her to the Verona Police Department for processing. At the station, Ashley read the standard statement for drivers and agreed to provide breath samples. The Breathalyzer showed a blood alcohol concentration of 0.22%, nearly three times the legal limit of 0.08%. After the paperwork was complete, she was released to a friend, who signed a form warning of possible liability. Ashley received several tickets, including DUI, reckless driving, careless driving, using a hand-held phone, an improper lane change, an illegal turn, and having an open container of alcohol or cannabis in the car. Court records show Ashley was found guilty of DUI on June 13, 2024. The careless driving charge was changed to obstructing traffic. She had to use an ignition interlock for three months, spend 12 hours at a driving resource center, and pay $880 in fines. The other five tickets were dropped as part of a plea deal.
