I turn on there. Hold it. >> All right, Rachel. So, how this is going to work is you're going to put this in your mouth like a straw and you're going to blow until I say stop. Okay. >> Blow. >> Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Keep going. Keep going. More. Awesome. Okay, you're at a 320. >> Okay. How much have you had to drink? >> On August 5th, 2023, approximately 9:03 p.m., officers Matthew Tommy and P. Jordina with the Highland Park Police Department responded to an accident call near the Mutual Ace Hardware store parking lot. The officers made contact with the caller who told the officers that he was driving his 2019 BMW westbound on Skoi Valley Road and a 2016 Mercedes swerved into the passenger side of his vehicle as he approached the intersection with Halfday Road. After the accident, the driver of the Mercedes fled the scene while the driver of the BMW followed her. As he was following her, he noticed the Mercedes skid into a ditch. After speaking with the caller, the officer Tommy approached the Mercedes which was in a ditch nearby. He made contact with the driver, later identified as Rachel Leashinski, and instructed her to exit the vehicle. >> 32. That's the Need to get out, Are you hurt? >> No, absolutely not. fire. >> Have you been drinking tonight? >> No. Um, not yet. >> Not yet. >> No. >> Are you sure I was smelling an order of alcohol? Do you have any alcohol in the car? Maybe. >> No. Where you coming from? was going to Libertyville to to pull up some I'm trying to call my parents and then I >> Why don't you stay right here for me? Okay. >> Okay. issue first. Can you tell me what happened? >> She's trying to get a bad night. And um >> what road were you driving on? >> So you're going 41 north. Where'd you turn around? 60. >> Turn on 60. Mhm. >> Okay. And you're start heading back south this way. >> When did we hit this car here? Where did they hit you? What happened? I just wanted to go home. >> Okay. >> And here I am. Um, I really want to tell my parents and just >> All right, ma'am. Do you see that curb right there? I'm going to have you go take a seat at it. Okay, >> sure. >> Just don't move for me. All right. Right there. >> Yep. A little further to the left. >> And just don't go anywhere. Right. All right. We have to sit right there. Hey, Tony. >> Hey, Tommy. >> Yeah. >> Let's have uh whoever this is pulling up. Let's have get all their information. Then we're going to take care of over here. >> What's your name? >> Rachel. >> Rachel, nice to meet you, Rachel. Do you live here in town? Rachel began to smoke a cigarette as she exited the vehicle and officer Tommy also detected the odor of alcohol. When Rachel was asked where she was coming from, she told the officers that she was coming from Libertyville where she had been trying to go on a date. Officer Tommy noticed that Rachel's eyes were glassy and bloodshot and she was slaring her speech. So he asked her how much she had been drinking. Rachel initially denied consuming alcohol based on his suspicion of impairment. Officer Tommy offered Rachel an opportunity to participate in field sobriety exercises. >> Sorry, I'm shaking and like freaking out like I cannot even believe. Mhm. Are you sure you're not injured? >> Yes. And I just want to like get >> All right. All right. So, we're just going to figure things out with the crash and then we'll see how we can get you home or get you a ride or just going on a date and like that didn't work out. And >> you just got you just caught you just had the date. Didn't go good. >> It didn't happen. No. What happened? >> He didn't want to go on the date. >> So, just start asking her name um basic questions. She wasn't sure what time. I said, "Where do you live?" She was like figure out what like just like you said, she was she wouldn't tell you at the store. >> Yeah. She wasn't really coming from um how much how much you drink. >> I can smell alcohol real kind of smell. >> All right. So, I'm home. I know you didn't get a chance to introduce myself. >> What's your last name? >> How do I spell that? L E S H C H I N S P Y. >> So I have L E S. Look at what happened from that car from that perspective. Can you tell me from your perspective what happened? >> I know we going nowhere. >> I just wanted to go home. I'm like >> where in Libertyville? >> Um I don't even know. I got lost in Libertyville. I'm trying to go out of the state and then um I don't know I got like lost and lost. Yeah. >> And then did >> you stop any restaurants in Libertyville? I know there's a whole street down that way. >> No. >> Okay. >> We didn't stop anywhere cuz I wanted to stop and I couldn't even get to where I wanted to stop. So, um Rachel, how much we had to drink? How long you been in ADA for? >> 3 years. >> 3 years. >> Uh >> July 1st. >> July 1st of this year or July 1st. 3 years ago. >> July 1st this year. >> Okay. This year. This year. Okay. >> You take any medication or anything like that? Do you you smoke or anything? What's that? Well, I smoke, but like I don't I've not had anything. I'm just Oh my god. He's like, I cannot believe. Yeah. So, what I got told is that you got to park right on the road. How did we end up over here? >> No idea. idea. You don't know how you end up in the ditch. >> Well, yeah. I was trying to get out and then I >> Okay. Oh my god. I hit a car on the way here. >> Yeah. >> Do you not remember hitting that car? >> Well, of course I remember. >> Okay. >> When you said you smoke, is it just cigarettes or do you smoke weed? >> Cigarettes. Cigarettes. >> All right, Rachel, hang tight and talk to my sergeant real quick. I got to get in touch with my parents. Is that okay? >> You need to what? >> I need to get in touch with my parents. >> Okay. Okay. Okay. Rachel, I just heard that there was a Chevy, a blue Chevy that tried to like check on you, might have been following you. Were they with you at all? >> I don't know. They didn't swing around and try to talk to you while you're in the ditch. See if you're okay? >> You the first person you saw? >> Yes. >> Okay. >> Hi. All right. So, Rachel, I know you said you weren't drinking, but we're going to do some field test if you're willing, just to confirm that. Just make sure you're safe to drive once we get the car out. >> Is this what you're going to do for me? >> All right. So, we're going to stand up right this way. You're going to come up >> in front of the squad car. The first exercise was the horizontal gaze nestagmus HGN test and officer Tommy observed a lack of smooth pursuit, distinct and sustained nestagmas at maximum deviation and the onset of nestagmas prior to 45°. The second exercise was the walk and turn test. During the walk and turn test, Rachel made attempts but she failed to maintain her balance or walk heel to toe. So this test was discontinued for her safety. The final exercise was the one leg stand test. During the one leg stand test, Rachel failed to raise her foot in the proper fashion and began to fall to the left after about 5 seconds. This test was also discontinued based on safety concerns. >> If you want you could set your phone down right here. >> I'm very late. Did you hit your head when you crashed? >> I don't know. I I'm just >> stand right here. >> So, you're going to fall for the first test. We'll be checking your eyes. All right. Do you have any eye conditions? Recent injuries or wearing contacts? No. So, what you're going to be doing is I'm moving my finger around and you're going to be following it with your eyes. All right. You're not going to move your head at all. Just your eyes. Any questions at all? >> I'm very like shaky about the accident. So, like I'm just I'm just >> Okay, that's it. >> All right. So, you're going to follow just my finger, right? Remember, don't move your head. >> All right, we do that again. All right. Mhm. All right. Any questions so far? Feeling okay? Mhm. >> All right. Remember, don't move your head. Just follow the finger. Mind pulling her We're going to be doing some walking. Do you have any h injuries. Any leg injuries, injuries? You think that prevents you from walking normally? >> I had two back surgeries. >> Two back surgeries. Do you think it's going to stop you just from walking nine steps there next to the back? >> No. >> All right. So, you're going to face that way for me. You're going to get a position with your right foot in front of your left, heel to toe touching. >> Right foot in front on the left foot. We're not walking yet. >> So, yeah, you're in this position. You're going to hold it until you tell you to start. So, left foot planted, right foot up like that. Peel the toe. You see how I am? >> Can you get in that position for me? >> Yep. You got your left foot down. Do you have any other shoes or >> No, you want to do it barefoot? >> That might be better. >> Yeah, whatever. >> You got the shoes on the side. >> Just saying >> just like me. Left foot right foot. Left foot the brakes. It looks like we're having trouble. >> We try the one leg stand. We'll try that. >> All right. So, >> we're going to try a different one. Okay. Just cuz this one seems a little bit difficult. >> Okay. >> So, we're going to skip that. >> I'm like I'm not getting in. Like my whole body is shaking and I don't know what to do. >> You want the fire department to come? Can you do that? >> I'm just like really like shaky and I don't know what to do. Um, >> all right. So, we're going to stop. We're not worried about the walking right now. I just want you to face me. >> Put your legs together and your hands at your side just like this. >> All right. So, for this next one, we're going to be standing on one foot. I know we already talked about your back injuries. Any other injuries that might inhibit you from standing on one foot? >> No. All right. So, hold that position while I go through the instructions. You're going to lift one foot out in front of you. To your left, your right, that's up to you. You're going to hold it until I tell you to stop. While you're holding, you're going to count out loud in thousands. 1 1,000 2,000 so on until I say stop. You okay? All right. So, I'm going to demonstrate it for you. While you're doing it, you are going to stare down at your foot. So, do you want to watch me do it? So, I'm going to stand just like this. 1 1 100,00 2 100 3 100 4 100 5 100 Just like that. Keep my foot parallel to the ground. You think you're going to be able to try that? All right. So, when I say start, you're going to do that for me. All right. Make sure you keep your hands at your side with one foot off the ground about 6 in staring down your foot. Do you have any questions? All right. Ready? And don't forget to count my thousands. All right. And start. >> Okay. >> Okay. We're going to stop that one. >> All right. >> Rachel, I know you said you've not been drinking. Are you willing to use a portal breath test? >> All right. So, I turn on there. Hold it. Following the field sobriety exercises, officer Tommy offered Rachel an opportunity to take a preliminary breath test PBT. The results of the PBT indicated that Rachel's BAC was at 0.32%. Which is for times the legal limit of 0.08%. Based on the indicators of impairment they observed. All right, Rachel. So, how this is going to work is you're going to put this in your mouth like a straw and you're going to blow until I say stop. Okay? >> Blow. >> Blow. Blow. Blow. Blow. Blow. Keep going. Keep going. >> More. Awesome. Okay. You're at a 320. Okay. How much have you had to drink? >> 32. That's the right custody. Rachel's 's inability to perform the field sobriety exercises and the results of the PBT. Officer Tommy placed Rachel under arrest for driving under the influence. After she was handcuffed, Rachel was placed in the patrol car. A search of her vehicle yielded three cartons of Verden Pino Grigio wine in the back. Perfect. Hands behind your back. >> All right, Rachel. I'm going to lock these so they don't get unexpectedly spied on you. >> Can I call my I need to call my parents. >> Yeah, we're going to make sure you get uh phone calls. Okay. Yeah, for sure. >> Like I have to call them. >> Mhm. >> But they weren't answering, right? No. >> We'll try to call them ourselves, too. >> Yes, sir. >> Yeah, please. >> 911. Yeah, >> you go >> 3441 at 1393 road cross street and valley road 1393 road >> Rachel we are going to have the fire department come and talk to you just because of how intoxicated we are. Okay. >> So before that, are we going to call for another unit to search or uh yeah, >> we're going to sit you down in our vehicle, right? >> Hang on one second. We're just going to bring uh we're just going to bring our car around. So just have them >> Yeah. Just have them Nope, not right now. Right over here. Okay. Right here. Right here. Don't want you to fall anywhere. We'll definitely get a chance for that to call. Okay, let's step over in the water. So your parents and all are their phone numbers in your phone. >> Let's go over here. Walk back that car right there. Okay. Turn around. Walk right this way for me. >> Hey Rob, did you have them pull off? >> Yeah, we can set her center set here for now. My cigarettes need cigarettes. >> So, we can't have you smoke while you're in custody. Just a second. other side or just we're sitting while we're waiting for the search. >> Uh well, yeah, we put her on the >> Yeah, we're going to switch. Fine. Rachel, we're going to switch right down this way for me. Other side. Let me just here wait at this point. FD's here for them to chat with you. They're going to come up here. Come to the station and come to station you >> uh I'm going to let them go. I got everything from them statements. >> Uh they're all good. Everything's good with insurance tomorrow. >> Did they happen to do a witness statement too also? >> Yeah, I got two witness statements from them. >> Okay, beautiful. Thank you. >> And uh I have one. >> Yep. I got everything uh contact information from everybody in the car before. I do know there's four people, >> but uh I'm gonna let them be on with their night. >> Perfect. Okay. Um you guys will ride with the ambulance. We'll get your car to you. >> Okay. >> And then uh we'll take care of the inventory once it's pulled out of church. >> And you guys have a warning to motorist? >> We do. You guys need anything else? >> No. You have a delay packet? I have a full packet. Got you. Yeah, he's been retired for >> How's he doing? Good. All right. >> Uh, yeah. I'm going to run that 93 275. write her uh case number down somewhere if you can. The officers initially transported Rachel to the Highland Park Hospital for further evaluation. At the hospital, she told hospital staff that she had drank approximately two jugs of wine. After the warning to motorist form was read to her, Rachel agreed to provide blood and urine samples for testing. >> You want that? >> You want that done? >> Yeah. I don't know. I grew bull mastiffs. 93 >> 1095 station female mileage when ready >> 35924.6 6 35924.6 >> is open. for your waterfall. >> I'm kind of cold, but I'm okay. I'm just worried about my dress. After she was released from the hospital, the officers transported her to the Highland Park Police Department for further processing. Once they were at police HQ, Rachel was advised of her constitutional rights and she agreed to wave them and answer questions. During questioning, Rachel admitted to consuming wine before the accident. After questioning, Rachel was photographed and fingerprinted. Once they finished processing her, she was released to another adult on a recognizance bond pending her court appearance. >> I'll get your bag here in a second, too. >> They're kind of tight. I don't know if this one is really tight. Yeah, >> I can adjust that for you. >> Thanks. Just kind of hurt. >> I don't know. Supposed to hurt you. >> No, it's not supposed to hurt at all. Okay. >> Sorry about that. >> Maybe it should. That's enough for us to decide. Put your hands up. I'm going to have you turn around for me. Sorry. All right. So, I'm going to have you take a seat right here. >> And are you a righty or a lefty? A >> righty. I'm going to uncuff your left your right hand for me. Awesome. >> Take a seat. I'm like, "Mom, all these kids are going to like kill somebody if they touch me." So like they're like you know that I'm here for the long haul but not 21 years. >> Hey Serge. >> Hello. >> Hey. Do you guys need a B? >> Um no. Uh is there anybody that could help in booking though for just with the booking process. >> Absolutely. >> Okay. A >> how do you spell it? >> A Y L A >> I love that. I love that. Beautiful. >> You have Lana and I get really upset cuz people want to call her Elena or Lana like Lana wearing. >> She thinks you look like you're in your 20s. >> If I shave, I look like I'm high school. When we attended police academy, we had to be clean shaving and your hair was really short and it was not a good time for me. >> No. >> No. I'm an old man. So, this is removed. >> Yes. Oh, Rachel, something uh very important is the insurance that we uh got in the car was expired. Does anybody access it on your phone >> or updated? >> Progressive. Oh, no. >> When uh when he comes back, he's going to jot that down. Okay. Leave that up. That's your insurance number. >> All right. Give me that deal. >> Yeah. Meet up three for one minute. My first line. All right, Rachel, I'm going to read you something called a Miranda warning. Um, you are going to initial as we go through, if any point you have any questions, I want you to ask. Okay. >> Okay. >> So, here and here for you. So, after each part of the following warning, determine whether the suspect understands what he or she's being told. So, I'm just going to ask for a verbal confirmation. All right. Uh, you have the right to remain silent. Makes sense. >> Anything you say can and will be used as evidence against evidence evidence against you in court. You have the right to consult with a lawyer and have a lawyer present with you while you are being questioned. If you want a lawyer but are unable to pay for one, a lawyer will be appointed to represent you free of any cost to you. You may stop talking to me at any point or sorry at any time and you may also demand a lawyer at any time. >> Okay. Do you understand these rights? >> Perfect. Knowing these rights, do you want to talk to me without having a lawyer present? >> 100% your Okay. If yes, in waving your right to remain silent, can you state that no promise or threats have been made to you and no persuasion or coercion was used against you? All right. I'm just going to have you sign, date, then put your name underneath this. And it's currently 2:30 a.m. The fifth. >> Uh, the sixth. No. You want to be gentlemen? If I just leave you this page. Sure. All right. Rachel, I just need to go through a few questions with you just so I can find out more about what happened. All right. Can you tell me what happened? Cuz I got the other vehicle story. Can you tell me from your perspective what happened? >> I was just driving and then I hit that car and I went into the ditch. >> Okay. Do you know how you hit the car? Like where were you driving? Driving southbound on 41. >> Yeah. Um, >> I was going to dinner and I couldn't find where I was going. And then >> you said Libertyville, right? >> Yeah. But I couldn't like find a restaurant. And then, um, I turned around >> and came back and got up at like half day instead of central. Um, >> when you get off on half day, did you take the exit ramp or did you just try to take a right turn after the exit ramp? >> I took the exit ramp. >> You took the exit ramp. Okay. >> Um, when you hit the other vehicle, did you stop and have a conversation? Hey, let's meet over here. Anything like that? I ended up in the >> ditch. So, you just continued on. Okay. You were wearing your seatelt during that, right? Mhm. >> Okay. >> You know, I've gone lost in liberty a few times trying to find all those restaurants. I don't even know where I was. It was just in a driveway and it was a city. >> Definitely understand that. Anything else that you think I should know about the accident? All right. So, I just want to make sure I have all my facts straight just from your perspective. Driving southbound on 41. You meant to get off on Sun, but you just got up a couple stops too early. You took the exit ramp to the far right. Um, the other vehicle. Do you remember what the other vehicle looked like? >> He was black. >> I remember. >> Okay. Do you know where you hit him? I just like kind of brushed them in the back. Okay. >> I mean, my car is not a mess. >> I think I I might have sideswiped them. I don't know. Um I don't know. I was just wanting to get off the road. >> Yeah. >> I'm frustrated. >> Yeah. And then you pulled into the Ace Hardware. How'd you end up in the ditch? >> I was driving fast. Just wanted to Well, >> get home. >> Not fast. I was just driving recklessly and driving drunk, right? Doesn't know what it is. So, and I ended up in the ditch. So, that's another explanation. >> Except I just want to make sure I got the full story from everybody just that way, you know, everyone gets their time to say, Here's the standard. Yeah. Yeah. A12. >> Uh, yes. A2. >> Sorry, Rachel. It's me again. Just got a few more questions we got to go through. Um, I know I just told you the time, but do you know what time it is now? >> You said 2:30ish. >> 2:30ish. Yeah. Um, you know what the day is? >> The 6th. >> The 6. Perfect. What day of the week is it now? >> Sunday morning. >> Sunday morning. And I know some of these seem a little silly. Uh, do you know what city you're in? >> Park. >> Hound Park. Yep. >> I hope. >> No, we're still in H Park. Don't worry. Uh, when did you last eat? >> Um, I ate at like 1:30. >> 1:30? Yeah, cuz you were going to dinner. That's right. Um, have you seen a doctor or a dentist lately? >> No. Are you diabetic? No. >> Perfect. So, that means you don't take any insulin. Um, other than the effects of the drinking, are you feeling ill at all? That's good. At least, right? >> Um, no physical defects you haven't been injured lately, right? answer that. I just want to show you started your apartment, got dressed, got ready for the day, drove to Libertyville, we're driving back, right? Yeah. >> Okay. Um, about what time do you think you started head back heading back on Liberty, though? here >> like 7:15 >> 7:15 >> supposed to be 7:15 >> 7:30 somewhere in that range >> and I know you told us on the side already you've been drinking can you just confirm that again for me if you had to estimate how much you're drinking >> drink a bottle of wine >> bottle of wine >> 11601A Not more than >> two, like less than two bottles of wine. >> Bottle and a half. Okay. >> It's those curtains that are like >> it's a bottle and I don't know what they are. So they sell in the wateries >> like jugs. >> No, it's like a coconut water almost. It's like >> Oh, it's like a bigger box. >> It's like a little But it's like Yeah, it's like a carton. I don't know. >> Like the frenzia box is that sort of thing. Yeah, but not the whole box. Like it was just like the little Yeah. >> So whatever that is. >> Were you drinking at home or on the way there? >> At home. >> About what time did you start drinking? >> Uh improver. >> Four. >> Did you take any medication today? What time did you stop drinking? Do you think >> before I got in the car? So 6:45. >> 6:45. >> Uh, is there a way to >> Can you delete those yet or no? or it doesn't let you if you try. >> You can do whatever. >> Um after you save it. >> Just confirming you know you were under the influence now, right? >> I deleted. >> Perfect. And you know you were involved in accident, right? >> Um >> and you've done anything since the accident to uh obedience to require. Perfect. So, while we were inventorying the vehicle as part of our like process to tow, >> um, we did find some bottles in the car. >> I'm sorry. >> Are those from today? >> Yesterday. >> So, one was half empty. >> You just brought it with you? >> Yep. >> Okay. So, you didn't drink in the car at any time? >> No, I brought it with me for after >> after dinner. Okay, gotcha. We just got to make sure. >> And the other one was when I drank earl. >> Okay. Where' you have in the car? So I know for their porch just in case they got jumbled around during the accident. >> Um the back seat. >> The back seat. >> Yeah. >> Not the trunk though. I know my the back seat. >> Okay. >> Perfect. >> Anything else in the vehicle that you're worried about? >> No. >> We did have some of your personal documents. We put them in a folder in a bag for you. Like some birth certificates, things like that. >> We got to go through everything. So we'll put it in a special bag so it won't get lost. >> The military. >> Yeah. There's like >> just didn't think it was gonna get lost or anything controlled uh device. >> Perfect. Of course. >> Okay. You're right. You won't let me. >> So, how it works is once we let you go, um you have to wait 12 hours if you're going to be the one driving just to make sure you are. So, we're something else is picking it up. Um you're able to go to the place where we had it towed to, which we'll give the information when we're done with here. >> Maybe you just put the 305 on the >> I can tell. I wonder what we can do.
