The caller said he was driving his 2019 BMW west on Skokie Valley Road when a 2016 Mercedes suddenly swerved into the passenger side of his car near Half Day Road. After the crash, the Mercedes driver tried to leave. The BMW driver followed her and watched as the car skidded off the road into a ditch. Officer Tolmie spoke with the caller, then went to the Mercedes and asked its driver, Rachel Leshchinsky, to get out. Rachel stepped out and lit a cigarette. Officer Tolmie smelled a strong odor of alcohol. When he asked where she had been, she said she was coming from Libertyville and was trying to go on a date. Her eyes looked glassy and bloodshot, and her speech was slurred. Asked how much she had drunk, Rachel first said she had not had any alcohol. Officer Tolmie suspected she might be impaired and asked her to take field sobriety tests. During the Horizontal Gaze Nystagmus test, Rachel’s eyes did not track smoothly. Officer Tolmie saw clear nystagmus at the farthest point of her gaze, and it began before her eyes reached a 45-degree angle. Rachel then tried the Walk and Turn test twice but could not keep her balance or walk heel-to-toe. Officer Tolmie stopped the test for her safety. During the One Leg Stand, she had trouble lifting her foot and began leaning to the left after about five seconds. He stopped that test as well. Officer Tolmie then asked Rachel to take a Preliminary Breath Test. It showed a blood alcohol concentration of 0.32%, four times the legal limit of 0.08%. Based on her signs of impairment, her difficulty with the tests, and the breath test result, he arrested her for driving under the influence. Officers handcuffed Rachel and placed her in the patrol car. A search of her Mercedes turned up three cartons of Verdange Pinot Grigio wine in the back. The officers first took Rachel to Highland Park Hospital for an evaluation. She told hospital staff she had consumed about two jugs of wine. After staff explained the Warning to Motorist form, Rachel agreed to give blood and urine samples. When the hospital released her, officers drove her to the Highland Park Police Department for further processing. At the station, they advised her of her rights. She waived them and agreed to answer questions, then admitted she had drunk wine before the crash. After questioning, officers photographed Rachel and recorded her fingerprints. Once processing was complete, she was released to another adult on a Recognizance Bond while awaiting her court date. Officer Tolmie charged her with driving under the influence, illegally transporting alcohol, ignoring a traffic sign, driving with a revoked registration, leaving the scene of an accident with damage, and failing to slow down to prevent a crash.
