Around 1:00 a.m. on August 20th, 2025, patrolman Matthew Gmbiski with the Mammoth Beach Police Department observed a northbound 2009 Honda Accord swerving and driving with high beams in the area of Ocean Avenue and Valentine Street. He began following the vehicle and he observed the driver continue to swerve and drive under the speed limit. Patrolman Goiski eventually activated his emergency lights to initiate a traffic stop and the driver pulled over in the vicinity of Ocean Avenue and Serest Road. He exited his patrol car and made contact with the driver who was identified as Christine Barbara. >> Wrong window. >> Sorry. >> That's right. Um I'm actually an Uber driver. Hi. Sorry. >> Hi. I'm officer going to be asking at Mont Beach Police. She's going to buy cameras on record this stop. No problem. >> Have your license insurance? >> Of course. So um I'm actually an Uber driver. [laughter] >> Okay. >> And um so I was about to like pick up passengers I guess. Um but I could definitely show you that. >> Okay. >> Sorry. Um I could definitely give that to you. How are you? What? I'm sorry. What was I doing wrong? Can I have your license registration insurance, please? >> Um, I guess. Yeah. What What was I doing? >> What were you doing? Well, you were high beaming people. Number one. >> I'm sorry. >> You were high beaming people and then you were also swerving. You kept crossing over the shoulder line. >> I see. I'm really sorry. I just um So, I um I'm an Uber driver, so I was going to like pick up people in the area. >> Gotcha. Can I just have your license? >> Of course. Yeah. I'm really sorry. >> Okay. >> Um let me just grab my bag. Sorry, I'm just nervous cuz uh >> as you know when you're being like pulled over. >> Gotcha. >> Um let me just grab my bag. Sorry about that. >> Okay. >> Thank you for being nice. Um >> where are we headed to tonight? >> Um so I was going to pick up like Uber passengers in the area. Okay. >> Um I'm from Hlet, but I um on a Tuesday pick up people like in this area. >> Gotcha. Um, but yeah, my parents always say too to show that I uh I love the cops. And >> where are you coming from right now? >> Um, just like Pure Village where I was picking people up. >> You were picking people up in Pure Village. >> Mhm. >> And you were going to pick up more people. >> Uh, yes, exactly. But my parents always say to show they're like, "Oh, yeah, your grandpa was like um a cop so to show you." >> Okay. And where uh where are the people you picked up then? um in like in the Pure Village area. >> Okay. >> Um so thank you for Yeah. Um Oh, this my license. >> So if you're doing Uber, >> I can hit a ticket. I could That would be amazing. >> If you're doing Uber, why isn't your Uber app open? >> Um I can show you like the Uber app. >> Well, were you going to pick up people up right now? >> Um yep. Just in this area. >> So that means you would have been accepted a ride, right? >> Um so I was in Uber like in uh in Long Branch. Okay. >> And um so I was leaving from like my friend's apartment there and I like pick up people kind of late at night in in New Jersey. >> Okay. So you weren't in Pure Village. You're at your friend's apartment. >> Um no, I just I pick up people from like Pure Village. >> Gotcha. Do you have registration insurance? >> Of course. Yeah. Thank you. Um but yeah, a lot of my um my parents will be like, "Oh, yeah, show them you're from like this area." >> Okay. >> Um >> any registration insurance for >> N. Thank you for being so nice. Okay. >> Definitely can. Yeah. >> All right. Hang tight. >> Yeah. I don't know, man. I think she's messed up on something. I I don't I don't think it's uh I don't think it's alcohol, but she was like all over the road. Um I mean I mean I'm going to check her license to see if maybe there's like a mental thing going on, but I don't think so. like she's very giddy when she her motions I don't know if you're watching very slow >> she's she's like this very slow all over >> forgot forgot the registration forgot the insurance and then she's like very like laughing did you hear her like laughing constantly >> like very like and then I I knocked on the window like four times >> like I walked up on the passenger side I thought she saw me knocked on the window she's looking to the left knocked on the window again she's still looking to to her left, knocked on the window again. I think the third or fourth time I knocked on the window, she finally was like, >> "Where'd she come from?" >> She said she was she said she's doing Uber. Like I didn't see an Uber app open. And she she just said that she was Ubering people in Long Branch, but she said she came from her friend's apartment and her eyes super dilated. Like super dilated. like even even when I hit him with the light, like they they didn't constrict much at all. So, I'm I'm thinking it's some type of I don't know. I don't want to make any assumptions, but like my first reaction with her constantly like laughing was like a hallucinagen or something, but I don't I don't think I mean it could be weed. I don't know. I think it's something. I don't I don't know what it is exactly, but very weird. Unless, like I said, unless she's like flagged in here as like a >> Where she from? >> Has Okay. They're on She's not marked as anything like with mental health or anything like that. >> No calls for mental health or anything like that? >> No, just a couple stops. I don't know, man. That's really weird. And her driving behavior was so whack. It was like all over the place. She was only going 30 miles an hour, high beaming everybody to come at her. And then she pulled over and I don't know, she shut her car off, I guess. No idea. >> Yeah, sometimes people do that. He knocked on the passenger side window and the driver initially opened the wrong window. Christine initially had trouble locating all her documents and she told the officer that she was an Uber driver who had been picking up people in the area of Pier Village in Long Branch. She later told the officer that she was coming from Rooney's Oceanfront restaurant in Long Branch where she had gotten dinner with friends. She initially denied consuming any alcohol, but she would later admit to patrolman Peter Farmer at the station that she had a cocktail at the bar. Patrolman Deliski then returned to his patrol car to check her license. Based on his suspicion of impairment, Christine was eventually asked to exit the vehicle and perform field sobriety exercises. >> Hey, miss. >> Hello. >> Hi. So, um, listen, just because your driving behavior is a little concerning, I just want to make sure you're okay to drive. >> I am. >> Okay. Would you mind stepping out to do a few tests for me? >> Of course. >> What's What's on your nose? >> Um, I don't know. It's like, >> so what I was just um I was meeting up with friends and I am about to like Uber drive. So I was like I don't I don't know. >> Okay. So what were you doing with your friends? >> Um we were just meeting up in Pure Village by the beach and I I am an Uber driver. I'm not trying to be >> Yeah, I know. You told me that a couple times now. >> Yeah. >> What um what's you have like stuff on your shirt and everything too. What is all that on your shirt? >> I'm sorry. >> Probably just stains from like eating shrimp at Rudy. >> Um nothing. Yeah. >> Gotcha. So, would you mind just stepping out real quick? I want to make sure you're good to drive, right? >> Of course. >> Great. Thank you. >> Of course. >> I was like, "All right, I'm definitely not drunk. I would just um >> Okay. >> Um I was about to So, and I was about to like meet people in Belar to pick up more Uber drive. >> So, were you go >> I was eating just like shrimp. [laughter] Gotcha. You can you can step over here, right? From you were eating shrimp from the bar. Which bar were you at? >> Um, just at Rooney, but just for dinner. I got not drunk. >> So So where were you? You were in Rooney's for the bar or were you at Rooney's picking up passengers? You told me to pick your passenger. You just You can step over here now, man. >> Okay. >> Just at Rooney. Sorry. Hello. >> Hi. >> Hi. >> Okay. >> Um, yeah. Just to clarify, I'm definitely not like a drunk driver and I don't My grandpa was like the NYPD. Like I respect cops. >> Okay. >> Um but no, I was just at Rooney, so getting like dinner there earlier tonight and got >> I know you're pointing out my shirt, but I was like, "Oh, I just >> Yeah, I mean you have you have like stuff all down. >> Yeah, cuz I like ate dinner. >> Okay. When did you eat dinner at 1:00 in the morning?" >> Um um at like 9. >> 9. So, what have you been doing since then? >> Um, just hanging out with like friends who live in that area. >> Okay, gotcha. So, for this first test is a test of your eyes. Do you have Do you wear contacts? >> No. >> Do you have Do you wear glasses? >> Definitely not drunk, but No. >> Do you wear glasses? >> No. >> Okay. So, this first test going to put Have you Can you put your feet together just like this? >> Yeah. I'm definitely not drunk driving. I know you guys are You're really nice and I know like you >> just put your feet together just like this >> touching just like me. >> Okay. Just put your feet touching. You're not touching. Perfect. And keep your hands down by your sides. >> Okay. >> Like this against your body. >> I'm really sorry. >> That's okay. I want you to just keep your hands against your body. Just like this. Keep your hands like there. >> Okay. >> Against your body. >> The first exercise was the horizontal gaze nice HGN test. During the HGN test, Browundi observed 66 indicators of impairment. The second exercise was the lack of convergence test. The third exercise was the walk and turn test. During the walk and turn test, Christine failed to touch heel to toe on each step, took an incorrect number of steps, and turned improperly. The fourth exercise was the one leg stand test. Christine failed to raise her foot in the proper fashion and put her foot down before the test was complete. The final exercise was the modified rumb balance test. Okay. >> I want you to stay in that position the entire time during this test. Okay. You understand? >> Got it. >> Okay. So, can you see the big red light right there? >> Yeah. >> Okay. And you have no other eye issues, right? >> I'm definitely not drunk, but yes. I Yeah. >> And you have no eye issues? >> No. No. No. >> Okay. So, you can see this big red light, right? >> Okay. >> What I want you to do is follow that big red light with just your eyes and your eyes only. Don't move your head. >> Do you understand? >> Got it? Yep. >> Okay. Try not to move your head. Track it evenly. Okay, >> got it. Try not to move your head. Keep your head straight with me. All right. >> Okay. >> Keep your head straight with me. All right. >> Got it. Keep looking up here at the pen, right? It's going to go up this time. Okay. >> Okay. >> Okay. Just continue to follow it. I'm going to come around your face a couple times like this. I'm going to come into the bridge in your nose. I'm going to stop for a second. I'm going to come right back out. Okay, you understand? >> Got it. >> Okay, track it. Okay, make sure you follow it on the way in. Right. >> Okay, hang tight. >> 33 27. Can I get one out for testing? >> Sorry, I'm um I'm not just saying this, but I'm not drunk driving. >> Okay. >> I'm an Uber driver and um I was going to go to BMAR to pick people up. My grandpa was like the deputy inspector of the NYPD and I would never drunk drive. Okay. Um, >> that's good. >> And I know I guess I Yeah, I'm really sorry. >> Okay. >> Yeah. Not to like and we love the cops. >> Well, that's good. >> I know. I'm not saying that to just like not get pulled over, but that is the truth. >> I thought I saw six. >> I did, too. All right, miss. Do you have any uh physical injuries or disabilities that prevent you from doing a walking test? >> No. >> No. Okay, great. So, for this next test, I'm going to start by putting you into star position. It's called the walk and turn test. What I want you to do is imagine a line on the ground in front of you. >> Put your left foot on the line just like this. >> Okay. >> Okay. Put your right foot touching heel to toe with your left just like this. >> Okay. >> You can do that now. Put your right foot in front of your left. >> Sorry. Okay. >> And keep your hands down by your sides. >> Really nervous. [laughter] >> I understand. So, just do me a favor. Just see how my feet are straight in line with each other. Heel toe. Put your feet together just like mine are >> like this. Okay. >> Just heel touching heel to toe for me. >> Okay. >> They're not there. Put them in line. >> I'm just really like I'm shaking. Not because of you, but because um >> No worries. Just put your right foot on your left. >> My grandpa like really loves the car. >> I got you. Just put your feet together just like this. >> Okay. >> Touching heel to toe. >> Okay. >> You're not there yet. And keep your hands down by your sides. Okay. Okay, I see you're having trouble maintaining that position. >> Not because of you, though. I'm just really nervous. >> I understand. Just make sure your feet are touching heel to toe like this, just like mine are. And keep your hands down by your sides. >> Okay. >> Hands down by your sides and stay in that position the entire time while I demonstrate and explain this test to you. Do you understand? >> You understand? Okay. >> And I I wasn't drunk driving. >> I know. Just try to stay in that position for me. Okay. >> I guess you can understand, sir. >> Miss, just try to stay in that position for me. Okay. Just like this. All right. Try to stay right there. So, when I tell you to start, I want you to take a series of nine heel totoe steps down that imaginary line in front of you. >> Okay? Once you reach nine, you're going to take a series of small steps to turn yourself around. >> Okay? >> You're going to take nine more heel to toe steps back down that same line. Okay? >> I'm going to demonstrate for you now. Okay? I'm going to do three. You'll do nine. >> All right? >> One, two, three. Keep the lead foot planted. Turn yourself around. >> One, two, three. Again, you're going to do nine. I did three for demonstration purposes. >> Thank you for being so nice. >> That's all right. So, make sure you count your steps out loud. Make sure you're looking down at your feet while you're walking. Make sure you don't stop the test until you fully complete the test. And make sure you keep your hands down by your sides the entire time. >> Do you have any questions for me? >> Uh, no. You've been so nice. >> Okay. So, >> I'm really sorry. >> It's okay. When you're ready, you >> have to stop tonight. >> That's right. When you're ready, you can begin. >> Okay. I'm just nervous. Okay. One, two, three. >> Look down at your feet. >> Four. Okay. Five. Six. I'm just shaking cuz I'm nervous. Seven. >> Eight. >> Uh, nine. >> Okay. >> 10. 11. Uh, how many more? >> You turn around once you reach nine. Okay. >> Okay. So, this way. >> Yep. And then nine more back down the line. >> Okay. One, two, three. >> Make sure to keep your hands down by your sides. >> Four. Okay. Five. Six. >> Look down at your feet. >> Seven. Eight. Nine. >> Okay. You can relax. You're not injured after that test, right? >> No. I'm sorry. No. No. >> Okay. >> Nervous. >> That's all right. You're allowed to be nervous. So, I was going to pick people up in um by Belmar. >> Okay. The next test I have for you is called the one leg stand test. Okay. >> Okay. >> So, >> I'm going to start putting the start position. I want you to put your feet together just like this. >> Okay. >> All the way together for me. Just like this. Right. Perfect. And keep your hands down by your sides. >> I want you to stay in that position while I demonstrate and explain this test to you. You understand? >> Okay. You understand? >> Got it. Y >> Okay, perfect. So, when I tell you to begin, I want you to raise one foot of your choice approximately 6 in off the ground. Okay? >> You're going to keep that foot level and parallel to the ground. Not like this. >> Got it? >> Not like this. Parallel. Okay. While you have your foot elevated, you're going to look down at your foot and you're going to count out loud in the following manner. 1,00 1,002 1,003 all the way until I tell you to stop. >> Okay? >> You understand? >> Got it. >> I'm going to demonstrate it for you now. Okay. >> Okay. So you can see my foot is off the ground. My knees are straight and not bent. I don't want you to bend. Keep your knees straight. >> Okay? >> Keep your foot level, not like this. Level with the ground about 6 in. >> Okay? >> And you're going to keep your hands down by your sides. >> Okay? >> While you're in this position, you're going to look at your foot and count out loud. 1,001 1,002 1,003 1,004 all the way until I tell you to stop. >> Okay? Now, if you happen to put your foot on the ground while you're doing this test, I want you to pick it right back up and count from where you left off. That'll look like this. >> Okay? >> 1,00 1,002 1,003 1,004. You're going to continue to count in that manner until I tell you to stop. >> Got it. Okay. >> Do you have any questions? >> Nope. No. >> Do you understand? >> Yes, I do. >> Okay. When you're ready, you can begin. >> Okay. 1,001. I'm sorry. >> Make sure you don't bend your Don't bend your knee. >> Okay. I'm like, "Oh, no." I'm like, naturally, great. I'm very I'm very clumsy. You seem really >> Just keep just keep going. All right. >> 100,00 Look down at your foot. >> 100,005. Sorry. >> All right, we'll we're going to stop. We're going to stop the test. Okay, we're going to stop. >> It's not you. >> I was going to go pick people up as like an Uber driver. You seem really nice. I'm not drunk. I don't know why he pulled me over. >> I don't know. >> I know. You seem really nice. >> I try to be. Yes, I'm nice. >> I'm not trying to like not get pulled over, be like an [ __ ] I just don't >> No, I don't think of that. No, no, not at all. Don't worry. >> Um I was going to go pick people up in like um Belar like as an Uber driver. >> All right, miss last test I have for you. Yeah. >> I think he believes me that I'm not drunk. >> I understand. So, last test I have for you is here. Can you stand in front of me? >> Perfect. So, I want you to stand your feet together just like this. >> A nice person, too. >> Thank you. Stand your feet together just like this. All the way together. >> Okay. >> Put them all the way together. >> Okay. >> Just like mine are. Perfect. Keep your hands down by your sides. I want you to stay in that position the entire time while I demonstrate and explain this test. Okay. >> You understand? >> Got Yep. Yeah. >> So, when I tell you to begin this test, >> I want you to tilt your head back. >> Okay. Okay, >> you're going to close your eyes and while you're in this position. >> Once you think 30 seconds has gone by, you're going to bring your head back down, open your eyes, and say the word stop. >> Okay, >> it's the whole test. I'm going to demonstrate I'm going to demonstrate. I'm going to demonstrate a short version for you now. Right. >> You're standing here. I'll say start. >> Okay, >> stop. >> And then what do I do? Lift up my >> You're not lifting anything. Did you see what I did? I tilted my head back. I closed my eyes. Once I believe 30 seconds has gone by, bring my head back down, open my eyes, said stop. >> Do you have any questions? >> No. You seem really cold. >> You understand the test? >> Yeah, I think so. >> Okay. When you're ready, you can begin. Tilt your head back. >> Okay. Okay. Keep your head tilted back. Are you done? >> Um, I think so. >> You're finished? How did you count? >> I was kind of nervous cuz you pulled me over. >> Okay. How'd you count? >> Does that make sense, sir? All right. >> He just asked the question. You got what? How did you count? Like how did you count? 1 10 1 10 1 100 1 2 1 100 Just like that. Okay, >> just like that. But my grandpa was an NYPD officer. I'm not drunk. I'm just nervous because he pulled me over. >> Based on her erratic driving, her lack of coherence, and her inability to satisfactory complete the field sobriety exercises, Christine was placed under arrest for DWI. At this time, Christine became uncooperative and began resisting, but she did not get charged with resisting arrest. After a brief struggle, Christine was eventually placed inside the patrol car. Her vehicle was impounded for a 12-hour hold according to John's law while patrolman Gilmbi transported Christine to the Mammoth Beach Police Department for further processing. >> And I've never been pulled over by the cops in like years, and I'm just scared. I'm really sorry. >> Okay. Okay. Okay. Calm down. Don't cry. >> It's all right. Don't worry about it. >> I'm not nervous because you seem really nice. >> It's okay. Can you maybe tell him I'm not drunk? >> I I can't make that determination. Put your hands behind your back. >> Stop resisting. Do you want to catch another charge? >> Don't want to catch another charge. So, if for some reason she blows under, it's probably because she's crossed. I definitely smell something. There's a phone. I guess it's her purse. >> Yeah. Be careful. Be careful. I think she threw up. >> I think that's what I think that that's what was on her front of her shirt. >> I think I cannot confirm that, but can only be so nice before you have to start trying to get him in the car. And uh yeah, I'm not just sharing that story to feel like a >> watch watch your step getting out. Get out now. >> Okay. >> All right. Just step out. >> Okay. >> Okay. >> Um >> at the station, the standard statement from motor vehicle operators was read to her, but she refused to submit breath samples. After they finished processing Christine, she was released to her father pending her court appearance. He signed the potential shared lady warning on Christine's behalf. I brought your phone and your wallet with you from your car. Okay. >> So you can call your parents. >> Okay. So these steps I guess I'm confess or >> you are under arrest. Yes. For DWI. >> But I'm not um drunk. >> Okay. Let's go. We're going in here. >> That's all for the court to decide. Okay. >> Got it. >> All right. You can come in here and step to your left. >> Okay. >> Step to your left over here. >> Yeah. Sorry, I wasn't trying to be like a jerk to you. >> That's okay. >> Okay. >> Thank you. >> No problem. Um I did not charge resisting cuz when I when I >> when I told her um if she continued to pull away from us, she actually when I put the handcuffs on her, she pulled her arm out of it. >> Yeah. So, um she knows her case. She's an adult. She could discuss it with you. Um >> she we like a police name here. Gotcha. >> Father was a deputy inspector in Manhattan. >> Yeah, she mentioned that after she was under arrest. >> Gotcha. Well, we tried I tried to be as cooperative as possible, but when she started to resist, then we had to put her in the car. >> Freaked out. >> Okay. Yeah. >> Sorry. >> Okay. No, it's all right. She's been very cooperative, very nice the whole entire time, though. >> So, outside of the little bit of resisting, but >> yeah, that's she's got some emotional problems. >> Okay. I didn't know where this place was. >> Yeah, we're a small police department. We're only 12 officers. >> Yeah, I know. I just >> You could have your license back. So, um, this form, I don't have to read it to you verbatim, um, but basically this entire form is saying that you're going to take responsibility for her until she's sobered up. So, it's going to ensure she's not going to operate her vehicle. And then if she does and she causes any death, serious battle injury, or crashes, the liability will be on you, not the police department. That's what this form is saying. It's basically saying you're going to make sure she's not going to drive until she's completely sobered up. Okay. Um, I'll let her discuss the case with you. She she did refuse the breath test. So I can't tell you a BAC reading. >> Yeah. I don't know. >> But um >> so you could just sign there if you agree to take custody of her and you understand that you're taking liability off the police department on to you. I do. >> Okay. Great. I will bring her out to you in a second. Right. >> Hey, where's the car? >> The car is in Hennessy's towing. It's in Atlantic High. >> Yeah. It has to be held for a mandatory 12-hour hold. It's a law called John's law in New Jersey. So whenever we arrest a driver for DWI, the vehicle has a mandatory 12-hour hold. That's one. >> Okay. So, um, from from 1:00 in the morning. So, >> I'm not in a hurry. >> Do you want a copy of this for you? >> Uh, I'm not gonna >> Okay. >> I understand. >> Do you want a copy or no? I can give. Okay. >> Well, yeah, maybe. >> I'll I'll make a copy and I'll write down the tow information on the back. Right. Figure it out. Can I get in here quickly. I just I just got to write Hennessy's tow information on the back for him so he knows so he knows who the car is. That is your dad. Okay. [laughter] [laughter] This is not true. What happened? trying to disrespect. I wish you [laughter] >> Okay, Christine, you're free to go. Okay, I'll walk you out front. Patroliski issued Christine the following traffic tickets.
