The vehicle then struck a sign on the double yellow line and drove westbound through empty parking spaces on Main Street. After the driver passed his patrol car, Sergeant Marlor made a Uturn and activated his emergency lights to initiate a traffic stop. The driver stopped on Main Street in front of the Paul Mass Chevrolet dealership. The officer made contact with the driver who was identified as Donna. Hi, how are you? >> Good. How you doing? Okay. >> He just he yanked my hair. >> Okay. Donna told the officer that she was coming from Sunset Farm, but denied consuming any alcohol. He noticed that Donna's movements appeared sluggish and her eyelids appeared droopy. Donna was unable to provide the officer with a license. Based upon his suspicion of impairment, Donna was asked to perform field sobriety exercises. >> Do you have any paperwork for the car? >> Cuz nothing's coming back on the tag. The registration. >> Yeah, it's right here. She doesn't. I own the car. She's driving it for me. So, >> okay. >> It's just when I when I run it and nothing came back. He wants me to shut the window. >> Perfect. Thank you. >> Sorry. He was talking at the same time. >> Just to um let you know, I came three 3/4 of an inch away of being paralyzed. Okay. >> In 1997. So, okay. I can't really. >> We're gonna go up here. Okay. >> Well, normally. >> All right. >> And I don't drink. So, >> okay. We'll just go up here so we're off the road. >> Ma'am, I'll have you stand right over here so that the sun's not in your eyes and like that. And then just look right at me. >> Sergeant Marlor started with the horizontal gaze nestagmas HGN test. The second exercise was the walk and turn test. During the walk and turn test, Donna did not touch heel to toe on each step and took an incorrect number of steps. The third exercise was the one leg stand test. During the one leg stand test, Donna failed to raise her foot in the proper fashion and put her foot down after approximately 20 seconds. The final field sobriety exercise was a finger count test. >> I'm going to check your eyes. Okay. So, what I want you to do, can you see the tip of my finger? >> Mhm. I want you to follow my fingertip with just your eyes and don't move your head. Okay. I'm going to turn Have you turn this way a little bit so that I can't see your eyes? Turn and face me. >> Oh, we're going to start again. >> Yeah. Right there. Perfect. All right. Ready? Watch just my fingertip. So you you can't walk normal is what you're telling me. >> Yeah, I can show you my back. >> No, I'm not I'm not asking you to do that. >> Are are you able to walk a straight line? >> Yeah, but I'm just saying >> I understand. I'm going to take it into consideration. My point is I don't want to make you do something that you can't do. >> It's going to hurt, but I will do my best to help you. >> How about this? I'm going to I'll give you all the instructions. >> I didn't have anything to drink. >> Please just listen for one second. Okay. I have to make sure of this. Okay. Based on your driving and some of the other indicators that you give me, I have concerns and I just want to make sure. >> What indicators they give? >> Well, first of all, your speech sounds a little bit slurred. >> Okay. >> Um, you seem a little confused. >> I'm driving her car from California and >> she had a couple of beers. I didn't. >> Okay. >> That's why I'm driving. >> Ma'am, listen. I'm going to give you some instructions. >> Okay. >> But I'm not confused. >> Okay. I'm going to give you some instructions. After I give you the instructions, if you feel like you can't do it, that's fine. Just let me know. Okay? If it's going to be too much, that's fine. You don't have to do that one. Okay? All right. So, what I'll have you do, let's use this. Let's use this line right here. See this crack? >> I'll have you go on that end. I'm going to go on this end. >> I'll wait. >> No. No. Right. Right here. Right where you're at. Right here. This this line right there. Stand on that with your left foot like this. You can go to the side so you're not in the in the hole. And then your right foot in front. >> Either side >> like this. >> Yeah. Either side of that line. >> All right. On this side of this >> it either side means either one. I don't care which. >> I understand that. All right. >> So you see how I am? >> Yeah. >> I want you to do that same thing. >> Okay. >> Okay. So now just listen to me and watch me. I'm going to give you the instructions. Stay like that. Okay. So when I tell you to be to begin, I want you to take nine steps. All right. Each step I want your heel to touch your toe. I want you to keep your arms right by your sides and count your steps out loud. Okay? So, it'll look like this. One, two, three, all the way to nine. Okay? When you get to nine, I want you to turn making a series of small steps like this. And then take nine steps back. Okay? Once you start the test, >> three forward and nine back. >> Nine forward, nine back. >> You just did. >> I just showed you three, correct? Yep. Um, >> once you start the test, don't stop. Do it until you're done. >> So, nine forward, nine back. >> Correct. >> Okay. All right. Go ahead and begin. >> My back hurts. These shoes. >> Do you want to take the shoes off? Would that help? >> Probably. >> Go ahead. If you you can stop and take them off if you want. >> No, it's all right. I didn't count. Want me to start again? >> Sure. Let's try Let's try it again. Okay, what I'm going to have you do with either foot, doesn't matter which one, I'm going to have you raise your foot about six inches off the ground. Okay? >> Mhm. >> I'm going to have you keep your arms by your sides and point your toe like I'm doing. I'm going to have Not yet though. I'm going to have you look down at your foot and count 1,00 1,002 1,003 and keep going until I tell you to stop. You think you can do that? >> Which foot? >> It doesn't matter. Can you think? >> Can I hold my arms out? >> Nope. Your arms have to stay by your sides. 100,002 1003 1004 1005 1006 1007 1008 1009 101 2012 201345 2016201 >> That's right. Keep going. 122 It's hard because of my back. 23,24,025,26,027,28 like,29,30,31. >> You can stop. All right. What I'm going to have you do, put your hand like this and just just one. Either or. And you're going to I'm going to show you first and then you'll do it. Okay. You're going to go 1 2 3 4 4 3 2 1 1 2 3 4 4 3 2 1 >> 1 2 3 4 4 3 2 1 >> Again. >> Watch. >> One, two, >> one, two, three, four, four. >> You're using the thumb, right? >> Watch. >> I'm going to face this way like you. So you can see exactly. 1 2 3 4 4 3 2 1 1 2 3 4 4 3 2 1 >> Okay. 1 2 3 4 4 3 2 1 2 3 4 4 3 2 1 2 3 4 4 3 2 1. >> Okay. I don't believe you that you haven't had anything to drink. >> Why? >> Okay. Because I don't. >> Okay. Would you be willing to take a portable breath test? Okay. I mean, I'm going to have someone bring me one. We'll do that real quick. If it comes back with nothing on your in your system, then that's great. >> Well, I don't understand why you don't believe me. >> Just because of the indicators you're giving me. >> Okay. >> Okay. So, it's kind of cold. I'm going to have you wait in the car. I'm going to have I'm going to have someone bring that over here and then we'll do that real quick. Okay. All right. >> You want to grab it for me or anywhere at the station now? Yeah. >> All right. I'll have some. >> Thank you. If there's someone to the station head this way 23 negative It's I mean she's saying she has a bad back so it could be from that. You know >> what would you say for a PBT? >> If it weren't for the fact that she um >> she didn't say that she had a bad back. I probably would have just arrested her. >> Yeah, >> basically. But I hate to >> condition her. >> She did decent on some of the test while other ones. >> Exactly. >> And she's like >> I was like trying to watch peripherally. >> Even right when I when I when I first went to the car like she had snot running out of her nose. Her pupils are constricted, which is usually an indicator. >> Calling Sam DRE. >> Yeah. >> Yeah. I I have a feeling I have a feeling it's going to be drugs, not alcohol. Narro got her in 2017 for drugs. They got her in 2012 for a DUI. She's been arrested a bunch of times. >> You think they have drugs in the car? >> I don't think so. >> When you were standing at the driver's window, what was the passenger deal doing with the had the um wind visor? >> They were looking for the registration.
