He saw a black Toyota 4Runner turn sharply from Robinson Street onto Main Street. The SUV struck a sign on the double yellow line, then swerved west through empty parking spaces. As it passed his cruiser, Sergeant Marler made a U-turn and switched on his emergency lights. The driver stopped outside the Paul Masse Chevrolet dealership, where Marler approached and identified her as Donna. Donna told the sergeant she had just left Sunset Farm and said she had not been drinking. Marler noticed that her movements were slow and her eyelids appeared heavy. When he asked for her license, she could not produce it. Suspecting impairment, he asked her to complete field sobriety tests. The first test was the Horizontal Gaze Nystagmus, or HGN, test. Donna then attempted the Walk and Turn. She struggled to keep her steps heel-to-toe and did not count the required number correctly. During the One Leg Stand, she again had trouble. She could not raise her foot properly and put it down after about 20 seconds. The final exercise required her to count with her fingers. Marler returned to his cruiser and checked Donna's information. The record showed several prior arrests, including at least two Rhode Island DUI cases. He then asked another officer to bring a portable breathalyzer. Donna resisted and did not blow into the device correctly. Sergeant Marler arrested Donna for driving under the influence. Her erratic driving and the smell of alcohol raised concern. She had also struggled with the field tests and failed the portable breath test. Her past arrests and DUI convictions added to the concerns. At 4:11 PM, officers placed her in the cruiser and took her to the South Kingstown Police Department, arriving by 4:21 PM for processing. At the station, officers read Donna the Implied Consent Notice. At 4:46 PM, she refused to provide blood samples. She later appeared before Justice of the Peace Tom O'Brien and was released at 7:10 PM. Her court date was set for December 4, 2023. Sergeant Marler issued citations for DUI, refusing a chemical test, making an improper turn at an intersection, and violating lane-use rules. If you enjoyed this BodyCamBust video.
