Please just have your license registration insurance going on. >> Um, >> just a few quick things I got to tell you. One, I'm wearing a body camera. So I tell everybody. And number two, you know I stopped you. >> Do you know I stopped you? >> Yeah. >> Yeah. Actually, I don't know why you >> You have no headlights on. >> Did you get your license on you, too? Around 08 a.m. on September 14th, 2024, Sergeant Joseph Barnacle with the Shrewsbury Police Department observed a 2008 Dodge being driven without headlights. While headed southbound on Broad Street, he initiated a traffic stop and the driver stopped on Broad Street in the vicinity of Ober Place. He initiated contact with the driver and she was identified as 22year-old Carly. Should be a clock back there. I put my purse right here. And you came in the car yourself. Right here. >> There we go. >> Sorry. >> I'm sorry. >> That's all right. Perfect. Got your driving record. >> How's your driving? >> Never in the >> Got you. Okay. Just give me a second. I'll be right back. I'll be clear. >> No, I'm good. >> 48. >> 39 40. You just went up this way. I'm 104. Yeah, very nice. No lights, right? Yep. >> Yeah, they pass on. >> Hell yeah. She will let me part of the car real quick. There's two other people in the car. I don't give a hard time or anything, but wrong one. Let's see. All right. As Sergeant Barnagle was speaking with Carly, he detected the odor of alcohol and noticed other indicators of impairment. Carly provided the officer with her documentation, and Sergeant Barnacle radioed for Patrolman Bowler to arrive on scene and assist. Based on his suspicion of impairment, Carly was asked to exit the vehicle and perform field sobriety exercises. How do you pronounce your last name? Is it Huff Naggel? Is that how you pronounce it? You do me a favor. Separate the car for me. Just want to make sure you're okay to drive. >> Hold on one second. Wait. That's perfect. How you going? I just didn't want to c Thank you. And then just go up to the sidewalk over there. Just keep your hands out your pockets for up on the sidewalk, please. Yep. There you go. And then just see where my light is. Right back there. Perfect. And then face. Perfect. There we go. Hands to your pocket for me on your at your sides. All right. Just going to do a few quick tests. If there's anything that you don't understand, sometimes I talk a little fast. Just tell me to repeat myself. I will. All right. So, first things first, what I want you to do, stand your feet together, your hands are your side for me like you have. Good. See this pen? >> Yes. >> What I'm going to do is I'm going to give a few passes across your face. Okay. I just want you to follow this pen with your eyes and your eyes only. You understand everything I told you so far? Sergeant Barnacle started with the horizontal gaze nestagmas HGN test. During the HGN test, Sergeant Barnacle observed the lack of smooth pursuit, distinct and sustained nestagmas at maximum deviation, and the onset of nestagmas prior to 45°. The second exercise was the walk and turn test. During the walk and turn test, Carly failed to touch heel to toe on each step and turn them properly. The final exercise was the one leg stand test. During the one leg stand test, Carly failed to raise her foot in the proper fashion and put her foot down before the test was complete. I guess just follow the pen. Try not to move your head, right? Don't move your head. Just your eyes. There you go. All the way. Perfect. Keep it like like you're looking straight at me. >> I'm sorry. >> It's okay. It's all right. Like you're looking straight at me. Okay. Just your eyes. It's all right. Just keep on. Few more. All right. Doing a good good job. Okay, that should go up this time. All right, same thing. Get cheaper where it is. Just your eyes open. Good. All right, next one. What I want you to do, same thing. No, there you are. Oh, sorry. >> Yeah, it's it's okay. It's okay. I'm going to explain it to you. All right, just when I explain it to you, just follow the directions. Right. If I I'm going to tell you when to start the test, when to walk or what not to just follow my directions. All right. What I want you to do first, put your left foot on the ground and then put your right foot in front of your left foot. Heel the toe like I'm standing. So, you can do that for me now. Perfect. Heel toe. Perfect. Now, stay like that the whole time until I tell you to start. Okay. When I tell you to start, what I want you to do is take nine HTO steps in a straight line. I'm going to demonstrate it for you. Okay? So, just watch what I do. Demonstrate it, then you're going to do it. All right? So, when I tell you to start, you're going to do nine to steps in a straight line like so. Okay? You step out loud. One, two, three. I'm only going to do three to show you. You're going to do nine, right? >> Nine. >> Yep. Once you once you get to nine, leave at least on the ground. Here's the small steps to turn back around. Nine steps back. Same thing, counting each step out loud. 1 2 3 all the way to nine. Right. >> So, it's nine steps down, heel to toe. Counting each step out loud. Turn back around. Same thing. Nine steps back, heel to toe, counting each step out loud. You understand everything I told you? >> Yes. >> Okay, you can start. 1 2 3 4 5 6 7 8 9 and then nine back. 1. 2 3 4 5 6 7 8 9. >> Good. Last one. >> All right. What I need you to do like the first time, like the first starting position we did, feet together, hands at your side. All right. When I tell you to, same thing. I'm going to give you directions. Don't start until I tell you to. You're going to pick a leg of your choosing. I don't care which one, but I'm I'm just going to do it with my right. All right. So, when I tell you to take a leg of your choosing, you lift 6 in off the ground like so. You need to count loud. 1,00 1 1,002 1,003. You're going to keep going until I tell you to stop. You understand? The whole time you're doing the test, keep your hands on your side. >> And I want you to look at your raised foot. Hold on one second. You can begin. 1,00 1 1 >> Keep your hands on your side, too. But oh, >> it's okay. Let me do it again. Sorry. My fault. Feet together. Hands to your side. Right. When I tell you to start, lift it whichever leg you want. 6 off the ground. Count out loud. 1 10002. If you do put your foot down at any at any time, just pick it back up for me. All right. The whole time you're doing it, look at your race foot and keep your hands at your side. Do you understand everything I told you? >> Yes. >> All right. You can begin. 100,00 1,002 1,003 1004 1005 1006 sorry >> 1,001 1,002 Sorry >> 1,001 1002 1,003 10045 1006 1007 1008 Cool. >> I'm not very well. >> That's right. >> Based on the odor of alcohol and her inability to satisfactorily complete the field sobriety exercises, Sergeant Barnacle placed Carly under arrest for driving under the influence. After she was placed under arrest, her vehicle was impounded by for a mandatory 12-hour hold under J's law. Sergeant Barnacle transported Carly to the Shrewsbury Police Department for further processing. Hey, >> do me a favor. Turn around for me. >> Yeah. >> You're in arrest for DWI. You have anything on you in your pockets or anything like that? No. >> All right. You have a wallet and your phone in the car. What's What's in the car? So, you have been arrested for driving long NJS-39450. The law requires you to submit samples of your breath for the purpose of testing to determine alcohol content. A record of the taking of your breath samples, including the test results, will be made upon your request. A copy of that record will be made available to you. After you have provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. If you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. A court may find you guilty of both refusal and driving while intoxicated. If the court finds you guilty of refusal, you will be subject to various penalties, including license revocation of up to 20 years, a fine of up to $2,000, installation of ignition interlock, and referral to an intoxicated driving resource center. These penalties may be in addition to penalties imposed by the court for any other offense of which you are found guilty. You have no legal right to have an attorney, physician, or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as refusal to submit the breath testing. Even if you agree to take the test, but then do not follow my instructions, do not properly perform a test or do not provide sufficient breath samples, I will charge you with refusal to submit the breath testing. I repeat, the law requires you to submit samples of your breath for testing. Will you submit samples of your breath? Yeah, bring a verbal besides a thumbs up. >> My dad would say no, but >> what do you say? >> At the Shrewsbury Police Department, Carly was read the standard statement for motor vehicle operators, and she agreed to submit breath samples. Her alco test results indicate a back level of 0 to 5%, which was more than triple the legal limit of 0.08%. When the officers were finished with processing her, Carly was released to a sober adult after he signed the potential Chev warning form on Carly's behalf. Carly was issued the following traffic citations, operating under the influence. Reckless driving, careless driving, traffic on marked lanes, and failure to use lighted lamps. >> Okay. I'm not going to go to jail. >> Get out. Get out.
