How much have you had to drink tonight? >> I've not drunk anything. >> You haven't drank any alcohol at all. Where are you coming from right now? >> My friend's house. >> Okay. Where are the wristbands from? >> Huh? >> As he was speaking with Emily, he observed indicators of impairment and asked her how much she had to drink. Emily initially denied having anything to drink, but Officer Bar then asked her where the wristbands were from. She told him that she had been at a nightclub called Eden earlier that evening and she would later admit to having to drinks before driving. Based on his suspicion of impairment, Emily was transported to a nearby parking lot so that he could administer field sobriety exercises. >> Eden. >> Eden. Club Eden. That's where you were earlier. Yeah. >> Okay. Would you want to hop out of the car for me, please? >> Just you you can leave your phone on the seat. You don't have your license in your bag? >> No, I left my entire >> Okay. Um, I just need you to leave that stuff on the seat. Phone and phone in your purse there on your seat. Just Yeah, just leave your phone right there. We're going to come right back here. Okay. Just come on back here for me. Just stand here with this officer. I'll be I got to get some car. Stay right here. Right. Right right here. America. >> You can face the face. >> Okay. I'm going to move my car over a little bit. >> Okay. Just uh What's your name? >> What's your name? >> Emily. >> Say it again. >> Emily. >> Emily. Just stay right here. I'm watching fighting. Hang on. Hang on. Hang on. Hang on. Hang on. >> I'm not [ __ ] getting a gun. I'm a [ __ ] child. >> Huh? I was getting my ID myself. >> Okay. I don't I can't have you hold your cell phone. Okay. Come over here with me. Come on over here with me. I want to I want to check your eyes. Okay. >> All right. Um, you might Can you turn your front lights up? >> Yeah. >> Do you have any medical problems at all? >> Yeah. >> What? What's wrong? >> I have I'm on four different antibiotics right now. >> Antibiotics? >> I'm on four different kidney strains. And um I also had a problem with my liver and my kidneys. >> Okay. >> I was in I was in hospital the other day. >> Okay. Um, how often do you take those medications every day? >> Yeah, I took them today. >> Well, I got I got four one of them was four times a day. Officer Bosch started with the horizontal gaze nice HGN test. The second exercise was the walk and turn test. During the walk and turn test, Emily did not touch heel to toe in each step and failed to count aloud as instructed. The final exercise was the one leg stand test. During the one leg stand test, Emily failed to raise her foot in the proper fashion. >> Two of them are three times a day and one of them is twice a day. >> Okay. Um any pro any um physical problems with your body like any broken bones, anything like that? >> No. >> Okay. Do you wear contacts? >> No. I wear glasses though. >> Okay. Can you put your feet together like this and then arm straight down to your side? >> Can I ask a question? >> Yeah. >> Huh? I can't understand you. >> I You got to speak up. >> Yes. Yes, it is. >> I'm sorry. I'm just about my boyfriend. So, I'm just Okay. Well, listen. I need to make sure you're >> I need to make sure you're okay to drive. Okay. >> I I'm I'm not going to lie. I have I have two dreams. >> Okay. Well, look, I just want to check your eyes. Okay. >> Okay. Will you let me check your eyes? >> Yeah. >> Okay. Just keep your arms down to your side for me. Okay. All right. Speak your head a little bit. You see the red light here? >> Yeah. >> Okay. What I want you to do is follow that light with your eyes, but keep your head still. Okay. If you have to blink, you can blink during this. Okay. But concentrate on that red light. All right. Heat up here. Keep your eyes on it. >> Sorry. >> Just keep your eyes on the light. Okay. Listen. >> You got to keep your eyes keep your eyes on the light. Okay. You want to finish this? >> Yeah. >> Okay. >> I'm just pay attention to the red light. Okay. This is very important. >> Yeah. Okay, guys. There's a couple other exercises I'm going to ask you to do. Okay. Involves walking out of line and standing on one leg. Those are the exercises. >> You willing to do those for me? >> Okay. We're going to have to go into a parking lot somewhere. Um, >> are you willing to pull the Toyota? >> Uh, no, not yet. Okay. I don't want you to drive your car yet. Um, you mind hoping in my car? We'll back up. See that little parking lot right here? Like where the dumpster is? We'll back up up there. Okay. We're going to go right there to that parking lot. >> Yeah. Yeah. Yep. I'll let you know in just a second. >> Okay. Oh, I get you on this side. Okay, we're going to go right up over here. Okay, come on over here. 672 relocated um to a parking lot behind the Chipotle uh to do FS uh on the Horatio side. See this that white line right there? >> Yeah. >> So, >> I know I know what I know what to do. >> Well, I got to explain everything to you. Okay. >> I know what to do. like you do the one the seven is it seven steps or eight steps like one thing or the other? >> Yep. I'll explain it all. Okay. I have very specific instructions that I want you to follow. Okay? So, if you think you know what I'm about to tell you, forget all of that stuff. Just go off of the instructions that I'm going to give you. Okay? So, >> you have to keep that camera on. >> I have to keep it on. Yes, ma'am. It's got to be a recording. Yes. So, this is the line we're going to use right here. Okay. Now, I'm going to explain everything to you and then when I'm done explaining it, I'll demonstrate it. Okay. So during the instructions, what I want you to do is put your left foot on the line. Nope. Go ahead back to the start of the Go back to the beginning. Just put your left foot on the line. Then take your right foot, place it in front of your left foot so the heel touches the toe. Nope. Don't begin walking yet. Don't begin walking yet. >> I know what it is. Left foot. >> Go ahead and put your left foot on the line. See how I'm standing? I want you to stand just like this. Now take your right foot, place it in front of your left foot, but do not begin to walk. So go ahead and do that. >> Okay. Make sure it touches heel to toe. Put your arms down to your side. Stand just like that and do not begin walking until I tell you to start. Okay? >> So when I tell you to start walking, I want you to take nine heel totoe steps, counting your steps out loud as you walk down that line. You're then going to turn around, walk back down the line. Nine heel totoe steps, counting your steps out loud. Now each step needs to be heel to toe. And make sure you're counting out loud. Your first step will be number one. And it'll look just like this. 1 2 3 and so on all the way to nine. >> Okay. >> So on your nine step, leave your front foot on the line. Remove your back foot. Take a series of small steps to complete a turn just like this. And then you walk back down the line. Nine. Heel to toe steps. Counting your steps out loud. 1 2 3. And so on all the way to nine. Remember, while you do this, I want you to keep your arms down to your side. Make sure you make sure you look at your feet. >> Do me a favor. Stay over there. Make sure you watch your feet as you walk. Make sure you count your steps out loud so I can hear. And then once you start walking, don't stop walking until you've completely finished it. Okay. So, what I want you to do is get back into that position that I told you to stand in. Okay. So, take your right foot, place it in front of your left foot. Okay. Now, do you have any questions for me? You understand how to do everything? >> Yeah. >> Okay. Go. You You can go ahead and put your foot back on there and begin when you're ready. Okay, do me a favor. Come on down here. Right about where the light is. Turn around and face me. Can you put your feet together, arm straight down to your side? Good. Stand just like that. Now, don't do anything until I tell you to. Okay? So, with this one, when I tell you to, I want you to raise one foot. You can choose whichever one you want. Okay? Now, like I said, you whichever one you want. I'm going to pick my left foot, raise it up so it's 6 in off of the ground. Point your toe out so the bottom of your foot is parallel to the ground. Look at that foot and count allow 1,00 1,00 2 1 3 and so on until I tell you to stop. If you put your foot down at any point, just pick it back up and continue counting from where you left off. And you'll count until I tell you to stop. Tell me where to go. >> What's that? >> Tell me where you want me to go. >> Okay. Do you have any questions first? >> No. >> Okay. You can begin when you're ready. Make sure your arms are down to your side, though. >> Make sure you count out loud. >> Three. One, two. >> I have no bow. >> Okay. And you've got to you've got to be looking at your foot. >> Three. Four. Five. Six. Make sure to keep looking at your foot. >> Okay, you can stop. Put your foot down. Based on her erratic driving, her indicators of impairment, and her inability to adequately perform the field sobriety exercises, officer Bar told Emily that she was being placed under arrest for DUI as he was placing the handcuffs on her. Emily immediately began to resist and punched him in the back of the head several times. Another officer immediately intervened, and there was a brief struggle before she was placed inside the patrol car. Hey, >> stay back. Stay back. >> Josh, I'm right here. >> Josh, I got the other one. >> Emily, stop. Emily, >> stop. >> Stop. >> Back off of me. >> Stop. >> Stop. >> No. Back up. Back up. >> [ __ ] >> yo. Oh boy. That's a little too much. Yo, my guy. My dog. [laughter] All right. [laughter] Ow. Can you just make it a bit looser? [ __ ] you. You [ __ ] const. [gasps] [laughter] Hey, we're going to stand you up and I'm going to have you sit [laughter] in the back of my car. Okay. >> Ask you a couple questions. >> Can you just make it a bit looser, please? It really [ __ ] hurt. You stupid fool. >> Okay, we're going to stand you up. Okay. You just make every [ __ ] loss. >> Stand up. >> Stop it. >> Are you gone now? >> You made it a [ __ ] loser. It [ __ ] hurt. >> I see your need to wear them out. You lose anything else? >> No. I think so. What are you looking for? >> What's your question? >> What happened? >> 605. >> Are they ready? 600 units out of >> 101. >> Perfect. Nice car. >> Keep as much distance as you want. >> You just saw everything that happened. Do you think that's reasonable? >> I want I was going to talk about before it. Obviously, there's stuff that leads up to what happened. >> She's made. It's all on video. I'm not here to argue against what happened. >> That was That was very unreasonable. That's all. >> She was just at my house. >> Oh, I don't know. >> That's why >> you saw when I got here. So, I don't know. >> That's what I'm saying. >> That's why I just asked him to talk. He just said, "Yeah, two seconds ago." He just walked away. Not an option. >> Okay. >> How's it going? >> I have another unit that'll take the report for the bad report. >> One of ours is coming. >> Yeah, Scott's coming up. >> Okay. What was it? >> Huh? >> She hit us head like three or four times. >> Oh, yeah. Like we Yeah, we just got a little fight with her in the struggle. She >> got a unit question. >> Listen, sir. >> It's obvious we have things to do. So, I'll answer your questions, but it's limited. So, what are your questions? >> You said he said he'd answer my question. He's the only one that's going to have the answer. Search my house 10 minutes ago and now we're here. You know what I'm saying? That's what I'm saying. And now he acting like I'm not alive. So that's all I'm saying. >> But he's he's a little occupied right now. >> He's not occupied. >> Huh? >> Yeah. I guess the friends you always know what's going on. >> I jammed the [ __ ] out of your thing earlier. >> Did you? Yeah. So, we could have CBT and stuff, see how it feels. I don't I mean, it just feels like it's swollen a little bit. >> No, we'll sue we'll sue the risk management. If it gets worse, then you just go to CGH. >> Yeah. So, we went to go 10:15 >> and she started to fight. >> So, I had one handcuff on her. >> Okay. >> She got it. Then then she she got away. She hit me in the back of the head like two, three, four times. >> Are you serious? >> Straight punched. >> Okay. >> Yeah. >> Yep. Then we just we took her down. She was still fighting. Stood her up. She tried to like donkey and kick me backwards. >> Slipped out of one of the handcuffs again. >> She got one of the handcuffs. >> She want to? >> Yeah. >> You got her hand secure now, though, right? >> Yeah. Do you need >> She's not going to get She's not going to get out of her now. >> Okay. >> So, I just need you to write the B. >> Yeah, that's not a problem. >> And uh I I don't even have her in yet. >> On the tag. Are you going to do the CRA? Do you want me to do CRA? >> Well, can I add it to the Can I add it to the same CRA? >> Do a separate separate report number. So, yeah, a separate report number.
