He stopped the car on Howard Avenue. He met Emily Smith, the driver. She was 22. Officer Baar noticed signs she was impaired. He asked if she had been drinking. Emily first said no. Officer Baar asked about her wristbands. She said she was at Eden nightclub. Emily then admitted to two drinks. Officer Baar suspected impairment. He took Emily to a parking lot. There, he conducted field sobriety tests. The first test was the Horizontal Gaze Nystagmus. Next, he administered the Walk and Turn test. Emily did not step heel-to-toe. She also failed to count aloud. The final test was the One Leg Stand. Emily could not hold her foot properly. Her bad driving, impairment signs, and failed tests led to arrest. Officer Baar told Emily she was charged with DUI. As he handcuffed her, she resisted. Emily punched him in the back of the head. Another officer helped. They put her in the patrol car. Emily went to jail for processing. At the jail, she refused breath tests. Charges included DUI, resisting an officer with violence, and driving with a suspended license. Emily was later released. She awaits her court date. Tampa Police arrested Emily before. That was for DUI on September 29, 2021. She took breath tests then.
