He then observed a black vehicle with heavy damage to its right rear fender. After making contact with the driver of the black 2014 Tesla Model X, the driver pointed towards a white 2014 GMC SUV and told Officer Salgado that the GMC was probably the vehicle that had struck his car. >> Also check my record on my texts. As he was speaking with her, he observed indicators of impairment and asked her if she had anything to drink. While she initially denied consuming any alcohol, she would later admit to consuming a can of ginger mule 8% in Gottenburg earlier that afternoon. >> I just need to ask you you need to come down uh in the area of First and Willow just to stay with the female for a moment. >> Zimmerman. I have an ACL injury, an MCL injury. >> make sure to note that down. >> or any incapacity >> you also um Do you wear >> Officer Miller started with the horizontal gaze nystagmus HGN test. The second exercise was the walk and turn test. During the walk and turn test, Billy did not touch heel-to-toe on each step and turned them properly. The final exercise was the one leg stand test. During the one leg stand test, Billy failed to raise her foot in the proper fashion and did not count in the correct sequence. >> Contact lenses as well? >> I need glasses in a certain regard, but I'm not wearing them right now currently. >> Okay, I will make note of that, okay? >> The bigger note is if I limp in a certain regard >> Mhm. >> I have a full partial ACL tear and an MCL tear that I'm currently recovering from. >> Okay, no problem. I will definitely note that if I can see that, okay? >> Thank you, Mr. Miller. >> No problem at all. Here's what we'll do. >> Prefer me to call you Officer Miller or Mr. Miller? >> Whatever your preference is. >> No, it's your preference. It's to your discretion. >> So, I'm just going to have you stand right here. You're going to face me on this line. Okay? You're going to stand with your feet together and your hands at your side, okay? You're going to follow the tip of my finger. >> Which tip? Which finger? >> to follow this finger, okay? >> Got you. >> All right. Um I'm sorry. That's when I parked. >> Okay, you can relax for a moment. Uh the next test we're going to be doing is going to be called the walking turn test, okay? Um >> This is the one I'm worried about cuz of my ACL injury. >> I'll I'll definitely make note of that. If anything >> But like is this everything you make note of right now? I feel like I'm being under a deep surveillance. >> No, really. Yeah. >> I'm deeply worried because I don't want >> I understand. So, I am just I'm here to determine if you're able to operate a motor vehicle, okay? >> Oh, yeah. That's fine. >> That's all my purposes here. So, if you pass this test, you're free to go. Right? Um I'm going to have you stand there with your feet together and your hands at your side, okay? You're not going to begin this test until I tell you to. For demonstration purposes, I'm going to be taking three steps. When you conduct the test, you're going to be doing nine, okay? >> Okay. I'm just doing my best like I said. I'm really worried about my ACL tear. >> I understand. Correct. So, what you're going to do is on your line you're going to have your left foot on the line. You're going to have your right foot in front of it, okay? You're going to stay in that position until I tell you to begin the test. Do not start the test until I begin, okay? You're going to stay in this position though, just like this, until I tell you to begin the test. Okay? When I tell you to you're going to be taking nine steps, okay? I'm just doing my best because of my ACL tear. >> I understand. All I'm asking you to do >> This is my first time without a brace. Like >> So, all I'm asking you to do is to stay in the starting position as so, okay? >> Of course. Do not move until you tell me to move. >> Yes. So, you're going to take a series of small steps. You're going to take nine steps back, okay? One. Two. Three. And so on until you conclude the test. Throughout the duration of the test, you're going to keep your hands at your side and you're going to keep your eyes You're going to be watching your feet while you walk, okay? I understand, okay? >> Cuz just because of my ACL tear. >> All right. Do you understand the directions for the test? >> bit, but do you understand that >> Yes, I understand you have an injury. I'm I'm I'm taking that into consideration, okay? >> But I'm fighting beyond. >> Okay, no problem. You may begin the test now, okay? >> And beyond the test is me stepping >> You're going to nine steps forward, a series of small steps, and nine steps back. And you're going to keep your hands at your side, okay? Are you refusing to take the test? >> No, I mean no. >> Okay. So then I need you to >> there to be a miscommunication based on my ACL tear and >> There's no miscommunication. I'm going to make note of this while you're doing this, okay? >> I just want to make sure that you understand >> may begin the test. >> Thank you. I have an ACL tear. >> I understand. Thank you. All right, just stand at this line for me. >> I feel like I'm trying my best to >> you're good. The The The test is complete, okay? No problem. >> our next step? >> going to do, you're going to stand at that right there at that line. You're going to stand with your feet together and your hands at your side. >> Yes, sir. >> I'm going to be demonstrating this test, okay? During this test, you're going to keep your hands down at your side, and you're going to be watching your foot while you count. Do you understand the directions? >> I I think I do. Can I repeat them to you just so I'm sure because I'm being tested in a way this is >> No problem. >> You would like me to put one foot and elevate it in front of the other >> Correct. >> and hold it >> Mhm. >> for a period of time >> You're going to count out loud until I tell you to stop. >> And that is 6 seconds? >> I'm going to I'm going to count You're going to count You're going to You're going to count until I tell you to stop. Okay? >> I'm going to count one Mississippi or just one two? >> Mississippi. >> Yes, sir. >> Okay. >> And I can choose my leg? >> You can choose your leg.
