It's going to be Kennedy just west of Channel Side Florida Hotel India Papa Yankee 53. It's on a red Volkswagen Golf. 681 final's going to be at 11. Around 12:25 a.m. on December 31st, 2023. Officer Bailey with the Tampa Police Department observed a 2013 Volkswagen Golf running through a stop sign in the vicinity of E. Kennedy Boulevard and in 11th Street. He activated his lights to initiate a traffic stop and the driver pulled over near the entrance of a parking garage. The officer made contact with the driver who was identified as 25-year-old Isabella Shank. Driver, pull all the way over to the right. Now you're blocking this entire intersection. just I don't Good morning, ma'am. >> Hello. >> I'm Officer Bailey, Tampa Police Department. Do you have any idea why I pulled you over? >> No. >> All right. When I first saw you, you were coming southbound on 15th Street, approaching the four-way stop intersection at 4th Avenue, and it took me this long to catch up to you. All right. But you didn't stop at that four-way stop. It was right before you. Not not the intersection right where you saw that police officer on the traffic stop, but the one before that. >> The one in Eore. >> Yep. The one in Eore. >> Outside of the parking garage, >> right? >> The stop there. >> The stop there. >> Yes. The four-way stop at 4th Avenue and 15th Street. >> Okay. Do you have your driver's license, registration, and proof of insurance? >> Did I do a California roll? >> I'm sorry, I couldn't hear you. >> Did I do a California roll? Yeah, you rolled through the You slowed down, but you didn't stop. >> Where are you coming from tonight, ma'am? >> Uh, Eore. >> Where in Eore? >> Reservoir Bar. >> All right, Miss Shank, do you work there? >> No. >> Okay. Are you still living on? >> I live in St. Pete now. >> Okay. Do you have your registration and your insurance card with you? Is this your current address? >> As he was speaking with her, he observed indicators of impairment and detected the odor of alcohol. She told the officer that she and her passenger were coming from Reservoir Bar in the Abore City neighborhood. She admitted to consuming two beers before operating a motor vehicle. Based on his suspicion of impairment, Isabella was asked to exit the vehicle and perform field sobriety exercises. >> Uh, yes, >> that one's expired. >> Yeah. >> Do you have it on your phone? Maybe. And Miss Shank, how much have you had to drink tonight? >> Like a beer. >> I'm sorry I couldn't hear you. >> Two beers. >> Two beers. >> I don't think I have my current um insurance. >> Do you have it on your phone? >> I can text my mother and see if I have it. So, you don't have the app yourself? >> I do not. >> All right. Do you have a valid driver's license? >> Yes. >> No, you already gave it to me. I'm just asking you if you if it's valid. >> Yeah. >> All right. You mind stepping out of the vehicle for me so I can make sure you're okay to be driving? Just go stand right over there on the sidewalk. I'll be with you in just a moment. You can put that away for her for me, please. >> Yeah, that. >> Thank you. All right, Miss Shank, step over here so we're not in the way. All right. Now, the reason I ask you to step out of the vehicle is based on observations I'm making while talking to you. I'm a little concerned about your sobriety, and I do want to make sure it's safe for you to have been driving. Now, do you suffer from any kind of medical problems I might need to be aware of? You're not diabetic? Do you take insulin, have seizures, high blood pressure, taking a medication for any reason? Do you have any problems with your eyes other than needing glasses? Are you blind in either eye? All right. Now, one of the things I'd like to do to help me determine your sobriety is check your eyes. Is that all right? Can you take your glasses off for me? Just stand right here on top of that light. Just hold your glasses in your hand. Stand with your feet together just like I'm doing here. Sides of your feet touching just like I'm doing. There you go. Hands all the way down at your side touching your legs. All right. Can you see the light I'm holding in front of your face? >> Officer Bailey started with the horizontal gaze nestagmus HGN test. The second exercise was the walk and turn test. During the walk and turn test, Isabella did not touch heel to toe on each step, failed to cow aloud, and turned improperly. The third exercise was the one leg stand test, and Isabella failed to raise her foot in the proper fashion. >> What color is it? >> Red. >> All right, here's what I want you to do. I want you to look at that red light and follow the red light with your eyes only while keeping your head completely still. Do you understand? Need a yes or no from you? >> Yes. Sorry. >> Sorry, I'm squinting. I'm bad prescription. You open your eyes a little more for me. >> Sorry, I can't see. Try not to blink so much. >> Sorry, my eyesing with this wind. >> Tell you what, let's let's turn this way. Stand with your feet all the way together. Hands all the way down to your side. Is that better? We can put your glasses back on. >> All right, ma'am. So, I am seeing some indications in your eyes that's causing me a little bit of concern. Okay. Okay. So, what I'd like to do is continue my investigation and ask that you perform some additional field sobriety exercises that would consist of you walking a line and standing on one leg. Now, do you have any injuries or physical defects that would prevent you from being able to walk a line or stand on one leg? >> Um, only this knee has a little bit of a um injury that's recovering from last year. >> Okay. So, you hurt your knee last year. What What did you do to your knee? >> It was my meniscus tore. >> Okay. Did you get it fixed? Mm-m. I just wore a knee brace for a little while. >> Okay. Did it Did you recover at all? >> A little bit. It's a little bit um >> Are you able to walk normally without a cane? >> Yes, walk normally without a cane. >> Do you think you'd be able to walk a line and stand on one leg? A leg of your choosing? >> Okay. You want to do those exercises for me? >> Okay. Looks like you got a nice line right here that we could use. I'm just going to readjust my car. If you just stand right over here, I'll be with you in just a second. Okay. 681 54 not 1018. We're going to be in the entrance to the garage just north of Kennedy. All right, ma'am. You see this line on the pavement here? All right. Here's what we're going to do. I'm going to give you some instructions. I'm going to demonstrate what I want you to do, and I'm going to give you an opportunity to ask me questions if you have any. It's all going to be pretty straightforward. I'm not trying to trick you or surprise you, okay? But it is important that you follow my instructions exactly. So, with that being said, if there's anything that you don't understand, just make sure you ask questions when I give you the chance because once you start each exercise, you will not be able to stop in the middle of the exercise to ask any questions. Does that make sense so far? Okay. Now, I know this sounds like a silly question, but I have to ask. Do you know your right from your left? Show me your left hand. Okay. Very good. All right. Here's what I want you to do right now. Okay. Go ahead and take your left foot, your left foot only, and place it on the line. Next, I want you to take your right foot, place it directly in front of your left foot. So, the heel of your right foot is touching the toes of your left foot and put your hands down at your side, touching your legs. Now, stay in that position and don't do anything else until I tell you to. Do you understand so far? I need a yes or no from you. >> Yes. >> Okay. Now, when I tell you to begin, you're going to take nine heel totoe steps down the line, turn around like I'm about to show you, and then take nine heel to toe steps back. I'm going to demonstrate for you. It's going to look just like this. From the starting position, start walking with your back foot. Look down at your feet as you walk and count each step out loud like this. 1 2 3 and so on until you get to nine. Once you get to nine, keep your front foot on the line. Take your back foot off. Then use your back foot to take a series of small steps around your front foot to turn around. Once you've turned around, take nine heel to toe steps back. Again, look down at your feet and count each step out loud as you walk like this. One, two, three, and so on until you get to nine. Make sure every step touches heel to toe. Keep your hands down at your side the entire time. Don't step off the line and don't stop walking until you complete the entire exercise. Do you understand those instructions? Do you have any >> nine this way? Turn around. Nine. >> Correct. Do you have any other questions? >> Nope. Sorry. >> You think you understand? >> Yeah. Sorry, my left knee hurts. >> Okay. Now, if you don't have any questions and you think you understand, whenever you're ready, you can go ahead and begin. All right, you can go ahead and relax. All right, I want you to turn and face my car. All right, that car right there. Yep. >> No, ma'am. I want you to stay right where you're at. >> Turn and face directly towards my car. There you go. Just like that. I want you to stand with your feet all the way together, sides of your feet touching, hands all the way down at your side touching your legs. Stay in that position and don't do anything else until I tell you to. Do you understand so far? All right. Now, when I tell you to begin, I want you to raise one foot, either foot of your choice, about 6 in off the ground with your foot parallel to the ground. Now, 6 in is about that high. It's about the height of a soda can. I'm going to demonstrate for you. It's going to look just like this. Either foot of your choice, about 6 in high. Notice how my foot is parallel to the ground, both legs straight, hands down at your side, touching your legs. And then while looking down at your raised foot, I want you to count out loud like this. 1,00 1,002 100,00 and so on until I tell you to stop. Don't raise your arms for balance. Don't hop. Don't sway. And don't put your foot down. Do you understand those instructions? You have any questions about the instructions? All right, sit t. I got to grab my watch. All right. Do you have any questions about the instructions I gave you? Do you think you understand? 6814. >> All right, ma'am. If you don't have any questions and you think you understand, whenever you're ready, you can go ahead and begin. Make sure you're looking down at your foot. 1124 2015 2018. >> Can I step on my knee? That's not the minist one. Sorry. >> All right, you can stop. based on her traffic infraction, her indicators of impairment, her admission to consuming alcohol earlier that evening, and her inability to adequately perform the field sobriety exercises, Isabella was placed under arrest for driving under the influence. After she was placed under arrest, her friend attempted to argue with the officers before walking away. >> All right, I put your hands behind your back. >> Yeah. Can I use my knee that's not on my >> Pam? I gave you the opportunity to use whichever knee you felt comfortable with. That's the one you chose. >> That would be the one that I would I'm saying indications of impairment. I do believe you're impaired at this time. I'm placing you under arrest for DUI. >> Do you have anything on you concerned about, ma'am? No. I've >> got some really small wrists. Are you sure it counts on the other knee? I'm sorry. >> I gave you I gave you the chance to pick which one you wanted. >> Well, I I'm usually used to my left knee. I haven't used it in activity for a long time since got it hurt from working out last year. Haven't worked out since. >> Do you have anything on you I need to be concerned about? >> I do not. >> All right. This is something I say everybody I ask everybody. Okay. So, I say to everybody, if you happen to have something on you that you're not supposed to have, like drugs or weapons, and it gets missed during the search before you go to the jail, >> and then you go into the jail and they find it in the jail, you could be charged with a felony for introducing contraband into the jail. >> So, hypothetically speaking, if you did have something, this would be your chance to let me know about it. You understand? >> Thank you. >> All right. Step right over here. Do you have a a wallet or cell phone in the car you need me to grab for you? >> Yes, I absolutely do. >> Okay. Where is it? In the front seat, probably. >> In the front seat. >> My van's back. My phone is green. Is my friend okay to Uber home? >> Yeah, she's going to be able to drive. >> I'm really not able to just use my other knee that works correctly. >> I I gave you the chance to pick which one you wanted. >> Well, I'm so used to >> And that's the one you picked. >> I'm used to using >> All right. Step right over here, ma'am. But that's not the only reason I'm I'm making the arrest. There's there's other signs that that I'm observing while during this whole exercise in my bag. >> Grab it for you, ma'am. >> I'm going to grab it for you. Go ahead and step up for me. >> Not in the car. >> Your wallet, please. That's her wallet. That's not your wallet. >> She wants her wallet. She She asked for it >> and her phone. >> I don't have her phone. >> Okay. Can you step out, please? >> Yes. >> Unfortunately, we do have to tow the vehicle. >> Okay. You are free to go. You can call yourself an Uber, walk, do whatever you want to do. Call a friend, family member. >> So, I'm just curious. You were Why? >> We're running a stop sign and it's on video. >> And there was how many other people running a stop sign today? >> Ma'am, I'm not going to get into a debate with you. Okay, you're free to go. Have a safe night. >> I will. >> Okay. Lastly, >> she'll be at Orient Road Jail. >> She's got to be held for a minimum of eight hours. >> Bro, guess she wasn't paying attention when I told her the reason she was stopped. >> She want arguing. She wants debate. warm now. >> Yeah. >> Just making sure I'm not sticking you with anything. window. How far I'm help you. Ma'am, >> can I have all of the stuff that I need to help her get released because this doesn't seem quite fair. >> Okay. So, she'll be at Orient in jail. You know, >> I know where Orient jail is. >> Okay. So, that's all you really need. >> That's it. >> Yes, ma'am. >> And you arrest her on what charge? >> I'm not arresting her. The officer right there arrested for DUI. >> I need to talk to you. So I can answer your questions. The rest of her DI. That's all you need to know. What else do you need to know? >> And I saw the whole thing. >> Okay. And I think it was the first. >> It's okay. You can you can get her, Laura. You can do whatever you want. But as of right now, she's going to jail. >> Thank you. >> You're welcome. You're good. Yes, sir. FHP. Where is he going to? [laughter] That truck is not opening. Oh, guess we're stuck. >> Is she in your car? >> No, ma'am. >> She's in the other car. What do you need, ma'am? What do you need, ma'am? >> Let's talk to my friend. >> Okay. She's going to jail. >> For what? Because everyone around here has [ __ ] video proof. >> Okay. Again, you you can debate this later on, but >> I don't need to debate. >> He's having a debate with you right now. He's about to leave. >> Can I talk to my friend? >> He's about to leave to go to jail. Okay. So, I need you to step out of the way, please. >> Break down numbers and give it to him. >> Thank you. >> As long as we can call you. >> Exactly. I don't need to tell you what to do. >> No, you you need to ask a question if you want to answer. >> Thank you. Can I have my friend's information? >> I already gave you your friend information. That's officer Bailey. >> Give me anything. >> His name's Officer Bailey. >> You're welcome. You have a good day. >> That's it. That's all you're going to give me. >> That's all you need, right?
