What was that? >> We're going to turn out of here. >> Okay. All right. Wow. >> All right. Well, so you guys ready to drive? >> Oh, yeah. Yeah, I promise. >> Around 6:05 p.m. on November 11th, 2023, officer Keith Sentini with the Stone Harbor Police Department observed that a 2015 Toyota had been parked for about 15 minutes in the nil parking zone on the beach block of 104th Street. As he approached the vehicle to investigate further, he detected the odor of burnt cannabis. There were two females inside the vehicle and the one in the driver's seat was identified as 19-year-old Tara. Tara admitted to smoking inside her vehicle. >> The light is the only thing. >> No, it's fine. So, just let you know I'm recording. Um, so do you have your license on you by chance? >> Yeah. Can I see it? Thank you. >> How old are you? >> 19. >> All right, just hang tight. Okay. Just want to turn the car off real quick. Thank you. 364. Copy. 1903. Little foggy. When I first walked up, I thought I smell marijuana, but like I >> I smell it. There's no one in it. >> No, there's two people in it. >> Oh, there's two people. Two girls. >> I definitely smell burnt marijuana. >> What of age? >> 19. driver. I mean, it's hard. I can smell it from here, but it's faint. >> Oh, smoke was rolling like >> Oh, like coming out of the car. >> I couldn't tell. They were like I'm like 100% sure it was marijuana. Like smoke was coming out. >> Yeah. Did you ask about it yet? No. Could you smell it when you walked up? Why don't you roll the window down 1900? I got you. I was just zooming to get here. >> I saw it sitting here for like >> a while. >> A while. >> Did a couple laps, came back, it was still here. Right under a light, too. Come on. A little more slick. >> Where's she from? >> Real. Just stand by. I'm just standing by. I mean, I'm assuming we're going to confiscate what they have, but yeah, I'll go on I'll come on your side so I can see better. Oh, you heard it. She's negative 29. >> You want me to get her out? Do you want me to pull up and put my lights on? You're good. What's your name? >> Tara. Is that your name? >> Yeah. >> Okay. So, here's the deal. When I walked up here, I smelt marijuana. Car is running and you're in it. So, I'm going to ask you some questions. Make sure you're okay to drive. Okay. >> Okay. >> All right. So, can you count what's the highest level of education? >> Uh, high school. high school. All right. Are you familiar with the English alphabet? >> Yes. >> Okay. Can you start with the letter B and end with Q without singing? >> B Q R S T B W X Y Z start at B and Q, sir. >> Yep. Start with B and end with Q. >> Okay. Officer, the thing that we were doing is Yes, we were smoking. >> Absolutely. >> But we're waiting. >> We were smoking marijuana. We were going to sit here for about an hour. >> We're not smoking our entire thing. We're smoking until I'm sobering up. >> Yeah, she's sober. Well, I was going to sit with her here obviously and we're going to wait until both of us are sober and then we drive. >> Like I never drive I never drive under >> operated a vehicle under the influence obviously. >> Okay. A lot of my family, they work for like Kate May County Police Department, like Joey Trombetta and all them. Like that's my cousins and all them. Like they know I wouldn't operate a vehicle and she wouldn't. >> We just plan on being here for a while. >> Are you pointing at these if you wanted to smell these? These are both water with ice. >> We're not drinking. >> Like we're not drinking alcohol or anything like that. >> Okay. Well, is that a grinder right there in the middle? >> Yeah. >> All right. Can I have that? >> All right. So again, can you start with the letter B and end with Q? >> B Q B Q D >> Ma'am, can you not help her? >> I'm sorry. Can you ask a question? >> Okay. Can you start with the letter B and end with Q? For example, B C D >> B C D E F G H I J K L M N O P Q >> Okay. >> All right. >> I'm sorry, officer. Like, I know like I am stone. I'm sorry, but I really I seriously was going to wait. >> Like, we're going to be here for We I really we are going to be here for a while. >> Hold on just for one second cuz you're making it worse than it. >> All right. So, are you familiar with numbers? Right. >> Shortly after Sergeant Robert Walker arrived on scene to assist, Tara was asked to recite part of the alphabet and count backwards. She was initially unable to follow instructions when reciting the alphabet. After officer Santini made a phone call, it was determined that Terara would be asked to perform field sobriety exercises since she was exhibiting indicators of impairment. >> Yeah. >> High school. Can you start with 67 and count backwards to 52? 67 66 65 64 63 62 61 60 um 59 58 57 56 55 54 53 52 >> Okay. All right. So, since you admitted that you have smoked, um I'm just have you step out of the car. Just do some more tests on you. Okay. >> All right. So, can you step out, please? All right, let's take a walk this way, please. Do you have any weapons on you at all or anything like that? Nothing sharp. It's going to poke me. >> No. >> Okay. So, like I said, I'm just going to do a couple more tests. Make sure you're okay to drive. Okay. >> I really promise you I would never drive like when I'm stone like this. We really are just going to be here for a while hanging out. >> Okay. >> And one minute. Okay. So, can you just put your feet together just like this and your arms down at your side? Just kind of hang out like that. Okay. Mhm. The first field sobriety was the horizontal gaze nestagmus HGN test. The second exercise was the walk and turn test. During the walk and turn test, Terra failed to touch heel to toe on each step, took an incorrect number of steps, and turned improperly. The last exercise was the one leg stand test and Terra failed to raise her foot in the proper fashion and used her arms for balance. >> So, you got any problems with your eyes? I should know about. You see pretty well. >> Okay. So, I'm just going to check your eyes. Okay. Just hang tight. I'm going to go turn these off. Okay. All right. Feet together, arms down by your side. Okay. >> Okay. >> Can you see the tip of my pen? >> Yes. >> Can you focus on it? >> Yes. >> Okay. All right. So again, you focus on through my pen. See? So follow with your eyes and your eyes only. Okay. Keep your head still. Follow with your eyes and your eyes only. Do not move your head. >> Did I fail? >> No. No. I'm just going over the instructions. So, I'm going to check your eyes. Keep your head still. Follow the stimulus with your eyes and your eyes only. Do not move your head. Do you understand? >> Yes. >> Okay. >> Uh >> um right now I would say no. Um, we'll find out. I'll let as soon as we know, I'll let you know. So, you can do it. I'll stop. Follow my eyes. Okay, perfect. So, I'm going to do two more tests. Okay. Do you have any problems with balance? Anything along those lines? >> No. >> Any any issues with your feet? >> No. >> Okay. Do you want Do you want to do the test? So, it's going to be like a walk and turn and a one leg stand. Do you want to do those shoes on or you want you have the option to take them off? >> Um, I think I can do it with them on. >> You can do it with them on. Yeah. >> Okay. All right. So, I'm going to turn these back on. Okay. So, there's some light here. >> Just hang right right there. All right. So, if you want to walk over here, do you would you say this is flat level and clear of debris? >> Yeah. >> Okay. You think anything of this nature would mess up you walking? >> No. >> Okay. So, what I'll have you do, walk this way. Just stand here facing this way. So, what I have you do is uh so imagine there's a line. Okay? So, put your left foot on the line. Put your right foot in front of it with your right heel touching your left toe. >> Oh, my right heel touching my left toe. >> Yep. >> And do the same. >> What was that? >> Like do the same. >> Just put your left foot on the line. >> Okay. >> Put your right foot, your right heel touching your left toe. Keep your arms out on your side. You understand? So, look like this. Put your left foot on line. Right foot in front of your left. There you go. All right. Do not start until I tell you to. Do you understand? Yes. >> Okay. When I tell you to begin, I want you to take nine heel to toe steps on the line. >> Do you think I can actually take these off a platform? >> Yeah. >> Okay. >> All right. So, left foot on the line, right foot front of it with your right heel touching your left heel. Keep your arms out on your side. >> Okay. >> Understand? Yeah. >> All right. So, when I tell you to begin, I want you to take nine heel to toe steps on the line. >> When you get to your ninth step with your front foot, I want you to turn by taking several small steps. Okay? So, it's going to look like this. I'm going to demonstrate it for you. So, left foot on the line, right step or right foot in front of your left with your heel. So, it's going to go one, two, three. Your front foot's going to be on the line. You're going to turn by taking several small steps and return nine heel toe steps back. I did three just for demonstrations. So while walking, watch your feet, keep your arms at your side, and count your steps out loud. Once you begin, do not stop until you have completed. >> You said do darn small steps back. >> Nine heel to toe steps back. >> So nine heel toe steps back. Turn. Taking several small steps with your front foot on the line. Nine heel toe steps back. >> Watch your feet at all times. Keep your arms on your side. Count your steps out loud and do not stop until you have completed the test. >> Okay? >> Do you understand? >> Yes. >> Okay. You may begin. >> 1 2 3 4 5 6 7 8 9 I'm sorry. 1 2 3 4 5 6 7 >> Okay. >> I am really cold officer by the way. So like I am shaky. So >> Okay. >> Just like that, too. >> Okay. Not a problem. >> All right. So the last step, like you said, you have no problems with balance or anything like that, right? Okay. So I want you to paint your feet, hands just like this. All right, arms out on your side. And now begin test until I tell you to. Do you understand? >> Yes. >> Okay. When I tell you to begin, I want Well, when I tell you to, I want you to raise one leg, either leg approximately 6 in off the ground. Keep your both feet straight. Be both legs straight. And keep your eyes on the elevated foot. Do you understand? >> Yes. >> Okay. While in that position, count out loud. 1,001 100 1 2 1 1003 and so on until told to stop. Do you understand? Okay, just hang tight real quick. You have your watch on you real quick? Mine died. >> I just needed a timer. 88 79. Do you want me to go over that again? That was That was my fault. I'm I Okay. Yep. All right. So, I have to take responsibility for that one. Okay. So, stand with your feet and heels together like that. Uh do not begin until I tell you to. When I tell you to, I want you to raise one leg, either leg approximately 6 in off the ground. Keep both legs straight and keep your eyes on the elevated foot. While holding a position, count out loud. 1,00 1,002 1003 and so on until told to stop. Do you understand? All right. So, it's going to look like this. 1,00 1,002 1003 and so on until stop. Do you understand? >> All right. You may begin. >> Uh, it doesn't matter which leg. >> It doesn't matter. Raise your leg a little bit. Count out loud. Uh 1,00 1,002 1,003 100,004 1005 1006 1007 1008 1009 1,0123 1920 >> All right, stop. All right, perfect. All right, if you just want to hang tight over there, I'll make a phone call and you want to put your shoes back on. Um, we'll be right back with you. Okay. Yep. You can just hang out right at the back of your car here. All right, Tara. Based on the odor of burnt cannabis, her admission to smoking, and her inability to satisfactorily complete the field sobriety exercises, Officer Santini placed Tara under arrest for driving under the influence. Her vehicle was impounded for a 12-hour hold according to John's law. Officer Santini transported Tara to the Stone Harbor Police Department for further processing. Um, I'm going have you turn around and you're placed under arrest for uh driving on the influence of alcohol or drugs. Okay. So, I need you to turn around, please. No, >> no, that wasn't >> that wasn't for me. >> Is she getting arrested? >> She's not getting arrested. >> This is my house. >> It's going to get towed. Are you the registered owner? Um, she can take it if she wants. >> Can I pick it up? Would you be able to pick it up? >> No. Getting towed. >> We'll ask you. >> Whatever toe company um comes and picks it up, we'll let you know. Okay. Is that too tight? >> No. >> Okay. >> Um, do you know where my phone will go? >> What was that? >> Do you know where my phone will go? >> Your phone? >> Yeah. >> What's What's wrong with your phone? >> No. I'm just wondering like where what's going to happen with it when my car gets tired? >> Oh, well, what do you want me to grab? >> Um, my phone. Um, and my wallet, please. I mean, and my purse. Okay. Well, is your friend, you give permission for your friend to grab that? >> Yes. >> Okay. So, I'll grab that. Where is your registration insurance for your car? >> Uh, it should be on the glove box. My insurance is on my phone. It's on my back. >> Okay. This on your phone. >> Mhm. >> Which glove box? The center or the one where you're >> The one where she's on. >> Okay. She You give her permission to get in there and get it register. Okay. >> Just have a seat. You cannot afford to hire a lawyer when we appointed to represent you before any questioning if you wish at no expense to you. Do you understand the rights I have just read to you? >> What was that? >> Yes. >> Okay. Yo, Gilmore, can you just go on the other side? Seat below her. Can you go on the other side? >> He's just going to seat out you. Okay. >> Uh, yeah. Give me one second. Um, your friend wants to know if she can go in your phone and get some contact information. >> I'm going to grab her phone. >> Can you please have her um uh I can give her the passcode if you want that? And then can she call um my cousin um her name is Kendall. Um can you have her go online?
