It's not. >> This sounds so ridiculous. Five. I'm gonna fail this. Six. Seven. I'm not drunk. I swear. I'm just like fast. Eight. Nine. This is a set. This test is set up for failure. >> It's not. >> This is a geographical [ __ ] [ __ ] government test. >> Okay. Keep going. >> 1 2 3 4 5 6 7 8 9 >> Okay. Am I drunk or not? >> Is that how you wanted to complete the test? >> Yes, I do. >> Okay. >> Around 11:01 p.m. on August 1st, 2025, patrolman Amy Beeringer with the Mammoth Beach Police Department was working at a DWI checkpoint in the vicinity of 128 Ocean Avenue. While there was conspicuous signage indicating that U-turns were prohibited, she observed the driver of a gray 2025 Hyundai Sonata make an illegal U-turn from the southbound lane and continue northbound into Sebrite. Patrol woman Bearinger activated her emergency lights to initiate a traffic stop and the driver pulled over in the vicinity of Ocean Avenue and Imbry Place. She then exited her patrol car and made contact with the driver who was identified as Samantha Abbruso Delmoro. >> Hi, how are you? I'm Beach Police. Do you have your license, registration, and insurance? >> Um, yeah. So, I'm like in the middle of getting a new one. This is a rental car. >> Okay. Can you just turn the music down? I'm sorry. the reason why you're pulling over. >> When I get all your documents, I'll let you know. >> Why? >> Because that's how it works. I just want to know. >> I'll let you know right when I get all your documents. >> Um, so what do you need? Cuz it's a rental. >> Your license, the registration, and the insurance. Does it come with some type of >> And it's not mine. It's my dad's. >> Okay. Does it have any type of uh insurance in it? >> When I get all your documents, I'll let you know. >> So, you don't know why? No, I do not. >> No, I do. >> I want to know who I'm speaking to first. I want to get your documents. Do you at least have your license on you? >> Okay. Do you at least have your license on you? >> I have like a temporary license. >> Okay. Can I have it? >> It's like in my home. >> Okay. Can I see it? >> Well, like why are you pulling me over? >> Because you made a U-turn in the middle of Ocean Avenue and you can't make a U-turn. >> Okay. Johnny, can you sign that? No problem. >> Okay. Is it a New Jersey? Yeah. I'm sorry. I just can't see that far away. >> Um, can you just hold it here just so I can write the number down for you? >> I have like tickets, too. You have tickets >> for what? >> Like my old car. >> Okay. >> And like the license thing. So I got the license. Um like it was just like expired and then like um I missed like a date so I have to go to court. >> Okay. >> I'm sorry. You're what? >> I don't know. I'm like getting pulled over a lot for whatever reason and I just don't understand. >> Okay. Well, oh god. >> Unfortunately, I'm just pulling you over because you made a U-turn in the middle of Ocean Avenue. >> Where are you coming from tonight? >> Um, >> where was food? >> Um, Ro. Okay. How much have you had to drink tonight? >> None at all. I have like a glass of wine. >> Just a glass. Okay. How's your license though? Does it have problem? Does it have warrants >> or >> No, but like I have to go I was supposed to go to court and they had to reschedu it. So like for like a ticket. >> Okay. >> But the little silver one, I don't know if I could pay it or what. Like I definitely don't want to like be in a situation. And I called. I was like, I definitely get like arrested because I missed it. And they're like, no. >> Okay. >> But I just don't want >> What was the ticket for? >> My car was a mess and like my dad wouldn't fix it for like it was like his car. >> Okay. So, I'm in a rental. The rental that they had before that like blew up in New York City. >> Okay. >> The whole [ __ ] thing. So, like I'm in this one now and this one's saying it's a lot. >> Okay. All right. Just hang tight for me. >> She smells like alcohol. She's kind of nice. >> What's her >> She I honestly I don't even know. She had a temporary license. I guess she just got it. So, I just took the number off of her like uh like the what they the one they email you. She's kind of giving me a hard time to even give me her license. She said it's a rental car. Um, so I don't even know if she's going to get out of the car. >> I'm going to run her license, but I'm going to try and pull her out. >> All right. >> I don't know if you can smell anything, but I'm passenger side and it smells like booze. She said she was coming from food. I'm assuming home. >> From where? >> She said she was coming from food. And I said, "Where's food?" And she said, "Run." >> So long branch. >> As she approached Samantha, she detected the odor of alcohol and observed indicators of impairment. Samantha initially had trouble locating all her documents and she told the officer that she was coming from Rooney's Oceanfront restaurant in Long Branch. She initially denied consuming any alcohol before later admitting to having one glass of wine earlier that evening. Proloman Bearinger then returned to her patrol car to check her license. Based on her suspicion of impairment, Samantha was eventually asked to exit the vehicle and perform field sobriety exercises. If you wouldn't mind just stepping out of the car for me. I just want to run you through a few tests and then you're going to be okay to drive if the tests go accordingly. Okay. >> The vehicle just >> arrest me. >> No, I'm not. >> I just want you to perform some tests and then you'll be on your way. If not, >> okay. >> Just because the like you smell like I smell alcohol. So >> that's >> okay. No problem. >> It's really bright. >> I'm going to turn them off. >> Okay. Do you want to just step over here onto the sidewalk? Can you just shut my uh spotlight, too? >> I also can't see that well at night. >> You can't see that well at night? >> That's okay. Um you're a little taller than me in your heels, so I'm going to have you do is I'm going to have you >> whatever you're more comfortable in. It's totally up to you. >> So, >> okay, no problem. Um, but if you would just stand on the street and face me and I'll stand on the sidewalk. Nope. And then you're gonna stand right at the top here. You can just walk straight up to the Yep. Just go. I'll be a little bit taller than you and it makes it a little bit easier. Okay. Do you have any issues with your eyes, contacts, glasses, anything like that? >> I've got a lago so I just can't see that well at night. >> Okay. What is that? >> Is it just not being able to >> like I can't see. Like I have a little bit of night blindness. >> Okay. >> But I'm good. It's like not blind, but just I can't see the whole night. >> Okay, no problem. Any glasses, contacts, anything like that? >> I need them, but no. >> No. Okay. Okay. No problem. So, what you're going to do is you're going to stand with your feet together with your hands down by your side. >> The first exercise was the horizontal gaze nagmus HGN test. During the HGN test, patrol woman bearing observed the lack of smooth pursuit, but she could not make any other observations because Samantha was not cooperative. The following exercise was the walk and turn test. The final exercise was the one leg stand test. Sama failed to follow instructions during both of these tests as well. >> Can you see the tip of my pen? Okay. >> Yes, >> you can. Okay. Can you tell me what color it is? >> Black. >> Black. Okay. I know it's a silly question. I just have to ask. Okay. So, you're going to follow the pen, the tip of your p the pen with your eyes and your eyes only. Okay. You're not going to move your head at all. Do you understand? >> Yeah. Okay. You can see it. >> Yeah. >> Okay. Just follow it with your eyes and your eyes only. Okay. Can you follow it with your eyes? >> I don't really want to do this. Like, this is kind of weird. >> Okay. I'm just testing your eyes to make sure that you're okay to drive. >> I'm fine. >> Okay. No problem. >> Do you want to do the continue the test? >> No. >> No. Okay. Do you want to do any of the other balance tests? >> No. >> Nothing at all? >> No. >> Okay. Can you just stand right here then? >> What does that mean? >> I want you to stand right over there. >> Like what happens if I say no? >> You can refuse. >> I just feel like this is dumb. >> Okay, that's okay. You could sit just >> like what if you refuse? Is that bad? >> Well, I'm going to have to base my decision off of what my observations thus far. >> Oh, okay. >> So, it's up to you. >> You technically it's not. So, what do you want me to do? >> No, it is up to you. If you want to continue to the tests, I can continue to the tests. If you don't want to continue the tests, I'm gonna b make my decision off of what I've observed thus far. >> So, you want to give me a ticket? >> No, I don't want to give you a ticket. That's why I'm having you perform these tests. >> I want you to follow the pet. >> Fine. >> Okay. Can you stand closer to me? Okay. >> Sorry. >> I'm like this all the time. >> Okay. Can you see the pen? Okay. Can you stand with your hands down by your side? With by your side. Thank you. >> Yes. >> Can you see the pen? Okay. >> Yeah. Okay. You're going to follow with your eyes and your eyes only. >> Keep your head straight. >> I'm sorry. I'm not trying this. >> Do you want to continue the test? >> I'll try. Can you stand forward to me? >> Do you want to do the other two tests first? Then we can come back to this. Okay. >> Are you comfortable walking in those shoes? Because they are very tough. You're okay walking in them? >> Yeah. >> Okay. >> Sorry. >> No problem. >> All right. So you're >> see County. >> Okay. So you're going to pretend that there is a line, an imaginary line in front of you. Okay. Okay. So you're going to put your left foot on that line. >> Do you want to take your shoes off and walk in bare feet? >> Whatever. >> It's up to you. >> I can do heels. >> You want to do it in heels? >> Okay. So, you're going to leave your left foot on the line and you're going to place your right foot in front of your left touching heel to toe. >> Okay? >> And you're gonna Yep. And you're going to leave your hands down by your side. >> No. >> With your hands down by your side, you're going to stay in this position until I tell you to begin the test. Do you understand these instructions? >> Yeah. >> Okay. So, you're going to take I didn't tell you to start yet. So, you're going to take nine here. Put your hands down by your side. You're gonna take nine heel to toe steps down that line. >> Oh, like >> I'm gonna explain the instructions. You're gonna stay in the starting >> heel toe. >> I'll take these off. >> Okay. >> That's what you want, right? >> It It's whatever you want. If you're more comfortable in bare feet, then go bare feet. >> Nine heels to test left first. >> Okay. So, you're going to put your left foot on the line and you're put your right foot in front of your left with your hands down by your side touching heel to toe. And I didn't tell you to start yet. Okay. So, >> I'm not Okay. This is a hard test. >> Okay. Do you have any like injuries? >> Yeah, I have scoliosis. >> Okay. But does that [ __ ] >> Does that affect your balance when you're walking? >> Well, I'm like this. >> Okay. But that doesn't affect your balance. >> Well, my I'm uneven. >> Okay, that's fine. That's fine. >> All right. And you're going to stay with your left foot on the line and your right foot in front of your left. >> That's the other way around. >> With your left foot on the line. Okay. with your right foot in front of your left, >> touching heel to toe with your hands down by your side. >> Okay? You're going to stay in this position until I tell you to begin the test. Okay? >> Okay. You're going to take nine heel totoe steps >> down that line. At the end of your ninth step, leaving your lead foot planted on the line. >> Okay? >> You're going to take a series of small steps to turn around and take nine heel to toe steps. I'm going to demonstrate it for you. It's going to look like this. One, two, three. Okay, >> you're going to take a series of small steps and you're going to count back. One, two, three. Again, I did three. You're going to do nine. So, you're going to look you're going to look Okay, you're going to look down at your feet. You're going to count your steps out loud, keeping your hands down by your side, touching heel to toe, and taking nine heel to toe steps. Do you understand these instructions? >> We'll find out. >> Well, do you understand them or no? Do you want me to reexlain them? >> Nine and nine, right? Nine heel totoe steps with a series of small steps leaving your lead foot planted on the line and nine heel totoe steps up. Okay, >> count your steps out loud. Look down at your feet to you. Count them. >> You're not going to count them to yourself if you're counting out loud, right? >> Okay, so count to nine that way. And then what do I do at the end? >> A series of small steps to turn around, leaving your lead foot planted on the line, and another series of nine steps back down the line. >> Okay, >> do you understand these instructions? >> Yeah. Okay, you may begin with your hands down by your side. >> Okay. One, two. This is like your drunk test, but like I'm not drunk. Like, it's impossible to do this. You know that, right? >> It's not. >> Three. Four. >> Okay. Keep going. >> One, two, three, four, five, six, seven, eight, nine. >> Okay. Am I drunk or not? >> Is that how you wanted to complete the test? >> Yes, I do. >> Okay. The next one is going to be the one leg stand. You're going to stand with your feet together with your hands down by your side. You're going to pick one foot, either of your choosing, approximately 6 in off the ground. I'm going to demonstrate it. Okay? It's going to look like this. 1 10 1 2 1 1003 and so on until I tell you to stop. So that foot is going to be parallel to the ground with your legs straight. And you're going to count aloud in the fashion 100200 3 and so on. Keep your hands down by your side and counting out loud. >> I wasn't listening you. Sorry. >> Okay. No problem. >> Can you say that again? Yeah. So, you're going to stand with your hands down by your side and your feet touching heel to toe. Yep. Right there. You're going to lift one foot either of your choosing approximately 6 in off the ground. It's this approximately the size of a soda can. It's going to stay parallel to the ground with your legs straight. And you're going to cattle out in the series of 1001, 100,00. Do you understand? Do you want me to demonstrate it again? >> Yeah. What if I say like I'm done? Well, that's up to you. I'm going to base my my decision >> figured out by now. Am I drunk or not? >> Well, I'm going to base my decision off of my observation. So, if you would like to stop the test, you can stop the test. >> I would like to stop the test. Am I drunk? >> Okay. So, just hang out here for a second. If you don't mind, I'm going to speak to my other officer. >> Yeah, just hang out there. It's fine. >> She's on Um, can we go up for a second? Like a sound? Are you good with it? >> Can you step back out of the vehicle for me? >> I just told you to hang out for a second >> because I'm arresting you for driving while intoxicated. I'm not drunk. >> Okay, that's fine. You can go inside and you can do the breath test and then we can proceed from there >> because that's how it's going to go. Can you please step out of the view >> based off of my based off of my observations? I gave you multiple times to perform the tests and this is my decision based off of my observations. >> I'm not drunk. >> Okay, that's fine. We can go inside and we can >> Where? >> Inside of our police station. >> I'm not going there. >> Okay, you are. >> Why? >> Because I'm placing you under arrest. >> Why? for driving while intoxicated. >> I'm not drunk. >> Okay. I gave you ample time to perform these tests. I smell alcohol. >> No, you don't. >> Okay. Can you please step out of the vehicle? >> No. >> This is not good. This is not correct. And you know it. >> Okay. If you don't step out of the car willfully and we have to pull you out of the car, that's an additional charge to just the DUI. >> I don't have a CUX in my truck. >> Okay, then you can prove that when we get inside. >> Are you [ __ ] kidding me? >> No. >> Why are you giving me >> based off of my observations? I had a glass of wine. >> Okay. >> Okay. Then we can prove that inside. >> Okay. Her dad doesn't care about her. >> Okay. >> So, you know what? You can think what you want in mom of thief. But that's the truth. So, if you want to [ __ ] arrest me, you're going to [ __ ] up that. >> Okay. >> I have enough [ __ ] going on. >> All right. >> And you're fine with that. You don't care. >> Well, it wasn't my choice. >> No, it is. I didn't do anything wrong. So, >> okay. Well, I gave you ample amount of time to perform the test. >> The [ __ ] shout out test set up to [ __ ] fail so that way you guys can [ __ ] get what you want. out of whoever the [ __ ] you want. Like, come on. >> No, I'm not [ __ ] stupid. >> Okay. So, can you please step out of the vehicle? >> No. >> You're not going to step out of the vehicle? >> No. >> So, you want an additional charge on top of >> No, I want you to do the right thing and arrest somebody that actually deserves to be arrested and it's not >> Okay. Well, unfortunately, you'll have your day in court to explain all of that and >> I do. And I don't any of this. So, >> okay. Well, this isn't court, so we're not going to deliberate that now. >> Great. So, like, why don't you find someone else? >> Okay. So, will you please step out of the vehicle? >> No. >> It's not a traffic. >> It is. It's just tickets. >> You're saying I have a DUI? Like, I'm good. I don't have a DUI. You're getting out one way or the other. >> I will get out. We're going to get you out. >> Well, you have two options. It's getting out of the car willfully or we're dragging out of the vehicle. Grab it. >> You can't do that. >> Can't withhold my stuff. >> Here's your phone. Get out of the car. >> We're not waiting all day. >> Yeah, we're not waiting on it. Um, >> come on. >> You have to get out. >> You're getting out of the car. >> And where am I putting the car? >> We're towing it. >> No, you're not. >> Yeah, we are. >> Yeah, we are. >> Why? >> Because that's the rules. >> I'm not drunk. Breathalyze me. >> We are when we go inside. >> No, right now. >> No, that's not a thing in New Jersey. >> No. Well, then what is it? You blow inside. >> Blow inside of what? >> Say that again. >> Blow inside of what? >> Inside of our police station. >> I'll do it now. >> You can't. It's not a thing. >> That's [ __ ] >> Jersey. >> Just get out of the car and make this easier. >> No, this is not easy. This is not >> Okay. So, you want to get dragged out of the car? >> No. I think this is [ __ ] insane. >> Okay. Well, you're either going to get out or we're going to drag you out. >> It's one of the >> You literally have two options. If we drag you out, you're getting additional charges. >> And it's criminal charges and they're criminal motor vehicle or motor. You're getting fingerprinting. I did nothing wrong. >> Okay. Well, you're getting out of the vehicle right now. So that's >> No, I'm being like harassed by the police. >> You're not. >> Yeah, I am. Every five [ __ ] seconds here. >> All right. >> For whatever [ __ ] reason. >> Okay. >> Can you get out? >> No. >> Then we're pulling you out. >> Do you want a criminal charge? >> What's the difference? >> Well, right now, right now, you're just getting tickets. >> What? Like for just >> for what? >> For this offense? No. >> No. For real? Like for what? What did I [ __ ] do? >> Well, you made the U-turn in the middle of Ocean Avenue. That was the reason. >> Find someone else. Like I'm not doing anything wrong. Leave me alone. I'm tired. I want to go home. >> Okay. You can go home when we're done with this. >> I'm not going in the back of your car. >> Okay. Well, you are. >> No, I'm not. >> I'm not a criminal. I'm not going in the back of a cop car. Both of you can know. >> There's nothing wrong with me. And you guys can literally know. Come on, let's go. >> No. >> Get out of the car. >> Why? >> Cuz you're getting arrested. >> For what? >> DWI. >> Come on. Let's go. >> I didn't I didn't drink. I'm not drunk driving. >> Get out of the car. >> Get out of the car. >> I'm pulling you out of the car in 3 seconds if you don't get out of the car. I've asked you kindly >> multiple times. >> No, I'm not. I'm not drunk driving. I'm not getting into >> I'm getting out regardless. Whether you're getting dragged out or getting out by yourself, you're getting out. >> Great. I'll get an Uber if it's like that. But like I'm not >> You're not getting an Uber. You're coming with us. >> No, I'm not. >> No, you are. >> Why? >> Because you're getting arrested >> for what? >> Drunk driving. >> I'm not drunk. >> Okay, you can. >> We will when we get inside. >> Because that's not how New Jersey works. >> Why? >> I don't know. Ask the lawmakers. >> Get out of the car. >> We're giving you one other opportunity. You either get out of the car or we're charging you with resisting. >> You said you have a three-year-old at home. >> If you get try to give me a drunk driving thing. You want to go home tonight or do you want to go to jail tonight? >> If you get criminally charged because you're going to tell the truth as to where I'm going in the back of that car. Like, no. >> We're going to our headquarters for DWI. You'll go home tonight for resisting arrest. You might go to jail for the rest of the weekend. >> E. >> Get out of the car. >> That's the You will not see a judge until probably Tuesday morning at 8 a.m. >> That's disgusting. >> Correct. So, you're going to either get out of the car. >> This is disgusting. >> Get out. >> So, you're either going to see a judge at 2 o'clock in the morning if we end up >> tonight in jail. >> No. >> No. >> If you go to jail tonight. >> No. Like right now. >> You're not going to jail. You're going inside for maybe 45 minutes. Maybe. >> Okay. Um, how about like No, I didn't do anything wrong. >> You're going >> to where? >> Our headquarters >> in Mammoth Beach. >> Correct. Who the [ __ ] am I not? >> You are. >> I'm not. >> Okay. >> Based on her traffic infraction, the odor of alcohol, her admission to consuming alcohol earlier that evening, and her inability to satisfactory complete the field sobriety exercises. Samantha was told to exit the vehicle because she was going to be placed under arrest for DWI. At this time, Samantha became uncooperative and refused to exit the vehicle. Despite multiple attempts, Samantha refused to cooperate, so she had to be forcibly removed from the vehicle. After a brief struggle, Samantha was eventually placed inside the patrol car. Her vehicle was impounded for a 12-hour hold according to John's law, while patrol woman bearing her transported Samantha to the Monmouth Beach Police Department for further processing. >> What? Get out of the car. >> Ow. Stop. Get out of the car. What the [ __ ] >> Get out of the car. >> OW. STOP. OW. Get off of me. Get off of me. >> What the [ __ ] >> Are you [ __ ] kidding me? Could have been a lot easier. >> Ow. >> Stop. Stop. Stop. >> Got it. >> Yep. >> My boot's out. >> All right, I'll grab it. Which one? Do you want me to pick up the whole thing? Is it up? >> You want to? >> I just wanted to slip off. >> I can't see it. >> What? Did you lock it? >> No. Sorry. >> It's fine. Honestly, it's fine. >> Yeah, as long as she's not going to slip it, I think it's fine. All right, come on. Tell Matt to start. >> I believe. >> Can I have my flashlight? >> All right. >> We're not sure yet. I'll let you know. >> Just step in the vehicle. >> [laughter] >> You got her. >> 33 32. Connie, I'm going to have a female 41. Can you start arties for a toe? >> Cino's daughter. >> I put her uh little bag in your front seat. >> Did you search through any of this? >> No, I didn't look at any of that. Can you hold this? 332. Just confirming there's two in custody there. will just see him. at >> least you already got 27. >> Yeah. >> Check that little yellow bag in the front seat, too. this house. >> Amy, you want her to come up here and I'll go in with you? >> Yes, please. >> Yeah, if you don't mind coming up this way. 32 from >> dead cross on >> that island. >> Okay, cool. Yeah, in a second. >> Let me out. >> When we get to headquarters, >> let me out. [crying] >> Just breathe. You're fine. County. I'll be transporting that female 41 to headquarters. I love starting and ending miles. Just take a breath, Amanda. Just take a deep breath. You're fine. Or Samantha. I'm sorry. Samantha, just take a deep breath. Samantha, just try and breathe.
