I'm officer Bow Plains Police. License, registration, shirts, please. Around 1:48 a.m. on April 6th, 2025, patrolman David Bowen with the Plains Bro Township Police Department observed Y 2017 Toyota Corolla swerving on Route One southbound in the vicinity of scutters no road. He activated his emergency lights to initiate a traffic stop and the driver initially pulled into the left lane before crossing back into the center lane and eventually stopping in the right lane just south of Mapleton Road. >> Just to let you know, my body camera is on. Okay. And the reason I'm stopping you, you're failing to maintain your lane. You're all over the place. >> Sorry, I'm not I'm not trying Where are you coming from? >> New Jersey. North. >> Okay. >> Where where were you out anywhere good in North Bergen? Uh, excuse me, North Bergen. >> Yeah. Like, you know, like 74th Street. >> No. Where's that? >> It's like by like, you know, Hudson County Park, like the big lake. >> No, I'm from like South Jersey. >> Oh, okay. Well, I was expecting an hour, but like the big like Okay. All right. How much have you had to drink tonight? Um, not a lot. I like the beer. >> Okay. How How many beers? >> Like one. >> Okay. When was that? >> Um, like 3 hours ago. >> 3 hours ago. Okay. How big How big was that beer? Or what kind? >> Um, >> was like an IPA or >> No, it was like like a Corona. >> Corona. Okay. All right. Do you have the registration insurance? >> Of course. >> This way. >> I remember my mom being here. It's like a Were you out anywhere good at uh 74th Street? Is that like a restaurant or is that just the name of the street? >> No, it's just the name of the street. >> Okay. Where were you? Were you were there anywhere good there? He made contact with the driver of the Toyota who was identified as 23-year-old Olivia Dmings. She provided him with a suspended driver's license and failed to produce a valid registration or proof of insurance. As he was speaking with Olivia, he detected the odor of alcohol and observed other indicators of impairment. Olivia told him that she was headed to her boyfriend's house near Atlantic City after leaving her home in North Bergen. Olivia eventually admitted to drinking alcohol earlier that evening based on his suspicion of impairment. Olivia was asked to exit the vehicle and perform field sobriety exercises after Corporal Atkinson and patrolman O'Brien arrived on scene to assist. >> What do you mean? >> Like were you out to eat? Did you hang out with friends? Like where were you coming from up there? >> Oh yeah. Yeah. No, I was just out with friends. I have like um >> I have everything on my phone. >> Okay, that's fine. You can show me it on your phone. >> Yeah. This is my my Geico. >> February. Okay. That that expired February of this year. Do you have you have an update one? >> That's it. February somewhere. >> Okay. >> Like I'm sorry. Like I'm like my parents like put everything. >> Okay. Who's Who's the >> I'm not going to lie. Like the registration like like this thing. >> So that that's different from the registration. That's inspection. Yeah. >> Inspection. >> Okay. >> But um >> where were you headed? Where were you headed to? >> I just live with my boyfriend. I always >> Where's your boyfriend live? >> Um right here like in um what is he called? >> Um he lives kind of by like um like the outskirts of like Atlantic City like that area. Okay. Do you know where you are right now? >> Yeah. >> Okay. Where are you right now? >> I always go by this area. >> Okay. >> Do you know where you are right now, though? >> Yeah. >> Area wise? Where where do you think you are right now? >> This is South Jersey. >> No, this is not this this is Middle Sex County. >> Yeah, but like South Central. >> Uh you're from Atlantic City. You're probably like an hour and a half. >> Yeah, I know. >> Okay. All right. All right. So, what I'm going to have you do, you can stop looking for that cuz I can smell the odor of alcohol coming from you. I'm going to have you get out. I'm going to run you through a few tests to make sure you're okay to drive. Okay. >> Yeah, of course. >> All right. That's all right. >> Yeah. >> All right. Perfect. You can step out on that side, Olivia. Now, you can you can leave your phone. >> All right. We're going to come right back here. All right. Can you just can you turn those off? Yeah. >> Petroman Bowen started with the horizontal gaze nice HGN test and he observed for six indicator of impairment. The second exercise was the walk and turn test. During the walk and turn test, Olivia failed to touch heel to toe on each step, took an incorrect number of steps, and failed to keep her arms at her sides. The final exercise was the one leg stand test. During the one leg stand test, Olivia failed to raise her foot in the prior fashion and displayed a lack of balance. >> You're good. Just right here. Right here. Right on this line. It's perfect. Uh just do me a favor. Put your feet together, hand to your side. Okay. So, the first test I'm going to do is I'm just going to check your eyes. Okay. So, you see you see the tip of my finger right here. >> Just follow the tip of my finger on my finger only. With your eyes and your eyes only. Do you wear glasses or contacts? >> Yeah, contacts. >> Do you have them in right now? >> Yeah. >> Okay, that's fine. But you don't have any issues that would prevent you from doing this test? No. >> Okay, very good. Just follow the tip of my finger. Right. Heat. Heat. Heat. You follow my finger. >> Follow your finger. >> What's that? >> I'm following your finger. >> Okay. You keep you keep staring straight at me, though. >> So, you're not following it. Just keep looking. You keep staring straight. >> Sorry. >> Okay. With your eyes, baby. Look at your eyes. >> All right. The next test we're going to do is call the walk and turn. Okay. >> Yeah. So, for the walk and turn for the first thing we're going to do, well, see this line right here? We're going to use this line. Put your left foot on the line. >> Left foot. You put your right foot in front of it just like this. Heel to toe. Hands down at your side. Hands down your side. And you're just Nope. Don't start. Left foot on the line. >> Okay. >> Okay. So, so your left foot. Perfect. With your right foot right in front of your left, heel toe. Hands at your side. >> What do you mean? >> Exactly like this. Okay. >> Right. Exactly like that. Hands down at your side. Wait, I don't get it. >> What's not to get? Left foot on the left foot on the line like you have. Yep. And then put your right foot directly in front of it touching heel to toe with your hands at your side. Do not start the test until I tell you to begin. Okay. >> All right. You understand? >> Yeah. >> Okay. So, from that position, you're going to take nine heel to toe steps down, turn around, and you do nine heel to toe steps coming back. I'm going to demonstrate and then you'll perform it. Okay? So, from that position, you do one. Nope. >> Get back in the starting position. >> Sorry. >> Do not start until I tell you to do so. Okay. >> So, from that position, you're going to take nine steps. I'm gonna do three. >> Yeah. >> One, two, three. Again, I did three for demonstration purposes. You're going to do nine. On your ninth step with your lead foot, >> you're going to do a series of small steps and turn around. And you're going to come back again with nine steps. One, two, three. Again, I did three. You're going to do nine. During the test, hands at your side, count out loud, watch your feet, and once you start the test, do not stop the test. Do you understand? >> Yes. >> All right. You may begin when you're ready. >> All right. All right. So, 1 2 3 and All right. Ready? Are you going to let me know when to start? >> Yep. Whenever you're ready. >> Ready? 1 2 3. And then I go again. 1 2 3. One 2 3 1 2 3 1 2 3 1 2 3 When do I turn around? All right, you're good. We We're going to move on to the next one. Just walk back to down here real quick. Go back over here. >> Why? >> No, you're good. You're good. We're going to stop the test. Go back over here real quick. We're going to do the last one. Okay. >> Yeah, I'm fine. >> All right. I >> I'm sorry. I just >> That's okay. You're fine. Uh put your feet together, hands down your side. We're going to do There's nothing that prohibit you from doing like a onelegged balance stance or anything. Okay. Right. >> Yeah. >> All right. So, when I tell you to do so, you're going to pick a leg of your choosing. It could be left leg or right leg. Doesn't matter. Okay. You're going to pick pick it up approximately 6 in from the ground. Okay, do it. Do it. >> Lights up. Just put your put your feet back together and put your hands back at your side. Do not start until I tell you to begin. >> Okay. >> When I tell you to do so, again, left or right, whichever leg of your choosing, >> you're going to pick it up approx approximately 6 in. Can I please finish instructing you? Okay. Thank you. >> I'm so sorry. >> 6 inches from the ground like so. And you're going to look down at your toe. You're going to count out loud. 1,00 1,002 1,003 and so on. >> Yeah. until I until I tell you to stop. Okay. >> So again, while you're doing the test, look down at whatever foot is raised, >> hands at your side, keep your legs straight, and count out loud. >> Hold on one second. Hold on one second. Hold on one second. >> All right, you can begin. >> 2009, 2002, 2003, 2004, 2005, 2006, Keep going. Yep. >> All right. You're you're good. >> Okay. I just had 34. >> I don't know if this is like over I don't again I don't know if it's personal. So, how much alcohol did you drink tonight? >> I just had a beer. >> A beer? >> Yeah. >> What kind? >> Um, you know, like the IPA is like the uh I think it's called like a I don't even know what it's called. She just had a bar and like whatever. She was like, "Just come to my house. Just like don't see him tonight." She's like, "Don't tell him." And I was like, "Okay." >> Okay. How long? Where'd you drink that drink? >> Um like in Elizabeth. >> Yeah. >> All right. >> Cuz that's where she works. >> I'm going walk you to your trunk of your car and then we'll talk about Officer Bond real quick. I told you getting hit by a car. Thank you. Over here. Over here. Car. We'll be right with you. I'm sorry. Where you headed to? >> Where you going? >> Last weekend. Yeah. [cheering] Heat. I'm sorry for the trouble I caused. I I didn't mean it. >> I don't know anything about what's going on out here. Just have somebody out of the vehicle. They have more officers come >> for safety. You guys, at the end of the day, you guys are just doing your job. I get it. just had some like personal stuff I was dealing with that I didn't want other people to know about. But >> all right, what I'm going to do, I'm going to check your eyes. Same test that he did with you. >> No, that's fine. >> All right. >> No, you guys are welcome to do any test you want on me. >> All right. So, same thing. Can you see my finger? All right. >> Yeah. Move it from side to side. Keep your head totally still facing me or you move your eyeballs. Okay. >> Got it. Heat. Heat. Sorry, it's cold. >> I know. It's too little chilly out here. >> So sorry. Same thing. This time we're going to go off. >> Okay. Yeah, of course. I lost like >> it's just >> sorry you didn't make that right >> it was >> based on her erratic driving the odor of alcohol her admission to consuming alcohol earlier that evening and her inability to satisfactorily complete the field sobriety exercises. Olivia was placed under arrest for driving under the influence. After she was placed under arrest and placed inside the patrol car, her vehicle was impounded for a 12-hour hold according to John's law. Patrolman Bowen transported Olivia to the Plains Bro Township Police Department for further processing. All right, just do me a favor. Turn around, face that way. >> All right, just put your hands behind your back. All right, we placed under arrest for DWI. Okay. What's that? >> Oh my gosh. >> Do you need anything out of the car? Cuz the car could be towed. >> Oh my gosh. What do you mean? I'm being placed. >> You're being placed under arrest for DWI? >> Okay. >> Do you need anything out of the vehicle? >> I need my phone. I need to call my mom. >> Okay, we'll we'll call your mom in a little bit. >> Is there a house key or anything in there? >> No, >> there's no house keys. Okay. >> Call my mom. Guys, you don't understand. >> Do you have anything on you in your pockets or anything? >> I don't. >> No, >> I need to call my mom. >> Okay, we'll call her in a little bit. >> You'll have You'll have that chance after going to call me a record. >> So, in the state of New Jersey, a DWI is a traffic ticket. essentially speeding ticket. So in other states like Pennsylvania, it's a per it's a criminal offense. So that's the one thing in the state of New Jersey that it's not. So it's not a good thing, but it's not the end of the world. >> But I want to understand a seat right here. Okay. >> Yeah. So either uh >> she showed me insurance from but it >> play nice nice >> but expired expired February of this year. >> Which part the insurance or registration? She didn't show me registration. >> The insurance card she gave you was >> Was it? She showed me on her phone, but it's expired from February this year >> on her phone. Take a picture or she went on the app. >> Just like uh just a policy date to date like from start to finish on the app. >> While you're here, can we start looking for a valid card if the list? Just issue both. >> Uh yeah. If we can't find one, just issue the 6B2 and then that's her problem to if she has a valid policy and she can't get the digital card right now, then easy peasy. But uh >> at the station, Olivia was read the standard statement for motor vehicle operators and she agreed to submit breath samples. Her alco test results eventually indicated a back level of 0.170% which was more than double the legal limit of 0.08%. 08%.
