Hey everybody, this is a crazy video where this cop loses qualified immunity for walking in a backyard. >> You have a warrant or reason to be on private property? We've had problems with being bullied here in our yard and officers coming I didn't say you did. I said the officers that have been coming through my gate without a warrant. >> Okay. >> Have been bullying me in my yard. Police officer, you're in my yard. >> I just came over here to see if y'all all right. >> We're great. I don't >> Y'all good? >> That's why I've said, why are you in my yard without a warrant or cause? Does that give you right to come on >> private property? >> I can check your gate. I can check on you, sir. >> No, you can't. The curtilage of your home is protected area. Cops are not allowed to just waltz up on your curtilage of your home or walk in a unsecured gate because it's unsecured. This cop is a buffoon. >> So, you can come through an unsecured gate >> Listen. >> without a warrant, you can come on private property without a warrant? Just because you want to? You're asking that's what you're telling me. >> I'm here to answer questions if it's unsecured property. I'm making sure that everything is all right. >> That still doesn't matter. Still private property. You know the property line. >> Yes, sir, I do. It was an unsecured gate. >> But nobody requested your your presence here. >> I'm just talking. All right. >> Walk of shame. Here's the walk of shame. The cops are not allowed to walk in your backyard through your unsecured gate to make sure that you're okay. Sometimes they get reasonable articulable suspicion of a crime being committed, they can walk up on the curtilage of your property to investigate a criminal offense. Maybe your neighbor called about a complaint where you're allegedly selling drugs and the police want to go do what's called a knock and talk and talk to you about this complaint that your neighbor made about you allegedly selling drugs. Defense is enough that it should keep the police out of your property because it's a fence. You're not allowed to go beyond this fence without permission from the homeowner. It's really basic legal theory, officer. It's not hard. He knows he's wrong. I mean, you can tell from the look on his face and the way he really tries to reach for this unsecured gate thing and and try to to make sure that you're okay. I'm just making sure that you're okay. He's trying to justify his unreasonable entry on your property. When he unlawfully enters your property, he puts himself at risk of losing qualified immunity because now he's violated your Fourth Amendment right and your Sixth Amendment right and he's working on your First Amendment right. I mean, this guy really doesn't understand the whole protection of qualified immunity mean you have to be operating within the color and the scope of the law. And if you operate outside of the color and scope of the law, then you can lose qualified immunity just this fast. What do you think?
