the lane it is okay heree turn [Music] water hey brother I got a DUI right here um Beverly and Shaler he's turning right on shifer you want it um I mean no I'll always take it yeah no I'll take it it's out of New Jersey it's on yeah definitely F I'm over ATA the officer pulled the vehicle over and explained to the female driver the reason for the stop the driver who was from New York denied having anything to drink despite the erratic driving the officer suspecting DUI requested her to step out of the car for a further evaluation officer Garcia Shamy Police Department get your driver's license where you coming from ma'am I'm coming from a after spot I'm not sure the name I think it was I'm not sure the name I was with my friends you with your friends yeah I'm from out of town okay where you from I'm from New York New York okay you got South Carolina ID yeah yeah my grandmother lived in South Carolina I used to live there when I was pregnant I got a 7-year-old I got you so you got any weapons or any uh narcotics inside the car I need to know about no no nothing like that no okay so the reason why I stopped you know why it stopped you man was I going too fast I was going 30 something you was all over the roadway okay you weren't using your turn Signet or anything and then you even did an improper lane change and you couldn't even maintain your lane so are you okay to drive that's my concern right now I'm okay I Live 5 minutes away I live at the brook in Brook Haven in Brook Haven okay so how much did you have to drink today to drink did you have anything to drink today no okay so why are we all over the road I'm not familiar with this area I got family that live out here so I'm back and forth so I live in South Carolina bburg as on my license but I'm from New York but you from New York yeah I'm from New York as you can hear in my accent so where did you come from exactly so that's the after spot so before that you come from Hollywood right there on off the be for Highway I think so cuz before that I came from a place called the and that was a place like a African place like a a parking okay okay so I have an officer here my he's basically a sergeant gei in order for me to let you go and drive we want to make sure that you're okay to drive okay just based off the indicators you gave us of going in and out of the roadway not using it your your turn turning signal and stuff like that so Sergeant gee is going to talk to you can you step out of the car for us sure okay she's coming out on that side another officer arrived to assist with the evaluation throughout the interaction the driver kept insisting that New York has different rules than Georgia which confuses the officer how are you hi good evening how are you I'm doing good I'm Sergeant G with SH police okay I'm take care oh where you coming from tonight I don't know the exact place that I'm not from here but before that I came from a place called rosebar rosebar Lounge okay what rosebar Lounge yeah before this place I last came from I'm not from here I'm from neor okay I got you all right we you heading to Home where's home at for you the brook and Brook okay shallow for Road 2500 shallow for Road I got you okay all right how much you had to drink tonight I didn't drink at all nothing okay no I don't drink at all nothing okay no all right no prescription medications anything like that no I don't take any medication okay okay all right I just got here so that's why I'm asking no I understand it's fine okay what brings you here from New York I'm from New York I got a family that live in South Carolina so my main address on my address is South Carolina but I live in with a family member okay so my address okay all right so how long have you been here in Atlanta uhhuh since 202 how come we still got New Jersey tag that's a rental so I'm suppos yeah that's a rental I got the rent like 2 days ago I actually drove back so I'm waiting for a white one this is the gray one I'm supposed to get one oh I got you yeah okay that makes sense all right fav just step up here which one just step right up here real quick okay you stand right front the car if you don't mind oh you can relax I'm just going to talk to offic your G okay try to get me the door what you got did you get any no I'll ask her she'll take a breath test so I I basically told her that in order for me to let her yeah I'm okay ready in order for me to let her leave um that you were going to come give her a test um she was all over the road man she improper lane change didn't use her turn signal okay um yeah really to main day got you got you got you all right so I was talking with officer Garcia obviously the one who stopped you he said you're kind of having some trouble staying your lane and and some other yeah I'm not from here you guys have a little more more rules in like New York so is staying inside of the lane different in New York no it's not different but like you guys have way like I've drawn I got my license since I was like 18 I've never got pulled up forever ever in life okay all right how old are you now 26 I'll okay all right so all right Officer Garcia just said that you're having some issues staying within the lane mhm um basically crazy because I signal I'm so confused right now okay all right so basically I just want to make sure you're safe to operate your vehicle okay it you take no prescription medication at all and you haven't had anything to drink no I started therapy Thursday actually and I put myself in therapy I'm perfectly fine okay all right I have a um it's called an a toxy meter it's a preliminary birth test positive or negative for alcohol if you are um it's completely voluntary okay if you'd like to do that then I can I can go grab that takes to about 20 seconds to do it and then we'll send you on your way okay whatever it works I just want to get home I have work in a morning I work from home work for Verizon supervisor at Verizon call center or Verizon call center mhm how long you been out there two years I got the job two years ago okay all right what call center do you work at so I work in Atlanta but my call center is Tampa but I get calls from like all over the world okay all right hang tight with officer gcia you for a second okay get okay all right this is all sealed tight so you know don't have any germs on it okay I'm going to open it up put on here this is super simple all I'm ask you just take a deep breath blow into the tube for about 5 Seconds just like blowing up a balloon just like take about 5 Seconds keep that going but I need about 5 Seconds of that without stopping okay okay and once you do that we're done and we'll get you on your way fair enough no problem Fair all right go ahead and take a deep breath for me and then go and blow in there go go go go go go go go go go go go go go all right hold F all right little less air you did a great you did a great job on that except they blew a little too hard I'm sorry that's all good so little less just nice and steady like I don't sound silly but okay deep breath and go ahead and go go go go go perfect awesome it came back with a blood alcohol content of 0.147 this was significantly higher than the legal limit of 0.08 in Georgia despite the evidence the driver continued to deny consuming any alcohol why weren't you just truthful huh how come you just weren't truthful how about wait I didn't have anything in J all right so 5 minutes from home my daughter's with her with her dad I got to wake up and go to work list I get I get that so that's the reason all right I can tell you that you have that your speech is slurred just by just by talking with you okay so my question is is that how much have you had to drink I mean just just be up front I know it's not nothing no of course okay the officers following protocol asked her to participate in field sobriety exercises she agreed and her performance further confirm their suspicions I have a couple of options for you okay okay option A I have some evaluations so I can run you through to see if you're safe to drive okay all right involves be checking your eyes your ability to walk stand and balance okay it's a series of three evaluations okay okay completely voluntary if you'd like to to do those we can probably do them right over there on that sidewalk and get out of the roadway mhm um is that something you be willing to participate in whatever works that's going to go when my kid got work and morning she's seven she'll be seven in April 24 who's she with right now her dad okay so she's I got you all right let's step over here what I'll do is running through some EV yeah please running through some evaluations and then all right you have a jacket in the car no this is the only jacket I have all right step down this way for me okay hey Garcia can you kill my fronts all right all right you wear glasses or contacts no not at all okay do you have any issues with your eyes at all not that I know I mean I have a little bit of ey sight problem in this eye but I think I should be fine enough I haven't had any like issues otherwise okay gotcha anything any traumatic head injury no not at all not any head injury okay all right anything that affects your ability to walk stand or balance no I should be fine okay all right I'm going to ask you just put go ahead and put your feet together for Stand By Your Side for now what I'm going to ask you is keep your head still I'm going to ask you just to focus on the tip of my finger okay all right I want you to keep head perfectly still just follow with your eyes and your eyes only okay here you go ahead and stay in this position I'm going to demonstrate for you what I'd like you to do okay this is just a called walk and turn okay what I'd like you to do is imagine a straight line for me okay right down in the middle of this all right what I like you to do is take and put your left foot on that line right foot in front of the left heel the toe put your arms down by your side go ahead and stay in that position until I tell you to stop okay this is Sil left foot on the line is this good left foot on the line right foot in front of the left heel the toe and go ahead and keep your arm down by your side and stay there for me okay okay good I need you to hang oh my goodness ready all right you shortest one all right you can stop all right you can stop okay back up here stay one end up falling here as a result she was arrested for DUI you're okay now I know you can slip my cuffs cuz of how skinny you are if you do is going to be really bad day for you okay you've been very Cooperative with us this far okay mhm just just go ahead and just keep it like that no problem all right it's not the end of the world you are going to jail today though cuz you are under arrest with Pui all right is there anything in the car value yeah is there anything in the car value that's valuable my phone I'll get your phone for you'll need that um I have a question yeah sure I have a phone call on my phone that I would like to get can you please get my phone so I remember the number uh we're going to bring your phone with you okay so I don't remember everybody's I at the jail they're going to give you your phone and go ahead and look after being advised of her Miranda rights she agreed to further testing at the station I'm going to read you I got to read you this okay no problem ah now I can smell the alcohol I couldn't smell it out there a search of her vehicle revealed a gun despite her denying having any such weapon the state of Georgia's conditioned your privilege to drive upon the highways of theate will you submit to the state administered chemical test of your breath and your blood I do awesome thank you 371 radio black red accept it all right hang tight for me okay okay I um I stopped the evaluation cuz she um it wasn't safe she was going to fall so so light too um yeah he all over the road bro yeah see he's going to blow I asked her for breath and blood I'm going to um she agreed so I'm going to take her we'll take her to 150 and do in talk okay so I tell 393 to go ahead and transport cuz I told her to hold real quick um so she's going to intox no just have her hold I mean I'm going to call CT real quick is that his J1 yeah that's his she was then transported to the police station for testing I've never been like arrested before like what happens to my vehicle and things like that so it was going to go to Brown and Brown Tony which is in our city of shambley where you're at right now M um I'm going to give you the address exactly where it's at as long as it's written down yeah sorry as long as it's written down that's fine yeah you're going to have all the information for departing from me okay okay and like I'm not familiar with how this works like I said I'm not like a criminal with prior like how does it work with like contacting a family member because usually people that are in this situation that I know they're able to make a phone call and I know that I I'm a daughter of a sergeant so in New York Sergeant yeah of in New York oh look New York of course so like I just want to know like how this works yeah out here so it's similar you are going to get a phone call right it's just not right away you got to book you in first in County Jail no problem and then be that phone call all right all right and approximately how long does that take because I do have work at 9:00 take so it's going to be about a good hour or so okay do you think realistically I'll be out by 9ine cuz I have to it's a possibility okay you're going to have you already going to have a a bond that you got to make so so a bond has to be made yeah for you would get out unless you want to see the judge tomorrow morning and stay in jail okay yeah I just have to make it for work and there's no phone call that can be made now like as it right now no for our policy I can't let you do that all right okay so in other words we're going to use these things here you're going to blow back kind of like you did the two before okay except it wants you to fill it up it wants you to blow a lot of air in if you do that I asked you for breath and for blood but if we can get through this I don't have to pull your blood that Mak sense you said if we get through this we have to pull my blood no I don't yeah if this is successful we don't have to go do a blood draw okay okay so and I'll give you I'll give you the instructions again it has to go through a little cycle I'm going to enter your enter in your information once we get all that done it takes there we got to do it twice so once we do the first one the second one takes about 5 minutes to wait and then we'll be done okay sure I know have at 95 a.m. okay and I know that I'm not like intoxicated to the point where like I can't make work so like if we get like I said I know you're not here to accommodate me but if we can get this successfully done by the time I can make work I'm realistic I'm a supervisor I'm not in a position to afford to miss work sure so I'm going to tell you that this is when I tell you that we you're going to make this as painless as possible for you not of course so these are citations so we're not booking you into the cab county and you have to see a judge or anything like that we're literally going to book you in with our citations it's traffic charges okay okay so you're going to have to do is bond out okay you'll be able to do that once you get there if here the thing I'm not familiar with being like in car or arrested So when you say bond out a person who's not from here and has no family here realistically what is bonding out if they have no resources you Bond yourself out yeah with what so I mean you're you're driving a Porsche you don't have way to bond yourself out I'm going to be completely honest with you I have an older guy who likes me he got me that Porsche before this Porsche I was driv in a Honda Civic I work from home for Horizon like what I make as a supervisor is nowh here with that portion here so like it's different I make an honest living I used to work I used to work for Verizon I I spent 16 years there so as a supervisor I could tell you I made a I made 45,000 as a supervisor yes from home I promise you they robbing y'all they are I don't know if because I live in the south or what I have to say can I go case to New York that like you want to change like salaries or like that's the only reason why I'm still like in the South that's crazy so some dude just gave you a porer drive not some dude so it's a guy that's older that likes me all right fair enough how Chesters go you really called him a Chester that's what he is he's like definitely more than half my age from 26 that was like 43 I'm not mistaken nice guy though so uhhuh all right all right we're going to do this and then you guys and we'll talk about how long that alcohol takes to get out of your system okay take a deep breath mhm and then blow and keep going Fill This Bar all the way up mhm all right go go go go go go go all right good perfect go and have a seat okay all right that's going to do it thing recycle in 5 minutes we'll do it again and you're done okay okay what I literally had a margarita just one so like I'm very shocked at this because like I said growing up in a Caribbean West indan household when you're giving beer and wine at 10 years old 11 years old and it's normal to drink from your parents spent a lot of years there girl all right go ahead and do what you did last time go way go go go go go go go go go go go keep going okay you're good okay perfect go have a seat thank you the breathalyzer test there showed a BAC of 0.126 exceeding the legal limit of 0.08 [Applause] [Music] [Applause] all right I'm going to give you a copy of this you take with you so you have it mhm um once it's done it's going to show what your breath alcohol content is and I'll cover that for you in just a second and then officer M will transport you and she's outside mhm waiting for you let me ask you this uhhuh so when I first became a cop the first thing that I ran into wasn't a murderer it was a young lady about your age uhhuh maybe a little older probably another two years uhhuh who was intoxicated and killed a mother a father and two children oh my God so do you know how many fatality accidents I've worked involving DUIs a lot more than I'll ever see murders in my whole life it might not be your intention what it happens no of course I just want I exper my like I said I have law enforcement I Lieutenant my is a 91 operator 911 operator for bton County so like I'm well connected with like you know offices out here so like I just wanted to know like how does that work let me share this with you real quick okay so we get you on the road1 126 that's for you uh-huh um what does that mean the state a state of Georgia that's the basically the gram the the number of grams in your blood okay so 08 G is what the legal I I say legal the per se limit is in Georgia you don't have to be a 08 to be D DUI but they establish a 08 as a per se limit okay okay so you are about 55 6 % above that okay so 8 and you're to .12 and one drink can do that I know one big ass drink I'm just [Music] say this W be confiscated or anything like that charged with DUI she was subsequently transported to the deob jail I think she have any other property no that's say I gave her the pH already
