Let's cut all this. >> I haven't I haven't drove. >> I haven't drove. >> Your car is on. >> Your car was on. >> Okay. >> Just give us a second. We're going to We have to go through a series of things now. Okay. >> Yeah. >> When did you drink? How long ago did you drink? >> What What is it right now? I parked here. This is probably cameras. I parked. I I came to Pier 13. Never drove. Never drove. I just I've been here all night. >> This is [ __ ] disgusting. >> Yeah, it's pretty gross. >> Can you just stop reaching your pockets for now? >> If you can't find your ID, it's fine. >> Just Yeah. Just Just stop digging. Just stop digging. >> Just stop digging. If you can't find it, it's fine. Go ahead. [Music] >> Uh, we're probably need [Music] >> I never drove. That's the thing. I never drove. >> Was it going to the hospital? >> No. No. Never drove. >> Never drove. >> Honestly, we're down. It's It's pretty bad over here. >> Yeah. Never drove. Is he completely inebriated? >> What' you say your name was? >> Ricky Gonzalez. >> Ricky Gonzalez. >> Never drove. >> What's your date of birth? [Music] >> Clearly, but the only thing is his car was on. But he stated that he was here tonight. >> Never drove >> knocked out completely. [Music] >> I just want to at least get an assessment. [Music] >> So never drove. That's the key, right? Where I knocked out completely was I never drove. That's the That's the curveball here, you know. >> Yeah. The curveball is in New Jersey, it doesn't matter if you drove or not. [Music] >> Never drove. >> It doesn't matter if you drove or not. Your car was on and we can say that you had intention to drive. >> Ah, okay. Never drove. So, here here's the thing. I never drove. >> Yeah, you said that. >> I know. So, >> yeah, it's pretty up here. >> Yeah. Yeah. So, >> I never drove. Man, you said, >> "All right, you can stop saying that. We heard you." >> Okay. >> So, what's happening is we're going to have an officer come here. They're going to conduct this field soiety test on you. >> All right. >> And if they think that you're okay to drive and we'll get you checked out by the ambulance, you'll be free to go. Cool. All right. Oh my god. Just going to clean myself up real quick. Is that okay? >> Yeah. >> Yeah, I know. This is embarrassing. >> So, this has been parked here since we we already >> we went over this. Okay. I'm >> And you said you weren't driving. We know all this. Okay. So, stop talking and just stand by until another officer gets here. >> Sounds good. I can just clean up real quick. Is that okay? >> Just don't do anything. Just stand still. >> Just put your shirt back on. That's it. How you doing? >> So this has been part [Music] Now I'm going on bracing. So he was we literally were just sitting here s uh gear 13 by the handicap box. Yeah. He's sleeping. He was drooling. And then his face was almost on like the the wheel. And then I get closer. I look at the floor. It's throw up there. And then he has throw up all on himself and inside of his vehicle. >> And what did he say? He said he was here since >> he said he parked Yeah. with the car on. And he said that he parked here at 8:00 p.m. at night. That he never drove. never drove >> the the car was running. Yeah. >> Yeah. But apparently I spoke to And what? >> So I spoke to Sergeant Sodto and he said that we need to >> Yeah. He was in the driver's seat. >> Yeah. But >> so Sergeant Sodto said we need to have the intent. >> Absolutely. Absolutely. So >> I did not see the car at all. >> Hey, it's it's Ricky. >> So I was I I called Sergeant Sodto cuz I was asking him about it and he goes, "Well," he goes, "We have to we have to find out if he had the intent." He goes, "Yeah, he was in the driver's seat." But did he have the intent? Was he really there from 8:00? >> Came back. >> Um, he's this guy saying he didn't drive the car. >> I I have not. >> So, >> um, where did I go? Um, >> okay. I went to Madison. I went to I went to >> I don't know. I didn't even talk to the guy yet, >> but I don't I mean >> Madison and maybe one other spot. I did not drive for a second. >> Okay. >> Not for a second. >> My question is what was your what was your game plan tonight? Where were you how were you going to get home? Where do you live? Uh, I live in Fairview. Okay. Um, >> how how were you planning on? >> My my my game plan was to get home. This is not my car. This is my aunt's car. Um, I don't have a car. >> Um, I was just borrowing the car just to go out. Um, I actually didn't have a a game plan to drive. Okay. >> Um, I don't I don't drive. >> Um, so >> yeah, I got you. >> You don't drive? >> I don't drive. You have a license? >> I have a license. Yes. >> Valid and everything. >> Valid, all that. Oh, this is not my car. This is my aunt's car. >> So, how were you planning on getting home tonight from the >> I don't even know. I don't even know. I don't even know. I don't I don't even know how I was I don't even know. >> I I was supposed to get home by Uber. Uh I was supposed to get home by >> You were going to leave the car? >> I was going to leave you on you. >> Yes, I do. Let me [Music] >> I saw. [Music] >> All right. Let me It's somewhere. >> All right. All right. Well, sir, come come here real quick with me. >> Uh, don't worry about the ID. >> Yeah. Or Yeah, you can give it to him. So, you you did >> So, I never drove. That's the key, right? Where >> I got I got destroyed. >> Came back and bottom left my uh my date of birth. I never drove, >> you know. So, it's like I knocked out in the car, never moved it. >> So, how'd the car get here? >> I drove here sober. I drove here 100% didn't drink, >> parked here. >> At what time was that? >> This is my my aunt's handicap. >> At what time was that? >> Um, say I got here at 8:00 p.m. That's a lack of a better You can check cameras. >> Okay. >> Did not drink before getting here, went out to Madison, drank at Pier 13, drank at Madison. I don't even know how I got back to this car. I don't even I don't even know how I got back to this car. and had zero intention of driving. Zero intention. >> If the car was the car on >> I wasn't on scene. >> I don't I don't even think the car was on. I had no intention. I was knocked out. I was I was I was sleeping. >> Okay. All right. Give me one second. >> I was going to tell you what he just told me. That's why. >> So he said that he It's his aunt's car. She I guess she has a handicap placard or something. So he parked it there. He goes, "I wasn't drinking. I showed up, parked it there cuz she has the handicap thing." He goes completely sober. He goes, "I went out. If you're 13, I went to the Madison." He goes, he goes, "I got bombed." He goes, "Yeah, don't even remember." >> Yo, Tino. >> Yeah. >> Did you see anything like the >> does not appear intoxicated right now? >> No, not at all. >> He's very clear. >> Yeah. Like he's told he continues to talk to us and said the same thing like 18 times. >> Well, he he probably just woke up from [ __ ] heavy drinking most likely, but still. Yeah. >> Listen, that's why I was in between like it's a medical because his kids throwing up on himself and joke. I don't think he had the intention to drive. I think he was I don't think he even could have drove by the way it was it was seeing >> and he was just sleeping at like >> saying he went to two places and just came back here to chill. >> That's what he was saying. He parked here at 8 p.m. >> He's not starting to speech or anything, but >> that's what I'm saying. Like I'm not stumbling. It's not I want like >> I don't if he doesn't. >> So Tyler, if how do you prove the driver? Right. So that's what Sergeant Sod was saying is if we had intention of him driving like if we can articulate that he was going to drive intoxic but he may not >> like that's the thing he doesn't remember. >> That's the thing though if he's saying what he's saying you know although he doesn't remember he's been here for at least >> hold on. But that's the thing like say >> no. Yeah, you did it right to drive, you know, like >> if the car was operating, >> but like that's what we were torn at first because we didn't know if it was like a medical if he was like throwing up on himself cuz we saw every we saw the vomit on the outside and the bomb >> that that's my fault. You know what I mean? Like Yeah, there was no parking. I I did it because of that. Um >> yeah, this has been parked here all night. I haven't moved it for a second. >> See, you want 34 check now? No, not yet. Stand by. >> Um, all right. So, we're going to have to stand by then cuz now I'm going to have to see if I can look at video. >> Yeah. >> To make sure that that that you didn't move the vehicle. >> Perfect. >> So, if I because there's there's cameras in this area. If we look at the cameras right now, it's going to show that >> 100%. I'm not bullshitting for a second. I >> What was the >> So, I was with two friends, right? So, I'm assuming my friends brought me back here. I knocked out. Never moved. Never moved. >> I I um >> You need new friends. But >> Yeah. Yeah. Exactly. >> No, just who that was rude. But you get what I'm saying? >> True, though. It's like I should have went home instead of coming back to coming back to the car. >> They should have brought you home. >> Yeah. I I knocked out >> confused me a little bit cuz he was mentioning he was like but you know did he have the intent >> right I mean you know without us even saying the words I mean there's a chance I would get a battle do you want me to do the the eyes on him at least to see what his eyes look like >> because we don't have admission. We don't have the intent. >> I could check the eyes >> so I I I shot a video for them around >> that's mine >> 10 p.m. >> Okay. >> So I was drinking from 9 to say 10:30 p.m. >> Okay. And then >> how many drinks do you think? >> I would say I had two two there at Pier 13, two at Madison. >> Okay. >> Three at Madison. >> So completely Yeah. I'm I'm Yeah. 100% like drunk 100%. Are you okay? >> Yeah. >> I got a stuff. [Music] >> So, you said you were filming for him. What do you do? >> Yeah. So, >> small >> I'm technically a journalist. Uh, but I do small business spotlights where I go to small businesses spotlight the space blows up. >> Um, perspective >> 43 states a lot. So, >> the fact of >> basically I mean >> where does what's your platform? Yeah, I mean >> hpost.com >> cuz like how can you know like his he had the >> Instagram, >> Tik Tok. So, you know, I would say the the platform is Instagram though. Platform is Instagram. Um yeah, this is this is this is bad. This is in terms of like where I was like I'm so [ __ ] happy that I wasn't driving. I'm so happy. uh you know, so I'm I'm actually pretty pretty pretty pretty thankful right now. This is this is pretty insane. This is pretty insane. Uh yeah, [Music] >> I don't drink. That's the funny thing, you know. I drink maybe like >> say like twice >> twice a month, you know. >> Excuse me, sir. >> Yes. Yes. So, if you can just stand up in front of me here. Um, so I'm going to here you come over here. So, I'm going to perform a standard field sobriety test on you. Okay. >> Um, do you have any medical conditions that prohibit you from doing the test? >> Do you wear glasses? >> No. >> You wear contacts? No. Nothing at all? So, legs, back, ankles, everything's good. >> Okay. So, all I'm going to need you to do is follow the tip of this pen. >> Okay. Can you see this? >> Yes. >> So, I want you to follow it with your eyes and your eyes only. Do not move your head. >> Okay. Hold on. Let's stay close. here. Just watch. I'm going to have to use this line here. >> All right. So, what you're going to do is you're going to come over to these concrete here. Just face me right on this blue line. >> So, you're going to use this blue line for the test. Okay. Absolutely. I'm going to demonstrate the test for you. You are not to begin the test until I tell you to begin. >> Perfect. >> Okay. So, just hang out a second. Okay. So, the next portion of the test is a walking test. Okay? Like I said, I'm going to demonstrate it. You are not to begin until I tell you to begin. Okay. >> Perfect. >> So, you could use this line um direction that you're going to follow. Okay? So, what you're going to do is you're going to take your left foot and you're going to place it on that line. You can do that for me now. >> And then you're going to take your right foot and you're going to touch it. I didn't tell you to do anything yet. You're going to take your right foot and you're going to touch it heel to toe in front of your left foot. Okay? And you are to remain in that position until I complete the demonstration of the test and I tell you to begin. Okay? >> So place your right foot in front of your left foot touching heel to toe >> and remain in that position until I complete the demonstration. Okay? So this is what you're going to do. You're going to take nine heel to toe steps and you're going to count each step out loud. Okay? So it's going to look something like this. One 2 3 But you're going to do nine. >> Okay? >> And when you get to your ninth step, you're going to leave your lead foot on the ground. You're gonna take a series of small steps to turn around and you're going to take an additional nine heel totoe steps back. Okay, >> sounds good. >> Do you understand? >> Yes. >> Okay. >> So, like one 2 3 4 5 6 7 8 9. Turn back. >> Yep. The way I demonstrated. One. 2 3 4 5 6 7 8 9 [Music] [ __ ] disgusting. Okay, the next phase of the test is a one leg stand test. Okay, you can pick whichever leg of your choosing. I'm going to demonstrate the set to you again, and you don't have to be getting into. Okay, so it's going to look something like this. You're going to take whichever foot you choose. You're going to lift it approximately 6 in off the ground with your toe pointing forward. And you're going to count out loud. 100 1 2 10003 until I tell you to stop. Going something like this. 1001,002 1003 1004 and so on until I tell you to stop. Okay. Do you understand? >> Understood. >> Sure. You can be >> 100,001 10 cool. This is 100,00 1 I'm sorry 1001 10 1002 1003 1004 1005 1006 10007 1007 1008 1009 1001 1002 1003 100 >> All right, you can stop. He's a 25. >> All right, listen sir. You're going to be placed under arrest tonight, okay? For driving under the influence. But I wasn't driving. So that's the thing, right? >> So let me just explain something to you. >> Yeah. >> All right. Just hear me out. >> So >> I never drove. >> Okay. Can I can I can I finish? >> So based on everything that you told us, right? You came back here completely blacked out according to you. >> Correct. >> You had no idea what your intent was at that time. >> Right. So all you need to be doing is sitting in that driver's seat >> and that's it. >> Yeah. The vehicle doesn't even have to technically be actually transport. >> So I mean I can smell the alcohol on your breath. >> Uhhuh. >> And >> No, absolutely. I'm obliterated. >> And you also didn't do the testing correctly. >> Yes. >> TDS. >> TDS. >> Evidence bag in anybody's car. >> Say it again. Say it again. >> Pocket right here. >> No, it is not weed. >> Whatever was in your pocket. >> What? What was that? >> I don't know. Only you would know, man. It's not my pocket. I just >> Let me see. Is that [ __ ] white? >> Oh my [ __ ] >> All right. Can you stop moving around? >> Stop moving. All right, man. >> Let's actually Let's get you up to the front of the car right now. Standing by the front seat right here. Face the car. >> All right. Spread your back up a little bit for me. >> Got a lot of >> You have any shorts or anything underneath? >> No. I think Wait, who you with? >> Me? >> Okay. Thank you, man. I appreciate it. I didn't get >> evidence bag. >> I used mine before. >> Earlier tonight as well. >> I used mine earlier tonight. >> What do you need? >> An evidence bag. >> We've all used our evidence bags today. All right. One more. [Music] >> What plants are these, bro? All right. >> So, I never drove. That's the thing, right? Like I I I understand like me about people like [ __ ] I never [ __ ] drove. So, >> nothing wrong. >> I wasn't expecting to find >> I didn't think so. I didn't think I didn't I don't even know how they got there. >> I don't do coke. You could Oh, >> that got planted on me. >> That got planted on. >> No, I swear to God it did. not planted on me, but I must have been holding it for somebody. >> You have any questions? >> Yeah, I I do. So, I didn't drive, right? And they're just pulling [ __ ] out of my pocket now, right? >> So, all right. So, I'll explain the process to you. I I was here the whole time. I'll explain it to you. So, if you're intoxicated in the driver's seat with the key in the ignition, the law will say that you have intent to drive, >> right? That's how they found you. Then there's something called totality circumstances. >> You admitted to being drunk, >> we still gave you the benefit of the doubt by doing the test, >> which I passed. >> You could have been You failed. >> You failed. >> You could have been arrested. No, one second. One second. You could have been arrested for any of those other things. Still gave you the benefit of the doubt and you failed the test. Okay? So that's why now you being placed one second and then you can speak. So I want I want you to be very clear. Then you were placed under arrest and the reason why they're searching you is because there's something called search incident to arrest. So when someone's placed under arrest, you're allowed to search that person. Okay? >> So that's why that's why they're in your body. How do you >> um I'm the DWI expert performed three tests on you today. >> What's hard though? >> All right. It'll be in the report. >> Okay. >> So, was it >> cuz I can't tell you. >> Was it the best? >> I can't tell you. I didn't conduct the test. >> Okay. So, >> it will be in it will be indicated in the report. >> Understood. >> Yeah. >> I never drove >> again. I I the first part I explained to you already. >> Yeah. >> So, the law says you intent with the intent. The key is in the ignition. >> Let me tell you something. If you were laying in the backseat of your car, keys in your pocket with a pillow, you have no intent of driving that car. >> When officers find you in the driver's seat, in the ignition, >> ready to rock and go. Let me know when you're done. >> You had it. You had >> or I can um understand. >> I can I can take them up with kids. Explain. Yep. Yeah, you can do that. >> I can take them up with kids. Yeah. Yeah. >> And just stand by. Um, >> I got it. I got it. I got it. I never Bro, can you take this off? >> No. >> What? >> Bro, I'm not a piece of [ __ ] bro. This is all This is all like, >> you know, I'm going to learn my lesson from this. >> Multiple officers explained to me. >> All right. Can you just take the take the handcuffs off? Oh, sorry. >> I'm going to just grab his ID. >> Yeah. >> Yeah. Take anything that's his with him. >> Okay. >> ID. >> Yeah. Don't >> I'm going to keep your stuff up here. Okay. >> You got the CDS? >> No, you saw the CDS. >> You want me to take that as well? But I'm really I've never been this at all. >> You've never been arrested before? >> No. >> All right. Well, let's clean up with you. Okay. >> Give us one second. We just got to get you first. >> I don't think you're being annoying. >> Mhm. >> Huh? >> It's open. >> Then we're going to hold on to this. >> All right. >> Hold on. >> Hold on. Hold on. I'll stop then. I'm going to be transferring shortly. >> I think this is as far as it goes. >> Huh? >> No, I don't need that. >> You want your phone with you? >> Oh, yeah. Please. >> Okay. Yeah, please. Yeah, >> that's as far as it goes. It's stuck. >> All right. >> So, if we can't then >> All right. Come around. >> Yeah. >> Yeah. This side right here. >> No, don't undo this. >> No, I cannot change ankles. Keep this locked up. See? All right. >> This has another This is his phone. >> Um, my bag and everything is in there, but come up anyway. >> All right. >> All right. CVS is in this bag. Don't mix these up. That's his property. >> This is his property. >> Where's your uh keys for the car? You got to hold it right here. >> Where are they? I didn't open it. >> No, you locked it. >> Yeah. >> Step out for me. >> Oh, also do me a favor. Put one to go outside. second foot. Okay. >> Yeah. Yeah, I got you. Holy [ __ ] I have I'm not I don't even drink. I don't even drugs. This is [ __ ] hilarious. >> How you doing? >> Pretty long. >> We're still going to be off, right? Stay here. Fine for me. Stay here. One second. out of my pocket. So if I if I if I was given that during the night, he said, "Okay, I'll hold it." Whatever the [ __ ] I don't do that [ __ ] >> I got to get tested for it. >> Is that what's in there? Come on, my man. [Music] >> When I take off one cup, you're going to put your one hand on the wall at a time. Okay. You're going to keep it on the wall. Camera still roll. >> Okay. We just out of here. Second area. >> Do you know how many bottles we found? How many do you know? Can I take this shirt off? >> Don't move. Face forward. Keep both hands on the wall. >> No, you can't take the shirt off. >> You have anything else in your pocket, man? >> I have no idea, bro. I I kind of >> I don't go out, bro. You know what I mean? That's the thing is like I don't I don't read this. This is not my scene. This is not my my vibe. This is not my what I do. Um >> this is not my life really. Like I don't drink. I don't do drugs. You can test people with [ __ ] whatever the [ __ ] you found. I must have been handed it put in my pocket. Like I get free [ __ ] all day, you know? And that that must have been one of those free things that [Music] >> I'm [Music] still got we still got a Vex in the back of the car. You want me to bring it inside real quick? >> Yeah. All right, turn around. Put your hand. >> Take a seat. >> Take a seat. Who's these? I'm going just see if you got to talk one hand. All right. At this point, >> Oh, wait. No, I might activate. >> I'm going to stand on I'm going to stay on. >> Okay. >> All right. [Music] When the driver woke up, officers observed him to have bloodshot eyes and he appeared to be confused. They also detected the odor of an alcoholic beverage emanating from his breath. A search incident to arrest found him to be in possession of a small baggie containing a white powdery substance. He was transported to police headquarters where he was processed on charges of possession of CDS and driving while intoxicated.
